		<section display-inline="no-display-inline" id="HC3FC59363C6843D8AD37964FD2D3AAF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kids in Disasters Well-being, Safety,
			 and Health Act of 2007</short-title></quote>.</text>
		</section><section id="HCC6300A7C4654CEFAF5184AE7B659341"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the terms <term>child</term>
			 and <term>children</term> mean an individual or individuals, respectively, who
			 have not attained 18 years of age.</text>
		</section><section id="H9C58EBBAE62A4642B100C96438376EEA"><enum>3.</enum><header>Establishment of
			 Commission</header><text display-inline="no-display-inline">There is
			 established a commission to be known as the <quote>National Commission on
			 Children and Disasters</quote> (referred to in this Act as the
			 <quote>Commission</quote>).</text>
		</section><section id="H236E21BF378A499EA1C1FB57D8B3C8E8"><enum>4.</enum><header>Purposes of
			 Commission</header><text display-inline="no-display-inline">The purposes of the
			 Commission are to—</text>
			<paragraph id="HECEE3129253C480D81150550E0709E00"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a comprehensive study to examine
			 and assess the needs of children as they relate to preparation for, response
			 to, and recovery from all hazards, including major disasters and
			 emergencies;</text>
			</paragraph><paragraph id="HB3C1CCBF46DB4C8BB300488572894ED3"><enum>(2)</enum><text display-inline="yes-display-inline">build upon the investigations of other
			 entities and avoid unnecessary duplication, by reviewing the findings,
			 conclusions, and recommendations of other commissions, Federal, State, and
			 local governments, or nongovernmental entities, relating to the needs of
			 children as they relate to preparation for, response to, and recovery from all
			 hazards, including major disasters and emergencies; and</text>
			</paragraph><paragraph id="H6E7EFA284C3A4F56B200F8D2C7337E8"><enum>(3)</enum><text>submit a report to
			 the President and Congress on specific findings, conclusions, and
			 recommendations to address the needs of children as they relate to preparation
			 for, response to, and recovery from all hazards, including major disasters and
			 emergencies.</text>
			</paragraph></section><section id="HCD987169198C43AAB946AC0049977D51"><enum>5.</enum><header>Composition of
			 Commission</header>
			<subsection id="H2CFCCCA887134D1700E14FFB845F9706"><enum>(a)</enum><header>Members</header><text>The
			 Commission shall be composed of 10 members, of whom—</text>
				<paragraph id="HECB9D4979894469F8F9D001CC5AEF29B"><enum>(1)</enum><text>1
			 member shall be appointed by the President;</text>
				</paragraph><paragraph id="HD283DAF22F7B4100BD25D5C065AF54A8"><enum>(2)</enum><text>1
			 member, who is of a different political party than that of the member appointed
			 under paragraph (1), shall be appointed by the President;</text>
				</paragraph><paragraph id="H365AD06A66F54CAB9646128E752075B7"><enum>(3)</enum><text>2
			 members shall be appointed by the majority leader of the Senate;</text>
				</paragraph><paragraph id="H47AA3A5B7FC74640B21FEF5306135476"><enum>(4)</enum><text>2
			 members shall be appointed by the minority leader of the Senate;</text>
				</paragraph><paragraph id="HBF50BA39BDA54A7792EBEDDB7EF5CD14"><enum>(5)</enum><text>2
			 members shall be appointed by the Speaker of the House of Representatives;
			 and</text>
				</paragraph><paragraph id="H5960B262A6A543FFA1DC7D83238400EC"><enum>(6)</enum><text>2
			 members shall be appointed by the minority leader of the House of
			 Representatives.</text>
				</paragraph></subsection><subsection id="H0A5520880D514FFEAB7B6509ED77321D"><enum>(b)</enum><header>Chairperson and
			 vice-chairperson selection</header><text>The Chairperson and Vice Chairperson
			 shall be elected from among members of the Commission.</text>
			</subsection><subsection id="HF4AF320A75ED4B9B9153DF2E1B190028"><enum>(c)</enum><header>Governmental
			 appointees</header><text>An individual appointed to the Commission may not be
			 an official or employee of the Federal Government.</text>
			</subsection><subsection commented="no" id="HD048C3356F7C4E07AE98C185E8002D29"><enum>(d)</enum><header>Commission
			 representation</header><text display-inline="yes-display-inline">The Commission
			 shall include—</text>
				<paragraph id="H4AD5DD2D21CA4902B07EC10456A824BF"><enum>(1)</enum><text>representatives
			 from private nonprofit entities with demonstrated expertise in addressing the
			 needs of children as they relate to preparation for, response to, and recovery
			 from all hazards, including major disasters and emergencies; and</text>
				</paragraph><paragraph id="HC0EB54C33A9D4DEB896872E9256FEEFF"><enum>(2)</enum><text display-inline="yes-display-inline">State emergency managers and local
			 emergency managers.</text>
				</paragraph></subsection><subsection id="HA0ABF360A6D545118C70A6C66EA489E0"><enum>(e)</enum><header>Qualifications</header><text display-inline="yes-display-inline">Members appointed under subsection (a)
			 shall include—</text>
				<paragraph id="H75FC01638729441E9B9B32BB37409934"><enum>(1)</enum><text display-inline="yes-display-inline">individuals involved with providing
			 services to children, including health, education, housing, and other social
			 services, including grant and entitlement programs;</text>
				</paragraph><paragraph id="HB60868A615384B9586B0D2C9ADDFC09C"><enum>(2)</enum><text>individuals with
			 experience in emergency management, including coordination of resources and
			 services among State and local governments, the Federal Government, and
			 nongovernmental entities;</text>
				</paragraph><paragraph id="HA10C5C74D94A4520006395508782BBD"><enum>(3)</enum><text>individuals with
			 philanthropic experience focused on the needs of children;</text>
				</paragraph><paragraph id="HD6388E2566EE440997E87F64B206A912"><enum>(4)</enum><text display-inline="yes-display-inline">individuals with experience in providing
			 donated goods and services, including personnel services, to meet the needs of
			 children and families as they relate to preparation for, response to, and
			 recovery from all hazards, including major disasters and emergencies;
			 and</text>
				</paragraph><paragraph id="H651D88DE5E42430C9FF6BA56F85E067"><enum>(5)</enum><text>individuals who
			 have conducted academic research into related issues.</text>
				</paragraph></subsection><subsection id="HD2B8FECC72DB40ADA329032618CDCA35"><enum>(f)</enum><header>Appointments</header><text>All
			 members of the Commission shall be appointed not later than 90 days after the
			 date of enactment of this Act.</text>
			</subsection><subsection id="HA1C58A834C7C4686A794DCFB77F7356B"><enum>(g)</enum><header>Initial
			 meeting</header><text>The Commission shall meet and begin the operations of the
			 Commission not later than 120 days after the date of enactment of this
			 Act.</text>
			</subsection><subsection commented="no" id="HC7B2CD0D31E5478EA77BB6484B85D1DF"><enum>(h)</enum><header>Quorum and
			 vacancy</header>
				<paragraph id="HFC478E24500D4E47AC7E293100D06CF9"><enum>(1)</enum><header>Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Commission
			 shall constitute a quorum, but a lesser number of members may hold
			 hearings.</text>
				</paragraph><paragraph id="HEDC1AADFDF3045F488EC867C07AE9581"><enum>(2)</enum><header>Vacancy</header><text>Any
			 vacancy in the Commission shall not affect its powers and shall be filled in
			 the same manner in which the original appointment was made.</text>
				</paragraph></subsection></section><section id="HB1EF34F8028B4C2799519CF56B5C505F"><enum>6.</enum><header>Duties of
			 Commission</header><text display-inline="no-display-inline">The Commission
			 shall—</text>
			<paragraph id="HEAA5364872D64C668E53B40216748FC1"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a comprehensive study that examines
			 and assesses the needs of children as they relate to preparation for, response
			 to, and recovery from all hazards, including major disasters and emergencies,
			 including specific findings relating to—</text>
				<subparagraph id="H16993B65DB544572B7C52F81D9A1F626"><enum>(A)</enum><text>children’s
			 physical and mental health;</text>
				</subparagraph><subparagraph id="H8AF5596B8F6546D091F2C5DD000017E3"><enum>(B)</enum><text>child care,
			 including in private for-profit and nonprofit settings;</text>
				</subparagraph><subparagraph id="HA6091BE880534890B53EE1407E642D34"><enum>(C)</enum><text>child
			 welfare;</text>
				</subparagraph><subparagraph id="H3186759B6A1544FDA8B4C12BA142957C"><enum>(D)</enum><text>elementary and
			 secondary education;</text>
				</subparagraph><subparagraph id="H7F7ABBD5122946B7ABBE09C6592200D5"><enum>(E)</enum><text>sheltering,
			 temporary housing, and affordable housing;</text>
				</subparagraph><subparagraph id="H481A32A7606742A7B1E15F608600009F"><enum>(F)</enum><text>transportation;</text>
				</subparagraph><subparagraph id="H573F2AD52A2748ADACD9207CAD2222F4"><enum>(G)</enum><text>entitlement and
			 grant programs;</text>
				</subparagraph><subparagraph id="H4B7EAE6891F84BEF9F98F2764F008DE8"><enum>(H)</enum><text>juvenile
			 justice;</text>
				</subparagraph><subparagraph id="H6A1FAD74CA2B4E6785202948F77F5513"><enum>(I)</enum><text>evacuation;
			 and</text>
				</subparagraph><subparagraph id="H06A2D2E94E434A8C841D003699FFF200"><enum>(J)</enum><text>relevant
			 activities in emergency management;</text>
				</subparagraph></paragraph><paragraph id="HD98CE87AA8DF4762B4A04542991602DD"><enum>(2)</enum><text display-inline="yes-display-inline">identify, review, and evaluate existing law
			 relevant to the needs of children as they relate to preparation for, response
			 to, and recovery from all hazards, including major disasters and
			 emergencies;</text>
			</paragraph><paragraph id="H23B01CFDF846434B85006616A7EAFFEE"><enum>(3)</enum><text>identify, review,
			 and evaluate the lessons learned from past disasters and emergencies relative
			 to addressing the needs of children; and</text>
			</paragraph><paragraph id="H6045ABA4EB0F4C188863FFB31F4961B1"><enum>(4)</enum><text display-inline="yes-display-inline">submit a report to the President and
			 Congress on the Commission’s specific findings, conclusions, and
			 recommendations to address the needs of children as they relate to preparation
			 for, response to, and recovery from all hazards, including major disasters and
			 emergencies, including specific recommendations on the need for planning and
			 establishing a national resource center on children and disasters, coordination
			 of resources and services, administrative actions, policies, regulations,
			 financing, and legislative changes as the Commission considers
			 appropriate.</text>
			</paragraph></section><section id="HF0F03B350170499DBB40174E83DED237"><enum>7.</enum><header>Powers of
			 Commission</header>
			<subsection id="HAD329BAE9766410B8F5CB2234D45787E"><enum>(a)</enum><header>Hearings</header><text>The
			 Commission may hold such hearings, meet and act at such times and places, and
			 receive such evidence as may be necessary to carry out the functions of the
			 Commission.</text>
			</subsection><subsection id="HC61A9A9E4807453E909B26D767362C14"><enum>(b)</enum><header>Information from
			 Federal agencies</header>
				<paragraph id="HC999EB083EA64BD7AAF310E332FE6296"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commission may
			 secure directly from any executive department, bureau, agency, board,
			 commission, office, independent establishment, or instrumentality of the
			 Federal Government such information, suggestions, estimates, and statistics as
			 the Commission considers necessary to carry out this Act.</text>
				</paragraph><paragraph id="H0683F6D535484949B7E2D04D8BDBDAE6"><enum>(2)</enum><header>Provision of
			 information</header><text>On request of the Chairperson of the Commission, each
			 department, bureau, agency, board, commission, office, independent
			 establishment, or instrumentality shall, to the extent authorized by law,
			 provide the requested information to the Commission.</text>
				</paragraph><paragraph id="H4C83E8C06FB549F5A604E353A67CF6B2"><enum>(3)</enum><header>Receipt,
			 handling, storage, and dissemination</header><text>Information shall only be
			 received, handled, stored, and disseminated by members of the Commission and
			 its staff consistent with all applicable statutes, regulations, and Executive
			 orders.</text>
				</paragraph></subsection><subsection id="H0CDA5480EBEF46FE007F19969632CF1"><enum>(c)</enum><header>Assistance from
			 Federal agencies</header>
				<paragraph id="H3F63C73C8EB74383B32E198E00BB6851"><enum>(1)</enum><header>General services
			 administration</header><text display-inline="yes-display-inline">On request of
			 the Chairperson of the Commission, the Administrator of General Services shall
			 provide to the Commission, on a reimbursable basis, administrative support and
			 other services necessary for the Commission to carry out its duties.</text>
				</paragraph><paragraph id="HAF0E80F1DF0B4184923E67DE72C70618"><enum>(2)</enum><header>Other
			 departments and agencies</header><text>In addition to the assistance provided
			 for under paragraph (1), departments and agencies of the United States may
			 provide to the Commission such services as they may determine advisable and as
			 authorized by law.</text>
				</paragraph></subsection><subsection id="HC4072C6BAE5B48289054746EB5E783CE"><enum>(d)</enum><header>Contracting</header><text>The
			 Commission may enter into contracts to enable the Commission to discharge its
			 duties under this Act.</text>
			</subsection><subsection commented="no" id="H6B79E3318F154194B472EC0010327D58"><enum>(e)</enum><header>Donations</header><text>The
			 Commission may accept, use, and dispose of donations of services or
			 property.</text>
			</subsection><subsection id="H164B3FA568334C01A073B7AAD200A907"><enum>(f)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as a department or agency of the
			 United States.</text>
			</subsection></section><section id="HFE79F4C905184984AED5B05F41B538B0"><enum>8.</enum><header>Staff of
			 Commission</header>
			<subsection id="HD7CD88C3B4E44919B3C47C8C8CC58B2B"><enum>(a)</enum><header>In
			 general</header><text>The Chairperson of the Commission, in consultation with
			 the Vice Chairperson, in accordance with rules agreed upon by the Commission,
			 may appoint and fix the compensation of a staff director and such other
			 personnel as may be necessary to enable the Commission to carry out its
			 functions, in accordance with the provisions of title 5, United States Code,
			 except that no rate of pay fixed under this subsection may exceed the
			 equivalent of that payable for a position at level V of the Executive Schedule
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text>
			</subsection><subsection id="H6DCDE902BB12418FA89CCFF3B90287AF"><enum>(b)</enum><header>Staff of Federal
			 agencies</header><text display-inline="yes-display-inline">Upon request of the
			 Chairperson of the Commission, the head of any executive department, bureau,
			 agency, board, commission, office, independent establishment, or
			 instrumentality of the Federal Government may detail, without reimbursement,
			 any of its personnel to the Commission to assist it in carrying out its duties
			 under this Act. Any detail of an employee shall be without interruption or loss
			 of civil service status or privilege.</text>
			</subsection><subsection id="H24F64CC863F644B68C8C003C004CA015"><enum>(c)</enum><header>Consultant
			 services</header><text>The Commission is authorized to procure the services of
			 experts and consultants in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United
			 States Code, but at rates not to exceed the daily rate paid a person occupying
			 a position at level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5,
			 United States Code.</text>
			</subsection></section><section commented="no" id="HC6AD30E8E30140B9B97947CC7D3F8EB8"><enum>9.</enum><header>Travel
			 expenses</header><text display-inline="no-display-inline">Each member of the
			 Commission shall serve without compensation, but shall receive travel expenses,
			 including per diem in lieu of subsistence, in accordance with applicable
			 provisions in the same manner as persons employed intermittently in the
			 Government service are allowed expenses under <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United
			 States Code.</text>
		</section><section id="H79DF4BF40B9F42B7A4789ED64757AE4D"><enum>10.</enum><header>Federal Advisory
			 Committee Act applicability</header><text display-inline="no-display-inline">The provisions of the Federal Advisory
			 Committee Act shall apply to the Commission, including the staff of the
			 Commission.</text>
		</section><section id="HC815B5132301478899DA1046346390"><enum>11.</enum><header>Reports of
			 Commission; termination</header>
			<subsection id="H5B82F6379CBE4CC7BBD4E42600A0F667"><enum>(a)</enum><header>Interim
			 report</header><text>Not later than December 31, 2008, the Commission shall
			 submit to the President and Congress an interim report containing specific
			 findings, conclusions, and recommendations required under this Act as have been
			 agreed to by a majority of Commission members.</text>
			</subsection><subsection id="H2C49C25DDA234BC89532BB835D2C0330"><enum>(b)</enum><header>Final
			 report</header><text display-inline="yes-display-inline">Not later than 24
			 months after the date of the enactment of this Act, the Commission shall submit
			 to the President and Congress a final report containing specific findings,
			 conclusions, and recommendations required under this Act as have been agreed to
			 by a majority of Commission members.</text>
			</subsection><subsection id="H52A287DC3A0740C6AA900000859DE54D"><enum>(c)</enum><header>Termination</header>
				<paragraph id="H61DAE3B2D2784AB591CE923BB7858081"><enum>(1)</enum><header>In
			 general</header><text>The Commission, and all the authorities of this Act,
			 shall terminate 180 days after the date on which the final report is submitted
			 under subsection (b).</text>
				</paragraph><paragraph commented="no" id="H0AA615CB9BE44DA0AD05C840D95F7436"><enum>(2)</enum><header>Records</header><text>Not
			 later than the date of termination of the Commission under paragraph (1), all
			 records and papers of the Commission shall be delivered to the Archivist of the
			 United States for deposit in the National Archives.</text>
				</paragraph></subsection></section><section id="H73739BA45ACF4EF984BBE225D0E98B96"><enum>12.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to carry out this Act, $2,000,000 for each of
			 fiscal years 2008 and 2009.</text>
