		<official-title>To amend title III of the Americans with Disabilities Act
		  of 1990 to require, as a precondition to commencing a civil action with respect
		  to a place of public accomodation or a commercial facility, that an opportunity
		  be provided to correct alleged violations.</official-title>

		<section id="H2761D1AE3BB54FAE87908D9695FC86E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>ADA Notification Act of
			 2007</short-title></quote>.</text>
		</section><section id="H6E72EFA24BC04C26A7007600C5A420A4"><enum>2.</enum><header>Opportunity to
			 correct alleged violations of ADA as precondition to civil actions regarding
			 public accomodations and commercial facilities</header><text display-inline="no-display-inline">Section 308(a)(1) of the Americans with
			 Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12188">42 U.S.C. 12188(a)(1)</external-xref>) is amended—</text>
			<paragraph id="H700651F95A2D41F5AED15DABB26766C9"><enum>(1)</enum><text>by striking
			 <quote>(1) AVAILABILITY</quote> and all that follows through <quote>The
			 remedies and procedures set forth</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7B7ED93DD63A4627A4A024AC8DF0386" style="OLC">
					<paragraph id="H7D7EC74B68A3414FA2053EE85DE33BE8"><enum>(1)</enum><header>Availability of
				remedies and procedures</header>
						<subparagraph id="H25DCE76A44E64672A4004C284502653D"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraphs (B) and (C), the remedies and
				procedures set forth</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H230CBA2CF1A94D2A894456006423D968"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDC479A4D2DDF43C29322879DD7BA3DE" style="OLC">
					<subparagraph id="H6EE0C8B66C7641D4AA00A5C4BA986644"><enum>(B)</enum><header>Opportunity for
				correction of alleged violation</header><text>A State or Federal court shall
				not have jurisdiction in a civil action filed with the court under subparagraph
				(A), or under a provision of State law that conditions a violation of any of
				its provisions on a violation of this title, unless—</text>
						<clause id="H05DC0066F996482281B41C94DFA27209"><enum>(i)</enum><text>before filing the
				complaint, the plaintiff provided to the defendant written notice of the
				alleged violation, and the notice was provided by registered mail;</text>
						</clause><clause id="H6A50ED09082E41B000388CB53E5EEA18"><enum>(ii)</enum><text>the notice
				identified the specific facts that constitute the alleged violation, including
				identification of the location at which such violation occurred and the date on
				which such violation occurred;</text>
						</clause><clause id="HDAB3FBD821FF4F1AA2479E596D27EEAA"><enum>(iii)</enum><text display-inline="yes-display-inline">90 or more days has elapsed after the date
				on which such notice was provided;</text>
						</clause><clause id="H25FA5DD27A6E438A96E8063DDEF290B5"><enum>(iv)</enum><text display-inline="yes-display-inline">the notice informed the defendant that the
				civil action could not be commenced until the expiration of such 90-day period;
				and</text>
						</clause><clause id="H34D02D89D88E43D090AAB4E5DC005F37"><enum>(v)</enum><text display-inline="yes-display-inline">the complaint states that, as of the date
				on which the complaint is filed, the defendant has not corrected the alleged
				violation.</text>
						</clause></subparagraph><subparagraph id="HD2D5FEECAE8B44DC8F36E45329DEF7B6"><enum>(C)</enum><header>Exceptions</header><text>Subparagraph
				(B) shall not apply to civil actions brought under—</text>
						<clause id="HCB0FEF2C5A9048E6B080F04E9471176E"><enum>(i)</enum><text display-inline="yes-display-inline">Rule 65 of the Federal Rules of Civil
				Procedure requesting preliminary injunctive relief or temporary restraining
				orders; or</text>
						</clause><clause id="H05B632313B90423CB2F8703249405D58"><enum>(ii)</enum><text display-inline="yes-display-inline">State or local court rules requesting
				preliminary injunctive relief or temporary restraining
				orders.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
