		<section id="H631B3670779349B9B9B3BEDD4E3BC2DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prosecutorial Tools Improvement Act of
			 2007</short-title></quote>.</text>
		</section><section id="H33BEB4F674FB42D19D06CF5C1499BBC7" section-type="subsequent-section"><enum>2.</enum><header>Murder and other
			 violent crimes committed during and in relation to a drug trafficking
			 crime</header>
			<subsection id="HD6B15E9ADA404092BCC9A10406BF59D4"><enum>(a)</enum><header>In
			 General</header><text>Part D of the <act-name parsable-cite="CSA">Controlled
			 Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by adding at the
			 end the following:</text>

					<section id="HE6D9C9E98D514066952B002B003D8372"><enum>424.</enum><header>Murder and
				other violent crimes committed during and in relation to a drug trafficking
				crime</header>
						<subsection id="H724B413EDE0A4111B91E052C9FFF21CA"><enum>(a)</enum><header>In
				general</header><text>Whoever, during and in relation to any drug trafficking
				crime, knowingly commits any crime of violence against any individual that is
				an offense under Federal law punishable by imprisonment for more than 1 year or
				a felony offense under State law that is punishable by a term of imprisonment
				of 5 years or more, or threatens, attempts or conspires to do so, shall be
				punished by a fine under title 18, United States Code, and—</text>
							<paragraph display-inline="no-display-inline" id="H2668D4B5576442A79CB5B24C35BFCDC9"><enum>(1)</enum><text display-inline="yes-display-inline">for murder, kidnapping, conduct that would
				violate section 2241 if the conduct occurred in the special maritime and
				territorial jurisdiction of the United States, or maiming, by imprisonment for
				any term of years or for life;</text>
							</paragraph><paragraph id="H8D76857D702C41D39F515809B02F51C2"><enum>(2)</enum><text>for a serious
				violent felony (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/3559">section 3559</external-xref> of title 18, United States Code)
				other than a felony described in paragraph (1), by imprisonment for not more
				than 30 years;</text>
							</paragraph><paragraph id="H87924C90EFD74784A2C671B4E07973BD"><enum>(3)</enum><text>for a crime of
				violence that is not a serious violent felony, by imprisonment for not more
				than 20 years;</text>
							</paragraph><paragraph id="HE1AF41E315C041DEB9C43D3E1B59E5E"><enum>(4)</enum><text display-inline="yes-display-inline">for conspiring to commit a crime of
				violence, by imprisonment for not more than 10 years; and</text>
							</paragraph><paragraph id="H867F04BEB2724E86AC4243844E976DD4"><enum>(5)</enum><text display-inline="yes-display-inline">for threatening to commit a crime of
				violence, by imprisonment for not more than 8 years.</text>
							</paragraph></subsection><subsection id="H18B686147F504A48A84CA3CCD55500CC"><enum>(b)</enum><header>Venue</header><text>A
				prosecution for a violation of this section may be brought in—</text>
							<paragraph id="H0AD1B9129BFF40F4A1A67E981EF4E159"><enum>(1)</enum><text>the judicial
				district in which the murder or other crime of violence occurred; or</text>
							</paragraph><paragraph id="HA1DE33770F144CA7A4A38B86BB68BB00"><enum>(2)</enum><text>any judicial
				district in which the drug trafficking crime may be prosecuted.</text>
							</paragraph></subsection><subsection id="H6AF9501932A44DF497211B954FB79350"><enum>(c)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="H6C8DE66EC15A4056BD55B00079BFE38C"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>crime of violence</term>
				means an offense that has as an element the use of physical force against the
				person of another; and</text>
							</paragraph><paragraph id="HE3A4620346F3432DA1391650B523972F"><enum>(2)</enum><text>the term
				<term>drug trafficking crime</term> has the meaning given that term in section
				924(c)(2) of title 18, United States
				Code.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H178B6A280B5C42309704B4871818F3BC"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of contents for the Comprehensive Drug Abuse
			 Prevention and Control Act of 1970 (<external-xref legal-doc="public-law" parsable-cite="pl/91/513">Public Law 91–513</external-xref>; 84 Stat. 1236) is
			 amended by inserting after the item relating to section 423, the
			 following:</text>

					<toc committee-id="SSJU00" regeneration="no-regeneration">
						<toc-entry level="section">Sec. 424. Murder and other violent crimes
				committed during and in relation to a drug trafficking
				crime.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H53803120CE6B4666A3FD028BAFC2DA86"><enum>3.</enum><header>Expansion of
			 rebuttable presumption against release of persons charged with firearms
			 offenses</header><text display-inline="no-display-inline">Section 3142(e) of
			 title 18, United States Code, is amended in the matter following paragraph (3),
			 by inserting after <quote>that the person committed</quote> the following:
			 <quote>an offense under subsection (g)(1) (where the underlying conviction is a
			 drug trafficking crime or crime of violence (as those terms are defined in
			 section 924(c))), (g)(2), (g)(3), (g)(4), (g)(5), (g)(8), (g)(9), (g)(10), or
			 (g)(11) of section 922,</quote>.</text>
		</section><section id="HD57B98ED36B9441493C5EF2378334CB5"><enum>4.</enum><header>Statute of
			 limitations for violent crimes and terrorism offenses</header>
			<subsection id="H285469D9B1374B41B8541EC812CBC9E"><enum>(a)</enum><header>Statute of
			 limitations for violent crimes</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">Chapter 213</external-xref> of title 18, United
			 States Code, is amended by adding at the end the following:</text>
				<quoted-block committee-id="SSJU00" id="H84F4DD9D2F404616A1D751FE18C4FE9C" style="USC">
					<section id="HF9FF1C5F6CD74DDD864787F630AD55EA"><enum>3299A.</enum><header>Violent crime
				offenses</header><text display-inline="no-display-inline">No person shall be
				prosecuted, tried, or punished for any noncapital felony crime of violence,
				including any racketeering activity or gang crime which involves any crime of
				violence, unless the indictment is found or the information is instituted not
				later than 8 years after the date on which the alleged violation occurred or
				the continuing offense was
				completed.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC1A12D764696428C9F6FCBA8407227B8"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections at the beginning of chapter 213
			 of title 18, United States Code, is amended by adding at the end the
			 following:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H51CD77B009E340999411AEAB701935F0"><enum>(c)</enum><header>Statute of
			 limitations for terrorism offenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3286">Section 3286(a)</external-xref> of title 18,
			 United States Code, is amended—</text>
				<paragraph id="H9842840626F44926A0A9DA8CCC5ABAB"><enum>(1)</enum><text>in
			 the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">Eight-year</header-in-text></quote> and inserting
			 <quote><header-in-text level="subsection" style="USC">Ten-year</header-in-text></quote>; and</text>
				</paragraph><paragraph id="H5DA99CF0080543FB008582C717E779C"><enum>(2)</enum><text>in
			 the first sentence, by striking <quote>8 years</quote> and inserting <quote>10
			 years</quote>.</text>
