<section id="HC08DB75E009D45208516A526EFE292F"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Federal Judgeship Act of 2007</quote>.</text> </section>
<section id="HA99B4F5F12AB40AD86E4DC869BB02582"><enum>102.</enum><header>Circuit judges for the circuit courts of appeals</header>
<subsection id="H95A42BBA30E042FAACF7B7D33875D124"><enum>(a)</enum><header>In General</header><text>The President shall appoint, by and with the advice and consent of the Senate—</text>
<paragraph id="H80FBB89DA1DA4D3592DFE695CA59F5B2"><enum>(1)</enum><text>1 additional circuit judge for the first circuit court of appeals;</text> </paragraph>
<paragraph id="H289BF782F58A40C1AFF43FF0F7C2BF90"><enum>(2)</enum><text>2 additional circuit judges for the second circuit court of appeals;</text> </paragraph>
<paragraph id="H048494E11F7C4B61B2F5806D502D2831"><enum>(3)</enum><text>1 additional circuit judge for the sixth circuit court of appeals; and</text> </paragraph>
<paragraph id="HCFF89DF0E7D54D54812B9B8F8424E1DB"><enum>(4)</enum><text>5 additional circuit judges for the ninth circuit court of appeals, whose official duty station shall be in California.</text> </paragraph></subsection>
<subsection id="H8C33DA88B57D438B935CF5BA594E1200"><enum>(b)</enum><header>Temporary Judgeships</header>
<paragraph id="HB389B941FF3F4DE39393C061F1114E5"><enum>(1)</enum><header>In general</header><text>The President shall appoint, by and with the advice and consent of the Senate—</text>
<subparagraph id="H0B13769E855A44ECAF583F7F30D4CE2F"><enum>(A)</enum><text>1 additional circuit judge for the eighth circuit court of appeals; and</text> </subparagraph>
<subparagraph id="H27493CC110984476ADCDE0381DB77EA8"><enum>(B)</enum><text>2 additional circuit judges for the ninth circuit court of appeals, whose official duty station shall be in California.</text> </subparagraph></paragraph>
<paragraph id="H33BF3DB6EF894B8D989CF963FD3FF519"><enum>(2)</enum><header>Vacancies</header>
<subparagraph id="H1B88FE6E590749E380BCA7B97400F165"><enum>(A)</enum><header>Eighth circuit</header><text>The first vacancy in the office of circuit judge in the eighth circuit court of appeals, occurring 10 years or more after the confirmation date of the judge named to fill the circuit judgeship created in that circuit by paragraph (1)(A) shall not be filled.</text> </subparagraph>
<subparagraph id="H8F158976A1E843CBB140283BECCE2855"><enum>(B)</enum><header>Ninth circuit</header><text>The first 2 vacancies in the office of circuit judge in the ninth circuit court of appeals, occurring 10 years or more after judges are first confirmed to fill both temporary circuit judgeships created by paragraph (1)(B) shall not be filled.</text> </subparagraph></paragraph></subsection>
<subsection id="H7D85205705BA4C5C88DEA2A9AAEFE7FF"><enum>(c)</enum><header>Table of Judgeships</header><text>In order that the table contained in <external-xref legal-doc="usc" parsable-cite="usc/28/44">section 44</external-xref> of title 28, United States Code, will, with respect to each judicial circuit, reflect the changes in the total number of permanent circuit judgeships authorized under subsection (a) of this section, such table is amended to read as follows:</text>

<subsection id="HDEFDCE594C29438B856BC0258082C6F8"><enum>(c)</enum><header>Existing Judgeships</header>
<paragraph id="H201CB0A929A04604A0F6003B49FEC44"><enum>(1)</enum><header>Permanent judgeships</header><text>The existing judgeships for the district of Hawaii, the district of Kansas, and the eastern district of Missouri authorized by section 203(c) of the Judicial Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/650">Public Law 101–650</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) shall, as of the effective date of this Act, be authorized under <external-xref legal-doc="usc" parsable-cite="usc/28/133">section 133</external-xref> of title 28, United States Code, and the incumbents in those offices shall hold the office under <external-xref legal-doc="usc" parsable-cite="usc/28/133">section 133</external-xref> of title 28, United States Code, as amended by this Act.</text> </paragraph>
<paragraph id="H44F9E9BF70EC49B8A0F7B114EDE59BA2"><enum>(2)</enum><header>Extension of temporary judgeship</header><text>Section 203(c) of the Judicial Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/650">Public Law 101–650</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/133">28 U.S.C. 133</external-xref> note) is amended in the fifth sentence (relating to the northern district of Ohio) by striking <quote>15 years</quote> and inserting <quote>20 years</quote>.</text> </paragraph></subsection>

<subsection id="H99A8DE399DA04CD98816A7EC02F0C480"><enum>(p)</enum><header>Savings Provisions</header>
<paragraph id="HDE532A482C7C46EAA4166BE8D5191418"><enum>(1)</enum><header>Tenure of incumbent judges</header><text>A judge of the District Court of the Virgin Islands in office on the effective date of this section shall continue in office until the expiration of the term for which the judge was appointed, or until the judge dies, resigns, or is removed from office, whichever occurs first. When a vacancy occurs on the court on or after the effective date of this section, the President, in accordance with <external-xref legal-doc="usc" parsable-cite="usc/28/133">section 133(a)</external-xref> of title 28, United States Code, shall appoint, by and with the advice and consent of the Senate, a district judge for the District of the Virgin Islands.</text> </paragraph>
<paragraph id="H22682FE26A704152BC752FDF597C0016"><enum>(2)</enum><header>Retirement rights and benefits</header><text>The amendments made by this section shall not affect the rights under sections <external-xref legal-doc="usc" parsable-cite="usc/28/373">373</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/28/376">376</external-xref> of title 28, United States Code, of any judge of the District Court of the Virgin Islands who retires on or before the effective date of this section or who continues in office after that date under paragraph (1) of this subsection. Service as a judge of the District Court of the Virgin Islands appointed under section 24 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1614">48 U.S.C. 1614</external-xref>) shall be included in calculating service under sections <external-xref legal-doc="usc" parsable-cite="usc/28/371">371</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/28/372">372</external-xref> of title 28, United States Code, and shall not be counted for purposes of section 373 of that title, if the judge is reappointed, after the effective date of this section, under <external-xref legal-doc="usc" parsable-cite="usc/28/133">section 133(a)</external-xref> of title 28, United States Code, as district judge for the District of the Virgin Islands.</text> </paragraph></subsection>
<subsection id="HACDB1A3A653C4906A4F2570079A3CF77"><enum>(q)</enum><header>Amendments to Revised Organic Act of the Virgin Islands</header>
<paragraph id="H7DA629EF7EAC410CBDF90DB4B0600EA"><enum>(1)</enum><header>Repeals</header><text>Sections 24, 25, 26, and 27 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1614">48 U.S.C. 1614</external-xref>, 1615, 1616 and 1617) are repealed.</text> </paragraph>
<paragraph id="H9B85C4C7C4974728B0ECF0A4B0FA338D"><enum>(2)</enum><header>Rights and prohibitions</header><text>Section 3 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1561">48 U.S.C. 1561</external-xref>) is amended in the 23d undesignated paragraph—</text>
<subparagraph id="H525E62C3A2A6490F9448F608105E2609"><enum>(A)</enum><text>by inserting <quote>article III;</quote> after <quote>section 9, clauses 2 and 3;</quote> and</text> </subparagraph>

<paragraph id="H42389C1D509B4F8190E28F9E5EEFBFB8"><enum>(3)</enum><header>Jurisdiction</header><text>Section 21 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1611">48 U.S.C. 1611</external-xref>) is amended to read as follows:</text>

<section id="H52E022B1E8AF46689200FAC76C5E5EF1"><enum>21.</enum><header>Jurisdiction of the courts of the Virgin Islands</header>
<subsection id="H29FA4EB4A1A440DE8F88A51768261950"><enum>(a)</enum><header>Jurisdiction of the Courts of the Virgin Islands</header><text>The judicial power of the Virgin Islands shall be vested in such trial and appellate courts as may have been or may hereafter be established by local law. The local courts of the Virgin Islands shall have jurisdiction over all causes of action in the Virgin Islands over which any court established by the Constitution and laws of the United States does not have exclusive jurisdiction.</text> </subsection>
<subsection id="H0F4C29EAEE434172AA6B3E200748CECF"><enum>(b)</enum><header>Practice and Procedure</header><text>The rules governing the practice and procedure of the courts established by local law and those prescribing the qualifications and duties of the judges and officers thereof, oaths and bonds, and the times and places of holding court shall be governed by local law or the rules promulgated by those courts.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HE0C3622CBE67467AAA3538D9D467F1C"><enum>(4)</enum><header>Income tax matters</header><text>Section 22 of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1612">48 U.S.C. 1612</external-xref>) is amended to read as follows:</text>

<section id="H1F403040CB7C4210B8A82BACD876CFAC"><enum>22.</enum><header>Jurisdiction over income tax matters</header><text display-inline="no-display-inline">The United States District Court for the District of the Virgin Islands shall have exclusive jurisdiction over all criminal and civil proceedings in the Virgin Islands with respect to the income tax laws applicable to the Virgin Islands, except the ancillary laws relating to the income tax enacted by the legislature of the Virgin Islands. Any act or failure to act with respect to the income tax laws applicable to the Virgin Islands which would constitute a criminal offense described in chapter 75 of subtitle F of the Internal Revenue Code of 1986 shall constitute an offense against the Government of the Virgin Islands and may be prosecuted in the name of the Government of the Virgin Islands by the appropriate officers thereof in the United States District Court for the District of the Virgin Islands without the request or consent of the United States attorney for the Virgin Islands.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H1C22E0930060480BB06667ECD501C5D0"><enum>(5)</enum><header>Appellate jurisdiction</header><text>Section 23A of the Revised Organic Act of the Virgin Islands (<external-xref legal-doc="usc" parsable-cite="usc/48/1613a">48 U.S.C. 1613a</external-xref>) is amended—</text>
<subparagraph id="H932A1DDA1CE5407EB81D93D52B71BDAA"><enum>(A)</enum><text>by striking <quote>District Court of the Virgin Islands</quote> each place it appears and inserting <quote>United States District Court for the District of the Virgin Islands</quote>; and</text> </subparagraph>
<subparagraph id="HE5329C6BF45547BFB20087A07EFA6B6E"><enum>(B)</enum><text>in subsection (b), by striking <quote>pursuant to section 24(a) of this Act: <added-phrase>Provided,</added-phrase> That no more than one of them may be a judge of a court established by local law.</quote> and inserting <quote>pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/13">chapter 13</external-xref> of title 28, United States Code, or a recalled senior judge of the former District Court of the Virgin Islands. The chief judge of the United States Court of Appeals for the Third Circuit may assign to the appellate division a judge of a court of record of the Virgin Islands, except that no more than 1 of the judges sitting in the appellate division at any session may be a judge of a court established by local law.</quote>.</text> </subparagraph></paragraph></subsection>
<subsection id="HBCEA9B1554404AFD9E542E1457A7B8F"><enum>(r)</enum><header>Additional References</header><text>Any reference in any provision of law to the <quote>District Court of the Virgin Islands</quote> shall, on and after the effective date of this section, be deemed to be a reference to the United States District Court for the District of the Virgin Islands.</text> </subsection>
<subsection id="H7985B353B9234B0194B784C8534B62A2"><enum>(s)</enum><header>Effective Date</header><text>This section and the amendments made by this section shall take effect at the end of the 90-day period beginning on the date of the enactment of this Act. Any complaint or proceeding pending in the District Court of the Virgin Islands on the effective date of this section may be pursued to final determination in the United States District Court for the District of the Virgin Islands, the United States Court of Appeals for the Third Circuit, the United States Court of Appeals for the Federal Circuit, and the Supreme Court of the United States.</text> </subsection></section>
<section id="H61A26C28668E48C8862EF00083DA68EA"><enum>105.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in section 104(s), this title and the amendments made by this title shall take effect on the date of the enactment of this Act.</text> </section>

<subsection id="H23CF8045C8064F5DB74EDB2CAC3DC6DD"><enum>(c)</enum><header>Eligibility for Subsequent Appointments</header><text>A judge holding office in any of the districts enumerated in subsection (a) shall, at the expiration of the term of the judge (other than by reason of paragraph (1)(B) or (2)(B) of subsection (b)), be eligible for reappointment as a bankruptcy judge in that district.</text> </subsection></section>

<enum>III</enum><header>NINTH CIRCUIT REORGANIZATION</header>
<section id="H56337E2E02634A3B9541A8F1C37494F1"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Judicial Administration and Improvements Act of 2007</quote>.</text> </section>
<section id="HD0CAC82F1FF6440B855F605DCE6500A3"><enum>302.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph id="H135939486AE24AE591EDA092EF38555"><enum>(1)</enum><header>Former ninth circuit</header><text>The term <term>former ninth circuit</term> means the ninth judicial circuit of the United States as in existence on the day before the effective date of this title.</text> </paragraph>
<paragraph id="HA0902C8D23FB46CC9BF4E2C49A9F9AA"><enum>(2)</enum><header>New ninth circuit</header><text>The term <term>new ninth circuit</term> means the ninth judicial circuit of the United States established by the amendment made by section 303(2)(A).</text> </paragraph>
<paragraph id="H65A5C3840E0F4EC8AE3049226DAFB35E"><enum>(3)</enum><header>Twelfth circuit</header><text>The term <term>twelfth circuit</term> means the twelfth judicial circuit of the United States established by the amendment made by section 303(2)(B).</text> </paragraph></section>
<section id="H81817AD87E43454CBA0582324568271D"><enum>303.</enum><header>Number and composition of circuits</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/41">Section 41</external-xref> of title 28, United States Code, is amended—</text>

<section id="H203ADCB86E734D648F922CF02042F377"><enum>306.</enum><header>Assignment of circuit judges</header><text display-inline="no-display-inline">Each circuit judge of the former ninth circuit who is in regular active service and whose official duty station on the day before the effective date of this title—</text>
<paragraph id="H45574C7612D1456184124DF6949765E"><enum>(1)</enum><text>is in California, Guam, Hawaii, or the Northern Mariana Islands shall be a circuit judge of the new ninth circuit as of such effective date; and</text> </paragraph>
<paragraph id="H2761694163A94F91BC26C8A98B33AEE5"><enum>(2)</enum><text>is in Alaska, Arizona, Idaho, Montana, Nevada, Oregon, or Washington shall be a circuit judge of the twelfth circuit as of such effective date.</text> </paragraph></section>
<section id="H6B88F5F4B7B14B5F82918958BD848239"><enum>307.</enum><header>Election of assignment by senior judges</header><text display-inline="no-display-inline">Each judge who is a senior circuit judge of the former ninth circuit on the day before the effective date of this title may elect to be assigned to the new ninth circuit or the twelfth circuit as of such effective date and shall notify the Director of the Administrative Office of the United States Courts of such election.</text> </section>
<section id="H63392FC7E70B4BB39C74A4107DEE16EF"><enum>308.</enum><header>Seniority of judges</header>
<subsection id="idE492C487979E42C2985D265962F5375E"><enum></enum><text display-inline="yes-display-inline">The seniority of each judge—</text>
<paragraph id="H731EFFD9E38640A1BE8C2D9D009514AF"><enum>(1)</enum><text>who is assigned under section 306, or</text> </paragraph>
<paragraph id="H6AAE362A7F354CD78F6F235C89A9A96E"><enum>(2)</enum><text>who elects to be assigned under section 307,</text> </paragraph><continuation-text continuation-text-level="subsection">shall run from the date of commission of such judge as a judge of the former ninth circuit.</continuation-text></subsection></section>
<section id="HE2F01312C0524E3497CEAC7D18E4E7F9"><enum>309.</enum><header>Application to cases</header><text display-inline="no-display-inline">The following apply to any case in which, on the day before the effective date of this title, an appeal or other proceeding has been filed with the former ninth circuit:</text>
<paragraph id="H24CD6549D153405DB966A741224C4854"><enum>(1)</enum><text>Except as provided in paragraph (3), if the matter has been submitted for decision, further proceedings with respect to the matter shall be had in the same manner and with the same effect as if this title had not been enacted.</text> </paragraph>
<paragraph id="HB5695F451AD442A1ADEEE9FE72DE4383"><enum>(2)</enum><text>If the matter has not been submitted for decision, the appeal or proceeding, together with the original papers, printed records, and record entries duly certified, shall, by appropriate orders, be transferred to the court to which the matter would have been submitted had this title been in full force and effect at the time such appeal was taken or other proceeding commenced, and further proceedings with respect to the case shall be had in the same manner and with the same effect as if the appeal or other proceeding had been filed in such court.</text> </paragraph>
<paragraph id="H8F63FE2D0B974A63B600B947E2CCA08C"><enum>(3)</enum><text>If a petition for rehearing en banc is pending on or after the effective date of this title, the petition shall be considered by the court of appeals to which it would have been submitted had this title been in full force and effect at the time that the appeal or other proceeding was filed with the court of appeals.</text> </paragraph></section>
<section id="H681FE15F38B249AF8339857425F2DDB2"><enum>310.</enum><header>Temporary assignment of circuit judges among circuits</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/291">Section 291</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<subsection id="H120A960DAD4B4BC592101FACBB398C26"><enum>(c)</enum><text>The chief judge of the Ninth Circuit may, in the public interest and upon request by the chief judge of the Twelfth Circuit, designate and assign temporarily any circuit judge of the Ninth Circuit to act as circuit judge in the Twelfth Circuit.</text> </subsection>
<subsection id="HFEC2649A511D46C68BC0733C276F6D7E"><enum>(d)</enum><text>The chief judge of the Twelfth Circuit may, in the public interest and upon request by the chief judge of the Ninth Circuit, designate and assign temporarily any circuit judge of the Twelfth Circuit to act as circuit judge in the Ninth Circuit.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="HB55FFE677AEC4DD6A7A0AA868D56FA9B"><enum>311.</enum><header>Temporary assignment of district judges among circuits</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/28/292">Section 292</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text>

<subsection id="H7FA58655B3EC4904855D6FFBF9CC7DDF"><enum>(f)</enum><text>The chief judge of the United States Court of Appeals for the Ninth Circuit may, in the public interest—</text>
<paragraph id="H407752BF73E441C8A4837FBC59540096"><enum>(1)</enum><text>upon request by the chief judge of the Twelfth Circuit, designate and assign 1 or more district judges within the Ninth Circuit to sit upon the Court of Appeals of the Twelfth Circuit, or a division thereof, whenever the business of that court so requires; and</text> </paragraph>
<paragraph id="HB2EEB4277AC14BC6A212139607117988"><enum>(2)</enum><text>designate and assign temporarily any district judge within the Ninth Circuit to hold a district court in any district within the Twelfth Circuit.</text> </paragraph></subsection>
<subsection id="H56DFD22E364143ADBF6BB17659A04E47"><enum>(g)</enum><text>The chief judge of the United States Court of Appeals for the Twelfth Circuit may in the public interest—</text>
<paragraph id="H7F7FDA54FFDF4676A552D303006F3698"><enum>(1)</enum><text>upon request by the chief judge of the Ninth Circuit, designate and assign 1 or more district judges within the Twelfth Circuit to sit upon the Court of Appeals of the Ninth Circuit, or a division thereof, whenever the business of that court so requires; and</text> </paragraph>
<paragraph id="HD5BF14669296471DBACB693E8B16C743"><enum>(2)</enum><text>designate and assign temporarily any district judge within the Twelfth Circuit to hold a district court in any district within the Ninth Circuit.</text> </paragraph></subsection>
<subsection id="HA34FD4E504544A13B55E3D5702FFCCB8"><enum>(h)</enum><text>Any designations or assignments under subsection (f) or (g) shall be in conformity with the rules or orders of the court of appeals of, or the district within, as applicable, the circuit to which the judge is designated or assigned.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H31667A0DF76E4BF2A8EE760000CA7977"><enum>312.</enum><header>Administration</header><text display-inline="no-display-inline">The court of appeals for the ninth circuit as constituted on the day before the effective date of this title may take such administrative action as may be required to carry out this title and the amendments made by this title. Such court shall cease to exist for administrative purposes 2 years after the date of the enactment of this Act.</text> </section>
<section id="H846662AF0B9542AA9E9FF3B591F6B8D9"><enum>313.</enum><header>Effective date</header><text display-inline="no-display-inline">This title and the amendments made by this title shall take at the end of the 1-year period beginning on the date of the enactment of this Act.</text> </section>
<enum>IV</enum><header>AUTHORIZATION OF APPROPRIATIONS</header>
<section id="HDD21BF4C839646FC00FD787673F85F24"><enum>401.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated for each of fiscal years 2008 through 2011 such sums as are necessary to carry out this Act, including such sums as may be necessary to provide appropriate space and facilities for the judicial positions created by this Act. Funds appropriated pursuant to this section in any fiscal year shall remain available until expended.</text> </section>
