		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to make improvements relating to students with

		<section display-inline="no-display-inline" id="H5BEDFD88F51B4FCFAA137733CBE950D4" section-type="section-one"><enum>1.</enum><header>Students with
			 disabilities</header><text display-inline="no-display-inline">Section 1111(b)
			 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)</external-xref>) is
			 amended—</text>
			<paragraph id="HAB0E5B49EB0542218182F7A500C2DFD8"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="HDE3781A355B74ED8BD00A66E1FA56286"><enum>(A)</enum><text>in subparagraph
			 (C)—</text>
					<clause id="HBB6B3460152F40DB93AABBECFC4D6F23"><enum>(i)</enum><text>in
			 clause (vi), by striking <quote>and</quote> at the end;</text>
					</clause><clause id="H723281C3725D49ACB31EFC6DDFA3F752"><enum>(ii)</enum><text>in
			 clause (vii), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
					</clause><clause id="H99BFC07C25CC44C087B1127DF005F4C4"><enum>(iii)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HD569D733F0EC4972BF4FCB7F6B1527B5" style="OLC">
							<clause id="HF19CF7E048794879817B2B8976A56A4"><enum>(viii)</enum><text display-inline="yes-display-inline">ensures that both the participation and
				performance of students with disabilities utilizing the reasonable
				accommodations for children with disabilities (as defined in section 602(3) of
				the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>)), or the
				modifications for children with disabilities they regularly use in daily
				classroom instruction as documented in their individualized education program
				or their plan under section 504 of the Rehabilitation Act of 1973 (29 U.S.C.
				794), are counted for the purposes of determining adequate yearly
				progress.</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="H2FDFCEBA274D4991846947B5932088E6"><enum>(B)</enum><text>in subparagraph
			 (D)—</text>
					<clause id="HE183DD36283E4A8B8976FDDDB7342712"><enum>(i)</enum><text>by
			 redesignating clauses (i) and (ii) as (ii) and (iii), respectively; and</text>
					</clause><clause id="H89953A1A99424707A6CD8868C3C59D83"><enum>(ii)</enum><text>by
			 inserting before clause (ii) (as so redesignated) the following:</text>
						<quoted-block display-inline="no-display-inline" id="HC1F3C28E69044C7691493FD4443CD7ED" style="OLC">
							<clause id="HC005A002E9B84F14B3DEBBC8E5164CD"><enum>(i)</enum><text display-inline="yes-display-inline">shall ensure that students with
				disabilities who take the academic assessments on which adequate yearly
				progress is based and who utilize the reasonable accommodations for children
				with disabilities (as defined in section 602(3) of the Individuals with
				Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>)), or the modifications for
				children with disabilities they regularly use in daily classroom instruction as
				documented in their individualized education program or their plan under
				section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>), are counted for
				the purposes of determining adequate yearly progress for a school;</text>
							</clause><after-quoted-block>; and</after-quoted-block></quoted-block>
					</clause></subparagraph></paragraph><paragraph id="HD135EC4E728947E8A89F0001F4FAAA00"><enum>(2)</enum><text>in paragraph
			 (3)(C)—</text>
				<subparagraph id="HD59368D1097B4C93A284BCCE00839550"><enum>(A)</enum><text>in clause (xiv) by
			 striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="H212B3459C19F4EE7929C24B14F00CA4C"><enum>(B)</enum><text>in clause (xv) by
			 striking the period at the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H8570754EBFA04CD9A87BC85F355840A9"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4B141054736D4B74A53579F6D55654DB" style="OLC">
						<clause id="H45E067E5E39C44F1B7D56B67372DCA95"><enum>(xvi)</enum><text display-inline="yes-display-inline">ensure that both the participation and
				performance of students with disabilities utilizing the reasonable
				accommodations for children with disabilities (as defined in section 602(3) of
				the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401(3)</external-xref>)), or the
