		<official-title>To amend the Consumer Product Safety Act to provide the
		  Consumer Product Safety Commission with greater authority to require recalls,
		  mandatory routine product testing, and for other purposes.</official-title>

		<section id="HD325C310461049949C2C4FB4F336BFE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Family Product Safety Protection
			 Act</short-title></quote>.</text>
		</section><section id="H9A8C759D663E44D2AD42AAFC5E220B5"><enum>2.</enum><header>Commission
			 authority relating to recalls</header>
			<subsection id="H36C561E4F3DD48F4AF20F74243CD7709"><enum>(a)</enum><header>Commission
			 recall authority</header><text>Section 12(a) of the Consumer Product Safety Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/2061">15 U.S.C. 2061(a)</external-xref>) is amended—</text>
				<paragraph id="H1B144CC8D2784EDB88779931BAAFEC49"><enum>(1)</enum><text>by striking
			 <quote>(a)</quote> and inserting <quote>(a)(1)</quote>; and</text>
				</paragraph><paragraph id="HC3C18FA3827D4752A89F7539D426E7E2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HAF37D02E394A4F98AF37A426346772CD" style="traditional">
						<paragraph id="H9C36175B19884AF9B87E38FD91BBC2D" indent="up1"><enum>(2)</enum><text>Notwithstanding any of the disclosure
				requirements in section 6, the Commission may order the recall of any consumer
				product that the Commission determines to be an imminently hazardous consumer
				product, and may disclose information relating to the recall and the product to
				the
				public.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC4E6B25F637B450CB76FEF09D388002D"><enum>(b)</enum><header>Reduced Period
			 of Notice to Manufacturers and Private Labelers With Respect to Disclosure of
			 Information</header><text display-inline="yes-display-inline">Section 6(b)(1)
			 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2055">15 U.S.C. 2055(b)(1)</external-xref>) is amended by striking <quote>not less than
			 30 day</quote> and inserting <quote>not fewer than 10 days</quote>.</text>
			</subsection><subsection id="HFB8790B94EEE4731B6B19C9AEC5FC44"><enum>(c)</enum><header>Establishment of
			 Minimum Fine for Failure To Comply With Order</header><text display-inline="yes-display-inline">Section 20(a)(1) of such Act (15 U.S.C.
			 2069(a)(1)) is amended—</text>
				<paragraph id="H8A0040D46A1342E8AB4413F58CC6BB25"><enum>(1)</enum><text>in the first
			 sentence, by inserting <quote>, and in the case of a person who violates
			 subsection (a)(5) of such section by selling at retail any product that is the
			 subject of a recall order, such person shall be subject to a civil penalty of
			 not less than $500 and not more than $10,000 for each such violation</quote>
			 after <quote>for each such violation</quote>; and</text>
				</paragraph><paragraph id="HD82EB465190245759B72E94B496286B5"><enum>(2)</enum><text>in the third
			 sentence, by striking <quote>of section 19(a)(3)</quote> and inserting
			 <quote>of paragraph (3) or (5) of section 19(a)</quote>.</text>
				</paragraph></subsection></section><section commented="no" id="H7323059283484FA6B07F40966EFE302C"><enum>3.</enum><header>Testing
			 requirement</header><text display-inline="no-display-inline">Section 14 of the
			 Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2063">15 U.S.C. 2063</external-xref>) is amended—</text>
			<paragraph id="HA979ABDF7DE042BD001745DCD72B2098"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>or upon a reasonable testing program</quote> and insert
			 <quote>, as required under subsection (b)</quote>; and</text>
			</paragraph><paragraph id="H2C45556E25F1472089FF94132DD9E388"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>The Commission may by rule prescribe reasonable testing
			 programs for</quote> and inserting <quote>The Commission shall by rule
			 prescribe reasonable testing requirements for the routine testing
			 of</quote>.</text>
			</paragraph></section><section id="HE17E987DC5F743B4B3A0D8EB00E49F13"><enum>4.</enum><header>Authorization of
			 Appropriations for Consumer Product Safety Commission</header><text display-inline="no-display-inline">Section 32(a) of the Consumer Product Safety
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2081">15 U.S.C. 2081</external-xref>) is amended—</text>
			<paragraph id="HE063703FE6154623A20188E000791EA7"><enum>(1)</enum><text>by striking
			 <quote>, not to exceed</quote>; and</text>
			</paragraph><paragraph id="HE390158EBC814367AD32834F7FFB1647"><enum>(2)</enum><text>by striking
			 paragraphs (1) and (2), and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0F21BB8A9ACD4C0FA17DB3487B8C56C7" style="traditional">
					<paragraph id="HFDEF4D8A02F14A1BB4C33EB25DD4711B"><enum>(1)</enum><text display-inline="yes-display-inline">$85,000,000 for fiscal year 2008;</text>
					</paragraph><paragraph id="HC7BEBFFD45B8414EA9364EB3497619F7"><enum>(2)</enum><text>for fiscal year
				2009 and subsequent fiscal years, an amount that is not less than the amount
				appropriated for the preceding fiscal year, increased by a percentage equal to
				the percentage increase for the preceding fiscal year in the total number of
				goods imported to the United
				States.</text>
