		<section id="H5B041D1CED794C02A6BB7976A422AFD1" section-type="section-one"><enum>1.</enum><header>Short title; table of
			 contents</header>
			<subsection id="HF641D66D8B0D45FCAEAA1115C691A437"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Border
			 Security and Elimination of Sanctuary for Illegal Aliens Act of
			 2007</short-title></quote>.</text>
			</subsection><subsection id="H7A4F6E28EF044CAE9612296891E56B38"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents of this Act is as follows:</text>
			</subsection></section><section id="H0B8781119C954269AE30F98E968EAC68"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H661F4ED81AF64B358498498E1F4DC912"><enum>(1)</enum><text>The illegal entry
			 into the United States of dangerous gang members, such as MS–13, is a direct
			 threat to the security of the United States.</text>
			</paragraph><paragraph id="HDA7B6539A9F04867B170E857AFDB3DBF"><enum>(2)</enum><text>The continuing
			 rise of illegal immigration increases the chances that a terrorist will gain
			 entry into the United States undetected.</text>
			</paragraph><paragraph id="H11B3F15BD7804147921C536CBBF981EF"><enum>(3)</enum><text>The rising cost to
			 United States taxpayers to support housing, health care, education expenses,
			 and criminal justice for illegal aliens has reached between $11,000,000,000 and
			 $22,000,000,000 per year.</text>
			</paragraph><paragraph id="HF434F39069B74D6492C64D555E16FA9"><enum>(4)</enum><text>Any attempt to deal
			 with illegal aliens currently living in the United States must start with the
			 United States securing its borders.</text>
			</paragraph></section><section id="HD66D3CF9E75D4256AF870044F50FAB9"><enum>3.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 Congress that the worsening crisis of illegal immigration must be
			 solved.</text>
		</section><section id="HD62582EFEAF34D2590B5275E47CB907F"><enum>4.</enum><header>Border
			 security</header>
			<subsection id="H8CBDA782B5634BD28BD2C02EA9F95848"><enum>(a)</enum><header>Full-time
			 active-duty Border Patrol agents</header><text>In order to fulfill the
			 requirement under section 5202 of the Intelligence Reform and Terrorism
			 Prevention Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/458">Public Law 108–458</external-xref>; 118 Stat. 3734) (relating to an
			 increase in the number of positions for full-time active-duty border patrol
			 agents within the Department of Homeland Security), and subject to the
			 availability of appropriations for such purpose, the Secretary of Homeland
			 Security shall—</text>
				<paragraph id="H50A79549FA184D989B477CE549489D9D"><enum>(1)</enum><text display-inline="yes-display-inline">increase incentives to recruit individuals
			 to become such agents by offering such individuals repayment of higher
			 education loans, not to exceed $6,000 per year and a maximum of $40,000;
			 and</text>
				</paragraph><paragraph id="HEDF49F4695F140C291FC07E44F71E577"><enum>(2)</enum><text>develop incentives
			 to retain experienced border patrol agents through the establishment of a
			 retention program.</text>
				</paragraph></subsection><subsection id="HB111ED815D7E40669FED87B0A13E894D"><enum>(b)</enum><header>Deployment of
			 technology</header><text>In accordance with section 2(a)(1) of the Secure Fence
			 Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/367">Public Law 109–367</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1701">8 U.S.C. 1701</external-xref> note), the Secretary of Homeland
			 Security is authorized to deploy newly-developed and cutting-edge technologies
			 to secure the international land and maritime borders of the United
			 States.</text>
			</subsection><subsection id="H09509753347C4281B2000033993B1914"><enum>(c)</enum><header>Construction of
			 border fence</header><text>The Secretary of Homeland Security shall—</text>
				<paragraph id="H3211C9C711524C899CA76C48B7A1D081"><enum>(1)</enum><text>make a priority
			 the construction of the border fencing required under section 102 of the
			 Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C.
			 1103 note); and</text>
				</paragraph><paragraph id="H96EB2AF7F8B3480EB3E4B16BA0126A6"><enum>(2)</enum><text>not later than June
			 30, 2008, submit to Congress a report on the progress and expected completion
			 date of such construction.</text>
				</paragraph></subsection></section><section id="H98028741F1434E27A994872C2B72B91E"><enum>5.</enum><header>Mandated
			 collaboration to end sanctuary of illegal aliens</header><text display-inline="no-display-inline">If an alien who is unlawfully present in the
			 United States is arrested for any offense by a State or local law enforcement
			 agency, the head of such agency shall immediately notify United States
			 Immigration and Customs Enforcement (ICE) of such arrest and the identity of
			 such alien.</text>
		</section><section commented="no" id="H93CEEBB5686D443CB1D3BDE244373C9C"><enum>6.</enum><header>Expedited removal
			 and criminal penalties of criminal aliens</header>
			<subsection id="H8CD150CFF8D440C387B41765741EFC9B"><enum>(a)</enum><header>Action by ICE;
			 expedited removal</header><text display-inline="yes-display-inline">Upon
			 notification under section 5, the alien arrested under such section shall be
			 immediately detained by United States Immigration and Customs Enforcement and
			 presented before an immigration judge (as defined in section 101(b)(4) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(4)</external-xref>)), the name and
			 fingerprints of such alien shall be added to an appropriate watch list
			 maintained by the Department of Homeland Security concerning aliens who have
			 been unlawfully present in the United States, and such immigration judge shall
			 order such alien immediately removed from the United States without being
			 released from detention and without further hearing or review in the same
			 manner as an alien described in subparagraph (A)(i) of section 235(b)(1) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)</external-xref>) is subject to immediate removal from the United
			 States under the provisions of such section.</text>
			</subsection><subsection id="HE35F6B04C009416FA821FB245939C4F1"><enum>(b)</enum><header>Permanent
			 ineligibility for admission to United States</header><text>Section
			 212(a)(9)(C)(i)(I) of the Immigration and Nationality Act (8 U.S.C.
			 1182(a)(9)(C)(i)(I)) is amended by striking <quote>for an aggregate period of
			 more than 1 year</quote> and inserting <quote>for any period of time</quote>.</text>
			</subsection><subsection commented="no" id="H70D38FBC2E074A758C00FFCE09006ED4"><enum>(c)</enum><header>Criminal
			 penalties for subsequent unlawful presence</header><text>An alien who is
			 removed from the United States under subsection (a) and who is subsequently
			 determined to be unlawfully present in the United States shall be imprisoned
			 for not more than five years and fined in accordance with title 18, United
			 States Code, and shall be removed from the United States in accordance with the
			 expedited removal proceedings described in such subsection after the completion
			 of such alien’s term of imprisonment.</text>
