<enum>I</enum><header>Office for Combating the Proliferation of Weapons of Mass Destruction</header> <section id="HDB4FB11BC82548758CE8C792DEDA19"><enum>101.</enum><header>Office for combating the proliferation of weapons of mass destruction</header> <subsection id="HF36E3260C7644036B2ACEDCAA0256699"><enum>(a)</enum><header>Establishment</header><text>There is established within the Executive Office of the President an office to be known as the <quote>Office for Combating the Proliferation of Weapons of Mass Destruction</quote> (in this title referred to as the <quote>Office</quote>).</text></subsection> <subsection id="H56D2FF0A7D654EF5B85B4B45F923E7E"><enum>(b)</enum><header>Officers</header> <paragraph id="HDCB0BE76E9B544489293A8002BFA3C82" display-inline="yes-display-inline"><enum>(1)</enum><text>The head of the Office shall be the Director of the Office.</text></paragraph> <paragraph id="HCE464734275A4E4E9BF784FE3681705E" indent="up1"><enum>(2)</enum><text>There shall be a Deputy Director of the Office, who shall—</text> <subparagraph id="H747970C76C9345F9845DAFBDB7391076"><enum>(A)</enum><text>assist the Director in carrying out the responsibilities of the Director under this title; and</text></subparagraph> <subparagraph id="HD8BECDCF81F44154A558AF1CAC8EB207"><enum>(B)</enum><text>serve as Acting Director in the absence of the Director and during any vacancy in the office of Director.</text></subparagraph></paragraph> <paragraph id="HD4B30D16A04946CFA630C5E28D7F2B33" indent="up1"><enum>(3)</enum><text>The Director and Deputy Director—</text> <subparagraph id="HA11F4362FC524128008687009965ABF0"><enum>(A)</enum><text>shall be appointed by the President, by and with the advice and consent of the Senate; and</text></subparagraph> <subparagraph id="HE7C030C1B3C0435D98EB075115291989"><enum>(B)</enum><text>shall serve at the pleasure of the President.</text></subparagraph></paragraph> <paragraph id="H747488E02CB84FDABAA4E1009DC40080" indent="up1"><enum>(4)</enum><text>No person shall serve as Director or Deputy Director while serving in any other position in the Federal Government.</text></paragraph></subsection> <subsection id="HFFE0752269EE403DB608632126CAEED1"><enum>(c)</enum><header>Responsibilities</header><text>Subject to the direction and control of the President, the responsibilities of the Director shall include the following:</text> <paragraph id="H43464DD58F4340BDB515009763048BA9"><enum>(1)</enum><text>To develop policies, goals, objectives, and priorities for the United States for preventing the proliferation of weapons of mass destruction.</text></paragraph> <paragraph id="H615CDA22FA0541AAAA00B155156F8DA"><enum>(2)</enum><text>To serve as the principal advisor to the President with respect to those policies, goals, objectives, and priorities.</text></paragraph> <paragraph id="HAE783B9EE72B485287D6DB77E93C95C0"><enum>(3)</enum><text display-inline="yes-display-inline">To develop a comprehensive strategy for the United States for the prevention of the proliferation of weapons of mass destruction, to be known as the <quote>Strategy for Combating the Proliferation of Weapons of Mass Destruction</quote> (in this title referred to as the <quote>Strategy</quote>).</text></paragraph> <paragraph id="H1256510183EE4D3F8B97C7DB20A4DAD6"><enum>(4)</enum><text display-inline="yes-display-inline">To coordinate, oversee, and evaluate the implementation and execution of the Strategy by the agencies of the Federal Government with responsibilities for preventing the proliferation of weapons of mass destruction.</text></paragraph> <paragraph id="H30334FFC86FE45AE9654A2236C400F4"><enum>(5)</enum><text>To direct the development of comprehensive annual budgets submitted under <external-xref legal-doc="usc" parsable-cite="usc/31/1105">section 1105(a)</external-xref> of title 31, United States Code, for the programs and activities under the Strategy.</text></paragraph> <paragraph id="H51908084EE514A1F815936D40014B780"><enum>(6)</enum><text display-inline="yes-display-inline">To certify to the President, prior to the submission to Congress of each annual budget under that section, whether the budget for each element of preventing the proliferation of weapons of mass destruction is consistent with and adequate for carrying out the Strategy.</text></paragraph> <paragraph id="H81E77D3A0A8C4D659012A9B12BD006FF"><enum>(7)</enum><text display-inline="yes-display-inline">To carry out any other responsibilities relating to development, coordination, funding, and implementation of United States policy on the prevention of the proliferation of weapons of mass destruction that the President considers appropriate.</text></paragraph></subsection> <subsection id="H65A34A5BE04A4D30B3D77EAC1C7FAFBB"><enum>(d)</enum><header>Authorities of the director</header><text>In carrying out subsection (c), the Director shall have authority to—</text> <paragraph id="HE50CFE61E8CE485DAB0075D67B65C17"><enum>(1)</enum><text display-inline="yes-display-inline">develop and present to the President annual unified budgets for the prevention of the proliferation of weapons of mass destruction, including the authorities to—</text> <subparagraph id="HEBA5180385FB40E99889E55F8D320072"><enum>(A)</enum><text display-inline="yes-display-inline">provide guidance on the development of annual budgets for each element of the prevention of the proliferation of weapons of mass destruction;</text></subparagraph> <subparagraph id="HB07A8A9475B9455F8F581B9D1DAF5BB1"><enum>(B)</enum><text display-inline="yes-display-inline">direct, coordinate, and modify the annual budgets of the elements of the prevention of the proliferation of weapons of mass destruction, in consultation with the heads of those elements; and</text></subparagraph> <subparagraph id="H8AC91031AB3D40AAB44326E650FFACB1"><enum>(C)</enum><text display-inline="yes-display-inline">approve the budget of each element of the prevention of the proliferation of weapons of mass destruction before that budget may be provided to the President for transmission to the Congress;</text></subparagraph></paragraph> <paragraph id="H8BEE901E8DC74709A0E31EE6FE00D27"><enum>(2)</enum><text display-inline="yes-display-inline">transfer between accounts and agencies funds appropriated and associated resources available for the prevention of the proliferation of weapons of mass destruction and detail personnel when the Director makes a determination that doing so is necessary in order to—</text> <subparagraph id="HD98562232AFC49ADA9BC00EE5F16BE9F"><enum>(A)</enum><text>respond to an emergent risk of proliferation;</text></subparagraph> <subparagraph id="H092568724A074FE19403FDC65F1F9E57"><enum>(B)</enum><text>eliminate duplication of effort; or</text></subparagraph> <subparagraph id="HCACE607BDDF64EAA8369FC6F8740BC63"><enum>(C)</enum><text>significantly increase programmatic efficiency;</text></subparagraph></paragraph> <paragraph id="H19B13E6F8F164F85A008EFE2A7EC7606"><enum>(3)</enum><text>select, appoint, employ, and fix compensation of such officers and employees of the Office as may be necessary to carry out the functions of the Office;</text></paragraph> <paragraph id="H535149369D4F401DB1E9F56DEE60DC59"><enum>(4)</enum><text display-inline="yes-display-inline">subject to paragraphs (3) and (4) of subsection (e), request the head of a department or agency, or program of the Federal Government to place department, agency, or program personnel who are engaged in activities involving the prevention of the proliferation of weapons of mass destruction on temporary detail to another department, agency, or program in order to implement the Strategy, and the head of the department or agency shall comply with such a request;</text></paragraph> <paragraph id="H1DF2B3BF8C724BF98DEC76DEB6503C7D"><enum>(5)</enum><text>use for administrative purposes, on a reimbursable basis, the available services, equipment, personnel, and facilities of Federal agencies;</text></paragraph> <paragraph id="H8FD53B59260A437F82765B08C434FCDC"><enum>(6)</enum><text>procure the services of experts and consultants in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, relating to appointments in the Federal Service, at rates of compensation for individuals not to exceed the daily equivalent of the rate of pay payable under level IV of the Executive Schedule under section 5311 of that title;</text></paragraph> <paragraph id="H98F255DA98CD49A7893E4F54CBEAD5E"><enum>(7)</enum><text>use the mails in the same manner as any other department or agency of the executive branch; and</text></paragraph> <paragraph id="H31C2E36BA8404DD88E73A214405C00E3"><enum>(8)</enum><text>monitor implementation of the Strategy, including—</text> <subparagraph id="H7C01CA2ECA734F2DA924014EF4333448"><enum>(A)</enum><text>conducting program and performance audits and evaluations; and</text></subparagraph> <subparagraph id="H4210709F537F4195A8871CE0AE3FD850"><enum>(B)</enum><text>requesting assistance from the Inspector General of the relevant agency in such audits and evaluations.</text></subparagraph></paragraph></subsection> <subsection id="HE7E6AA6EA1A54A4B8B6CCCD4C21B8653"><enum>(e)</enum><header>Personnel detailed to office</header> <paragraph id="H0502962C866345CC9B8243431C3CE126" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">chapter 43</external-xref> of title 5, United States Code, the Director shall perform the evaluation of the performance of any employee detailed to the Office for purposes of the applicable performance appraisal system established under that chapter for any rating period, or part thereof, that the employee is detailed to the Office.</text></paragraph> <paragraph id="H60D22097D5DC4D8400CDB99D7957D50" indent="up1"><enum>(2)</enum> <subparagraph id="HFE4421B7D2DD469E85BE89901F9EC712" display-inline="yes-display-inline"><enum>(A)</enum><text>Notwithstanding any other provision of law, the Director may provide periodic bonus payments to any employee detailed to the Office.</text></subparagraph> <subparagraph id="H0EE113B574994F46875FB5E8D1592D43" indent="up1"><enum>(B)</enum><text>An amount paid under this paragraph to an employee for any period—</text> <clause id="HC19B46DD3C9F4EF1B55580DE4E87F637"><enum>(i)</enum><text>shall not be greater than 20 percent of the basic pay paid or payable to such employee for such period; and</text></clause> <clause id="HCCD5F3F7E6DC4221AC5643722F616026"><enum>(ii)</enum><text>shall be in addition to the basic pay of such employee.</text></clause></subparagraph> <subparagraph id="H621144792C3D427BA57F7971E3EE662B" indent="up1"><enum>(C)</enum><text>The aggregate amount paid during any fiscal year to an employee detailed to the Office as basic pay, awards, bonuses, and other compensation shall not exceed the annual rate payable at the end of such fiscal year for positions at level III of the Executive Schedule.</text></subparagraph></paragraph> <paragraph id="H27110A7491AF466FA873B9AA334E3FD" indent="up1"><enum>(3)</enum><text>The maximum number of personnel who may be detailed to another department or agency (including the Office) under subsection (d)(4) during any fiscal year is—</text> <subparagraph id="HA1C85836348B4B4A8870E1E71B086F5F"><enum>(A)</enum><text>for the Department of Defense, 5;</text></subparagraph> <subparagraph id="HF8E0603A36094D5F86DBA6276BF2FB60"><enum>(B)</enum><text>for the Department of Energy, 5;</text></subparagraph> <subparagraph id="HF863FB4AD08B46BAA91DECE869C9FC9"><enum>(C)</enum><text>for the Department of State, 5; and</text></subparagraph> <subparagraph id="HDD5F0CCD4ADE418286FF27D676A15254"><enum>(D)</enum><text>for any other department or agency, 2.</text></subparagraph></paragraph> <paragraph id="H9E22178C881D4F88B6DE4FA0008F0088" indent="up1"><enum>(4)</enum><text>A detail under subsection (d)(4) shall expire on the last day of the fiscal year after the fiscal year in which it is ordered by the Director unless extended by law or by an official having authority to extend it further.</text></paragraph></subsection> <subsection id="H3DF9B5EA6F7742C3AB97D5AAAC4CED64"><enum>(f)</enum><header>Report on strategic plan</header> <paragraph id="HC7C1A1C33EF648AB8FFE2EFFA6607402" display-inline="yes-display-inline"><enum>(1)</enum><text>Not later than June 1, 2008, the Director shall submit to Congress the Strategy developed under subsection (c)(3), together with any recommendations of the Director for legislative changes that the Director considers appropriate with respect to either the Strategy and its implementation or the Office.</text></paragraph> <paragraph id="HD0CA19E6EEEB4683ADDB75C8E9B0825B" indent="up1"><enum>(2)</enum><text>Not later than December 31 of each year after 2007, the Director shall submit to the Congress an updated Strategy and any such recommendations.</text></paragraph></subsection> <subsection id="HA83BE2744EAD409E9FBCD5382D2002C"><enum>(g)</enum><header>Global coalition</header> <paragraph id="H4EE944875E7A4C03BF1848F6D16573A5" display-inline="yes-display-inline"><enum>(1)</enum><text>The Director shall develop the Strategy and, in consultation with the Secretary of State, carry out the programs for which the Director is responsible in coordination with appropriate officials of the foreign governments concerned.</text></paragraph> <paragraph id="HB87AD3E9B434485096783D14726827A1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In consultation with the Secretary of State, the Director shall seek to develop and provide leadership for a coalition of United States and foreign governments committed to achieving the prevention of the proliferation of weapons of mass destruction through programs similar to those specified in section 103.</text></paragraph></subsection> <subsection id="H3977CF27F6A94AAE8232D96233DD8B17"><enum>(h)</enum><header>Oversight by Congress</header><text>The location of the Office in the Executive Office of the President shall not be construed as affecting access by Congress, or any committee of Congress, to—</text> <paragraph id="H8C4E28C4A613486DA1C6E65827F25373"><enum>(1)</enum><text>any information, document, record, or paper in the possession of the Office or any study conducted by or at the direction of the Director; or</text></paragraph> <paragraph id="HBAAB0ECC52EE4F3DBB43DE554B04C964"><enum>(2)</enum><text>any personnel of the Office, including the Director.</text></paragraph></subsection> <subsection id="HA7494E1DEA9B45108C00242C84FF7C9E"><enum>(i)</enum><header>Pay of director and of deputy director</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">Chapter 53</external-xref> of title 5, United States Code, is amended—</text> <paragraph id="HC47EA5E08F9C401DBCB9613B879EA769"><enum>(1)</enum><text>in section 5312, by inserting after the item relating to the Director of National Intelligence the following new item:</text><list list-type="none" level="paragraph"><list-item><quote>Director of the Office for Combating the Proliferation of Weapons of Mass Destruction.</quote>; and</list-item></list></paragraph> <paragraph id="HE1CE71407ABE4F9AA8EDC419F545A500"><enum>(2)</enum><text>in section 5313, by inserting after the item relating to the Administrator of the Federal Emergency Management Agency the following new item:</text><list list-type="none" level="paragraph"><list-item><quote>Deputy Director of the Office for Combating the Proliferation of Weapons of Mass Destruction.</quote>.</list-item></list></paragraph></subsection> <subsection id="H2276711B3DE144579446D901CDA2F539"><enum>(j)</enum><header>Authorization of Appropriations</header><text>There all authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section> <section id="HBC6809AA9E29458888859E078D6D76EB"><enum>102.</enum><header>Request for corresponding Russian director</header><text display-inline="no-display-inline">It is the sense of the Congress that, as soon as practical, the President should personally request the President of the Russian Federation to designate an official of the Russian Federation having authorities and responsibilities for the prevention of the proliferation of weapons of mass destruction commensurate with those of the Director and with whom the Director should coordinate with respect to the planning and implementation in the Russian Federation of activities having the purpose of securing weapons of mass destruction.</text></section> <section id="H73BAB74C428C48AF00435B74F45CF86"><enum>103.</enum><header>Scope</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HA62A63A477DF49CDA9587695DD4D005E"><enum>(1)</enum><text>The term <term>prevention of the proliferation of weapons of mass destruction</term> includes activities under—</text> <subparagraph id="H53EA87638CBA44A7BEAA00C4B526008E"><enum>(A)</enum><text>the programs specified in section 1501(b) of the National Defense Authorization Act for Fiscal Year 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/104/201">Public Law 104–201</external-xref>; 110 Stat. 2731; <external-xref legal-doc="usc" parsable-cite="usc/50/2362">50 U.S.C. 2362</external-xref> note);</text></subparagraph> <subparagraph id="H49B42AE6D440416C892D72D09E00411F"><enum>(B)</enum><text>the programs carried out by the National Nuclear Security Administration using amounts made available pursuant to an authorization of appropriations for defense nuclear nonproliferation activities;</text></subparagraph> <subparagraph id="HF31C220007C3442A89005B8BED8513EC"><enum>(C)</enum><text>programs authorized by section 504 of the Freedom for Russia and Emerging Eurasian Democracies and Open Markets Support Act of 1992 (the FREEDOM Support Act) (<external-xref legal-doc="usc" parsable-cite="usc/22/5854">22 U.S.C. 5854</external-xref>) and programs authorized by section 1412 of the Former Soviet Union Demilitarization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5902">22 U.S.C. 5902</external-xref>); and</text></subparagraph> <subparagraph id="H169CC7C1A0044F8A90082DFDA619F972"><enum>(D)</enum><text>a program of any agency of the Federal Government having a purpose similar to that of any of the programs identified in subparagraphs (A) through (C), as designated by the Director and the head of the agency.</text></subparagraph></paragraph> <paragraph id="H3175B09316264F0E90B5F76C837126FB"><enum>(2)</enum><text>The term <term>weapons of mass destruction</term> means chemical, biological, and nuclear weapons, and chemical, biological, and nuclear materials that can be used in the manufacture of such weapons.</text></paragraph></section>

and</text></subparagraph> <subparagraph id="H8AC91031AB3D40AAB44326E650FFACB1"><enum>(C)</enum><text display-inline="yes-display-inline">approve the budget of each element of the prevention of the proliferation of weapons of mass destruction before that budget may be provided to the President for transmission to the Congress;</text></subparagraph></paragraph> <paragraph id="H8BEE901E8DC74709A0E31EE6FE00D27"><enum>(2)</enum><text display-inline="yes-display-inline">transfer between accounts and agencies funds appropriated and associated resources available for the prevention of the proliferation of weapons of mass destruction and detail personnel when the Director makes a determination that doing so is necessary in order to—</text> <subparagraph id="HD98562232AFC49ADA9BC00EE5F16BE9F"><enum>(A)</enum><text>respond to an emergent risk of proliferation;</text></subparagraph> <subparagraph id="H092568724A074FE19403FDC65F1F9E57"><enum>(B)</enum><text>eliminate duplication of effort; or</text></subparagraph> <subparagraph id="HCACE607BDDF64EAA8369FC6F8740BC63"><enum>(C)</enum><text>significantly increase programmatic efficiency;</text></subparagraph></paragraph> <paragraph id="H19B13E6F8F164F85A008EFE2A7EC7606"><enum>(3)</enum><text>select, appoint, employ, and fix compensation of such officers and employees of the Office as may be necessary to carry out the functions of the Office;</text></paragraph> <paragraph id="H535149369D4F401DB1E9F56DEE60DC59"><enum>(4)</enum><text display-inline="yes-display-inline">subject to paragraphs (3) and (4) of subsection (e), request the head of a department or agency, or program of the Federal Government to place department, agency, or program personnel who are engaged in activities involving the prevention of the proliferation of weapons of mass destruction on temporary detail to another department, agency, or program in order to implement the Strategy, and the head of the department or agency shall comply with such a request;</text></paragraph> <paragraph id="H1DF2B3BF8C724BF98DEC76DEB6503C7D"><enum>(5)</enum><text>use for administrative purposes, on a reimbursable basis, the available services, equipment, personnel, and facilities of Federal agencies;</text></paragraph> <paragraph id="H8FD53B59260A437F82765B08C434FCDC"><enum>(6)</enum><text>procure the services of experts and consultants in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, relating to appointments in the Federal Service, at rates of compensation for individuals not to exceed the daily equivalent of the rate of pay payable under level IV of the Executive Schedule under section 5311 of that title;</text></paragraph> <paragraph id="H98F255DA98CD49A7893E4F54CBEAD5E"><enum>(7)</enum><text>use the mails in the same manner as any other department or agency of the executive branch; and</text></paragraph> <paragraph id="H31C2E36BA8404DD88E73A214405C00E3"><enum>(8)</enum><text>monitor implementation of the Strategy, including—</text> <subparagraph id="H7C01CA2ECA734F2DA924014EF4333448"><enum>(A)</enum><text>conducting program and performance audits and evaluations; and</text></subparagraph> <subparagraph id="H4210709F537F4195A8871CE0AE3FD850"><enum>(B)</enum><text>requesting assistance from the Inspector General of the relevant agency in such audits and evaluations.</text></subparagraph></paragraph></subsection> <subsection id="HE7E6AA6EA1A54A4B8B6CCCD4C21B8653"><enum>(e)</enum><header>Personnel detailed to office</header> <paragraph id="H0502962C866345CC9B8243431C3CE126" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">chapter 43</external-xref> of title 5, United States Code, the Director shall perform the evaluation of the performance of any employee detailed to the Office for purposes of the applicable performance appraisal system established under that chapter for any rating period, or part thereof, that the employee is detailed to the Office.</text></paragraph> <paragraph id="H60D22097D5DC4D8400CDB99D7957D50" indent="up1"><enum>(2)</enum> <subparagraph id="HFE4421B7D2DD469E85BE89901F9EC712" display-inline="yes-display-inline"><enum>(A)</enum><text>Notwithstanding any other provision of law, the Director may provide periodic bonus payments to any employee detailed to the Office.</text></subparagraph> <subparagraph id="H0EE113B574994F46875FB5E8D1592D43" indent="up1"><enum>(B)</enum><text>An amount paid under this paragraph to an employee for any period—</text> <clause id="HC19B46DD3C9F4EF1B55580DE4E87F637"><enum>(i)</enum><text>shall not be greater than 20 percent of the basic pay paid or payable to such employee for such period; and</text></clause> <clause id="HCCD5F3F7E6DC4221AC5643722F616026"><enum>(ii)</enum><text>shall be in addition to the basic pay of such employee.</text></clause></subparagraph> <subparagraph id="H621144792C3D427BA57F7971E3EE662B" indent="up1"><enum>(C)</enum><text>The aggregate amount paid during any fiscal year to an employee detailed to the Office as basic pay, awards, bonuses, and other compensation shall not exceed the annual rate payable at the end of such fiscal year for positions at level III of the Executive Schedule.</text></subparagraph></paragraph> <paragraph id="H27110A7491AF466FA873B9AA334E3FD" indent="up1"><enum>(3)</enum><text>The maximum number of personnel who may be detailed to another department or agency (including the Office) under subsection (d)(4) during any fiscal year is—</text> <subparagraph id="HA1C85836348B4B4A8870E1E71B086F5F"><enum>(A)</enum><text>for the Department of Defense, 5;</text></subparagraph> <subparagraph id="HF8E0603A36094D5F86DBA6276BF2FB60"><enum>(B)</enum><text>for the Department of Energy, 5;</text></subparagraph> <subparagraph id="HF863FB4AD08B46BAA91DECE869C9FC9"><enum>(C)</enum><text>for the Department of State, 5; and</text></subparagraph> <subparagraph id="HDD5F0CCD4ADE418286FF27D676A15254"><enum>(D)</enum><text>for any other department or agency, 2.</text></subparagraph></paragraph> <paragraph id="H9E22178C881D4F88B6DE4FA0008F0088" indent="up1"><enum>(4)</enum><text>A detail under subsection (d)(4) shall expire on the last day of the fiscal year after the fiscal year in which it is ordered by the Director unless extended by law or by an official having authority to extend it further.</text></paragraph></subsection> <subsection id="H3DF9B5EA6F7742C3AB97D5AAAC4CED64"><enum>(f)</enum><header>Report on strategic plan</header> <paragraph id="HC7C1A1C33EF648AB8FFE2EFFA6607402" display-inline="yes-display-inline"><enum>(1)</enum><text>Not later than June 1, 2008, the Director shall submit to Congress the Strategy developed under subsection (c)(3), together with any recommendations of the Director for legislative changes that the Director considers appropriate with respect to either the Strategy and its implementation or the Office.</text></paragraph> <paragraph id="HD0CA19E6EEEB4683ADDB75C8E9B0825B" indent="up1"><enum>(2)</enum><text>Not later than December 31 of each year after 2007, the Director shall submit to the Congress an updated Strategy and any such recommendations.</text></paragraph></subsection> <subsection id="HA83BE2744EAD409E9FBCD5382D2002C"><enum>(g)</enum><header>Global coalition</header> <paragraph id="H4EE944875E7A4C03BF1848F6D16573A5" display-inline="yes-display-inline"><enum>(1)</enum><text>The Director shall develop the Strategy and, in consultation with the Secretary of State, carry out the programs for which the Director is responsible in coordination with appropriate officials of the foreign governments concerned.</text></paragraph> <paragraph id="HB87AD3E9B434485096783D14726827A1" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In consultation with the Secretary of State, the Director shall seek to develop and provide leadership for a coalition of United States and foreign governments committed to achieving the prevention of the proliferation of weapons of mass destruction through programs similar to those specified in section 103.</text></paragraph></subsection> <subsection id="H3977CF27F6A94AAE8232D96233DD8B17"><enum>(h)</enum><header>Oversight by Congress</header><text>The location of the Office in the Executive Office of the President shall not be construed as affecting access by Congress, or any committee of Congress, to—</text> <paragraph id="H8C4E28C4A613486DA1C6E65827F25373"><enum>(1)</enum><text>any information, document, record, or paper in the possession of the Office or any study conducted by or at the direction of the Director; or</text></paragraph> <paragraph id="HBAAB0ECC52EE4F3DBB43DE554B04C964"><enum>(2)</enum><text>any personnel of the Office, including the Director.</text></paragraph></subsection> <subsection id="HA7494E1DEA9B45108C00242C84FF7C9E"><enum>(i)</enum><header>Pay of director and of deputy director</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">Chapter 53</external-xref> of title 5, United States Code, is amended—</text> <paragraph id="HC47EA5E08F9C401DBCB9613B879EA769"><enum>(1)</enum><text>in section 5312, by inserting after the item relating to the Director of National Intelligence the following new item:</text><list list-type="none" level="paragraph"><list-item><quote>Director of the Office for Combating the Proliferation of Weapons of Mass Destruction.</quote>; and</list-item></list></paragraph> <paragraph id="HE1CE71407ABE4F9AA8EDC419F545A500"><enum>(2)</enum><text>in section 5313, by inserting after the item relating to the Administrator of the Federal Emergency Management Agency the following new item:</text><list list-type="none" level="paragraph"><list-item><quote>Deputy Director of the Office for Combating the Proliferation of Weapons of Mass Destruction.</quote>.</list-item></list></paragraph></subsection> <subsection id="H2276711B3DE144579446D901CDA2F539"><enum>(j)</enum><header>Authorization of Appropriations</header><text>There all authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section> <section id="HBC6809AA9E29458888859E078D6D76EB"><enum>102.</enum><header>Request for corresponding Russian director</header><text display-inline="no-display-inline">It is the sense of the Congress that, as soon as practical, the President should personally request the President of the Russian Federation to designate an official of the Russian Federation having authorities and responsibilities for the prevention of the proliferation of weapons of mass destruction commensurate with those of the Director and with whom the Director should coordinate with respect to the planning and implementation in the Russian Federation of activities having the purpose of securing weapons of mass destruction.</text></section> <section id="H73BAB74C428C48AF00435B74F45CF86"><enum>103.</enum><header>Scope</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HA62A63A477DF49CDA9587695DD4D005E"><enum>(1)</enum><text>The term <term>prevention of the proliferation of weapons of mass destruction</term> includes activities under—</text> <subparagraph id="H53EA87638CBA44A7BEAA00C4B526008E"><enum>(A)</enum><text>the programs specified in section 1501(b) of the National Defense Authorization Act for Fiscal Year 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/104/201">Public Law 104–201</external-xref>; 110 Stat. 2731; <external-xref legal-doc="usc" parsable-cite="usc/50/2362">50 U.S.C. 2362</external-xref> note);</text></subparagraph> <subparagraph id="H49B42AE6D440416C892D72D09E00411F"><enum>(B)</enum><text>the programs carried out by the National Nuclear Security Administration using amounts made available pursuant to an authorization of appropriations for defense nuclear nonproliferation activities;</text></subparagraph> <subparagraph id="HF31C220007C3442A89005B8BED8513EC"><enum>(C)</enum><text>programs authorized by section 504 of the Freedom for Russia and Emerging Eurasian Democracies and Open Markets Support Act of 1992 (the FREEDOM Support Act) (<external-xref legal-doc="usc" parsable-cite="usc/22/5854">22 U.S.C. 5854</external-xref>) and programs authorized by section 1412 of the Former Soviet Union Demilitarization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/5902">22 U.S.C. 5902</external-xref>); and</text></subparagraph> <subparagraph id="H169CC7C1A0044F8A90082DFDA619F972"><enum>(D)</enum><text>a program of any agency of the Federal Government having a purpose similar to that of any of the programs identified in subparagraphs (A) through (C), as designated by the Director and the head of the agency.</text></subparagraph></paragraph> <paragraph id="H3175B09316264F0E90B5F76C837126FB"><enum>(2)</enum><text>The term <term>weapons of mass destruction</term> means chemical, biological, and nuclear weapons, and chemical, biological, and nuclear materials that can be used in the manufacture of such weapons.</text></paragraph></section> <enum>II</enum><header>Global Cleanout</header> <section id="H6D3C2B257A524915B0F64DCC79FDF800"><enum>201.</enum><header>Authorization of Appropriations</header><text display-inline="no-display-inline">In addition to amounts otherwise available for such purposes, there are authorized to be appropriated to the Secretary of Energy to carry out the program under section 3132 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (<external-xref legal-doc="usc" parsable-cite="usc/50/2569">50 U.S.C. 2569</external-xref>) $100,000,000 for each fiscal year.</text></section> <enum>III</enum><header>Expansion of Proliferation Security Initiative</header> <section id="H6D87B0ECC4F74F49800700B53369F6D"><enum>301.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="H7077DDA6E99946B084EB96E4B1BFF87B"><enum>(1)</enum><text>the President should strive to expand and strengthen the Proliferation Security Initiative announced by the President on May 31, 2003, placing particular emphasis on including countries outside of NATO; and</text></paragraph> <paragraph id="H1AB5BECA771443DC8DE0C6AB2B5C80"><enum>(2)</enum><text>the United States should engage the United Nations to develop a Security Council Resolution to authorize the Proliferation Security Initiative under international law, including by providing legal authority to stop shipments of weapons of mass destruction, their delivery systems, and related materials.</text></paragraph></section> <section id="H17E328E749E84F97836CE5FE372A6B4"><enum>302.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated for fiscal year 2008, $50,000,000 to conduct joint training exercises regarding interdiction of weapons of mass destruction under the Proliferation Security Initiative. Particular emphasis should be given to allocating money from this total—</text> <paragraph id="H9F8A9D7B95D44A139378137D00B1225B"><enum>(1)</enum><text>to invite other countries that do not participate in the Proliferation Security Initiative to observe the joint training exercises; and</text></paragraph> <paragraph id="H4AA8B4BA5570464DB0D4E343B5BD2BF1"><enum>(2)</enum><text display-inline="yes-display-inline">to conduct training exercises with countries that openly join the Proliferation Security Initiative after the date of enactment of this Act.</text></paragraph></section> <enum>IV</enum><header>Cooperative Threat Reduction Programs</header> <section id="HA338ABFDF2394A59A4BA2B5E673BA841"><enum>401.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated for Cooperative Threat Reduction programs not less than—</text> <paragraph id="H1C81C43E26FD462885C0B7C448FD38DF"><enum>(1)</enum><text>$500,000,000 for fiscal year 2008;</text></paragraph> <paragraph id="H07B70F2CE1A3472BB70060CF3C77E8E2"><enum>(2)</enum><text>$550,000,000 for fiscal year 2009;</text></paragraph> <paragraph id="H0B392B03F710452AA370F900A0C53E16"><enum>(3)</enum><text>$600,000,000 for fiscal year 2010;</text></paragraph> <paragraph id="HF5926BB062AC4090B4CC41B9EC34BA5E"><enum>(4)</enum><text>$650,000,000 for fiscal year 2011; and</text></paragraph> <paragraph id="H3684385651BD49B5AA796BFD47B005E"><enum>(5)</enum><text>$700,000,000 for fiscal year 2012.</text></paragraph></section> <section id="HF61B3FB2891A457B9273B66F1058222F"><enum>402.</enum><header>Permanent waiver authority for chemical weapons destruction facility in Russia</header><text display-inline="no-display-inline">Section 1305 of the National Defense Authorization Act for Fiscal Year 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/5952">22 U.S.C. 5952</external-xref> note) shall not apply to the obligation and expenditure of funds during a fiscal year for the planning, design, or construction of a chemical weapons destruction facility in the Russian Federation if the President submits to Congress a written certification with respect to that fiscal year that includes—</text> <paragraph id="H0B577C5EB8D3483DA53EA55079B1E95D"><enum>(1)</enum><text>a statement as to why the waiver of the conditions during the fiscal year covered by such certification is consistent with the national security interests of the United States; and</text></paragraph> <paragraph id="HFDE3C784D1424CB898CDBF141004CDFC"><enum>(2)</enum><text>a plan to promote a full and accurate disclosure by the Russian Federation regarding the size, content, status, and location of its chemical weapons stockpile.</text></paragraph></section> <section id="HC8A10F67527142F085C2795CF4FFE016"><enum>403.</enum><header>Removal of funding limitation on activities outside the former Soviet Union</header><text display-inline="no-display-inline">Section 1308(c) of the National Defense Authorization Act for Fiscal Year 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/135">Public Law 108–135</external-xref>; 117 Stat. 1662; <external-xref legal-doc="usc" parsable-cite="usc/22/5963">22 U.S.C. 5963(c)</external-xref>) is repealed.</text></section> <section id="H897FE27F2D4845E0A1E961DC7F21BEEC"><enum>404.</enum><header>Liability report</header><text display-inline="no-display-inline">Not later than April 1, 2008, and every 6 months thereafter, the President shall submit to Congress a report identifying liability concerns regarding, and impediments to, the renegotiation of the Cooperative Threat Reduction umbrella agreement and ongoing negotiations for the implementation of the Plutonium Disposition, Nuclear Cities, and other cooperative nonproliferation programs. The report shall also outline a plan to address and resolve such concerns and impediments.</text></section> <section id="H18E51795096F49D18D07AEEB084C0032"><enum>405.</enum><header>Definition</header><text display-inline="no-display-inline">In this title, the term <term>Cooperative Threat Reduction programs</term> means the programs specified in section 1501(b) of the National Defense Authorization Act for Fiscal Year 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/104/201">Public Law 104–201</external-xref>; 110 Stat. 2731; <external-xref legal-doc="usc" parsable-cite="usc/50/2362">50 U.S.C. 2362</external-xref> note).</text></section>
