<legis-type>AN ACT</legis-type> 
<official-title display="yes">To direct the United States Sentencing Commission to assure appropriate punishment enhancements for those involved in receiving stolen property where that property consists of grave markers of veterans, and for other purposes.</official-title>

<section id="H1FE3D14EA937433BAD099ED7DEB22061" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let Our Veterans Rest in Peace Act of 2008</short-title></quote>.</text></section>
<section id="H15411DCF5F4B4F1BAE1EA562FDD3B9A0"><enum>2.</enum><header>Findings and declaration</header><text display-inline="no-display-inline">The Congress finds and declares that—</text>
<paragraph id="HB64D2017E6EB42B6847CEB3300985313"><enum>(1)</enum><text>every cemetery should do all it can to protect each grave marker, headstone, monument, or other object, intended to permanently mark a grave;</text></paragraph>
<paragraph id="H18D93680324342159EA7AB341D70F6D0"><enum>(2)</enum><text>every citizen of the United States should be watchful and mindful of desecrations of any gravesite and report any such suspected behavior to local, State, or Federal law enforcement authorities; and</text></paragraph>
<paragraph id="H1ABECF7ACA604458896343FD744052BC"><enum>(3)</enum><text>all citizens, including veterans, have earned the right to rest in peace.</text></paragraph></section>
<section id="H61592E1798034512809FBF883484A935"><enum>3.</enum><header>Direction to the Sentencing Commission</header>
<subsection id="H1B13D0A6855C4CEFB677B114BA29DC9"><enum>(a)</enum><header>In general</header><text>Pursuant to its authority under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994</external-xref> of title 28, United States Code, the United States Sentencing Commission shall review and, if appropriate, amend the Federal sentencing guidelines and policy statements to ensure the guidelines and policy statements provide adequate sentencing enhancements for any offense involving the desecration, theft, or trafficking in, a grave marker, headstone, monument, or other object, intended to permanently mark a veteran’s grave.</text></subsection>
<subsection id="H6E872B378C3E414CB1AF49378CDF8226"><enum>(b)</enum><header>Commission Duties</header><text>In carrying out this section, the Sentencing Commission shall—</text>
<paragraph id="H7BC01434201C4E618D8CBCBB45ADE0E2"><enum>(1)</enum><text>ensure that the sentences, guidelines, and policy statements relating to offenders convicted of these offenses are appropriately severe and reasonably consistent with other relevant directives and other Federal sentencing guidelines and policy statements;</text></paragraph>
<paragraph id="HA41D5197631C42C3BF8221C1D8AEA19D"><enum>(2)</enum><text>make any necessary conforming changes to the Federal sentencing guidelines; and</text></paragraph>
<paragraph id="HFEE17C45D8D641B688D2A0DC196172C2"><enum>(3)</enum><text>assure that the guidelines adequately meet the purposes of sentencing as set forth in <external-xref legal-doc="usc" parsable-cite="usc/18/3553">section 3553(a)(2)</external-xref> of title 18, United States Code.</text></paragraph></subsection></section>
