		<official-title>To amend title 11 of the United States Code with respect
		  to modification of certain mortgages on principal residences, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="HC53F928CF1A94A8F867B8318477FC824" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Emergency Home Ownership and Mortgage
			 Equity Protection Act of 2007</short-title></quote>.</text>
		</section><section id="H8774C7845E714600B4AB47B07F3111EC"><enum>2.</enum><header>Determination of
			 secured status</header><text display-inline="no-display-inline">Section 506(b)
			 of title 11, the United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HDFD38D8BDBBC489DB708DCE1582D8D05" style="OLC">
				<quoted-block-continuation-text quoted-block-continuation-text-level="subsection">While a
				case is pending, no fee, costs, or charges may be added to a debt that is
				provided for in a chapter 13 plan and is secured by the debtor's principal
				residence unless the holder of the secured claim gives timely notice of such
				fee, costs, or charge to the debtor and to the
				trustee.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HCC95DC62AF3F48089CC8F4BD2DA1003"><enum>3.</enum><header>Limitation of 1978
			 exemption that prevents Federal bankruptcy courts from making modifications to
			 the terms of a mortgage on a debtor’s principal residence</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/1322">Section 1322(b)(2)</external-xref> of title 11, United
			 States Code, is amended by striking <quote>, other than a claim secured only by
			 a security interest in real property that is the debtor’s principal
			 residence,</quote>.</text>
		</section><section id="H2ED9F60977934A1C9CA5BD58E62DC3F7"><enum>4.</enum><header>Modification of
			 claims secured by debtor’s principal residence</header>
			<subsection id="HEDF85DC6EB5F4D2DA709513D1BDF5CB0"><enum>(a)</enum><header>Contents of
			 plan</header><text><external-xref legal-doc="usc" parsable-cite="usc/11/1322">Section 1322(b)</external-xref> of title 11, the United States Code, is
			 amended—</text>
				<paragraph id="H64BC12BC997242FAB298DCDB82F98507"><enum>(1)</enum><text>in paragraph (10)
			 by striking <quote>and</quote> at the end,</text>
				</paragraph><paragraph id="HC078F73BFADA4393B4C4C415FD16BF7B"><enum>(2)</enum><text>by redesignating
			 paragraph (11) as paragraph (12), and</text>
				</paragraph><paragraph id="H4BA5E7B4456647FC8EA2415CF2EA445D"><enum>(3)</enum><text>by inserting after
			 paragraph (10) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H4D93A6DC45474396BF7E7952E9EFA780" style="USC">
						<paragraph id="H6C650F1B7A6B4D3592EB1017A627DDF8"><enum>(11)</enum><text display-inline="yes-display-inline">provide for payment of allowed claims
				secured by the debtor’s principal residence consistent with section 1325(a)(5),
				over a period exceeding the period permitted under section 1322(d);
				and</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE6EE067374BB43A08817392EB9D22FCC"><enum>(b)</enum><header>Confirmation of
			 plan</header><text display-inline="yes-display-inline">Section 1325(b)(5) of
			 title 11, the United States Code, is amended by inserting <quote>except as
			 otherwise provided in section 1322(b),</quote> after <quote>(5)</quote>.</text>
			</subsection></section><section id="HE79495F456884690AF493B3776ADAFF"><enum>5.</enum><header>Elimination of
			 credit counseling requirement for chapter 13 debtors facing
			 foreclosure</header><text display-inline="no-display-inline">Section 109(h) of
			 title 11, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HC7922667F3144DFAA5BA5DF4617211C5" style="OLC">
				<paragraph id="H9D256BCF65EE4AFE86B1DE666BE73BF9" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The requirements of paragraph (1) shall not
				apply with respect to a debtor in a case under chapter 13 who submits to the
				court a certification that the holder of a claim secured by the debtor’s
				principal residence has initiated a judicial or non-judicial foreclosure on the
				debtor’s principal
				residence.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HDCD5F53968F140E5AF2EDF8E20EE8200"><enum>6.</enum><header>Confirmation of
			 plan</header><text display-inline="no-display-inline">Section 1325(a) of title
			 11, the United States Code, is amended—</text>
			<paragraph id="H0653D279287D41668FE0B18132AB805C"><enum>(1)</enum><text>in paragraph (8)
			 by striking <quote>and</quote> at the end,</text>
			</paragraph><paragraph id="HC0552FDD01F24579A73D38F90100CDF3"><enum>(2)</enum><text>in paragraph (9)
			 by striking the period at the end and inserting <quote>; and</quote>,
			 and</text>
			</paragraph><paragraph id="H3E39A9AD6F1245B2ACCEE9183576085E"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (9) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HD142CC3D36074368ABD1BDB8B15456F" style="OLC">
					<paragraph id="HD2AE46DE9D4345CF957700C94D0779B"><enum>(10)</enum><text display-inline="yes-display-inline">notwithstanding paragraph (5)(B)(i)(I), the
				holder of a claim that is paid pursuant to section 1322(b)(11) shall retain the
				lien securing such claim until payment of such
				claim.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H466C49BEEAED4751BAAC3CF6502600F0"><enum>7.</enum><header>Discharge</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/1328">Section 1328</external-xref> of title 11, the United States
			 Code, is amended—</text>
			<paragraph id="H2E5A0E714712456FA7F471CBE765F407"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="HE8C86F96A9094A5C9EEE08AB8F318B13"><enum>(A)</enum><text>by inserting
			 <quote>(other than payments to holders of allowed claims provided for under
			 section 1322(b)(11)</quote> after <quote>paid</quote> the 1st place it appears,
			 and</text>
				</subparagraph><subparagraph id="H228D3C5DED0E4619BBC766C700290053"><enum>(B)</enum><text>in paragraph (1)
			 by inserting <quote>or 1322(b)(11)</quote> after <quote>1322(b)(5)</quote>,
			 and</text>
				</subparagraph></paragraph><paragraph id="H8AF43DA60A814FEE97A13F134140D259"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1) by inserting <quote>or
			 1322(b)(11)</quote> after <quote>1322(b)(5)</quote>.</text>
