		<section display-inline="no-display-inline" id="H18B774320ABF4E5C89EC1478D300AE17" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Las Cienegas Enhancement and Saguaro
			 National Park Boundary Adjustment Act</short-title></quote>.</text>
		</section><section id="H28BE98721FBD45DC88745C5721063474"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H4B8ABBF178D44309B8EF99A1AA8B8493"><enum>(1)</enum><header>Conservation
			 area</header><text>The term <term>Conservation Area</term> means the Las
			 Cienegas National Conservation Area.</text>
			</paragraph><paragraph id="HBE677444952145E3833EA1AC37844EA"><enum>(2)</enum><header>County</header><text>The
			 term <term>County</term> means Pima County, Arizona.</text>
			</paragraph><paragraph id="H38A746BA3870461E99C1D928015F00A"><enum>(3)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the Sahuarita
			 parcel of land, as generally depicted on the map entitled <quote>Las Cienegas
			 Enhancement Act—Federal Land</quote> and dated April 17, 2007.</text>
			</paragraph><paragraph id="H0FE02161CB224C1A9F322326B5A954FA"><enum>(4)</enum><header>Landowner</header><text>The
			 term <term>landowner</term> means Las Cienegas Conservation, LLC.</text>
			</paragraph><paragraph id="HFB5D865253C2418A8477D06BF8638EDF"><enum>(5)</enum><header>Non-federal
			 land</header><text>The term <term>non-Federal land</term> means—</text>
				<subparagraph id="H119FB9B0FC014B9F88FF27076317A018"><enum>(A)</enum><text>the
			 Empirita-Simonson parcel of land consisting of approximately 2,392 acres, as
			 generally depicted on the map entitled <quote>Las Cienegas Enhancement
			 Act—Non-Federal Land</quote> and dated April 17, 2007; and</text>
				</subparagraph><subparagraph id="HC1BBAA4919B54F50B218A89135DB9C00"><enum>(B)</enum><text>the Bloom parcel
			 of land consisting of approximately 160 acres, as generally depicted on the map
			 entitled <quote>Saguaro National Park, Bloom Tract</quote> and dated April 17,
			 2007.</text>
				</subparagraph></paragraph><paragraph id="HC612C05769E44491AAA5438E4BCDE71"><enum>(6)</enum><header>Park</header><text>The
			 term <term>Park</term> means Saguaro National Park.</text>
			</paragraph><paragraph id="HA9C348DD4D6E4654A6F577C9585100C6"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H9364001B756C414183D7E4B9EE0E799"><enum>(8)</enum><header>Well
			 site</header><text>The term <term>well site</term> means a well site that
			 consists of approximately 98 acres of land, as generally depicted on the map
			 entitled <quote>Las Cienegas Enhancement Act—Non-Federal Land</quote> and dated
			 April 17, 2007.</text>
			</paragraph></section><section id="H96242B37082D459BBC75F9E55904B6AA"><enum>3.</enum><header>Land
			 exchange</header>
			<subsection id="H909856BC4EB94F918E6939001DD8BDC5"><enum>(a)</enum><header>In
			 general</header><text>If the landowner offers to convey to the Secretary title
			 to the non-Federal land that is acceptable to the Secretary, the Secretary
			 shall—</text>
				<paragraph id="H16A541FAE9224E6BB61FF12BAF2E9507"><enum>(1)</enum><text>accept the offer;
			 and</text>
				</paragraph><paragraph id="H4D29EF128B234107BB0073E5A5F6CD7D"><enum>(2)</enum><text>simultaneously
			 convey to the landowner all right, title, and interest of the United States in
			 and to the Federal land.</text>
				</paragraph></subsection><subsection id="H408549374A114697BA050601C398EB38"><enum>(b)</enum><header>Valuation,
			 Appraisals, and Equalization</header>
				<paragraph id="HA3A7D38F03C84C6D9178B495005583D6"><enum>(1)</enum><header>In
			 general</header><text>As of the date of enactment of this Act, the value of the
			 Federal land and the non-Federal land—</text>
					<subparagraph id="HFE66DC52A0A54C99BA22D67CD16BEAA8"><enum>(A)</enum><text>shall be equal, as
			 determined by appraisals conducted in accordance with paragraph (2); or</text>
					</subparagraph><subparagraph id="H24FC0B47A6BC4693B540B4735EC128C7"><enum>(B)</enum><text>if not equal,
			 shall be equalized in accordance with paragraph (3).</text>
					</subparagraph></paragraph><paragraph id="H6A1B68A2998F4708B21D540094F824F"><enum>(2)</enum><header>Appraisals</header>
					<subparagraph id="H0C485E19B80C4F49A4317DC74410DB8F"><enum>(A)</enum><header>In
			 general</header><text>The Federal land and the non-Federal land shall be
			 appraised by an independent, qualified appraiser that is agreed to by the
			 Secretary and the landowner.</text>
					</subparagraph><subparagraph id="HA47159E92A8B401ABA1BA2300010CDF9"><enum>(B)</enum><header>Requirements</header><text>An
			 appraisal under subparagraph (A) shall—</text>
						<clause id="H1671B7E39E784FDBB553D8A42EA07E79"><enum>(i)</enum><text>be
			 conducted in accordance with—</text>
							<subclause id="H0994D0A659DE43CF93D5DFE2001084EC"><enum>(I)</enum><text>the Uniform
			 Appraisal Standards for Federal Land Acquisition; and</text>
							</subclause><subclause id="H9DD5B41523F747F7B780BCB9B609B601"><enum>(II)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice; and</text>
							</subclause></clause><clause id="HF66AB3711ACD4A11A52C3825EFD05509"><enum>(ii)</enum><text>not
			 later than 180 days after the date of enactment of this Act, be submitted to
			 the Secretary and the landowner for approval.</text>
						</clause></subparagraph></paragraph><paragraph id="H173B121BD0E6402A9D25827B9DE27079"><enum>(3)</enum><header>Equalization</header>
					<subparagraph id="H906AAE0F0B104F518C01F69987FC01AF"><enum>(A)</enum><header>In
			 general</header><text>If the value of the Federal land and the non-Federal land
			 is not equal, the value may be equalized by—</text>
						<clause id="H55BD11AFAB3E41B1A86D2BD2453EE8A5"><enum>(i)</enum><text>the
			 Secretary by making a cash equalization payment to the landowner;</text>
						</clause><clause id="H30BCFA0E93674977A9B4DC7F81641F67"><enum>(ii)</enum><text>the
			 landowner by making a cash equalization payment to the Secretary; or</text>
						</clause><clause id="HD5E9756AB593445DBF00003354C18C"><enum>(iii)</enum><text>reducing the
			 acreage of the Federal land or the non-Federal land to be exchanged, as
			 appropriate.</text>
						</clause></subparagraph><subparagraph id="H343CDB5E13BB484EB01CC8E91A0AE95"><enum>(B)</enum><header>Amount of
			 payment</header><text>Notwithstanding section 206(b) of the Federal Land Policy
			 and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>), the Secretary may accept a cash
			 equalization payment under subparagraph (A)(ii) in an amount that exceeds 25
			 percent of the value of the Federal land.</text>
					</subparagraph><subparagraph id="H1CCCC9717870407EA136DFE5FCD263"><enum>(C)</enum><header>Cash equalization
			 payments</header>
						<clause id="HB3F1E57A367646A3A2A1A505D2FECD23"><enum>(i)</enum><header>Disposition</header><text>Any
			 cash equalization payments received by the Secretary under subparagraph (A)(ii)
			 shall be deposited in the Federal Land Disposal Account established by section
			 206(a) of the Federal Land Transaction Facilitation Act (43 U.S.C.
			 2305(a)).</text>
						</clause><clause id="H6E534C599B9B4E45B4EE3179C594BCC3"><enum>(ii)</enum><header>Use</header><text>Amounts
			 deposited under clause (i) shall be available to the Secretary, without further
			 appropriation and until expended, for the acquisition of land and interests in
			 land in southern Arizona.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H8772E7C6515149979DC2A11000CFD752"><enum>(c)</enum><header>Conditions of
			 conveyance</header>
				<paragraph id="H643CDD4D856E48DE8172DE8322B15FD"><enum>(1)</enum><header>In
			 general</header><text>As a condition of the conveyance of the Federal land to
			 the landowner, the landowner shall—</text>
					<subparagraph id="HA34EF92B5E5E468E8F65552D1E411463"><enum>(A)</enum><text>pay the costs of
			 carrying out the exchange of the Federal land and the non-Federal land under
			 this section, including any direct costs relating to any environmental reviews
			 and any required mitigation of the Federal land;</text>
					</subparagraph><subparagraph id="H416F43628B5F4A8E84E0D7B6AFFB0900"><enum>(B)</enum><text>enter into an
			 agreement with the County to convey to the County the well site; and</text>
					</subparagraph><subparagraph id="HE1C05B414BE34DFC9765F297705100B3"><enum>(C)</enum><text>relinquish to the
			 County any water rights to the well site held by the landowner.</text>
					</subparagraph></paragraph><paragraph id="HFC1D133089C74A9DB4658CC2E66EC8DA"><enum>(2)</enum><header>Valid existing
			 rights</header><text>The exchange of Federal land and non-Federal land shall be
			 subject to any easements, rights-of-way, and other valid encumbrances in
			 existence on the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="HDF80F3D32D8C46F1AEA19F907600DEAA"><enum>(d)</enum><header>Legal
			 descriptions</header><text>The Secretary and the landowner may mutually agree
			 to—</text>
				<paragraph id="HA8531E76E3DF4F22A5A6970062318F85"><enum>(1)</enum><text>correct minor
			 errors in the legal descriptions of the Federal land and the non-Federal land;
			 or</text>
				</paragraph><paragraph id="H342A93A09ECB4916A810688924CA22D6"><enum>(2)</enum><text>make minor
			 adjustments to the boundaries of the Federal land and the non-Federal
			 land.</text>
				</paragraph></subsection><subsection id="H884B04993BB04E6F92A2D5C302673D0"><enum>(e)</enum><header>Deadline for
			 completion of exchange</header><text>It is the intent of Congress that the land
			 exchange under this section shall be completed—</text>
				<paragraph id="HF667590409DD4B6CAAB523C96D1D17A5"><enum>(1)</enum><text>not later than 1
			 year after the date of enactment of this Act; or</text>
				</paragraph><paragraph id="H264480E7EC2A48E19981B8874241A089"><enum>(2)</enum><text>if there is a
			 dispute with respect to the appraisal, not later than 90 days after the date on
			 which the dispute is resolved.</text>
				</paragraph></subsection></section><section id="H9C6182788F7547158282A9838B1C1C8E"><enum>4.</enum><header>Administration</header>
			<subsection id="HDFC39EE232F442B48EAC514F4787F9BB"><enum>(a)</enum><header>Administration
			 of land acquired by the United States</header>
				<paragraph id="H669844CD8BC34AADBF534678CD19B632"><enum>(1)</enum><header>Empirita-Simonson
			 parcel</header><text>On acquisition by the Secretary, the parcel of non-Federal
			 land described in section 2(5)(A) shall—</text>
					<subparagraph id="H055FB067CAE9489FA58BDA2BD9F89C06"><enum>(A)</enum><text>become part of the
			 Conservation Area; and</text>
					</subparagraph><subparagraph id="HB280431E682142E1B4357F1B801F8BA0"><enum>(B)</enum><text>be administered by
			 the Secretary in accordance with <external-xref legal-doc="public-law" parsable-cite="pl/106/538">Public Law 106–538</external-xref> (16 U.S.C.
			 460<italic>ooo</italic> et seq.).</text>
					</subparagraph></paragraph><paragraph id="H80F905EF74B7433FA6077863B14ED9E7"><enum>(2)</enum><header>Bloom
			 parcel</header><text>On acquisition by the Secretary, the parcel of non-Federal
			 land described in section 2(5)(B) shall—</text>
					<subparagraph id="H43BE48F9423A4A588017167601FCB9FA"><enum>(A)</enum><text>become part of the
			 Park; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2ECBEF450CA44BD3944401ADCD519749"><enum>(B)</enum><text>be administered by
			 the Secretary in accordance with the Saguaro National Park Establishment Act of
			 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410zz">16 U.S.C. 410zz et seq.</external-xref>).</text>
					</subparagraph></paragraph></subsection><subsection id="H931031EC30D2467F81A69823C0135326"><enum>(b)</enum><header>National
			 conservation area boundary adjustment</header><text>The boundary of the
			 Conservation Area is modified to exclude the 40-acre tract of Bureau of Land
			 Management that is leased to the town of Elgin, Arizona, for a sanitary
			 landfill.</text>
			</subsection><subsection id="H8700A8F84A7546A28CE79374D307D685"><enum>(c)</enum><header>Road
			 access</header><text>Not later than 18 months after the date on which the
			 non-Federal land is acquired by the Secretary, the Secretary shall, in
			 accordance with section 507 of the Federal Land Policy and Management Act of
			 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1767">43 U.S.C. 1767</external-xref>), provide to the Secretary of Agriculture a right-of-way
			 through the non-Federal land for motorized public road access to the boundary
			 of the Coronado National Forest.</text>
			</subsection></section></legis-body>
