		<official-title>To amend the Atomic Energy Act of 1954 to improve and
		  strengthen the safety inspection process of nuclear
		  facilities.</official-title>

		<section display-inline="no-display-inline" id="H6EF81257561541E8A57BBB5FE8CFFE48" section-type="section-one"><enum>1.</enum><header>Independent safety
			 assessments</header><text display-inline="no-display-inline">Section 103 of the
			 Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>) is amended by inserting after
			 subsection d. the following:</text>
			<quoted-block display-inline="no-display-inline" id="HC5F481443BDE4744B3FBF68BCCF39C08" other-style="nuclear" style="other">
				<subsection id="H21583F8CB4D344C8AAA4B3A1C0AD5F14"><enum>e.</enum><header>Independent
				safety assessments</header>
					<paragraph id="H6D3DC880A0314FBDACB216AA9C677EED"><enum>(1)</enum><header>Development of
				procedure</header><text>Not later than 90 days after the date of enactment of
				this subsection, the Nuclear Regulatory Commission (referred to in this
				subsection as the <quote>Commission</quote>) shall develop an independent
				safety assessment procedure.</text>
					</paragraph><paragraph id="HA91BFD87A7A249ACB29EE63904105263"><enum>(2)</enum><header>Conduct of
				assessment</header>
						<subparagraph id="H71857CAA3D9446D1A1ACA4F45BD80035"><enum>(A)</enum><header>Definition of
				eligible requestor</header><text>In this paragraph, the term <term>eligible
				requestor</term> means—</text>
							<clause id="H87638DDFF8B14D97A7DD5D374615D74"><enum>(i)</enum><text>a
				Governor of a State in which a facility of a licensee is located;</text>
							</clause><clause id="H3AD9B2199E6648C1A1A1671DA3D37D89"><enum>(ii)</enum><text>a
				public utility commission of a State in which a facility of a licensee is
				located; and</text>
							</clause><clause id="HCE860077E59B428194F948CAD5B22E27"><enum>(iii)</enum><text>a Governor of a
				State that—</text>
								<subclause id="HB494C8810E524E28A8C96E40FB7CF558"><enum>(I)</enum><text>because of dangers
				to the public relating to potential ingestion of water or foods that have been
				contaminated with radiation from a commercial nuclear power plant, is located
				in an emergency planning zone, as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/350">section 350.2</external-xref> of title 44, Code of
				Federal Regulations (or a successor regulation); and</text>
								</subclause><subclause id="H076E95ABEF73436CBFD6C15983333184"><enum>(II)</enum><text>is not the same
				State in which the facility of the licensee is located.</text>
								</subclause></clause></subparagraph><subparagraph id="H949C70EDC8E74D84A0AC5FABEAA7080"><enum>(B)</enum><header>Request of
				assessment</header>
							<clause id="H300C1D15445F4A939CDBEA5CC0734920"><enum>(i)</enum><header>In
				general</header><text>At the request of an eligible requestor, the Commission
				shall conduct an independent safety assessment in accordance with the
				independent safety assessment procedure developed under paragraph (1) if the
				licensee has—</text>
								<subclause id="H6749CF97F81D4ADE871C196C41E17EDB"><enum>(I)</enum><text>applied to the
				Commission for—</text>
									<item id="HD18E20BC567446A6AA40C88D03CC8372"><enum>(aa)</enum><text>an
				extension of the operating license of the licensee; or</text>
									</item><item id="H2E3AB3286D3B41AB9777F68B31A94F3C"><enum>(bb)</enum><text>approval of an
				extended power uprate for the licensee; or</text>
									</item></subclause><subclause id="HC0410C7EDCF840D690D8CB009F20CB01"><enum>(II)</enum><text>during any 5-year
				period, received, under the reactor oversight process of the Commission, 2 or
				more greater-than-green inspection findings.</text>
								</subclause></clause><clause id="HEF02363E1BC84580B38514FB1B97B059"><enum>(ii)</enum><header>Conduct of
				assessment</header><text>The Commission shall conduct an assessment requested
				by an eligible requestor under clause (i) not later than 18 months after the
				date on which the eligible requestor requested the assessment.</text>
							</clause></subparagraph></paragraph><paragraph id="HCFADE2D28E384E169446AC21C05E7794"><enum>(3)</enum><header>Inspection of
				facility</header>
						<subparagraph id="H3028CE96DC4F44E8A2905015A0937086"><enum>(A)</enum><header>In
				general</header><text>In conducting an independent safety assessment under
				paragraph (2)(B), the Commission shall inspect the design, construction,
				maintenance, and operational safety performance of the facility of the
				licensee.</text>
						</subparagraph><subparagraph id="HA618F7F673454E009DBF9F1775A1A71C"><enum>(B)</enum><header>Scope of
				inspection</header><text>An inspection of a facility of a licensee conducted
				under subparagraph (A) shall—</text>
							<clause id="H6BA7DD9C1160431297B15D19FAF99B06"><enum>(i)</enum><text>be
				at least equal in scope, depth, and breadth to the independent safety
				assessment conducted in 1996 by the Commission of the Maine Yankee Nuclear
				Power Plant, located in Wiscasset, Maine; and</text>
							</clause><clause id="H46149ED154E0453DA6EB1D006F58A83C"><enum>(ii)</enum><text>include an
				examination of the systems of the facility of the licensee, including—</text>
								<subclause id="H3D61794D8DF442FEAD004D70FD1257BD"><enum>(I)</enum><text>the reactor
				containment systems;</text>
								</subclause><subclause id="H57238011306E43EA9DA8BDD71DC8D800"><enum>(II)</enum><text>the reactor
				emergency core cooling systems;</text>
								</subclause><subclause id="HF97BDE7755EB48B1A9CA16EBBB1CC9C2"><enum>(III)</enum><text>the control room
				and containment ventilation systems;</text>
								</subclause><subclause id="H24ABE704265A4E1F8E97709F2CF600D5"><enum>(IV)</enum><text>the electrical
				system (including testing of relevant transients);</text>
								</subclause><subclause id="HDACA4B8ED9EF43A281004F18776FD327"><enum>(V)</enum><text>the condensate and
				feedwater systems;</text>
								</subclause><subclause id="HD6FFFC69C70D488EB078ABEB8BC3AA19"><enum>(VI)</enum><text>the spent fuel
				storage systems;</text>
								</subclause><subclause id="H13C91D52B165451CBC2396579E46C3C1"><enum>(VII)</enum><text>any other system
				requested by the Governor of the State, or a public utility commission of the
				State, in which the facility of the licensee is located; and</text>
								</subclause><subclause id="H86A196C0FB45454D93C8A38268906595"><enum>(VIII)</enum><text>any other
				system identified by a majority of the members of an inspection team described
				in paragraph (4).</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H512CA5F995554E26B886EF93D1673F1C"><enum>(4)</enum><header>Inspection
				teams</header>
						<subparagraph id="HDA4B8DBE6BC045C99DE69B62A96790B5"><enum>(A)</enum><header>In
				general</header><text>An independent safety assessment conducted under
				paragraph (2)(B) shall be conducted by an inspection team.</text>
						</subparagraph><subparagraph id="HA26EBDB0B7784D2793528B8441A32792"><enum>(B)</enum><header>Composition</header><text>An
				inspection team shall be composed of not less than 25 members, of whom—</text>
							<clause id="HA8084C77E67C4F86B2F872B992AEFFB6"><enum>(i)</enum><text>not less than 16
				members shall be—</text>
								<subclause id="H94AC3EF816F94AA888F940F680B65539"><enum>(I)</enum><text>employees of the
				Commission; and</text>
								</subclause><subclause id="H66C80A4F287244AB869BF325C0F2DA2D"><enum>(II)</enum><text>unaffiliated with
				the regional office of the Commission in the region in which the facility of
				the licensee is located;</text>
								</subclause></clause><clause id="H2BCFD927F1364F1F8196A4679DA7A7BD"><enum>(ii)</enum><text>not less than 6
				members shall be independent contractors who have not worked for, or at—</text>
								<subclause id="H5AB118C9A83B46A8A38DD06404BAC31B"><enum>(I)</enum><text>the facility of
				the licensee; or</text>
								</subclause><subclause id="HFB934CAFB5E04A55A18BDED300E5A6E7"><enum>(II)</enum><text>any other nuclear
				power plant owned or operated by the owner or operator of the facility of the
				licensee; and</text>
								</subclause></clause><clause id="H03C99420B0B0478DAEEA267B4F9EF4A8"><enum>(iii)</enum><text>not less than 3
				members shall be appointed by the eligible requestor.</text>
							</clause></subparagraph></paragraph><paragraph id="HE1639B54185C4C6FB8DEB4F9B907824C"><enum>(5)</enum><header>Report</header>
						<subparagraph id="HDB2D1C92F2D84228BB243BA9B723D84"><enum>(A)</enum><header>Preparation of
				preliminary report</header><text>Not later than 90 days after the date on which
				an inspection team completes an independent safety assessment of a facility of
				a licensee under paragraph (2)(B), the inspection team shall prepare a
				preliminary report describing the findings and recommendations of the
				inspection team.</text>
						</subparagraph><subparagraph id="H64B9FD60DCDB4607B519A2177D60AF87"><enum>(B)</enum><header>Availability of
				preliminary report</header><text>For a period of 90 days beginning on the date
				on which the inspection team completes a preliminary report prepared under
				subparagraph (A), the inspection team shall make available for review and
				comment by the public a copy of the preliminary report.</text>
						</subparagraph><subparagraph id="HA07B012BEA1C4B16BBBCA125E68DD9D8"><enum>(C)</enum><header>Consideration of
				comments</header><text>In preparing a final version of a preliminary report
				developed under subparagraph (A), the inspection team shall take into
				consideration any comments received from the public that are appropriate, as
				determined by the inspection team.</text>
						</subparagraph><subparagraph id="H4B0510FA90514FE299270019EF749709"><enum>(D)</enum><header>Submission of
				final version</header><text>Not later than 90 days after the date on which the
				period of review and public comment ends under subparagraph (B), the inspection
				team shall submit to the Commission a final version of the preliminary report
				developed under subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="H5BE7800814A74B17A0D7584F4C8630DD"><enum>(6)</enum><header>Affect on
				licensing actions</header><text>A final decision by the Commission of whether
				to extend an operating license, approve an extended power uprate, or continue
				to operate under a license at a facility of a licensee assessed under paragraph
				(2)(B) shall not be made until the later of the date on which—</text>
						<subparagraph id="H0DA2925EF7F54EDD80C5566B08C52C74"><enum>(A)</enum><text>the Commission has
				completed the independent safety assessment of the facility of the licensee;
				and</text>
						</subparagraph><subparagraph id="H3AC6717DED8D4506A857FCE9465F703"><enum>(B)</enum><text>the licensee has
				fully accepted and implemented each finding and recommendation of the report
				approved by the Commission relating to the independent safety assessment of the
				facility of the licensee submitted under paragraph (5)(D).</text>
						</subparagraph></paragraph><paragraph id="HCA2F8BABFC16418EBAE6BCADF52CCE11"><enum>(7)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this subsection $10,000,000 for each of fiscal years 2008 through 2012, to
				remain available until
				expended.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
