<legis-type>A BILL</legis-type> 
<official-title>To amend title 5, United States Code, to provide that a Member of Congress convicted of any of certain felony offenses shall not be eligible for retirement benefits based on that individual’s Member service, and for other purposes.</official-title>

<section section-type="section-one" id="HEEF1026815C74623A7B6E2D9CB1F1670" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Pension Forfeiture Act of 2007</short-title></quote>.</text></section> 
<section id="H6A6E3F46632B4C67B32C6660BF32AB8B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="H05612DBEF65D4D5796181198505F8C27"><enum>(1)</enum><text>Members of Congress pledge to uphold the Constitution and the laws of the United States;</text></paragraph> 
<paragraph id="H869522BF4A7D4A32B1A759AE74D10011"><enum>(2)</enum><text>Members of Congress are elected to serve in, and pledge to uphold, the public trust;</text></paragraph> 
<paragraph id="H0B868148B2624A6290BFD87837ADBE3B"><enum>(3)</enum><text>a breach of the public trust by a Member of Congress is a serious offense that should have serious consequences; and</text></paragraph> 
<paragraph id="H663264493DC64598B667FFF1CA72AD74"><enum>(4)</enum><text>taxpayers should not pay for the retirement benefits of Members of Congress who have breached the public trust.</text></paragraph></section> 
<section id="H1563EB4E1A8A480FA4BCDBF5E481AEC9"><enum>3.</enum><header>Forfeiture</header> 
<subsection id="H7BCD2CBD095B4035A4C1F8761CAD2786"><enum>(a)</enum><header>Civil Service Retirement System</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8332">Section 8332</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="HCBA2DF19A2234C42897F00AD851246DE"> 
<subsection id="H62D37B3907E845F084457B518B8781D6"><enum>(o)</enum> 
<paragraph display-inline="yes-display-inline" id="HDA6B86C1501A47F49DB30022DE166576"><enum>(1)</enum><text>Notwithstanding any other provision of this subchapter, the service of an individual convicted of an offense described in paragraph (2) shall not, if or to the extent rendered as a Member (irrespective of when rendered), be taken into account for purposes of this subchapter. Any such individual (or other person determined under section 8342(c), if applicable) shall be entitled to be paid so much of such individual’s lump-sum credit as is attributable to service to which the preceding sentence applies.</text></paragraph> 
<paragraph id="H5A2A9C445706411598879CDA849BDA4D" indent="up1"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="HF00B1AD7354E43EFA648F818DD1117D1"><enum>(A)</enum><text>An offense described in this paragraph is any offense described in subparagraph (B) for which the following apply:</text> 
<clause id="HB150D51571E54E7AA500C2488871763B" indent="up1"><enum>(i)</enum><text>The offense is committed by the individual (referred to in paragraph (1)) while a Member.</text></clause> 
<clause id="H12FA78CF23F94CD19EFC2C8EB400FBC6" indent="up1"><enum>(ii)</enum><text>The conduct on which the offense is based is directly related to the individual’s service as a Member.</text></clause> 
<clause id="H5823031747CA4D6A0002DA3C4DBDAC13" indent="up1"><enum>(iii)</enum><text>The offense is committed during the One Hundred Eleventh Congress or later.</text></clause></subparagraph> 
<subparagraph id="H7C84C3C664C74EC98B44CABA2EE32C" indent="up1"><enum>(B)</enum><text>The offenses described in this subparagraph are as follows:</text> 
<clause id="H88DD5628EA034CD6A8969BD0B720000"><enum>(i)</enum><text display-inline="yes-display-inline">An offense within the purview of section 201 (bribery of public officials and witnesses), 203 (compensation to Members of Congress, officers, and others in matters affecting the Government), 204 (practice in United States Court of Federal Claims or the United States Court of Appeals for the Federal Circuit by Members of Congress), 219 (officers and employees acting as agents of foreign principals), 286 (conspiracy to defraud the Government with respect to claims), 287 (false, fictitious or fraudulent claims), 371 (conspiracy to commit offense or to defraud the United States), 597 (expenditures to influence voting), 599 (promise of appointment by candidate), 602 (solicitation of political contributions), 606 (intimidation to secure political contributions), 607 (place of solicitation), 641 (public money, property or records), 1001 (statements or entries generally), 1341 (frauds and swindles), 1343 (fraud by wire, radio, or television), 1503 (influencing or injuring officer or juror), 1951 (interference with commerce by threats or violence), 1952 (interstate and foreign travel or transportation in aid of racketeering enterprises), or 1962 (prohibited activities) of title 18 or section 7201 (attempt to evade or defeat tax) of the Internal Revenue Code of 1986.</text></clause> 
<clause id="H11B28EB2E3BE4233909B4130B3CBE00"><enum>(ii)</enum><text>Perjury committed under the statutes of the United States in falsely denying the commission of an act which constitutes an offense within the purview of a statute named by clause (i).</text></clause> 
<clause id="H3E209038DEBD4CC18FBFA33B8067568E"><enum>(iii)</enum><text>Subornation of perjury committed in connection with the false denial of another individual as specified by clause (ii).</text></clause></subparagraph></paragraph> 
<paragraph id="HD202356169D44BFAB9F7F31594F2ABA9" indent="up1"><enum>(3)</enum><text>An individual convicted of an offense described in paragraph (2) shall not, after the date of the conviction, be eligible to participate in the retirement system under this subchapter while serving as a Member.</text></paragraph> 
<paragraph id="H20AFC1D0C29946A8B150A04EF01EBF" indent="up1"><enum>(4)</enum><text>The Office shall prescribe such regulations as may be necessary to carry out this subsection, including provisions under which interest on any lump-sum payment under the second sentence of paragraph (1) shall be limited in a manner similar to that specified in the last sentence of section 8316(b).</text></paragraph> 
<paragraph id="H0DC1DE52A14B40F1BED76E0778359CE8" indent="up1"><enum>(5)</enum><text>Nothing in this subsection shall restrict any authority under subchapter II or any other provision of law to deny or withhold benefits authorized by statute.</text></paragraph> 
<paragraph id="H0FDBDF0EAB6647EE9E4505E065296F2" indent="up1"><enum>(6)</enum><text>For purposes of this subsection, the term <term>Member</term> has the meaning given such term by section 2106, notwithstanding section 8331(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7ABC8F078BAA43ABA1FE9DF6002D0272"><enum>(b)</enum><header>Federal Employees’ Retirement System</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8411">Section 8411</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<subsection id="HF51E1108941440A2A220A38491925643"><enum>(i)</enum> 
<paragraph display-inline="yes-display-inline" id="HB0B56CEF29B94F0888832DFF72A63797"><enum>(1)</enum><text>Notwithstanding any other provision of this chapter, the service of an individual convicted of an offense described in paragraph (2) shall not, if or to the extent rendered as a Member (irrespective of when rendered), be taken into account for purposes of this chapter. Any such individual (or other person determined under section 8424(d), if applicable) shall be entitled to be paid so much of such individual’s lump-sum credit as is attributable to service to which the preceding sentence applies.</text></paragraph> 
<paragraph id="H8A96D5502E564D189BEC6DE6EC6FB22B" indent="up1"><enum>(2)</enum><text>An offense described in this paragraph is any offense described in section 8332(o)(2)(B) for which the following apply:</text> 
<subparagraph id="H0356EFF0980E49F789CEE9A6A2765400"><enum>(A)</enum><text>The offense is committed by the individual (referred to in paragraph (1)) while a Member.</text></subparagraph> 
<subparagraph id="H3FB56E8B4AAE470F861D89409F134CE0"><enum>(B)</enum><text>The conduct on which the offense is based is directly related to the individual’s service as a Member.</text></subparagraph> 
<subparagraph id="HA5F7C50105734A5A9805B62B59CBDAD"><enum>(C)</enum><text>The offense is committed during the One Hundred Eleventh Congress or later.</text></subparagraph></paragraph> 
<paragraph id="H26DBD1F622FF44A29B5982A86C8760B1" indent="up1"><enum>(3)</enum><text>An individual convicted of an offense described in paragraph (2) shall not, after the date of the conviction, be eligible to participate in the retirement system under this chapter while serving as a Member.</text></paragraph> 
<paragraph id="H93450806C059468FA103EA091D8C0066" indent="up1"><enum>(4)</enum><text>The Office shall prescribe such regulations as may be necessary to carry out this subsection, including provisions under which interest on any lump-sum payment under the second sentence of paragraph (1) shall be limited in a manner similar to that specified in the last sentence of section 8316(b).</text></paragraph> 
<paragraph id="H3A1E8EF6E0FB4580A1591E2413F48C45" indent="up1"><enum>(5)</enum><text>Nothing in this subsection shall restrict any authority under subchapter II of chapter 83 or any other provision of law to deny or withhold benefits authorized by statute.</text></paragraph> 
<paragraph id="HA226E03C4A8C43E88709B5C9C416DFAB" indent="up1"><enum>(6)</enum><text>For purposes of this subsection, the term <term>Member</term> has the meaning given such term by section 2106, notwithstanding section 8401(20).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H39EF2AF1A36D439B87BD48C1BBB8F85"><enum>(c)</enum><header>Thrift Savings Plan</header><text>Paragraph (5) of <external-xref legal-doc="usc" parsable-cite="usc/5/8432">section 8432(g)</external-xref> of title 5, United States Code, is amended by striking <quote>(5)</quote> and inserting <quote>(5)(A)</quote> and by adding at the end the following: </text> 
<quoted-block style="USC" id="HEAD10D91A5524F94B5129E16FD92CD15" display-inline="no-display-inline"> 
<subparagraph id="H357F0030804C4BD990375065B900D918" indent="up2"><enum>(B)</enum><text>Notwithstanding any other provision of law, contributions made by the Government under subsection (c) for the benefit of an individual and all earnings attributable to such contributions shall be forfeited—</text> 
<clause id="H024F28602BEB412AB6AEB5095F4E4589"><enum>(i)</enum><text>if any service rendered by such individual as a Member is made noncreditable as a result of a conviction described in section 8411(i); but only</text></clause> 
<clause id="H11D49DE722B64F2997C1007584A4601E"><enum>(ii)</enum><text>to the extent of any contributions attributable to periods of service rendered by such individual as a Member (as described in section 8411(i)(1)) and earnings thereon.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
