2.Congress finds the following:
(1)Thousands of
rescue workers who responded to the areas devastated by the terrorist attacks
of September 11, local residents, office and area workers, and school children
continue to suffer significant medical problems as a result of compromised air
quality and the release of other toxins from the attack sites.
(2)In a September 2006 peer-reviewed study
conducted by the World Trade Center Medical Monitoring Program, of 9,500 World
Trade Center responders, almost 70 percent of World Trade Center responders had
a new or worsened respiratory symptom that developed during or after their time
working at the World Trade Center; among the responders who were asymptomatic
before 9/11, 61 percent developed respiratory symptoms while working at the
World Trade Center; close to 60 percent still had a new or worsened respiratory
symptom at the time of their examination; one-third had abnormal pulmonary
function tests; and severe respiratory conditions including pneumonia were
significantly more common in the 6 months after 9/11 than in the prior 6
months.
(3)An April 2006
study documented that, on average, a New York City firefighter who responded to
the World Trade Center has experienced a loss of 12 years of lung
capacity.
(4)A peer-reviewed study of residents who
lived near the World Trade Center titled “The World Trade Center Residents’
Respiratory Health Study: New Onset Respiratory Symptoms and Pulmonary
Function”, found that data demonstrated a three fold increase in new-onset,
persistent lower respiratory symptoms in residents near the former World Trade
Center as compared to a control population.
(5)Previous research
on the health impacts of the devastation caused by the September 11 terrorist
attacks has shown relationships between the air quality from Ground Zero and a
host of health impacts, including lower pregnancy rates, higher rates of
respiratory and lung disorders, and a variety of post-disaster mental health
conditions (including posttraumatic stress disorder) in workers and residents
near Ground Zero.
(6)Launched in December 2001 by researchers at
Columbia University’s Center for Children’s Environmental Health, the World
Trade Center Pregnancy Study is ongoing. Thus far, the results of the study
show that babies born to women living within 2 miles of the World Trade Center
in the month following 9/11 were significantly smaller and lighter than babies
born to women who lived farther away, and that in utero exposure to WTC-derived
Polycyclic Aromatic Hydrocarbons may have increased the carcinogenic risk to
cohort children and contributed to a modest reduction in their cognitive
development.
(7)Federal funding
allocated for the monitoring of rescue workers’ health is not sufficient to
ensure the long-term study of health impacts of September 11.
(8)The Federal funding
allocated for medical monitoring does not provide for the medical monitoring of
New York City area residents, office and area workers, schoolchildren, or
Federal employees who responded to the terrorist attacks of September 11,
2001.
(9)A significant
portion of those who responded to the September 11 aftermath have no health
insurance, lost their health insurance as a result of the attacks, or have
inadequate health insurance for the medical conditions they developed as a
result of recovery work at the World Trade Center site.
(10)The Federal program to provide medical
treatments to those who responded to the September 11 aftermath, and who
continue to experience health problems as a result, was finally established
more than five years after the attacks, but is not adequately funded and is
projected to exhaust all Federal funding before the end of fiscal year
2007.
(11)Rescue workers and
volunteers seeking workers compensation have reported that their applications
have been denied, delayed for months, or redirected, instead of receiving
assistance in a timely and supportive manner.
(12)A February 2007 report released by the City
of New York estimated that approximately 410,000 people were the most heavily
exposed to the environmental hazards and trauma of the September 11 terrorist
attacks. More than 30 percent of the Fire Department of the City of New York
first responders were still experiencing some respiratory symptoms more than
five years after the attacks and according to the report, 59 percent of those
seen by the WTC Environmental Health Center at Bellevue Hospital (which serves
non-responders) are without insurance and 65 percent have incomes less than
$15,000 per year. The report also found a need to continue and expand mental
health services.
(13)Since the 5th anniversary of the attack
(September 11, 2006), about 500 workers a month have been signing up with the
monitoring and treatment programs, more than at any time since early
2004.
(14)According to
press reports, documents prepared by the National Institute for Occupational
Safety and Health reveal that the number of recovery workers getting sick is
increasing, and their illnesses are becoming more severe. More than 6,500
responders are receiving treatment for physical health conditions.
(15)The September 11
Victim Compensation Fund of 2001 was established to provide compensation to
individuals who were physically injured or killed as a result of the
terrorist-related aircraft crashes of September 11, 2001.
(16)The deadline for
filing claims for compensation under the Victim Compensation Fund was December
22, 2003.
(17)Some individuals
did not know they were eligible to file claims for compensation for injuries or
did not know they had suffered physical harm as a result of the
terrorist-related aircraft crashes until after the December 22, 2003,
deadline.
(18)Further research
is needed to evaluate more comprehensively the extent of the health impacts of
September 11, including research for emerging health problems such as cancer,
which have been predicted.
(19)Research is
needed regarding possible treatment for the illnesses and injuries of September
11.
(20)The Federal
response to medical and financial issues arising from the September 11 response
efforts needs a comprehensive, coordinated long-term response in order to meet
the needs of all the individuals who were exposed to the toxins of Ground Zero
and are suffering health problems from the disaster.
3.Amounts appropriated
pursuant to this Act (other than amounts appropriated for the WTC Health
Program Steering Committee or for the WTC Health Program Scientific/Technical
Advisory Committee) are designated as emergency requirements and necessary to
meet emergency needs pursuant to subsections (a) and (b) of section 204 of S.
Con. Res. 21 (110th Congress), the concurrent resolution on the budget for
fiscal year 2008.
<enum>I</enum><header>World
Trade Center Health Program</header>
<section id="H95830A4B50254D19A0206CC5E745AB5E"><enum>101.</enum><header>World Trade
Center Health Program</header><text display-inline="no-display-inline">The
<act-name parsable-cite="PHSA">Public Health Service Act</act-name> is amended
by adding at the end the following new title:</text>

Center Health Program</header>
<subtitle id="HA1F257C9E45E469088C6832F421130C3"><enum>A</enum><header>Establishment of
Program; Steering and Advisory Committees</header>
<section id="HD5E3248853A844D8987388E3CF7D7DD"><enum>3001.</enum><header>Establishment
of World Trade Center Health Program within NIOSH</header>
<subsection id="H414C6C0DF6F14BFA9B27B5D900F6002B"><enum>(a)</enum><header>In
general</header><text>There is hereby established within the National Institute
for Occupational Safety and Health a program to be known as the <quote>World
Trade Center Health Program</quote> (in this title referred to as the
<quote>WTC program</quote>) to provide medical monitoring and treatment
benefits—</text>
<paragraph id="H5B3C44A7FE2F46308C43267036D6E9F9"><enum>(1)</enum><text>to eligible
emergency responders and recovery and clean-up workers (including those who are
Federal employees) who responded to the 9/11 NYC terrorist attacks; and</text>
</paragraph><paragraph id="H6D768AB5A02B41FB8D3CE62DF9A9D6D7"><enum>(2)</enum><text>to residents and
other building occupants and area workers in New York City who were directly
impacted and adversely affected by such attacks.</text>
</paragraph></subsection><subsection id="H58099A57651A4B2B0096D7831A69F01"><enum>(b)</enum><header>Components of
program</header><text>The WTC program includes the following components:</text>
<paragraph id="H51F918B3EF81447ABEDC6CA3DD6B968B"><enum>(1)</enum><header>Medical
monitoring</header><text>Medical monitoring under sections 3011 and 3021,
including screening, clinical examinations, and long-term health monitoring and
analysis for individuals who were likely to have been exposed to airborne
toxins that were released as a result of the 9/11 NYC terrorist attacks.</text>
</paragraph><paragraph id="H708008FA165F458EB6B9246CE149DF20"><enum>(2)</enum><header>Treatment for
WTC-related conditions</header><text>Provision under sections 3012 and 3022 of
treatment and payment, without any cost-sharing, for all medically necessary
health and mental health care expenses (including necessary prescription drugs)
of individuals with a WTC-related health condition.</text>
</paragraph><paragraph id="HCEB865B987D34576B6BE6CEEC8E36DC"><enum>(3)</enum><header>Outreach</header><text display-inline="yes-display-inline">Establishment under section 3004 of an
outreach program to potentially eligible individuals concerning the benefits
under this title.</text>
</paragraph><paragraph id="H8FFEE5514211427DA0159CCF5DCB805B"><enum>(4)</enum><header>Uniform data
collection</header><text display-inline="yes-display-inline">Collection under
section 3005 of health and mental health data on individuals receiving
monitoring or treatment benefits, using a uniform system of data
collection.</text>
</paragraph><paragraph id="H14DB7F9EA81E46A2B4853CA254543399"><enum>(5)</enum><header>Research on WTC
conditions</header><text display-inline="yes-display-inline">Establishment
under subtitle C of a research program on health conditions resulting from the
9/11 NYC terrorist attacks.</text>
</paragraph></subsection><subsection id="H9DF8B7DE91094DA6B85773B7F8FF989F"><enum>(c)</enum><header>No
cost-sharing</header><text>Monitoring and treatment benefits are provided under
subtitle B without any deductibles, co-payments, or other cost-sharing.</text>
</subsection><subsection id="H45C5A1E5593F4A9AA244CA7C9DB171EB"><enum>(d)</enum><header>Primary
payer</header>
<paragraph id="H28817A9A419B41A0AC94B96627E9C8BF"><enum>(1)</enum><header>In
general</header><text>Subject to paragraph (2), monitoring and treatment
benefits are provided under subtitle B without regard to whether an individual
may have coverage for some or all of such benefits through health insurance or
otherwise.</text>
</paragraph><paragraph commented="no" id="HFA16A17C5BC5468CAA42A7006DA78F88"><enum>(2)</enum><header>Workers’
compensation exception</header><text>Payment for treatment under subtitle B of
a WTC-related health condition of an individual shall be reduced or recouped to
the extent that payment is made under a workers’ compensation law or plan of
the United States or a State for such treatment.</text>
</paragraph></subsection><subsection id="H3EA5A5B8DE23453889E6A4FC9CC9BE20"><enum>(e)</enum><header>WTC program
administration</header><text>The WTC program shall be administered by the
Director of the National Institute for Occupational Safety and Health, or a
designee of such Director.</text>
</subsection></section><section display-inline="no-display-inline" id="H6FEAC46B5BA8413798DF56BBCB1C9C79" section-type="subsequent-section"><enum>3002.</enum><header>WTC Health Program
Steering Committee</header>
<subsection id="H6586BC75727E433C8F1639665FDCB57"><enum>(a)</enum><header>Establishment</header><text>The
WTC program administrator shall establish an advisory committee to be known as
the WTC Health Program Steering Committee (in this section referred to as the
<quote>Steering Committee</quote>) for the purpose of providing the
administrator with advice and oversight on the WTC program.</text>
</subsection><subsection commented="no" id="HD564CF8D5BEA4AE99C22309D0508516F"><enum>(b)</enum><header>Membership</header>
<paragraph commented="no" id="HAE5A5571524B4139901BFFE04E7049E9"><enum>(1)</enum><header>Initial
membership</header><text>The Steering Committee shall initially be composed of
the following:</text>
<subparagraph commented="no" id="H78EBFCF9310841D786CFE924F06E41F"><enum>(A)</enum><header>WTC Monitoring
and Treatment Program Steering Committee</header><text display-inline="yes-display-inline">The members of the WTC Monitoring and
Treatment Program Steering Committee (as in existence on the day before the
date of the enactment of this title).</text>
</subparagraph><subparagraph commented="no" id="HB01C48EBD4304A41B536C2456F1DE8F1"><enum>(B)</enum><header>Appointments by
initial members</header><text>The following members, appointed by the Steering
Committee described under subparagraph (A) and subject to the approval of the
WTC program administrator:</text>
<clause commented="no" id="H7A46B17452774B0DBA91C5CC1CC409EF"><enum>(i)</enum><text>One representative
of the World Trade Center Environmental Health Center at Bellevue Hospital.</text>
</clause><clause commented="no" id="HEE61B5FCECE245FFAF6FEFE49699A676"><enum>(ii)</enum><text display-inline="yes-display-inline">Two representatives of the resident and
other non-responder population.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H3AE4CA4D24D049E2BCAE6B2500E83537"><enum>(2)</enum><header>Additional
appointments</header><text>The Steering Committee may appoint additional
members to the Committee, subject to the approval of the WTC program
administrator.</text>
</paragraph><paragraph commented="no" id="H6B0D7A2D01D84674A2ABBACAD7D067D"><enum>(3)</enum><header>Vacancies</header><text>A
vacancy in the Steering Committee shall be filled by the Steering Committee,
subject to the approval of the WTC program administrator, so long as the
composition of the Committee includes representatives of affected workers and
residents, representatives described in paragraph (1)(B), representatives of
the Clinical Centers of Excellence, and a representative of each Coordinating
Center of Excellence.</text>
</paragraph></subsection><subsection id="H5EAD40A1B87E413B9E5CC495E514B09D"><enum>(c)</enum><header>Relation to
FACA</header><text display-inline="yes-display-inline">The Steering Committee
shall not be subject to the Federal Advisory Committee Act.</text>
</subsection><subsection id="HDBB6723EC02F4796826EF6934235406B"><enum>(d)</enum><header>Meetings</header><text>The
Steering Committee shall meet at such frequency necessary to carry out its
duties, but not less than 4 times each calendar year.</text>
</subsection><subsection id="H5DE56D4603264906A074451B9100CEF7"><enum>(e)</enum><header>Reports</header><text>Not
less than once each calendar year, the Steering Committee shall submit to the
Congress a report on the recommendations of the Committee.</text>
</subsection><subsection id="H3FBA8BD929B649FCAED2BEB7B813E1BF"><enum>(f)</enum><header>Duration</header><text>Notwithstanding
any other provision of law, the Steering Committee shall continue in operation
during the period in which the WTC program is in operation.</text>
</subsection><subsection id="H54A39F982DC34CA5A482786FEDAAB31C"><enum>(g)</enum><header>Authorization of
appropriations</header><text>For the purpose of carrying out this section,
there are authorized to be appropriated such sums as may be necessary for each
fiscal year beginning with fiscal year 2008.</text>
</subsection></section><section id="H27FF55B8CD8647C6BC9DB8571380B2F"><enum>3003.</enum><header>WTC Health
Program Scientific/Technical Advisory Committee</header>
<subsection id="HDAD30433F32B4DED8687E9F4781D273D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The WTC program administrator shall
establish an advisory committee to be known as the WTC Health Program
Scientific/Technical Advisory Committee (in this section referred to as the
<quote>Advisory Committee</quote>) to review scientific and medical evidence
and to make recommendations to the administrator on additional WTC program
eligibility criteria and on additional WTC-related health conditions.</text>
</subsection><subsection id="H28683874004A41C686A21BAFD42B11A9"><enum>(b)</enum><header>Composition</header><text display-inline="yes-display-inline">The WTC program administrator shall appoint
the members of the Advisory Committee and shall include at least—</text>
<paragraph id="HFC9625E31B094DB8B4F43758F42E3348"><enum>(1)</enum><text>4 occupational
physicians, at least two of whom have experience treating WTC rescue and
recovery workers;</text>
</paragraph><paragraph id="H4A50C9ED4EE54A7B841000251C0047C6"><enum>(2)</enum><text display-inline="yes-display-inline">2 representatives of WTC responders;</text>
</paragraph><paragraph id="H8F88E2A575A24F5D93E847849CC1F2EF"><enum>(3)</enum><text>2 representatives
of WTC residents and other non-responders;</text>
</paragraph><paragraph id="H94DA2B5DCBC04F08899F87FAA0B29BE6"><enum>(4)</enum><text>an industrial
hygienist;</text>
</paragraph><paragraph id="H8FF907256507465BB7062EE8333800C9"><enum>(5)</enum><text>a toxicologist;</text>
</paragraph><paragraph id="H8C974EFB99AC4025AEAD55307BFDDDC1"><enum>(6)</enum><text>an epidemiologist;
and</text>
</paragraph><paragraph id="H4D294EF46FA140019F1F51AB634F75A5"><enum>(7)</enum><text>a mental health
professional.</text>
</paragraph></subsection><subsection display-inline="no-display-inline" id="HB4C065548DB046E388E4E89D2E03136C"><enum>(c)</enum><header>Meetings</header><text>The
Advisory Committee shall meet at such frequency as may be required to carry out
its duties.</text>
</subsection><subsection id="H65484CED58094CFDB706AF555EC7C1B"><enum>(d)</enum><header>Reports</header><text>The
WTC program administrator shall provide for publication of recommendations of
the Advisory Committee on the public website established for the WTC
program.</text>
</subsection><subsection id="HFC7836386C3349399BBF86ACC7F91E2B"><enum>(e)</enum><header>Authorization of
appropriations</header><text>For the purpose of carrying out this section,
there are authorized to be appropriated such sums as may be necessary for each
fiscal year beginning with fiscal year 2008.</text>
</subsection><subsection id="H6914CECC576F4DD38184BFB992BAC284"><enum>(f)</enum><header>Duration</header><text>Notwithstanding
any other provision of law, the Advisory Committee shall continue in operation
during the period in which the WTC program is in operation.</text>
</subsection><subsection id="HB6245D55E13B410A006BEBC00DD0000"><enum>(g)</enum><header>Application of
FACA</header><text>Except as otherwise specifically provided, the Advisory
Committee shall be subject to the Federal Advisory Committee Act.</text>
</subsection></section><section id="HD18C1A6CB3F84755AF7EF5EED848D0AA"><enum>3004.</enum><header>Community
education and outreach</header>
<subsection id="H4A516C81192C43D686137B3C399CCB2C"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The WTC program
administrator shall institute a program that provides education and outreach on
the existence and availability of services under the WTC program. The outreach
and education program—</text>
<paragraph id="H1A68C8ECB7624AE885BC47FBDD9DD376"><enum>(1)</enum><text>shall include the
establishment of a public website with information about the WTC program;
and</text>
</paragraph><paragraph id="HD6355D8D3FDC4ECB888200584CDFE208"><enum>(2)</enum><text>shall be conducted
in a manner intended—</text>
<subparagraph id="HE6309415DEA543C8AC56FBAC8BAEDE04"><enum>(A)</enum><text>to reach all
affected populations; and</text>
</subparagraph><subparagraph id="HF059A407AFC14B9FAC1B4D2C72740017"><enum>(B)</enum><text>to include
materials for culturally and linguistically diverse populations.</text>
</subparagraph></paragraph></subsection><subsection id="H8785910D7BBA402AB509A5FC4297F3FF"><enum>(b)</enum><header>Partnerships</header><text display-inline="yes-display-inline">To the greatest extent possible, in
carrying out this section, the WTC program administrator shall enter into
partnerships with local governments and organizations with experience
performing outreach to the affected populations, including community and
labor-based organizations.</text>
</subsection></section><section id="H80BF6698939C406792B7CE3032446CF8"><enum>3005.</enum><header>Uniform data
collection</header>
<subsection id="HC286914D9D064439BF00A5438D4DC51"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The WTC program
administrator shall provide for the uniform collection of data (and analysis of
data and regular reports to the administrator) on the utilization of monitoring
and treatment benefits provided to eligible WTC responders and eligible WTC
residents and other non-responders, the prevalence of WTC-related health
conditions, and the identification of new WTC-related medical conditions. Such
data shall be collected for all individuals provided monitoring or treatment
benefits under subtitle B and regardless of their place of residence or
Clinical Center of Excellence through which the benefits are provided.</text>
</subsection><subsection commented="no" id="HC813C8AD6AF7456FBF52D479B361E2C"><enum>(b)</enum><header>Coordinating
through Centers of Excellence</header><text>Each Clinical Center of Excellence
shall, under section 3006(d)(3), collect data described in subsection (a) and
report such data to the corresponding Coordinating Center of Excellence for
analysis by such Coordinating Center of Excellence under section
3006(a)(2)(A).</text>
</subsection><subsection id="HE4CC5D8DEF2D437ABDAE4D88874CC4EB"><enum>(c)</enum><header>Privacy</header><text display-inline="yes-display-inline">The data collection and analysis under this
section shall be conducted in a manner that protects the confidentiality of
individually identifiable health information consistent with applicable legal
requirements.</text>
</subsection></section><section id="HEBD196C05CA24366A754173D4D8F5E14"><enum>3006.</enum><header>Centers of
Excellence</header>
<subsection id="HC1C6CAA3EBE64C9DB000C779F2EF146D"><enum>(a)</enum><header>In
general</header><text>The WTC program administrator shall enter into
contracts—</text>
<paragraph id="HFF1F718F7E2244B38C6BC881F0574126"><enum>(1)</enum><text display-inline="yes-display-inline">with Clinical Centers of Excellence
specified in subsection (b)(1)—</text>
<subparagraph id="H2272D2F3013A436AAFEEA967BC29E366"><enum>(A)</enum><text>for the provision
of monitoring and treatment benefits under subtitle B;</text>
</subparagraph><subparagraph id="H0AD63B3FB1DE45D88600D480A97760B6"><enum>(B)</enum><text>for the provision
of outreach activities to individuals eligible for such monitoring and
treatment benefits;</text>
</subparagraph><subparagraph id="H9147DE07604444999D564FAAB320A20"><enum>(C)</enum><text>for the provision
of counseling for benefits under subtitle B, with respect to WTC-related health
conditions, for individuals eligible for such benefits; and</text>
</subparagraph><subparagraph id="H3AC884312D0B406494886C63667BDF3D"><enum>(D)</enum><text>for the
credentialing of other medical providers participating in the national network;
and</text>
</subparagraph></paragraph><paragraph id="H90C330BB43D140DD9D666C613B4526DB"><enum>(2)</enum><text>with Coordinating
Centers of Excellence specified in subsection (b)(2)—</text>
<subparagraph id="HBDBD41C9A2944AAD923253459C8F8258"><enum>(A)</enum><text>for receiving,
analyzing, and reporting to the WTC program administrator on data, in

subsection (d)(3);</text>
</subparagraph><subparagraph id="H02EC92E8E8F34696AF6B0002D110067"><enum>(B)</enum><text>for the development
of medical monitoring and treatment protocols, with respect to WTC-related
health conditions; and</text>
</subparagraph><subparagraph commented="no" id="H073ADCF6F4AA4F4282B077A85ED993A7"><enum>(C)</enum><text>for coordinating
the outreach activities conducted under paragraph (1)(B) by each corresponding
Clinical Center of Excellence.</text>
</subparagraph></paragraph></subsection><subsection id="H5C6F78787DC9453681211834D0EE0383"><enum>(b)</enum><header>Centers of
excellence defined</header>
<paragraph id="H847BC137A0AF479000946E3E82059098"><enum>(1)</enum><header>Clinical Center
of Excellence</header><text>In this title, the term <term>Clinical Center of
Excellence</term> means the following:</text>
<subparagraph id="H84C0C4E0ABA048208ED687C8E068CA2"><enum>(A)</enum><header>For FDNY
responders in New York</header><text display-inline="yes-display-inline">With
respect to an eligible WTC responder who responded to the 9/11 attacks as an
employee of the Fire Department of the City of New York and who resides in the
New York Metropolitan area, such Fire Department (or such entity as has entered
into a contract with the Fire Department for monitoring or treatment of such
responders).</text>
</subparagraph><subparagraph id="H77D2EC0E033D48E992CF83C91706D052"><enum>(B)</enum><header>Other WTC
responders in New York</header><text display-inline="yes-display-inline">With
respect to other eligible WTC responders who reside in the New York
Metropolitan area, the Mt. Sinai coordinated consortium, Queens College, State
University of New York at Stony Brook, University of Medicine and Dentistry of
New Jersey, and Bellevue Hospital.</text>
</subparagraph><subparagraph id="HBFFCE5B370F64D2D845C5BA7E95F36B1"><enum>(C)</enum><header>WTC residents
and other non-responders in New York</header><text display-inline="yes-display-inline">With respect to eligible WTC residents and
other non-responders who reside in the New York Metropolitan area, the World
Trade Center Environmental Health Center at Bellevue Hospital and such
hospitals or other facilities, including but not limited to those within the
New York City Health and Hospitals Corporation, as are identified by the WTC
program administrator.</text>
</subparagraph><subparagraph id="H269C97C200004C84982B251FA3A7C5AB"><enum>(D)</enum><header>All WTC
responders and non-responders</header><text display-inline="yes-display-inline">With respect to all eligible WTC responders
and non-responders, such other hospitals or other facilities as are identified
by the WTC program administrator.</text>
</subparagraph></paragraph><paragraph id="H98B9743C5D1A45A28914CC006678F9B7"><enum>(2)</enum><header>Coordinating
Center of Excellence</header><text>In this title, the term <term>Coordinating
Center of Excellence</term> means the following:</text>

and other non-responders</header><text display-inline="yes-display-inline">With

</subparagraph></paragraph><paragraph id="HC8574CB6092642A6A1046DF9DABF37E"><enum>(3)</enum><header>Corresponding
centers</header><text>In this title, a Clinical Center of Excellence and a
Coordinating Center of Excellence shall be treated as
<quote>corresponding</quote> to the extent that such Clinical Center and
Coordinating Center serve the same population group.</text>
</paragraph></subsection><subsection id="HE24C6BA9340C408DAAF8FB791200C26E"><enum>(c)</enum><header>Entitlement</header><text>A
Clinical or Coordinating Center of Excellence with a contract under this
section is entitled to payment of the costs of such Center in carrying out the
activities described in subsection (a).</text>
</subsection><subsection id="HAB3E6DEB91904E5581B9E1A4F59089C3"><enum>(d)</enum><header>Requirements</header><text>The
WTC program administrator shall not enter into a contract with a Clinical
Center of Excellence under subsection (a)(1) unless—</text>
<paragraph id="HB160E8E8DCC148C69B45DDD9BFECF1D"><enum>(1)</enum><text>the Center
establishes a formal mechanism for consulting with and receiving input from
representatives of eligible populations receiving monitoring and treatment
benefits under subtitle B from such Center;</text>
</paragraph><paragraph id="H448194F464CB46308BCF2DE83275165"><enum>(2)</enum><text>the Center provides
for the coordination of monitoring and treatment benefits under subtitle B with
routine medical care provided for the treatment of conditions other than
WTC-related health conditions; and</text>
</paragraph><paragraph id="H3A9063A9FD3C473F84D4F0235E73D2A1"><enum>(3)</enum><text display-inline="yes-display-inline">the Center collects and reports to the
corresponding Coordinating Center of Excellence data in accordance with section
3005.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H67AE75254CF44FCC00C60072703C3800" section-type="subsequent-section"><enum>3007.</enum><header>Programs regarding
attack at Pentagon</header><text display-inline="no-display-inline">The
Secretary may, to the extent determined appropriate by the Secretary, establish
with respect to the terrorist attack at the Pentagon on September 11, 2001,
programs similar to the programs that are established in subtitles B and C with
respect to the 9/11 NYC terrorist attacks.</text>
</section><section id="H8C00B334633B484EB7C2F29EF2F4A3D3"><enum>3008.</enum><header>Entitlement
authorities</header><text display-inline="no-display-inline">Subtitle B
constitutes budget authority in advance of appropriations Acts and represents
the obligation of the Federal Government to provide for the payment of costs of
monitoring and treatment in accordance with such subtitle and section 3006(c)
constitutes such budget authority and represents the obligation of the Federal
Government to provide for the payment of costs described in such
section.</text>
</section><section id="HDDB3800DFB104607A680F818BB2CF83D"><enum>3009.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H8B587223E6D84830AC4BC798E0B3D78"><enum>(1)</enum><text>The terms
<term>Clinical Center of Excellence</term> and <term>Coordinating Center of
Excellence</term> have the meanings given such terms in section 3006(b).</text>
</paragraph><paragraph id="H82DAF4A858F74CE39DC85B2D8B3BEF8B"><enum>(2)</enum><text>The term
<term>current consortium arrangements</term> means the arrangements as in
effect on the date of the enactment of this title between the National
Institute for Occupational Safety and Health and the Mt. Sinai-coordinated
consortium and the Fire Department of the City of New York.</text>
</paragraph><paragraph id="HC40834A809004C2A90CE3043079DCAB"><enum>(3)</enum><text>The terms
<term>eligible WTC responder</term> and <term>eligible WTC resident or other
non-responder</term> are defined in sections 3011(a) and 3021(a), respectively.</text>
</paragraph><paragraph id="H8869CF81393E4B82A73440744035AD00"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>Mt.-Sinai-coordinated
consortium</term> means the consortium coordinated by Mt. Sinai hospital in New
York City that coordinates the monitoring and treatment under the current
consortium arrangements for WTC responders other than with respect to those
covered under the arrangement with the Fire Department for the City of New
York.</text>
</paragraph><paragraph id="H9DFADB56FAC4405EB2F11525AEE73600"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>New York City disaster
area</term> means an area, specified by the WTC program administrator, within
which individuals who resided, worked, or otherwise were regularly present
during the period beginning on September 11, 2001, and ending on July 31, 2002,
were likely to have been exposed to airborne toxins that were released as a
result of the 9/11 NYC terrorist attacks, and includes the area within 2 miles
of the perimeter of the former World Trade Center site. In determining the
boundaries of the New York City disaster area, the administrator shall take
into consideration peer-reviewed research that has demonstrated potential
exposure to such toxins at a distance of within 5 miles from the former World
Trade Center.</text>
</paragraph><paragraph id="H3A6E5328D4A34E70983997A521B794C6"><enum>(6)</enum><text>The term <term>New
York metropolitan area</term> means an area, specified by the WTC program
administrator, within which eligible WTC responders and eligible WTC residents
and other non-responders who reside in such area are reasonably able to access
monitoring and treatment benefits under this title through a Clinical Centers
of Excellence described in subparagraphs (A), (B), or (C) of section
3006(b)(1).</text>
</paragraph><paragraph id="HE41891BBAE574D7CB4E895770125313B"><enum>(7)</enum><text>The term
<term>9/11 NYC terrorist attacks</term> means the terrorist attacks that
occurred on September 11, 2001, in New York City and includes the aftermath of
such attacks.</text>
</paragraph><paragraph id="H0A9C459601A143E6BE47945C743F2896"><enum>(8)</enum><text display-inline="yes-display-inline">The term <term>WTC Health Program Steering
Committee</term> means such Committee established under section 3002.</text>
</paragraph><paragraph id="H38DA54BF2CB84CDDBE4CDF1F532BF41D"><enum>(9)</enum><text>The term <term>WTC
program administrator</term> means the individual responsible under section
3001(d) for the administration of the WTC program.</text>
</paragraph><paragraph commented="no" id="H5F4891978C33422CBE5C8FF8F87B1DA"><enum>(10)</enum><text display-inline="yes-display-inline">The term <term>WTC-related health
condition</term> is defined in section 3012(a).</text>
</paragraph><paragraph id="HB4D7FC82B5124E48A93E9ED6BEDE08D3"><enum>(11)</enum><text display-inline="yes-display-inline">The term <term>WTC Scientific/Technical
Advisory Committee</term> means such Committee established under section
3003.</text>
</paragraph></section></subtitle><subtitle id="HEA59A50369E5423D90C884C0D786D100"><enum>B</enum><header>Program of
Monitoring and Treatment</header>
<part id="HB95FD10B95964397A04CF4232DC3ACFB"><enum>1</enum><header>For
WTC Responders </header>
<section id="H253E7E381ACE42A8B64FFE495D25D6AD"><enum>3011.</enum><header>Identification
of eligible WTC responders and provision of WTC-related monitoring
services</header>
<subsection id="H470E890C1E7D4C80B6246EE7568D046D"><enum>(a)</enum><header>Eligible WTC
responder defined</header>
<paragraph id="HFD20C48C84F64C2CA4B96C90A4E517FC"><enum>(1)</enum><header>In
general</header><text>For purposes of this title, the term <term>eligible WTC
responder</term> means any of the following individuals:</text>
<subparagraph id="HA836AB98C80643F6A72EE13CFBF4D061"><enum>(A)</enum><header>Currently
identified responder</header><text>An individual who has been identified as
eligible for medical monitoring under the current consortium arrangements (as
defined in section 3009(2)).</text>
</subparagraph><subparagraph id="H531D2AED5E77480AB0BCF93B933BE1F1"><enum>(B)</enum><header>Responder who
meets current eligibility criteria</header><text>An individual who meets the
current eligibility criteria described in paragraph (2).</text>
</subparagraph><subparagraph id="H092655A537A745B4BADB688F00531769"><enum>(C)</enum><header>Responder who
meets modified eligibility criteria</header><text>An individual who—</text>
<clause id="HE1B68488B9364E6F8B58B12849F4818"><enum>(i)</enum><text display-inline="yes-display-inline">performed rescue, recovery, demolition,
debris cleanup, or other related services in the New York City disaster area in
response to the 9/11 NYC terrorist attacks, regardless of whether such services
were performed by a State or Federal employee or member of the National Guard
or otherwise; and</text>
</clause><clause commented="no" id="H711A00D92B67492B8061DD8548D76897"><enum>(ii)</enum><text>meets such
eligibility criteria relating to exposure to airborne toxins, other hazards, or
adverse conditions resulting from the 9/11 NYC terrorist attacks as the WTC
program administrator, after consultation with the WTC Health Program Steering
Committee and the WTC Scientific/Technical Advisory Committee, determines
appropriate.</text>
</clause></subparagraph></paragraph><paragraph id="H28839E23E6EA42E2AC55F65741856F97"><enum>(2)</enum><header>Current
eligibility criteria</header><text>The eligibility criteria described in this
paragraph for an individual is that the individual is described in either of
the following categories:</text>
<subparagraph id="H1D2CE04115084EC982F80005CDA151B1"><enum>(A)</enum><header>Fire fighters
and related personnel</header><text display-inline="yes-display-inline">All
members of the Fire Department of the City of New York (whether fire or
emergency personnel, active or retired) who participated at least one day in
the rescue and recovery effort at any of the former World Trade sites
(including Ground Zero, Staten Island land fill, and the NYC Chief Medical
Examiner’s office) for any time during the period beginning on September 11,
2001, and ending on July 31, 2002.</text>
</subparagraph><subparagraph commented="no" id="H63C37B13687B4688BF1F94FA10AFA8D9"><enum>(B)</enum><header>Other WTC
rescue, recovery, and clean-up workers</header><text>The individual—</text>
<clause commented="no" id="H46CAC55727A94F5BAB1EEBFE5282DB1"><enum>(i)</enum><text>worked or
volunteered on-site in rescue, recovery, debris-cleanup or related support
services in lower Manhattan (south of Canal St.), the Staten Island Landfill,
or the barge loading piers, for at least 4 hours during the period beginning on
September 11, 2001, and ending on September 14, 2001, for at least 24 hours
during the period beginning on September 11, 2001, and ending on September 30,
2001, or for at least 80 hours during the period beginning on September 11,
2001, and ending on July 31, 2002;</text>
</clause><clause commented="no" id="HD55543E49A8B4523871177B959CD3606"><enum>(ii)</enum><text>was an employee
of the Office of the Chief Medical Examiner of the City of New York involved in
the examination and processing of human remains, or other morgue worker who
performed similar post- September 11 functions for such Office staff;</text>
</clause><clause commented="no" id="H90F5EAC7E0D64A9F8B7100E4B064F5DE"><enum>(iii)</enum><text>was a worker in
the Port Authority Trans-Hudson Corporation tunnel for at least 24 hours during
the period beginning on February 1, 2002, and ending on July 1, 2002; or</text>
</clause><clause commented="no" id="H18D7B9FE66654DCCB4C34CF430D4BC9F"><enum>(iv)</enum><text display-inline="yes-display-inline">was a vehicle-maintenance worker who was
exposed to debris from the former World Trade Center while retrieving, driving,
cleaning, repairing, and maintaining vehicles contaminated by airborne toxins
from the 9/11 NYC terrorist attacks during a duration and period described in
subparagraph (A).</text>
</clause></subparagraph></paragraph><paragraph id="H9124A7E218EC498BB4EFFBD5E3889249"><enum>(3)</enum><header>Application
process</header><text>The Coordinating Centers of Excellence shall establish a
process for individuals, other than eligible WTC responders described in
paragraph (1)(A), to apply to be determined to be eligible WTC
responders.</text>
</paragraph><paragraph id="H509B5DFE134C4AB481E29000638EDCD8"><enum>(4)</enum><header>Certification</header>
<subparagraph id="HAD5C727944F341159373B300EB7F7ED7"><enum>(A)</enum><header>In
general</header><text>In the case of an individual described in paragraph
(1)(A) or who is determined under paragraph (3) to be an eligible WTC
responder, the WTC program administrator shall provide an appropriate
certification of such fact and of eligibility for monitoring and treatment
benefits under this part. The administrator shall not deny such a certification
to an individual who is an eligible WTC responder.</text>
</subparagraph><subparagraph id="H16ED834C6CF8413AB64344F2BDF7D8C0"><enum>(B)</enum><header>Timing</header><text>In
the case of an individual who is determined under paragraph (3) to be an
eligible WTC responder, the WTC program administrator shall provide the
certification under subparagraph (A) within 60 days of such
determination.</text>
</subparagraph></paragraph></subsection><subsection id="H9157497AD2094D4FB349A93359860900"><enum>(b)</enum><header>Monitoring
benefits</header>
<paragraph id="HF7BB360ED1F04CE7992F720040B300E0"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">In the case of an
eligible WTC responder, the WTC program shall provide for monitoring benefits
that include medical monitoring consistent with protocols approved by the WTC
program administrator and including screening, clinical examinations, and
long-term health monitoring and analysis. In the case of an eligible WTC
responder who is an active member of the Fire Department of the City of New
York, the responder shall receiving such benefits as part of the individual’s
periodic company medical exams.</text>
</paragraph><paragraph id="H2DCAA14C9AE442AD902D40933B808F52"><enum>(2)</enum><header>Provision of
monitoring benefits</header><text>The monitoring benefits under paragraph (1)
shall be provided through the Clinical Center of Excellence for the type of
individual involved or, in the case of an individual residing outside the New
York metropolitan area, under an arrangement under section 3031.</text>
</paragraph></subsection></section><section id="HF9FFBDE6E2CE481690FEFC1C53BA506C"><enum>3012.</enum><header>Treatment of
eligible WTC responders for WTC-related health conditions</header>
<subsection id="H64CAC1F11AE041A88BDBDB6480EFDE23"><enum>(a)</enum><header>WTC-related
health condition defined</header>
<paragraph id="H05CF19A9D67E445C9F16106809D0E14"><enum>(1)</enum><header>In
general</header><text>For purposes of this title, the term <term>WTC-related
health condition</term> means—</text>
<subparagraph id="HE52CF980DF8E4935BABCDDE57A5003D"><enum>(A)</enum><text display-inline="yes-display-inline">an illness or health condition for which
exposure to airborne toxins, any other hazard, or any other adverse condition
resulting from the 9/11 NYC terrorist attacks is at least as likely as not to
be a significant factor in aggravating, contributing to, or causing the illness
or health condition;</text>
</subparagraph><subparagraph commented="no" id="H94CA247967464A8E97F2C1C855609069"><enum>(B)</enum><text display-inline="yes-display-inline">a mental health condition for which such
attacks are at least as likely as not to be a significant factor in
aggravating, contributing to, or causing the condition; and</text>
</subparagraph><subparagraph id="H61049324986A4E70823600B47C601C2D"><enum>(C)</enum><text>any presumed
WTC-related health condition (as defined in paragraph (2)).</text>
</subparagraph></paragraph><paragraph id="H593E953F5DB9421C8062477B89AD44D6"><enum>(2)</enum><header>Presumed
WTC-related health condition</header><text>For purposes of this title, the term
<term>presumed WTC-related health condition</term> means any of the following
health conditions, and any condition specified under paragraph (3):</text>

disorders</header>

the WTC program administrator for an illness or health condition not described
in paragraph (2) to be added to the list of presumed WTC-related
conditions.</text>
</subparagraph><subparagraph id="HB45C96CAFED74C488E00A44FB7E759F7"><enum>(B)</enum><header>Review</header><text>The
administrator shall establish a public process for receiving public input and
comments on any application under subparagraph (A).</text>
</subparagraph><subparagraph id="H228CD6511513412EB28F0780CE6D4783"><enum>(C)</enum><header>Considerations</header><text>In
making determinations on such applications, the findings and recommendations of
Clinical Centers of Excellence published in peer reviewed journals should be
given deference in the determination of whether an additional illness or health
condition, such as cancer, should be added to the list of presumed WTC-related
health conditions.</text>
</subparagraph><subparagraph id="H9A986E966F0640D392F959FC09BF9F1C"><enum>(D)</enum><header>Consultation</header><text>The
WTC program administrator shall consult with the WTC Health Program Steering
Committee and the WTC Scientific/Technical Advisory Committee in making a
determination on whether an additional health condition should be added to the
list of presumed WTC-related conditions.</text>
</subparagraph><subparagraph id="H43026D87392D45B381F206E650487457"><enum>(E)</enum><header>Determination</header><text>The
WTC program administrator shall add an illness or health condition to the list
of presumed WTC-related health conditions if, based on a review of the evidence
and consultations conducted under subparagraphs (B), (C), and (D), the
administrator determines that exposure to airborne toxins, other hazards, or
other adverse conditions resulting form the 9/11 NYC terrorist attacks is at
least as likely as not to be a significant factor in aggravating, contributing
to, or causing the illness or health condition.</text>
</subparagraph></paragraph></subsection><subsection id="HB3E097C908AD41A183B7F88917F7D16B"><enum>(b)</enum><header>Coverage of
treatment for WTC-related health conditions</header>
<paragraph id="H056CCCFD9C174A5493D72D140057083E"><enum>(1)</enum><header>Determination
based on presumed WTC-related health condition</header>
<subparagraph id="H6EEC3395D6544D96A6B9ECB2B571BA59"><enum>(A)</enum><header>In
general</header><text display-inline="yes-display-inline">If a physician at a
Clinical Center of Excellence that is providing monitoring benefits under
section 3011 for an eligible WTC responder determines that the responder has a
presumed WTC-related health condition, and the physician makes a clinical
determination that exposure to airborne toxins, other hazards, or adverse
conditions resulting from the 9/11 terrorist attacks is at least as likely as
not to be a significant factor in aggravating, contributing to, or causing the
condition—</text>
<clause id="H0360CD1F5A7F4F58A1AB6320534624A4"><enum>(i)</enum><text>the physician
shall promptly transmit such determination to the WTC program administrator and
provide the administrator with the medical facts supporting such determination;
and</text>
</clause><clause id="H6E3B9E7921984F4685E407C77CDC3E8D"><enum>(ii)</enum><text>on and after the
date of such transmittal and subject to paragraph (2), the WTC program shall
provide for payment under subsection (c) of the costs of medically necessary
treatment for such condition.</text>
</clause></subparagraph><subparagraph id="HE43EAB04442F4264ADCF8EBCC1BB4F06"><enum>(B)</enum><header>Review;
certification; appeals</header>
<clause id="HD19BB9D940F442FF96BE436E729F0000"><enum>(i)</enum><header>Review</header><text>A
Federal employee designated by the WTC program administrator shall review
determinations made under subparagraph (A)(i) of a WTC-related health
condition.</text>
</clause><clause id="HB4F1E28AC4BD4BD7BD4DB12871E16F47"><enum>(ii)</enum><header>Certification</header><text>The
administrator shall provide a certification of coverage of the treatment of
such condition based upon reviews conducted under clause (i). Such a
certification shall be provided unless the administrator determines that the
responder’s condition is not a presumed WTC-related health condition or that
exposure to airborne toxins, other hazards, or adverse conditions resulting
from the 9/11 terrorist attacks is not at least as likely as not to be a
significant factor in aggravating, contributing to, or causing the
condition.</text>
</clause><clause id="HF31F9BD6FDF249A8B14E523C12FC158D"><enum>(iii)</enum><header>Appeal
process</header><text>The administrator shall provide a process for the appeal
of determinations under clause (ii).</text>
</clause></subparagraph></paragraph><paragraph id="H943D7E9944EA44E5A0BAEDC1814400E4"><enum>(2)</enum><header>Determination
based on other WTC-related health condition</header>
<subparagraph id="HDDD8B715D79E4E3B9F6E2194CC20BFDD"><enum>(A)</enum><header>In
general</header><text>If a physician at a Clinical Center of Excellence that is
providing monitoring benefits under section 3011 for an eligible WTC responder
determines that the responder has a WTC-related health condition that is not a
presumed WTC-related health condition—</text>
<clause id="H660399B44C6E4C8A9EB44D83E4BF2B41"><enum>(i)</enum><text>the physician
shall promptly transmit such determination to the WTC program administrator and
provide the administrator with the facts supporting such determination;
and</text>
</clause><clause id="H2B3C83CF517B47B800362FD896E860C6"><enum>(ii)</enum><text>on and after the
date of such transmittal and pending a determination by the administrator under
subparagraph (B), the WTC program shall provide for payment under subsection
(c) of the costs of medically necessary services to treat such
condition.</text>
</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H456CA47CF2634205A77BFFA7BDCA7E9D"><enum>(B)</enum><header>Review;
certification</header>
<clause id="HABB2703487FD445EA3391DF6737911AE"><enum>(i)</enum><header>Use of physician
panel</header><text>The WTC program administrator shall provide for the review
of each determination made under subparagraph (A)(i) of a WTC-related health
condition to be made by a physician panel with appropriate expertise appointed
by the WTC program administrator. Such a panel shall make recommendations to
the administrator on the evidence supporting such determination.</text>
</clause><clause id="H2D097865123E4EABB6AE4582D6A79ED8"><enum>(ii)</enum><header>Review of
recommendations of panel; certification</header><text>The administrator, based
on such recommendations shall determine whether or not the condition is a
WTC-related health condition and, if it is, provide for a certification under
paragraph (1)(B)(ii) of coverage of such condition. The administrator shall
provide a process for the appeal of determinations that the responder’s
condition is not a WTC-related health condition.</text>
</clause></subparagraph></paragraph><paragraph commented="no" id="H2A8E6B6CCE58480D8BC7E1E6514B4D13"><enum>(3)</enum><header>Requirement of
medical necessity</header><text display-inline="yes-display-inline">The
determination under paragraphs (1)(A)(ii) and (2)(A)(ii) of whether treatment
is medically necessary for a WTC-related health condition shall be made by
physicians at the appropriate Clinical Center of Excellence, taking into
account, for presumed WTC-related health conditions, medical treatment
protocols established under subsection (d).</text>
</paragraph><paragraph id="HE268FADE3A02477E9954F29DA454DE3"><enum>(4)</enum><header>Scope of
treatment covered</header><text>The scope of treatment covered under such
paragraphs includes physician services, diagnostic and laboratory tests,
prescription drugs, inpatient and outpatient hospital services, and other
medically necessary treatment.</text>
</paragraph><paragraph commented="no" id="HA63ED4C2350B46E897AB073103C00082"><enum>(5)</enum><header>Continuation of
treatment while being enrolled in medical monitoring program</header><text display-inline="yes-display-inline">In the case of a WTC responder receiving
medical treatment under the current consortium arrangements but who has not
been determined to be an eligible WTC responder or enrolled in the medical
monitoring program under section 3011, while the individual is being enrolled
in such program the treatment shall be considered to be treatment under this
subsection for which payment may be made under subsection (c).</text>
</paragraph></subsection><subsection id="H2B2437166016421EB53B9D69CEA235CB"><enum>(c)</enum><header>Payment for
costs of treatment of WTC-related health conditions</header>
<paragraph id="H788B9EA4BC6149F187817716F1706716"><enum>(1)</enum><header>In
general</header><text>The WTC program shall provide for payment of the costs of
medically necessary treatment of WTC-related health conditions of eligible WTC
responders. The WTC program administrator shall establish methods for
determining the costs for such treatment.</text>
</paragraph><paragraph display-inline="no-display-inline" id="HABB4F8135F0E4A45B95100003795FF1C"><enum>(2)</enum><header>Administrative
arrangement authority</header><text display-inline="yes-display-inline">The WTC
program administrator may enter into arrangements with other government
agencies, insurance companies, or other third-party administrators to provide
for timely and accurate processing of claims under this section.</text>
</paragraph></subsection><subsection id="HE32D7A78CB2E43AAA1ACFFFF4C4C105E"><enum>(d)</enum><header>Medical
treatment protocols</header>
<paragraph display-inline="no-display-inline" id="HDED1C92BFA9D453C82C863AEB3CFF885"><enum>(1)</enum><header>Development</header><text display-inline="yes-display-inline">The Coordinating Centers of Excellence
shall develop medical treatment protocols for the treatment of eligible WTC
responders and eligible WTC residents and other non-responders for presumed
WTC-related health conditions under subsection (b).</text>
</paragraph><paragraph id="H602079AFC5AE4117999748FF64FD06FE"><enum>(2)</enum><header>Approval</header><text display-inline="yes-display-inline">The WTC program administrator shall approve
the medical treatment protocols, in consultation with the WTC Health Program
Steering Committee.</text>
</paragraph></subsection></section></part><part id="H5D4D4C67AE3B4CCA8C183C2468287F1D"><enum>2</enum><header>Community
Program</header>
<section id="HF8ED9B4851034E228F1119D8C7DF6849"><enum>3021.</enum><header>Identification
of eligible WTC residents and other non-responders and provision of WTC-related
monitoring services</header>
<subsection id="H1062250C9F854B3DB510C9C47900B08B"><enum>(a)</enum><header>Eligible WTC
resident and other non-responder defined</header>
<paragraph id="H16070390B32645238DDA394243A1D78F"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">For purposes of this
title, the term <term>eligible WTC resident and other non-responder</term>
means an individual who—</text>
<subparagraph id="H8D427293D45346838861D45D008DA2BF"><enum>(A)</enum><text>is a WTC
non-responder (as defined in paragraph (2));</text>
</subparagraph><subparagraph id="HC1977AD9F2284EB682C9E4A726EFF3FD"><enum>(B)</enum><text>is not an eligible
WTC responder; and</text>
</subparagraph><subparagraph commented="no" id="HC53D8927FD2942BCB63768D5E6B45E32"><enum>(C)</enum><text>meets such
eligibility criteria relating to exposure to airborne toxins, any other hazard,
or any other adverse condition resulting from the 9/11 NYC terrorist attacks as
the WTC program administrator, after consultation with the WTC Health Program
Steering Committee and the WTC Scientific/Technical Advisory Committee,
determines appropriate.</text>
</subparagraph></paragraph><paragraph id="H52504C6649EB4FBF8E0809139B3C1FE1"><enum>(2)</enum><header>WTC resident and
other non-responder defined</header><text>In this title, the term <term>WTC
resident and other non-responder</term> means an individual who is described in
any of the following subparagraphs:</text>
<subparagraph commented="no" id="HEAAA2AA88FF64B5C8543EEBCB323EA3C"><enum>(A)</enum><text display-inline="yes-display-inline">A person whose place of residence at any
time during the period beginning on September 11, 2001, and ending on July 31,
2002, was in the New York City disaster area.</text>
</subparagraph><subparagraph commented="no" id="H49AC425223A149D6A079E6AB3108B108"><enum>(B)</enum><text display-inline="yes-display-inline">A person who was working at any time during
such period in the New York City disaster area.</text>
</subparagraph><subparagraph commented="no" id="H2F6EA0405A9A453EB224284536691B00"><enum>(C)</enum><text display-inline="yes-display-inline">A person who attended school, child care,
or adult day care at any time during such period in a building located in the
New York City disaster area.</text>
</subparagraph><subparagraph id="HF5A0DA271B154942AF73C096BE1969B0"><enum>(D)</enum><text>A person who was
present in the New York City disaster area on September 11, 2001.</text>
</subparagraph><subparagraph id="H389B5CC43C194504AC009E69D1DCC8D7"><enum>(E)</enum><text display-inline="yes-display-inline">A person who was deemed eligible to receive
a grant from the Lower Manhattan Development Corporation Residential Grant
Program, who possessed a lease for a residence or purchased a residence in the
New York City disaster area, and who resided in such residence after September
11, 2001 and prior to May 31, 2003.</text>
</subparagraph><subparagraph id="HC7C3C5F11E9E43F1AD003C5057D5ED00"><enum>(F)</enum><text display-inline="yes-display-inline">A person whose place of employment—</text>
<clause id="H75D8458995A445BEA0E6A05C7E0000B9"><enum>(i)</enum><text>at
any time during the period beginning on September 11, 2001, and ending on May
31, 2003, was in the New York City disaster area; and</text>
</clause><clause id="HECD4ABCE829C45E7BE28B8C4AACD9BF3"><enum>(ii)</enum><text>was deemed
eligible to receive a grant from the Lower Manhattan Development Corporation
WTC Small Firms Attraction and Retention Act program or other government
incentive program designed to revitalize the Lower Manhattan economy after the
9/11 NYC terrorist attacks.</text>
</clause></subparagraph><subparagraph commented="no" id="H173CB8223E564FFAA8A365A0868EE302"><enum>(G)</enum><text>Any other person
whom the WTC program administrator determines to be appropriate.</text>
</subparagraph></paragraph><paragraph id="H3CDE085552D64F4FAFBC8761564577A2"><enum>(3)</enum><header>Eligibility
criteria</header><text>In establishing eligibility criteria under paragraph
(1)(C), the WTC program administrator shall—</text>
<subparagraph id="H7F66C725BDC34A5798D45088A6D720D6"><enum>(A)</enum><text>with respect to
clause (i) of such paragraph, take into account the period, and, to the extent
feasible, intensity, of exposure to airborne toxins, other hazard, or other
adverse condition;</text>
</subparagraph><subparagraph id="HBD981E793E1641C5AB581338CC23FB70"><enum>(B)</enum><text>base such criteria
on best available evidence of exposure and related adverse health effects;
and</text>
</subparagraph><subparagraph id="H4688773F36BC4EBCA1F900005B00597C"><enum>(C)</enum><text>consult with the
WTC Health Program Steering Committee, Coordinating Centers of Excellence
described in section 3006(b)(1)(C), and affected populations.</text>
</subparagraph><continuation-text continuation-text-level="paragraph">The
administrator shall first establish such criteria not later than 90 days after
the date of the enactment of this title.</continuation-text></paragraph></subsection><subsection id="HC8D5646741924414AA3D5DBF7001B33"><enum>(b)</enum><header>Monitoring
benefits</header>
<paragraph id="H1D91A680CC4149778B75AAAF006D9350"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">In the case of an
eligible WTC resident or other non-responder, the WTC program shall provide for
monitoring benefits that include medical monitoring consistent with protocols
approved by the WTC program administrator, in consultation with the World Trade
Center Environmental Health Center at Bellevue Hospital and the WTC Health
Program Steering Committee, and including screening, clinical examinations, and
long-term health monitoring and analysis.</text>
</paragraph><paragraph id="H8A48DDCC225240E28734DAC6D910E95F"><enum>(2)</enum><header>Source of
benefits</header><text>The monitoring benefits under paragraph (1) shall be
provided through a Clinical Center of Excellence with respect to the individual
involved.</text>
</paragraph></subsection></section><section id="H4D287C5676404203880092E1A9BF50D3"><enum>3022.</enum><header>Treatment of
eligible WTC residents and other non-responders for WTC-related health
conditions</header>
<subsection id="H11AAEFFE87104FE995315483F010EE52"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Subject to subsection
(b), the provisions of section 3012 shall apply to the treatment of WTC-related
health conditions for eligible WTC residents and other non-responders in the
same manner as such provisions apply to the treatment of WTC-related health
conditions for eligible WTC responders.</text>
</subsection><subsection id="HA5C8D52E6B104F9797A5FA67CB389CE6"><enum>(b)</enum><header>Substitution of
list of health conditions for presumed WTC-related health conditions</header>
<paragraph id="HC0516869BBE746B293B2D705937D4537"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">In applying
subsection (a), instead of applying the presumed WTC-related health conditions
described in section 3102(a)(2), the WTC program administrator shall establish,
with input from the Coordinating Center of Excellence described in section
3006(b)(2)(C), a list of WTC-related health conditions and associated exposure
criteria for which treatment benefits are presumptively available for eligible
WTC residents and other non-responders, or subgroups of eligible WTC residents
or other non-responders. In establishing such list, the WTC program
administrator shall review the presumed WTC-related health conditions listed in
paragraph (2) of section 3012(a) to determine which of the conditions meets the
criteria for a WTC-related health condition, as defined in paragraph (1) of
such section, for eligible WTC residents and other non-responders or sub-groups
of eligible WTC residents or other non-responders.</text>
</paragraph><paragraph id="HEAB3B2C38A26462E9C0051CD72C27300"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">The list of health conditions and
associated exposure criteria under paragraph (1) shall, with respect to
airborne toxins, other hazards, and other adverse conditions, be based upon the
best available scientific and clinical evidence on adverse health effects
related to exposures to such toxins, hazards, or adverse conditions,
respectively, in the eligible WTC resident and other non-responder
populations.</text>
</paragraph><paragraph id="HFA370E744FD84421AA98724E080646C5"><enum>(3)</enum><header>Consultation</header><text>The
WTC program administrator shall consult with and receive input from the WTC
Health Program Steering Committee and affected populations, and shall provide
an opportunity for public comment, in establishing the list under paragraph
(1).</text>
</paragraph><paragraph id="H4FA4AB1666CA49C4BCADE6F63DC71E25"><enum>(4)</enum><header>Deadline</header><text>The
WTC program administrator shall first establish and publish the list under
paragraph (1) in the Federal Register not later than 180 days after the date of
the enactment of this title.</text>
</paragraph><paragraph id="HE7FCE2828C5A49569083148DE4DC0061"><enum>(5)</enum><header>Treatment During
Interim Period</header><text display-inline="yes-display-inline">Until the date
on which WTC program administrator first publishes under paragraph (4) the list
under paragraph (1) for eligible WTC residents and other non-responder
populations, the Clinical Centers of Excellence described in section
3006(b)(1)(C) may provide medical treatment to such a resident or member of
such a population, if a physician at the Clinical Center of Excellence involved
determines that the resident or member, respectively, has a WTC-related health
condition. Such treatment shall be provided, without regard to the requirements
of section 3012(b)(2).</text>
</paragraph></subsection></section></part><part id="H8E37E9C192CD4D8FBA4B4D00A8FD26E8"><enum>3</enum><header>National
Arrangement for Benefits for Eligible Individuals Outside New York</header>
<section id="H79FE1B48F4FE4754B13E6BE632CC697E"><enum>3031.</enum><header>National
arrangement for benefits for eligible individuals outside New York</header>
<subsection id="H934E534A32E24A49BCF4E8CA5E87FEC3"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">In order to ensure
reasonable access to monitoring and treatment benefits under this subtitle for
individuals who reside in any State, as defined in section 2(f), outside the
New York metropolitan area, the WTC program administrator shall establish a
nationwide network of health care providers to provide such monitoring and
treatment benefits near such individuals’ areas of residence in such States, or
to establish a mechanism whereby individuals who are entitled to benefits for
such monitoring or treatment can be reimbursed for the cost of such monitoring
or treatment.</text>
</subsection><subsection commented="no" id="HF1F61B60859F4724A754C545772C2692"><enum>(b)</enum><header>Network
requirements</header><text>Any health care provider participating in the
network under subsection (a) shall—</text>
<paragraph commented="no" id="H98AE4B8ABC454BFBB2E064D8AE79EC1C"><enum>(1)</enum><text>meet criteria for
credentialing established by the Coordinating Centers of Excellence;</text>
</paragraph><paragraph commented="no" id="H66D32015F80B4B7500D67FC1252B24B4"><enum>(2)</enum><text>follow the
monitoring and treatment protocols developed under section 3006(a)(1); and</text>
</paragraph><paragraph commented="no" id="H3459D8CEB781448D973017E612E4591F"><enum>(3)</enum><text>collect and report
data in accordance with section 3005.</text>
</paragraph></subsection></section></part></subtitle><subtitle id="HBE49D55202894A37AB83A8E6B98FAC8"><enum>C</enum><header>Research into
Conditions</header>
<section id="HECABBFF3080242CF92009DB995C12C54"><enum>3041.</enum><header>Research
regarding certain health conditions related to September 11 terrorist attacks
in New York City</header>
<subsection id="H9548FB364B924C48AA1F1C9591BD7C56"><enum>(a)</enum><header>In
General</header><text display-inline="yes-display-inline">With respect to
individuals, including WTC responders and non-responders, receiving monitoring
under subtitle B, the WTC program administrator shall conduct or
support—</text>
<paragraph id="H98EECE7E3D3441888CBD079711A95D22"><enum>(1)</enum><text>research on
physical and mental health conditions that may be related to the September 11
terrorist attacks;</text>
</paragraph><paragraph id="HE663F1FC61E84A38B23F55796603F580"><enum>(2)</enum><text>research on
diagnosing WTC-related health conditions of such individuals, in the case of
conditions for which there has been diagnostic uncertainty; and</text>
</paragraph><paragraph id="HD8B303B0752A462DB34FFCF867755E18"><enum>(3)</enum><text>research on
treating WTC-related health conditions of such individuals, in the case of
conditions for which there has been treatment uncertainty.</text>
</paragraph></subsection><subsection id="H6A42EF651DBC4C44BF6943718256F496"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">The WTC program administrator shall carry
out this section in consultation with the WTC Health Program Steering
Committee.</text>
</subsection><subsection id="H4A77943DD2564F629DF01C00DE43BB9D"><enum>(c)</enum><header>Application of
privacy and human subject protections</header><text display-inline="yes-display-inline">The privacy and human subject protections
applicable to research conducted under this section shall not be less than such
protections applicable to research otherwise conducted by the National
Institutes of Health.</text>
</subsection><subsection id="H2AFA21F2A18C469688AC4665F21310E6"><enum>(d)</enum><header>Annual
Report</header><text>The WTC program administrator shall annually submit to the
Congress a report describing the findings of research under subsection
(a).</text>
</subsection><subsection id="H5FE6A6E8ECC64DD789BA007C6EDB88AC"><enum>(e)</enum><header>Authorization of
Appropriations</header><text>For the purpose of carrying out this section,
there are authorized to be appropriated such sums as may be necessary for each
of fiscal years 2008 through 2026, in addition to any other authorizations of
appropriations that are available for such purpose.</text>
</subsection></section></subtitle><subtitle id="H35F07401AF0E4A85B7A0D174B4BC93B"><enum>D</enum><header>Programs of the New
York City Department of Health and Mental Hygiene</header>
<section id="HF0DA14CB1D784CAB894BFB95AE2147AF"><enum>3051.</enum><header>World Trade
Center Health Registry</header>
<subsection id="HAE43F77E890543D5954318A8206DAC39"><enum>(a)</enum><header>Program
extension</header><text>For the purpose of ensuring on-going data collection
for victims of the 9/11 NYC terrorist attacks, the WTC program administrator,
shall extend and expand the arrangements in effect as of January 1, 2007, with
the New York City Department of Health and Mental Hygiene that provide for the
World Trade Center Health Registry.</text>
</subsection><subsection id="H9799A80C266D4733BD8369431D13A861"><enum>(b)</enum><header>Authorization of
appropriations</header><text>To carry out this section, there are authorized to
be appropriated such sums as may be necessary.</text>
</subsection></section><section id="H5EC42D8B858A4EA7A281005C4EB63847"><enum>3052.</enum><header>Mental health
services</header><text display-inline="no-display-inline">The WTC program
administrator may make grants to the New York City Department of Health and
Mental Hygiene to provide mental health services to address mental health needs
relating to the 9/11 NYC terrorist
attacks.</text>
</section></subtitle>.

general</header><text>Except as provided by subparagraph (B), no claim may be
filed under paragraph (1) after December 22, 2003.</text>
</subparagraph><subparagraph id="HD507A5EFAE784499BE84E3BAC71BE00"><enum>(B)</enum><header>Exceptions</header>
<clause id="H7F34676E4A5440FAA749EEB97D3EB9B5"><enum>(i)</enum><header>In
general</header><text>A claim may be filed under paragraph (1) by an individual
(or by a personal representative on behalf of a deceased individual) during the
period described in clause (ii), if the Special Master determines that—</text>
<subclause id="H3B57899C0564460199A46200932E30FE"><enum>(I)</enum><text display-inline="yes-display-inline">the individual first knew that the
individual had suffered a physical or psychological harm as a result of the
terrorist-related aircraft crashes of September 11, 2001, or the aftermath of
such attacks, after December 22, 2003, and before the date that is 5 years
after the date of the enactment of the James Zadroga 9/11 Health and
Compensation Act of 2007;</text>
</subclause><subclause id="HB8E260D113F944848F41D847009B8962"><enum>(II)</enum><text>the individual
did not for any reason other than as described in subclause (I) know that the
individual was eligible to file a claim under paragraph (1) until after
December 22, 2003;</text>
</subclause><subclause id="H63E65C143E4243A3BBA5FA91E5E5BB26"><enum>(III)</enum><text display-inline="yes-display-inline">the individual filed a claim under this
title before, on, or after December 22, 2003, and suffered a significantly
greater physical or psychological harm as a result of the terrorist-related
aircraft crashes of September 11, 2001, or the aftermath of such attacks, than
was known to the individual as of the date the most recent previous claim was
filed, and before the date that is 5 years after the date of the enactment of
the James Zadroga 9/11 Health and Compensation Act of 2007; or</text>
</subclause><subclause id="H60FE63EEBCDF4242B8E2B9C192072099"><enum>(IV)</enum><text>the individual
was not eligible to file a claim under this title before December 22, 2003, but
who becomes so eligible because of the amendments made by the James Zadroga
9/11 Health and Compensation Act of 2007.</text>
</subclause></clause><clause id="HF95F5A5E50284717AAE3E26EC6416C36"><enum>(ii)</enum><header>Period</header>
<subclause id="HFB635C698E2D4F86A8D98F7DB4F00A8"><enum>(I)</enum><header>In
general</header><text>Except as provided in subclause (II), the period
described in this clause is the two-year period beginning on the date of the
enactment of the James Zadroga 9/11 Health and Compensation Act of 2007.</text>
</subclause><subclause id="HC7FF7E25224B44699E8C96C3819319CB"><enum>(II)</enum><header>Exception</header><text display-inline="yes-display-inline">In the case of an individual who first knew
on a date after such date of enactment that the individual had suffered
physical or psychological harm described in subclause (I) of clause (i) or a
significantly greater harm, described in subclause (III) of such clause, the
period described in this clause is the two-year period beginning on the date
the individual first acquired such
knowledge.</text>
</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H6ECCB2BFBB9B4E5492FF83D1D2163F1D"><enum>202.</enum><header>Exception to
single claim requirement in certain circumstances</header><text display-inline="no-display-inline">Section 405(c)(3)(A) of the Air
Transportation Safety and System Stabilization Act (<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is
amended to read as follows:</text>

<subparagraph id="H5B108E6B3D454F78B0D9E93C813F29A8"><enum>(A)</enum><header>Single
claim</header>
<clause id="HFF4229F23AA649CBA496E2B3C566F5A3"><enum>(i)</enum><header>In
general</header><text>Except as provided by clause (ii), not more than 1 claim
may be submitted under this title by an individual or on behalf of a deceased
individual.</text>
</clause><clause id="H22CB7092F181422A9E6F22D5494054AD"><enum>(ii)</enum><header>Exception</header><text>A
second claim may be filed under subsection (a)(1) by an individual (or by a
personal representative on behalf of a deceased individual) if the individual
is an individual described in clause (i)(II), (i)(III), or (ii)(II) of
subsection
(a)(3)(B).</text>
</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section id="H236C0709923D4A56B7345EA5A6383DDC"><enum>203.</enum><header>Eligibility of
claimants suffering from psychological harm</header>
<subsection id="HE9AA1917ED3D4AED99C2FD1F3BCC85"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Section
405(c)(2)(A)(ii) of the Air Transportation Safety and System Stabilization Act
(<external-xref legal-doc="usc" parsable-cite="usc/49/40101">49 U.S.C. 40101</external-xref> note) is amended by inserting <quote>, psychological
harm,</quote> before <quote>or death</quote>.</text>
</subsection><subsection id="H6259D8A53548450DBCDD69A0D77007CA"><enum>(b)</enum><header>Conforming
amendments</header>
<paragraph id="HF1D526763C174A6BA22468C388328318"><enum>(1)</enum><text>Section 403 of
such Act is amended by striking <quote>physically injured</quote> and inserting
<quote>physically or psychologically injured</quote>.</text>
</paragraph><paragraph id="H2AAB27D15639416987F0085C0087119D"><enum>(2)</enum><text>Section
405(a)(2)(B)(i) of such Act is amended by striking <quote>physical harm</quote>
and inserting <quote>physical or psychological harm</quote>.</text>
</paragraph></subsection></section><section id="H762A231971754940B3AF11F6027014D2"><enum>204.</enum><header>Immediate
aftermath defined</header><text display-inline="no-display-inline">Section 402
of the Air Transportation Safety and System Stabilization Act (49 U.S.C. 40101
note) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3C6A8D47FC2A47068DC8C2EEDFDE3B21"><enum>(11)</enum><header>Immediate
aftermath</header><text display-inline="yes-display-inline">In section
405(c)(2)(A)(i), the term <term>immediate aftermath</term> means any period
beginning with the terrorist-related aircraft crashes of September 11, 2001,
and ending on July 31,
2002.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" id="HD5CD2F98F1FF4493849CA06F8B221837"><enum>205.</enum><header>Eligible
individuals to include eligible WTC responders and eligible WTC residents and
other non-responders</header><text display-inline="no-display-inline">Section
405(c)(2) of the Air Transportation Safety and System Stabilization Act (49
U.S.C. 40101 note) is amended—</text>
<paragraph id="H2315613F6981433100110960C594B1C9"><enum>(1)</enum><text>in subparagraph
(A)(i), by striking <quote>at the World Trade Center, (New York, New York), the
Pentagon (Arlington, Virginia), or </quote> and inserting <quote>in the New
York City disaster area, as defined in section 3009(5) of the Public Health
Service Act, (including at the World Trade Center, (New York, New York)), at
the Pentagon (Arlington, Virginia), or at</quote>;</text>
</paragraph><paragraph commented="no" id="H598DA829D7434305B0CA39EAFC8F4C05"><enum>(2)</enum><text>in subparagraph
(B), at the end by striking <quote>or</quote>;</text>
</paragraph><paragraph commented="no" id="HF2D85F462E244C72AEC1E09AD7012C0"><enum>(3)</enum><text>in subparagraph
(C), by striking <quote>subparagraph (A) or (B)</quote> and inserting
<quote>subparagraph (A), (B), or (C)</quote>;</text>
