		<official-title display="yes">To enhance citizen access to Government
		  information and services by establishing plain language as the standard style
		  for Government documents issued to the public, and for other
		  purposes.</official-title>

		<section id="H04D9B6117C2B4C869D3910ED76A0DCB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Plain Language in Government
			 Communications Act of 2008</short-title></quote>.</text>
		</section><section id="HFFD21E33164D4A7F9C7D57356128B5E1"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to improve the
			 Federal Government’s effectiveness and accountability to the public by
			 promoting clear communication that the public can understand and use.</text>
		</section><section id="HF7586A226C6A41B7A6491F4200B1AE4C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HCA579ABE47C6404F91FC19332D236B78"><enum>(1)</enum><header>Agency</header><text>The
			 term <term>agency</term> means an Executive agency, as that term is defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code.</text>
			</paragraph><paragraph id="HCFDCDB8BBC7B437889FCE104E0FCCD9"><enum>(2)</enum><header>Plain
			 language</header><text>The term <term>plain language</term> means language that
			 the intended audience can readily understand and use because it is clear,
			 concise, well-organized, and follows other best practices of plain language
			 writing.</text>
			</paragraph></section><section id="HEF6A6285C73E4B7D90C757629E8C3CC7"><enum>4.</enum><header>Responsibilities
			 of Federal agencies</header>
			<subsection id="H2A2432D48DA34CD900C394D7AE8263DB"><enum>(a)</enum><header>Requirement to
			 use plain language in new documents</header><text>Within one year after the
			 date of the enactment of this Act, each agency—</text>
				<paragraph id="H58F9934FA15840AF89A194C3ED27C4D8"><enum>(1)</enum><text>shall use plain
			 language in any covered document of the agency issued or substantially revised
			 after the date of the enactment of this Act;</text>
				</paragraph><paragraph id="H329DC5CA9D11499EA700A923552ECB1D"><enum>(2)</enum><text>may use plain
			 language in any revision of a covered document issued on or before such date;
			 and</text>
				</paragraph><paragraph id="H66868F2EC5B14283BA5D8DC1629D3F46"><enum>(3)</enum><text display-inline="yes-display-inline">shall, when appropriate, use the English
			 language in covered documents.</text>
				</paragraph></subsection><subsection id="H5EC80EE1CD0C446BAD9FCDC499BCF800"><enum>(b)</enum><header>Guidance</header><text>In
			 implementing subsection (a), an agency may follow either the guidance of the
			 Plain English Handbook, published by the Securities and Exchange Commission, or
			 the Federal Plain Language Guidelines. If any agency has its own plain language
			 guidance, the agency may use that guidance, as long as it is consistent with
			 the Federal Plain Language Guidelines, the Plain English Handbook, published by
			 the Securities and Exchange Commission, and the recommendations made by the
			 Comptroller General under section 5(c).</text>
			</subsection><subsection display-inline="no-display-inline" id="H102DE3793CEA4988968CF872F43137D"><enum>(c)</enum><header>Additional
			 provisions relating to use of English language</header><text display-inline="yes-display-inline">Nothing in this Act shall be
			 construed—</text>
				<paragraph id="H826780F29168407591B4DDA0A7D927C0"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit the use of a language other
			 than English;</text>
				</paragraph><paragraph id="H5548A1DA7837476BA118BFA27D5B9936"><enum>(2)</enum><text display-inline="yes-display-inline">to limit the preservation or use of Native
			 Alaskan or Native American languages (as defined in the Native American
			 Languages Act);</text>
				</paragraph><paragraph id="H4AADF4CD97094D8DB2B44CDE6FD3DFB9"><enum>(3)</enum><text>to disparage any
			 language or discourage any person from learning or using a language;</text>
				</paragraph><paragraph id="H6FCC532AF8854160A753BBBE00072CC6"><enum>(4)</enum><text>to impact or
			 affect protections regarding language access; or</text>
				</paragraph><paragraph id="HC86ABD0AC5694C4A9544C8EE1AD183D"><enum>(5)</enum><text>to
			 be inconsistent with the Constitution of the United States.</text>
				</paragraph></subsection><subsection id="H333D775DB3524B609EF66BD732811C8F"><enum>(d)</enum><header>Covered
			 document</header><text>In this section, the term <term>covered
			 document</term>—</text>
				<paragraph id="H93A4E76353EA4557A558597E43F69DB0"><enum>(1)</enum><text>means any document
			 that explains how to obtain a benefit or service or file taxes, or that is
			 relevant to obtaining a benefit or service or filing taxes; and</text>
				</paragraph><paragraph id="H67B38BC3A8254078005CC2FF1C9B5E8D"><enum>(2)</enum><text>includes, whether
			 in paper or electronic form, a letter, publication, form, notice, or
			 instruction but does not include a regulation.</text>
				</paragraph></subsection><subsection id="H554D026B1D0D42E597BBCFC7F0B48057"><enum>(e)</enum><header>Use of plain
			 language by agencies</header><text>Each agency should, to the extent
			 practicable and appropriate, use plain language in any collection of
			 information (as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(3)(A)(i)</external-xref> of title 44, United States
			 Code).</text>
			</subsection><subsection id="H90A66F14F57C42D6BAC66224FCB0F55B"><enum>(f)</enum><header>Incorporation of
			 Comptroller General Recommendations</header>
				<paragraph id="H2D730EAF41B24568B55102CFF9CAB85E"><enum>(1)</enum><header>Reports</header>
					<subparagraph id="H6A8F5A96A8BF4BF0AF21B7BCED97B613"><enum>(A)</enum><header>Federal aviation
			 administration</header><text display-inline="yes-display-inline">The
			 Administrator of the Federal Aviation Administration, acting through the Plain
			 Language Action and Information Network, shall submit to the committees
			 described in paragraph (2) a report on whether the recommendations made by the
			 Comptroller General in the report under section 5(c) have been incorporated
			 into the Federal Plain Language Guidelines described in subsection (b), and, if
			 such recommendations have not been incorporated, an explanation of why they
			 have not been incorporated.</text>
					</subparagraph><subparagraph id="HF4736B8A0B5C41BC85DFEBBD3139352"><enum>(B)</enum><header>Securities and
			 Exchange commission</header><text display-inline="yes-display-inline">The
			 Securities and Exchange Commission shall submit to the committees described in
			 paragraph (2) a report on whether the recommendations made by the Comptroller
			 General in the report under section 5(c) have been incorporated into the Plain
			 English Handbook described in subsection (b), and, if such recommendations have
			 not been incorporated, an explanation of why they have not been
			 incorporated.</text>
					</subparagraph></paragraph><paragraph id="HB8FB8E52414C475885F600886FEC5EC2"><enum>(2)</enum><header>Committees</header><text>The
			 committees described in this paragraph are the Committee on Oversight and
			 Government Reform of the House of Representatives and the Committee on Homeland
			 Security and Governmental Affairs of the Senate.</text>
				</paragraph><paragraph id="H74D063AE1B9E4DE8933E053EB6144F4"><enum>(3)</enum><header>Deadline</header><text display-inline="yes-display-inline">The reports required under paragraph (1)
			 shall be submitted within six months after the issuance of the report provided
			 by the Comptroller General under section 5(c).</text>
				</paragraph></subsection></section><section id="H331186F8BA08434DA203FB659E6CACB2"><enum>5.</enum><header>Reports to
			 Congress</header>
			<subsection id="H9ABBE2843F3B42FDBCE7971E550005B4"><enum>(a)</enum><header>Initial
			 report</header><text>Within six months after the date of the enactment of this
			 Act, the head of each agency shall submit to the Committee on Oversight and
			 Government Reform of the House of Representatives and the Committee on Homeland
			 Security and Governmental Affairs of the Senate a report that describes how the
			 agency intends to meet the following objectives:</text>
				<paragraph id="H1844A3DE7AE64055AA6E53F5D0D52DA0"><enum>(1)</enum><text>Communicating the
			 requirements of this Act to agency employees.</text>
				</paragraph><paragraph id="HF4B46287196D4CF5BA71E756965778E0"><enum>(2)</enum><text>Training agency
			 employees to write in plain language.</text>
				</paragraph><paragraph id="HC2320F0917C84C51B42827172FEF9E97"><enum>(3)</enum><text>Meeting the
			 deadline set forth in section 4(a).</text>
				</paragraph><paragraph id="H2E9F9B5B66444C70B5A4C971028C00D4"><enum>(4)</enum><text>Ensuring ongoing
			 compliance with the requirements of this Act.</text>
				</paragraph><paragraph id="HC3BA8F9062874F61ADD5213288C75CC"><enum>(5)</enum><text>Designating a
			 senior official to be responsible for implementing the requirements of this
			 Act.</text>
				</paragraph><paragraph id="H5E65B3CBCB6547D98FE8547B5300CE36"><enum>(6)</enum><text>Using, to the
			 extent practicable and appropriate, plain language in regulations promulgated
			 by the agency.</text>
				</paragraph></subsection><subsection id="HD24448EB9FB44771AECCDF5103F791BA"><enum>(b)</enum><header>Annual and other
			 reports</header>
				<paragraph id="HF38544BF15B948FB9D5231A3DAA1691"><enum>(1)</enum><text display-inline="yes-display-inline">The head of each agency shall submit to the
			 Committee on Oversight and Government Reform of the House of Representatives
			 and the Committee on Homeland Security and Governmental Affairs of the Senate a
			 report on—</text>
					<subparagraph id="H89E80751534F4F52BCBFA3BB50172EDC"><enum>(A)</enum><text>compliance with
			 this Act; and</text>
					</subparagraph><subparagraph id="H8B5AE370DE41468A91334C54A1CE121D"><enum>(B)</enum><text>the agency’s
			 continued efforts to meet the objectives specified in subsection (a).</text>
					</subparagraph></paragraph><paragraph id="H3B97D751412F485A942BC99FFAE8FC23"><enum>(2)</enum><text>A
			 report under this subsection shall be submitted—</text>
					<subparagraph id="H501335BDF58244BABDB88FE00882E05"><enum>(A)</enum><text>annually for the
			 first two years after the date of the enactment of this Act; and</text>
					</subparagraph><subparagraph id="H05EBC22016FB4ADF81AE8EAAAB225633"><enum>(B)</enum><text>once every three
			 years thereafter.</text>
					</subparagraph></paragraph></subsection><subsection id="H16B29F5D2AD1422CA45D6B662D57B377"><enum>(c)</enum><header>Evaluation and
			 Report by Comptroller General</header><text>Within six months after the date of
			 the enactment of this Act, the Comptroller General shall evaluate existing
			 guidance for agencies on writing in plain language, including the guidance
			 listed in section 4(b), and provide to the Office of Management and Budget, the
			 Committee on Oversight and Government Reform of the House of Representatives,
			 and the Committee on Homeland Security and Governmental Affairs of the Senate a
			 report providing recommendations on—<pagebreak></pagebreak></text>
				<paragraph id="HFF641399D9C5449A99D4ADBC17ED5F43"><enum>(1)</enum><text>plain language
			 guidelines; and</text>
				</paragraph><paragraph id="H007E207390514E3C9CE453C70582762"><enum>(2)</enum><text>best practices for
			 plain language.</text>
				</paragraph></subsection></section></legis-body>
