		<section id="H8D5D8556913A468EBF4B9C80498D7D43" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Same Number Act of
			 2007</short-title></quote>.</text>
		</section><section id="H752A32F10FB9486CA83051C1994C12A"><enum>2.</enum><header>Voice service
			 number portability</header>
			<subsection id="HC96CCEB6376B4C1F83F75E8C3D00D85F"><enum>(a)</enum><header>In
			 general</header><text>Title VII of the Communications Act of 1934 (47 U.S.C.
			 601 et seq.) is amended by inserting after section 714 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H43495406EEE64719BDDEBE1EE87BBEA3" style="OLC">
					<section id="H06A71D67EDF2490A9B4F02ED617EA3A0"><enum>715.</enum><header>Number
				portability</header>
						<subsection id="H5DD8CEB28E6745DB9D8795C28200B088"><enum>(a)</enum><header>In
				general</header><text>A provider of voice services has the duty to provide, to
				the extent technically feasible, number portability in accordance with
				requirements prescribed by the Commission.</text>
						</subsection><subsection id="H2E899B1E6971463E909547F7AEABCDBE"><enum>(b)</enum><header>Standards</header>
							<paragraph id="HB242502386C349198ED6E31ED8E1433"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Within 270 days after
				the date of enactment of the Same Number Act of 2007, to facilitate consumer
				choice among voice service providers the Commission shall establish number
				portability performance standards for voice service providers that, at a
				minimum—</text>
								<subparagraph id="HEFF4977BC03C4EC9B484EA5FD2EFDC00"><enum>(A)</enum><text>require voice
				service providers to port numbers in an expeditious and efficient manner that
				is technically feasible;</text>
								</subparagraph><subparagraph id="H75FB015D5E5843D69252D6B7D5EA28DE"><enum>(B)</enum><text>institute a
				uniform porting process in which the porting-out provider may require only the
				minimum information necessary to validate the requesting customer and complete
				the port;</text>
								</subparagraph><subparagraph id="H81BF23835175428A008C54D9AFB21BD"><enum>(C)</enum><text>prohibit the
				porting-out provider from deactivating and removing a number from its switch
				for at least forty-eight (48) hours after the scheduled port request is
				completed; and</text>
								</subparagraph><subparagraph id="HC9D2BC7CEFBC4706AC1D96976BED97A6"><enum>(D)</enum><text>encourage the
				reasonable automation of the porting process.</text>
								</subparagraph></paragraph><paragraph id="HF3C13DD45D48482584A8F2DC1465F043"><enum>(2)</enum><header>Flexibility</header><text>In
				adopting performance standards under paragraph (1), the Commission may—</text>
								<subparagraph id="H7B94F55865F74972BB6DFE45FA147640"><enum>(A)</enum><text>take into account
				differences between simple and complex ports; and</text>
								</subparagraph><subparagraph id="H33BBDFBF285F423FAAB4D82E75C481F3"><enum>(B)</enum><text>grant a waiver of
				such standards for any provider or class of providers that can show that such
				standards would result in unreasonable compliance costs for that provider or
				class, except that any such waiver shall be of limited duration.</text>
								</subparagraph></paragraph><paragraph id="H407C075C3D384C8FAD302808E7CF3729"><enum>(3)</enum><header>Public access to
				timeframes</header><text>The Commission shall make available to the public on
				its Internet website any standard timeframes established by the Commission
				under paragraph (1).</text>
							</paragraph></subsection><subsection id="HD528E52691134C2D847C98FE1BB62475"><enum>(c)</enum><header>Porting
				reporting</header>
							<paragraph id="H95D81B9614284ADDABE9B010C2A3DEB8"><enum>(1)</enum><header>Providers</header><text display-inline="yes-display-inline">Beginning 1 year after the date on which
				the Commission issues a final rule under subsection (b) establishing number
				portability performance standards for voice service providers, a voice service
				provider shall submit a report each year to the Commission on its number
				portability activity during the preceding 12 months, including a statement of
				the number of ports it failed to complete within the time required by the
				standards, and an explanation of the reason for such failures.</text>
							</paragraph><paragraph id="H5232A972A23C4007A9B45F977E857826"><enum>(2)</enum><header>Commission</header><text>Beginning
				1 year after the date on which the Commission issues the final rule under
				subsection (b), the Commission shall submit a report each year to the Senate
				Committee on Commerce, Science, and Transportation and the House of
				Representatives Committee on Energy and Commerce on the effectiveness and
				efficiency of the number portability performance standards for voice service
				providers established under this section.</text>
							</paragraph><paragraph id="H22ED764964474FFC8B347EEC3280D700"><enum>(3)</enum><header>Sunset</header><text>The
				requirements of this subsection shall cease to apply 60 months after the date
				on which the Commission issues such final rule.</text>
							</paragraph></subsection><subsection id="H4172B99DC3A446699D974C89928E63FF"><enum>(d)</enum><header>Numbering
				administration</header>
							<paragraph id="H9CDFE55C773D414093AD9723B21F2F2D"><enum>(1)</enum><header>Commission
				authority and jurisdiction</header><text display-inline="yes-display-inline">The Commission shall designate 1 or more
				impartial entities to administer telecommunications and voice service numbering
				and to ensure that numbers are available on an equitable basis. The Commission
				has exclusive jurisdiction of those portions of the North American Numbering
				Plan that pertain to the United States. Nothing in this subsection precludes
				the Commission from delegating to State Commission or other entities all or a
				portion of such jurisdiction.</text>
							</paragraph><paragraph id="H56FCF871A426491CA5A49208E6217CDC"><enum>(2)</enum><header>Costs</header><text>The
				costs of establishing numbering administration arrangements and number
				portability shall be borne by all voice service providers on a competitively
				neutral basis, as determined by the Commission.</text>
							</paragraph><paragraph id="HAA83DC76A0784B1196E746DB6DEC007"><enum>(3)</enum><header>Universal
				emergency telephone number</header><text>The Commission and any agency or
				entity to which the Commission has delegated authority under section 715(e)
				shall designate 9–1–1 as the universal emergency telephone number within the
				United States for reporting an emergency to appropriate authorities and
				requesting assistance. The designation shall apply to both wireline and
				wireless telephone service. In making the designation, the Commission (and any
				such agency or entity) shall provide appropriate transition periods for areas
				in which 9–1–1 is not in use as an emergency telephone number on the date of
				enactment of the Wireless Communications and Public Safety Act of 1999.</text>
							</paragraph></subsection><subsection id="HBF91C4B04117465A98BDF2DBB21DBF99"><enum>(e)</enum><header>Voice service
				defined</header><text>In this section, the term <term>voice service</term>
				means—</text>
							<paragraph id="H2BBFDC49D6E8492200134BF737928820"><enum>(1)</enum><text>a
				telecommunications service; or</text>
							</paragraph><paragraph id="H6420B068AB284443A6EE5E52AACEA4C0"><enum>(2)</enum><text>any service that
				is not a telecommunications service, but that otherwise is an IP-enabled voice
				service as defined in section 9.3 of the Commission’s regulations (47 C.F.R.
				9.3), as those regulations may be amended by the Commission from time to
				time.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB2A88523DB404DB3861570126C17D1F4"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 251 of the Communications Act of 1934 (47
			 U.S.C. 251) is amended—</text>
				<paragraph id="H18DFC31AE7544ED7A9B94E1942E3E7EF"><enum>(1)</enum><text>by striking
			 subsection (b)(2) and redesignating paragraphs (3), (4), and (5) of subsection
			 (b) as paragraphs (2), (3), and (4), respectively; and</text>
				</paragraph><paragraph id="HED7B8980DF024741BF942DE2923EA453"><enum>(2)</enum><text>by striking
			 subsection (e) and redesignating subsections (f), (g), (h), and (i) as
			 subsections (e), (f), (g), and (h), respectively.</text>
