<official-title>To prohibit a convicted sex offender from obtaining approval of immigration petitions filed by the offender on behalf of family members.</official-title>

<section id="H60985F90D9BE4FBEA2079093FF35D2F2" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header> 
<subsection id="H2D7944A41C6B406DA357AE773785C21E"><enum></enum><text>This Act may be cited as the <quote><short-title>Sex Offender Visa Loophole Elimination Act of 2007</short-title></quote>.</text></subsection></section> 
<section display-inline="no-display-inline" id="HF63E1333E9934608B8C3D9870B77CDB" section-type="subsequent-section"><enum>2.</enum><header>Barring convicted sex offenders from having family-based petitions approved</header> 
<subsection id="HF604883615D840D490AB354FED2D0086"><enum>(a)</enum><header>Immigrant family members</header><text>Section 204(a)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H7AAA6DD361DA45A5A5AF2E606E0585"><enum>(1)</enum><text>in subparagraph (A)—</text> 
<subparagraph id="HD0EB017862B14835B68112954B55006B"><enum>(A)</enum><text>in clause (i), by striking <quote>Any</quote> and inserting <quote>Except as provided in clause (viii), any</quote>; and</text></subparagraph> 
<subparagraph id="H2975BD22094142479DC9BCD08CD3277F"><enum>(B)</enum><text>by adding at the end the following:</text>

<clause id="H943B01B567DA4E1FA090494CF5581FA" indent="up3"><enum>(viii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H7E3A6403F2E84277BBCADC9B756BB708"><enum>(I)</enum><text>Clause (i) shall not apply to a citizen of the United States who has been convicted of a sex offense.</text></subclause> 
<subclause id="HA5C209A6D62044C6B37938A2F47847E2" indent="up1"><enum>(II)</enum><text>For purposes of subclause (I):</text> 
<item id="HCAD3A03B31BE4195A29667985CA009B1"><enum>(aa)</enum><text display-inline="yes-display-inline">The term <quote>sex offense</quote> means—</text> 
<subitem id="H623267AF65954178926E7D5E0525D6A2"><enum>(AA)</enum><text>a State, local, tribal, foreign, or other criminal offense that has an element involving a sexual act or sexual contact with another, or an attempt or conspiracy to commit such an offense;</text></subitem> 
<subitem id="H3B891B5449B44A9EAC8FB077644C24C5"><enum>(BB)</enum><text>a State local, tribal, foreign or other specified offense against a minor;</text></subitem> 
<subitem id="H4390D0DBEB524591835CB350142B82AD"><enum>(CC)</enum><text>a Federal offense (including an offense prosecuted under section <external-xref legal-doc="usc" parsable-cite="usc/18/1152">1152</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/18/1153">1153</external-xref> of title 18, United States Code) under section 1201, 1591, or 1801, or chapter 109A, 110, or 117, of title 18, United States Code, or any other Federal offense designated by the Attorney General for the purposes of this item; or</text></subitem> 
<subitem id="HB55CF6CF7789427592C27C1134EF0000"><enum>(DD)</enum><text>a military offense specified by the Secretary of Defense under section 115(a)(8)(C)(i) of the Department of Justice Appropriations Act, 1998 (<external-xref legal-doc="usc" parsable-cite="usc/10/951">10 U.S.C. 951</external-xref> note).</text></subitem></item> 
<item id="HBF0AB3BF45E744E0A4ADDCE621ADF27E"><enum>(bb)</enum><text display-inline="yes-display-inline">The term <quote>specified offense against a minor</quote> means an offense against a minor that involves any of the following:</text> 
<subitem id="H85C1F484AC0D42A78D4250007314B1B2"><enum>(AA)</enum><text>An offense (unless committed by a parent) involving kidnapping.</text></subitem> 
<subitem id="HC86B513BBF5540CD8F1E55D0E61E4047"><enum>(BB)</enum><text>An offense (unless committed by a parent) involving false imprisonment.</text></subitem> 
<subitem id="HC1C8229E8D404F2F8C27A68BFDDDCFB7"><enum>(CC)</enum><text>Solicitation to engage in sexual conduct.</text></subitem> 
<subitem id="H01AC5DE9147A41CEA9F5D856709E3D66"><enum>(DD)</enum><text>Use in a sexual performance.</text></subitem> 
<subitem id="HFA5E748E27304A2E8FC8B624BF35566F"><enum>(EE)</enum><text>Solicitation to practice prostitution.</text></subitem> 
<subitem id="H93ABDAB0FB104726928B4216A2F9FBA"><enum>(FF)</enum><text>Possession, production, or distribution of child pornography.</text></subitem> 
<subitem id="HFD2B0294AB41462AB83341BE3F46AF2F"><enum>(GG)</enum><text>Criminal sexual conduct involving a minor (less than 18 years old), or the use of the Internet to facilitate or attempt such conduct.</text></subitem> 
<subitem id="H4E1153C596C24C2482EC48FDA45F696"><enum>(HH)</enum><text>Any conduct that by its nature is a sex offense against a minor.</text></subitem> 
<subitem id="HE95999CAB0E442E7AC5BDC666CCA9EE7"><enum>(II)</enum><text>Video voyeurism, as described in <external-xref legal-doc="usc" parsable-cite="usc/18/1801">section 1801</external-xref> of title 18, United States Code.</text></subitem> 
<subitem id="H94B6A4EFB1514E9EB710CA72EF38A0C0"><enum>(JJ)</enum><text>Any attempt or conspiracy to commit an offense described in any of subitems (AA) through (II).</text></subitem></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H19AA96BF3A2E44F40045A947C1500930"><enum>(2)</enum><text>in subparagraph (B)(i)—</text> 
<subparagraph id="HF1E6376E1BD646EF8807D9D1BE77241B"><enum>(A)</enum><text>by striking <quote>(B)(i) Any alien</quote> and inserting the following:</text>

<subparagraph id="H922E02DD42B84B86B3CCE8A58B5EE061" indent="up2"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HADDAB454F91C47BEB9315569AA1C3B9B"><enum>(i)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="H94E66664CC514FFA90A4E548672E88F5"><enum>(I)</enum><text display-inline="yes-display-inline">Except as provided in subclause (II), any alien</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HCB10F92651A14002AB685854F059295C"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H1D322CAC9AB64B20BB681654CCBBFBBF"> 
<subclause id="H35DD99225EC04C2FB148D4A0AEC488E3" indent="up4"><enum>(II)</enum><text>Subclause (I) shall not apply in the case of an alien lawfully admitted for permanent residence who has been convicted of a sex offense (as defined in subparagraph (A)(viii)(II)).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H913E131950C6446798CD74D7F286197F"><enum>(b)</enum><header>Fiancées, Fiancés, and waiting nonimmigrant spouses</header> 
<paragraph id="H3092CA612B694EEAB1FD00D9D2D4C587"><enum>(1)</enum><header>Fiancées and fiancés</header><text>Section 214(d)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(d)(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H576C0C40046A41D59C7B2646D308BDDF" style="traditional"> 
<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">The Secretary of Homeland Security may not approve any petition filed by a petitioner who has been convicted of a sex offense (as defined in section 204(a)(1)(A)(viii)(II)).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HEB776DBE29B641BFBD58AB8DAA39A365"><enum>(2)</enum><header>Waiting spouses</header><text>Section 214(r)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(r)(1)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HFCF4C8A890CD48F49590D24D16A4B4C"><enum>(3)</enum><header>Clerical amendment</header><text>Section 101(a)(15)(K) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)</external-xref>), is amended by striking <quote>and (p)</quote> and inserting <quote>and (r)</quote>.</text></paragraph></subsection></section>
