		<section display-inline="no-display-inline" id="H68E5183E060D41F4B21C963959DC47B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>United States Commission on an Open
			 Society with Security Act</short-title></quote>.</text>
		</section><section id="HC7EFCA60A26F4E3B00EF318152BD0054"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HC505B8E47C8A4CE7905F7418CD4748A2"><enum>(1)</enum><text>an open society
			 which affords free access to public facilities and spaces and which protects
			 the right to engage in open discussion is an essential premise of American
			 governmental institutions and democratic values;</text>
			</paragraph><paragraph id="H0F737AD6458F4BBBBEAD00F400F8CB4C"><enum>(2)</enum><text>the United States
			 is currently facing a challenge to the safety and security of the public,
			 public employees, and public facilities and spaces that is unique in the
			 history of this Nation;</text>
			</paragraph><paragraph id="H99222137E592442096FF64BCA39F5C71"><enum>(3)</enum><text>to meet this
			 challenge without eroding or harming any of the basic tenets of the Republic
			 and of our democracy, this Nation needs to assemble the best thinking
			 available; and</text>
			</paragraph><paragraph id="H4E4ED8A0DEE8431198304FC3046FE97"><enum>(4)</enum><text>a
			 commission of experts from a broad base of disciplines and backgrounds is
			 necessary to examine all the factors that should be considered in securing
			 public safety from terrorist attacks while maintaining the highest level of
			 free and open access to the public.</text>
			</paragraph></section><section id="H20E38251D48E4B71B5AE5FA0710022D9"><enum>3.</enum><header>Establishment of
			 Commission</header>
			<subsection id="H0864FDE45E784DA2B65C709E00C8BB3C"><enum>(a)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>United States Commission
			 on an Open Society with Security</quote> (in this Act referred to as the
			 <quote>Commission</quote>).</text>
			</subsection><subsection id="HCB0FB8EFC25F4A53B35F781D86007F56"><enum>(b)</enum><header>Composition</header><text>The
			 Commission shall be composed of 21 members appointed by the President from
			 among individuals representing such fields or groups as the following:
			 architecture, technology, civil libertarians, humanists, members of the armed
			 forces, Federal Government employees, city planners, business leaders, lawyers,
			 artists, public building security, engineers, philosophers, historians,
			 sociologists, and psychologists. The President shall designate one of those
			 members to be the Chairperson of the Commission.</text>
			</subsection><subsection id="HB04B34E4E8E74D5EA7847B22BBEF9199"><enum>(c)</enum><header>Terms; quorum;
			 meetings; vacancies</header><text>Members shall be appointed for the life of
			 the Commission. Nine members of the Commission shall constitute a quorum, but a
			 lesser number may hold hearings. After its initial meeting, the Commission
			 shall meet at the call of the Chairperson of the Commission or a majority of
			 its members. Any vacancy in the Commission shall not affect its powers and
			 shall be filled in the same manner as the original appointment.</text>
			</subsection><subsection id="H15C05297B2E6402B9F5D85FEFB170544"><enum>(d)</enum><header>Appointments;
			 initial meeting</header>
				<paragraph id="H8EE58250210B4E819DCEADD23D6F1609"><enum>(1)</enum><header>Appointments</header><text>It
			 is the sense of Congress that the members of the Commission should be appointed
			 by not later than 90 days after the date of enactment of this Act.</text>
				</paragraph><paragraph id="H6E6B3EAC0D86497899C50005938D7EF9"><enum>(2)</enum><header>Initial
			 meeting</header><text>If, after 90 days following the date of enactment of this
			 Act, 9 or more members of the Commission have been appointed, the members who
			 have been appointed may meet, and the Chairperson shall have the authority to
			 begin the operations of the Commission, including the hiring of staff.</text>
				</paragraph></subsection></section><section id="HB65F6E98D40B485E88704BCE06A76223"><enum>4.</enum><header>Functions of
			 Commission</header>
			<subsection id="H20C9D1964F7841E895D61EC777D9600"><enum>(a)</enum><header>In
			 general</header><text>The Commission shall study and make findings and
			 recommendations relating to the question of how the Government of the United
			 States may provide, in a balanced manner, for both security in and public
			 access to Federal buildings and other Federal property and sites.</text>
			</subsection><subsection id="HC67AACA553AF462B988C5E3F54172D8F"><enum>(b)</enum><header>Matters To be
			 examined</header><text>In carrying out this Act, the Commission shall
			 specifically examine matters that relate to the security of, and open access
			 to, public facilities and spaces, including—</text>
				<paragraph id="H37ABFFEE37FA4DA783BDD700B171D470"><enum>(1)</enum><text>Federal, other
			 governmental, and private security practices and proposals, building design,
			 public space management, counterterrorism needs, and refurbishment of existing
			 Federal facilities;</text>
				</paragraph><paragraph id="H477435FCA9554862B1042C12449BE3C2"><enum>(2)</enum><text>the effect of
			 access to public facilities and spaces on—</text>
					<subparagraph id="H1FA050B15CDA45D699C825815540C501"><enum>(A)</enum><text>maintenance of
			 security and safety;</text>
					</subparagraph><subparagraph id="HDAB5091A59064A53B31E18AF5D59DB"><enum>(B)</enum><text>free speech, the
			 right to petition the Government, and other constitutional rights and civil
			 liberties;</text>
					</subparagraph><subparagraph id="HBCCDAF2E6DC549CAB0D6EC103294C3BD"><enum>(C)</enum><text>economies of
			 affected jurisdictions or parts thereof;</text>
					</subparagraph><subparagraph id="H586A9B952E86443D9594C932BD8483C0"><enum>(D)</enum><text>physical changes
			 and architectural aesthetics of affected areas;</text>
					</subparagraph><subparagraph id="H032F10ECBD374D7BA359D0E907F8D6F"><enum>(E)</enum><text>traffic and
			 congestion; and</text>
					</subparagraph><subparagraph id="H6CA5C2135F2747B4BC44B09778EBBEAF"><enum>(F)</enum><text>job performance of
			 employees within the affected facilities;</text>
					</subparagraph></paragraph><paragraph id="H3981C6527D6241A4BB27E9ACFA9C730"><enum>(3)</enum><text>current and
			 potential uses of technology to augment or replace traditional modes of
			 security;</text>
				</paragraph><paragraph id="H8F7B5267A0C74D188456007CFD91FC02"><enum>(4)</enum><text>practices of and
			 comparisons with other entities and nations; and</text>
				</paragraph><paragraph id="H8E1CF29C58434EE684EF301E2566001C"><enum>(5)</enum><text>current and
			 potential analytical methods of assessing the risks posed by the various forms
			 of terrorism, balanced against the specific needs and values of open
			 access.</text>
				</paragraph></subsection><subsection id="H7C3D0DAD588A4A7A00D9F0005E8C907"><enum>(c)</enum><header>Coordination of
			 activities</header><text>The Commission shall take appropriate measures to
			 avoid unnecessary duplication of efforts previously or currently being
			 undertaken by any other person or entity.</text>
			</subsection></section><section id="H3E492C278A924A93BF34E57305D51CB6"><enum>5.</enum><header>Powers of
			 Commission</header>
			<subsection id="HDB7AE079E8744AC400867E5B2500FAE6"><enum>(a)</enum><header>In
			 general</header><text>The Commission or, on the authorization of the
			 Commission, any member or agent of the Commission may hold such hearings, sit
			 and act at such times and places, take such testimony, and receive such
			 evidence as the Commission considers appropriate to carry out this Act.</text>
			</subsection><subsection id="H244F3FE9774842F6AE62C8A695592771"><enum>(b)</enum><header>Obtaining
			 official information</header><text>The Commission may secure directly from any
			 department, agency, or other entity of the United States information necessary
			 to enable it to carry out this Act. Upon request of the Chairperson of the
			 Commission, the head of such governmental entity shall furnish, to the extent
			 authorized by law, such information to the Commission.</text>
			</subsection><subsection id="HB5086688488941E484F700B7B800E2C7"><enum>(c)</enum><header>Security</header>
				<paragraph id="H9735676B4375452FB0FCCEA8A2AF2199"><enum>(1)</enum><header>Security
			 clearances</header><text>The members and staff of the Commission shall hold, as
			 a condition of appointment to or employment with the Commission, appropriate
			 security clearances for access to the classified briefing, records, and
			 materials to be reviewed by the Commission or its staff and shall follow the
			 guidance and practices on security under applicable Executive orders and agency
			 directives.</text>
				</paragraph><paragraph id="H8E00400B4C0C42B288A7EDEBED81B6E3"><enum>(2)</enum><header>Conditions to
			 granting access</header><text>The head of an agency shall require, as a
			 condition of granting access to a member of the Commission or a member of the
			 staff of the Commission to classified records or materials of the agency under
			 this Act, require the member to—</text>
					<subparagraph id="H447584D8DBFF4AAF822E3513B24580A7"><enum>(A)</enum><text>execute an
			 agreement regarding the security of such records or materials that is approved
			 by the head of the agency; and</text>
					</subparagraph><subparagraph id="H9B709EAE5BC5453FAA689CD4098553DB"><enum>(B)</enum><text>hold an
			 appropriate security clearance granted or recognized under the standard
			 procedures and eligibility criteria of the agency, including any special access
			 approval required for access to such records or materials.</text>
					</subparagraph></paragraph><paragraph id="H40793D251C96467C00004CC22750D11B"><enum>(3)</enum><header>Restriction on
			 use</header><text>The members of the Commission and the members of the staff of
			 the Commission may not use any information acquired in the course of their
			 official activities on the Commission for nonofficial purposes.</text>
				</paragraph><paragraph id="H58C5F44A13BB4F3BB1C4A3F85344C76D"><enum>(4)</enum><header>Need to
			 know</header><text>For purposes of any law or regulation governing access to
			 classified information that pertains to the national security of the United
			 States and to facilitate the advisory functions of the Commission under this
			 Act, a member of the Commission or a member of the staff of the Commission
			 seeking access to a record or material under this Act shall be deemed for
			 purposes of this subsection to have a need to know the contents of the record
			 or material.</text>
				</paragraph><paragraph id="H458559C047CE4511A90066198662AB94"><enum>(5)</enum><header>Rule of
			 construction</header><text>A reference in this subsection to the <quote>staff
			 of the Commission</quote> includes individuals described in sections 6(d) and
			 6(e).</text>
				</paragraph></subsection><subsection id="HBF482F552DBF4EF8BD4332B7AD78658F"><enum>(d)</enum><header>Mails</header><text>The
			 Commission may use the United States mails in the same manner and under the
			 same conditions as other departments and agencies of the United States.</text>
			</subsection><subsection id="H0C6A3B0D5DAB49B3B6E4177B8B326602"><enum>(e)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
			</subsection><subsection id="H103D77EC8D0E4BB194CCFC4C531949C0"><enum>(f)</enum><header>Administrative
			 support services</header><text>The Administrator of General Services shall
			 provide to the Commission, on a reimbursable basis, such administrative support
			 services as the Commission may request.</text>
			</subsection></section><section id="H6615A7DCEFFD403493AEAA2640403D70"><enum>6.</enum><header>Personnel
			 matters</header>
			<subsection id="HEB99DF67170E4E3692696BE92C85163F"><enum>(a)</enum><header>Compensation of
			 members</header><text>Members of the Commission shall not be compensated by
			 reason of their service on the Commission.</text>
			</subsection><subsection id="H0EDC2BA74BA942F8AC381B38B2D5FD73"><enum>(b)</enum><header>Travel
			 expenses</header><text>The members of the Commission shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for
			 employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United
			 States Code, while away from their homes or regular places of business in the
			 performance of services for the Commission.</text>
			</subsection><subsection id="HBE2C913C0E6142619BA2606D1EE16C45"><enum>(c)</enum><header>Staff</header><text>Subject
			 to such rules as the Commission may prescribe, the Chairperson of the
			 Commission, without regard to the provisions of title 5, United States Code,
			 governing appointments in the competitive service, and without regard to the
			 provisions of chapter 51 and subchapter III of chapter 53 of such title
			 (relating to classification and General Schedule pay rates), may appoint and
			 fix the pay of a staff director and such other personnel as may be necessary to
			 enable the Commission to carry out its functions; except that no rate of pay
			 fixed under this subsection may exceed the maximum rate of basic pay payable
			 for GS–15 of the General Schedule.</text>
			</subsection><subsection id="H7DCD65FB090D4987AF85D100DDEA8DC4"><enum>(d)</enum><header>Staff of Federal
			 agencies</header><text>Upon request of the Chairperson of the Commission, the
			 head of any department or agency of the United States may detail, on a
			 nonreimbursable basis, any of the personnel of that department or agency to the
			 Commission to assist it in carrying out its functions under this Act.</text>
			</subsection><subsection id="HC793E652E4D443EAA105E100DFBC028"><enum>(e)</enum><header>Experts and
			 consultants</header><text>With the approval of the Commission, the Chairperson
			 of the Commission may procure temporary and intermittent services under section
			 3109(b) of title 5, United States Code, at rates for individuals not to exceed
			 the daily equivalent of the maximum rate of basic pay payable for GS–15 of the
			 General Schedule.</text>
			</subsection></section><section id="HBB40946B3C5946E9AE4E157B9834DACC"><enum>7.</enum><header>Report</header>
			<subsection id="HD854CFD802D54CC58555C2F5B4B549D6"><enum>(a)</enum><header>Submission to
			 the President</header><text>The Commission shall transmit its final report to
			 the President not later than 2 years after the initial meeting of the
			 Commission. Such report shall contain a detailed statement of the findings and
			 conclusions of the Commission, together with its recommendations for such
			 legislative, administrative, or other action as the Commission considers
			 appropriate.</text>
			</subsection><subsection id="H56E233430A0B481988F975FC7D9EB50"><enum>(b)</enum><header>Submission to the
			 Congress</header><text>Not later than 6 months after receiving the final report
			 of the Commission under subsection (a), the President shall transmit such
			 report to Congress, together with any comments or recommendations (including
			 any proposed legislation) which the President considers appropriate.</text>
			</subsection></section><section id="H31BE4236D711490B8E9C83DE22BFCF86"><enum>8.</enum><header>Termination of
			 Commission</header><text display-inline="no-display-inline">The Commission
			 shall terminate on the 90th day after the date on which the Commission is
			 required to submit its final report under section 7(a).</text>
		</section><section id="HB0BAF413685C4C3498DE359F88607692"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act—</text>
			<paragraph id="H034DCDDA483147609C48484519C27429"><enum>(1)</enum><text>$5,000,000 for
			 fiscal year 2008; and</text>
			</paragraph><paragraph id="H206C4FBC42EE43D5AF52DCE8E0113705"><enum>(2)</enum><text>$5,000,000 for
			 fiscal year 2010.</text>
