		<section id="H9D4BC2F9D217468E9E07C3B53028737D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Revolutionizing Education Through
			 Digital Investment Act of 2007</short-title></quote>.</text>
		</section><section id="H9083D3EEFD304B439DA443633C8EBD68"><enum>2.</enum><header>National Center
			 for Learning Science and Technology Trust Fund</header>
			<subsection id="H679667CAE8114C519D002BBF097DB770"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a nonprofit corporation to be known as the <quote>National
			 Center for Learning Science and Technology</quote> (referred to in this Act as
			 the <quote>Center</quote>) which shall not be an agency or establishment of the
			 United States Government. The Center shall be subject to the provisions of this
			 section, and, to the extent consistent with this section, to the<act-name parsable-cite="CNCA"> District of Columbia Nonprofit Corporation Act</act-name>
			 (D.C. Code, section 29–501 et seq.).</text>
			</subsection><subsection id="HC780422595D145E08CDB864DE3197C04"><enum>(b)</enum><header>Funding</header>
				<paragraph id="H3A3FC94ED45D492C958C82A2886979E2"><enum>(1)</enum><header>In
			 general</header><text>There is established in the Treasury a separate fund to
			 be known as the <quote>National Center for Learning Science and Technology
			 Trust Fund</quote> (referred to in this Act as the <quote>Trust Fund</quote>).
			 The Trust Fund shall contain such amounts as are credited to the Trust Fund
			 under
			 <internal-xref idref="H650806E3CD5F448DB0EDDE7E34C7CAE2" legis-path="3.(b)(2)">paragraph (2)</internal-xref> and other funds obtained
			 under
			 <internal-xref idref="H4ECBFAEF8ACD468C93F30393CA1500FC" legis-path="3.(b)(3)">paragraph (3)</internal-xref>.</text>
				</paragraph><paragraph id="H650806E3CD5F448DB0EDDE7E34C7CAE2"><enum>(2)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Trust Fund such sums as may be necessary for the fiscal years 2008 through
			 2012.</text>
				</paragraph><paragraph id="H4ECBFAEF8ACD468C93F30393CA1500FC"><enum>(3)</enum><header>Additional
			 funds</header><text>The Trust Fund is authorized—</text>
					<subparagraph id="HA453B66BA8B44F95B607B1558400885C"><enum>(A)</enum><text>to accept funds
			 from any Federal agency or entity;</text>
					</subparagraph><subparagraph id="H44D8D155E292403495114426020708B"><enum>(B)</enum><text>to accept, hold,
			 administer, invest, and spend any gift, devise, or bequest of real or personal
			 property made to the Center; and</text>
					</subparagraph><subparagraph id="H00DA49696B2E46F49BCFD175FBD478D3"><enum>(C)</enum><text>to enter into
			 contracts with individuals, public or private organizations, professional
			 societies, and government agencies for the purpose of carrying out the
			 functions of the Center.</text>
					</subparagraph></paragraph></subsection><subsection id="HBFE5E6E821EB4FFF8C00FC9CFA8DE946"><enum>(c)</enum><header>Board of
			 Directors; functions, and duties</header>
				<paragraph id="H751ABC667933489F890986C0784429DB"><enum>(1)</enum><header>In
			 general</header><text>A board of directors of the Center (referred to in this
			 Act as the <quote>Board</quote>) shall be established to oversee the
			 administration of the Center. Such Board shall consist of 9 members to be
			 appointed by the Secretary of Education, who—</text>
					<subparagraph id="H4E63DDB9213B44B8ACECFFE283616BE"><enum>(A)</enum><text>reflect
			 representation from the public and private sectors; and</text>
					</subparagraph><subparagraph id="H8AE83B2A4E744AED9C06BC2E1D402621"><enum>(B)</enum><text>shall provide, as
			 nearly as practicable, a broad representation of various regions of the United
			 States, various professions and occupations, and various kinds of talent and
			 experience appropriate to the functions and responsibilities of the
			 Center.</text>
					</subparagraph></paragraph><paragraph id="H7CE0473578704140977922A6EDC32360"><enum>(2)</enum><header>Organization and
			 Operation</header><text display-inline="yes-display-inline">The board shall
			 incorporate and operate the center in accordance with the laws governing tax
			 exempt organizations in the District of Columbia.</text>
				</paragraph></subsection><subsection id="HFE8251EE83F942548C10162821B9A3A1"><enum>(d)</enum><header>Trust Fund
			 uses</header>
				<paragraph id="H17D11B644E61440EAAF638C96937F492"><enum>(1)</enum><header>Uses of
			 funds</header><text>To achieve the objectives of this Act, the Director of the
			 Center, after consultation with the Board, may use Trust funds—</text>
					<subparagraph id="H83B8271F13EC4F93946B51E3B28442DC"><enum>(A)</enum><text>to support basic
			 and applied research development and demonstrations of innovative learning and
			 assessment systems as well as the components and tools needed to create
			 them;</text>
					</subparagraph><subparagraph id="H150DF2B9995449D2AD0832BDC103BCB"><enum>(B)</enum><text>to support the
			 testing and evaluation of these systems; and</text>
					</subparagraph><subparagraph id="HBFF9BDBE24454A2D85C4FD49CCCB8C15"><enum>(C)</enum><text>to encourage the
			 widespread adoption and use of effective approaches to learning.</text>
					</subparagraph></paragraph><paragraph id="H9E02A934D01E46A6A17CA5600B693E"><enum>(2)</enum><header>Contracts and
			 grants</header>
					<subparagraph id="H9E0DE3A298094148A734C5003137A5BF"><enum>(A)</enum><header>In
			 general</header><text>In order to carry out the activities described in
			 <internal-xref idref="H17D11B644E61440EAAF638C96937F492" legis-path="3.(d)(1)">paragraph (1)</internal-xref>, the Director of the
			 Center, with the agreement of a majority of the members of the Board, may award
			 contracts and grants to colleges and universities, museums, libraries, public
			 broadcasting entities and similar nonprofit organizations and public
			 institutions (with or without private partners).</text>
					</subparagraph><subparagraph id="H99A267C39C1C41C7ADCDBADDED2780D2"><enum>(B)</enum><header>Public
			 domain</header>
						<clause id="H3373016E08ED4818BC68F8F234DA379F"><enum>(i)</enum><header>In
			 general</header><text>The research and development properties and materials
			 associated with a project in which a majority of the funding used to carry out
			 the project is from a grant or contract under this Act shall be freely and
			 nonexclusively available to the general public in a timely manner.</text>
						</clause><clause id="H1023B41B90D44E36BD4CD54576575300"><enum>(ii)</enum><header>Exemption</header><text>The
			 Director of the Center may exempt specific projects from the requirement of
			 <internal-xref idref="H3373016E08ED4818BC68F8F234DA379F" legis-path="3.(d)(2)(B)(i)">clause (i)</internal-xref> if the Director of the
			 Center and a majority of the members of the Board determine that the general
			 public will benefit significantly due to the project not being freely and
			 nonexclusively available to the general public in a timely manner.</text>
						</clause></subparagraph><subparagraph id="HC72838C0FFE24D8F992BA9579BFCAC49"><enum>(C)</enum><header>Peer
			 review</header><text>To the extent practicable, proposals for grants or
			 contracts shall be evaluated on the basis of comparative merit by panels of
			 experts who represent diverse interests and perspectives, and who are appointed
			 by the Director of the Center from recommendations from the fields served and
			 from the Board of Directors.</text>
					</subparagraph></paragraph></subsection><subsection id="HA5597AE603EF498BA2B01C49A7AC7BED"><enum>(e)</enum><header>Accountability
			 and reporting</header>
				<paragraph id="HF7337D19058F4FB89EEE8461F952EBC4"><enum>(1)</enum><header>Report</header>
					<subparagraph id="H21E74EB048084B5588EB40DD2528C586"><enum>(A)</enum><header>In
			 general</header><text>Not later than April 30 of each year, the Director of the
			 Center shall prepare a report for the preceding fiscal year that contains the
			 information described in
			 <internal-xref idref="H6458A5D63B754CB7BEF7F5D5CE2887E1" legis-path="3.(e)(1)(B)">subparagraph (B)</internal-xref>.</text>
					</subparagraph><subparagraph id="H6458A5D63B754CB7BEF7F5D5CE2887E1"><enum>(B)</enum><header>Contents</header><text>A
			 report under
			 <internal-xref idref="H21E74EB048084B5588EB40DD2528C586" legis-path="3.(e)(1)(A)">subparagraph (A)</internal-xref> shall include—</text>
						<clause id="H328B54544132418B88C1E3DFDF1BDB03"><enum>(i)</enum><text>a
			 comprehensive and detailed report of the Center’s operations, activities,
			 financial condition, and accomplishments, and such recommendations as the
			 Director of the Center determines appropriate;</text>
						</clause><clause id="H46DB3197C90746EEB900058BA829D4FE"><enum>(ii)</enum><text>a
			 comprehensive and detailed inventory of funds distributed from the Trust Fund
			 during the fiscal year for which the report is being prepared; and</text>
						</clause><clause id="HBE530D4DEA0C44D9B69346FF35FB6128"><enum>(iii)</enum><text>an
			 independent audit of the Trust Fund’s finances and operations, and of the
			 implementation of the goals established by the Board.</text>
						</clause></subparagraph><subparagraph id="H636AF12B88FF4B4DB431D23B7EC5D24"><enum>(C)</enum><header>Statement of the
			 Board</header><text>Each report under
			 <internal-xref idref="H21E74EB048084B5588EB40DD2528C586" legis-path="3.(e)(1)(A)">subparagraph (A)</internal-xref> shall include a
			 statement from the Board containing—</text>
						<clause id="HC8E44FE33FED4B559E7B9120B0BE00A1"><enum>(i)</enum><text>a
			 clear description of the plans and priorities of the Board for the subsequent
			 5-year period for expenditures from the Trust Fund; and</text>
						</clause><clause id="H0FD424891802406E9DCDBD62D15C84F5"><enum>(ii)</enum><text>an
			 estimate of the funds that will be available for such expenditures from the
			 Trust Fund.</text>
						</clause></subparagraph><subparagraph id="H844FB5B2FFB74B22B5E5A40052B891E"><enum>(D)</enum><header>Submission to the
			 President and Congress</header><text>A report under this subsection shall be
			 submitted to the President and the Committee on Education and Labor of the
			 House of Representatives and the Committee on Health, Education, Labor, and
			 Pensions of the Senate.</text>
					</subparagraph></paragraph><paragraph id="HA235E43D44C649518FA60006218E48EE"><enum>(2)</enum><header>Testimony</header><text>The
			 Director and principal officers of the Center shall testify before the
			 appropriate committees of Congress, upon request of such committees, with
			 respect to—</text>
					<subparagraph id="H5452026B42524C2C804BD4F5189CA9C9"><enum>(A)</enum><text>a report prepared
			 under
			 <internal-xref idref="H21E74EB048084B5588EB40DD2528C586" legis-path="3.(e)(1)(A)">paragraph (1)(A)</internal-xref>; and</text>
					</subparagraph><subparagraph id="H758DF366B93B423E907D91E6717A440"><enum>(B)</enum><text>any other matter
			 that such committees may determine appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="H658E004246B84D6C91A9C39DF32993E6"><enum>(f)</enum><header>Use of funds
			 subject to appropriations</header><text>The authority to make grants or enter
			 into contracts or otherwise to expend funds under this section is subject to
			 such amounts as are provided in advance in appropriations Acts.</text>
