		<section id="HE9A772F82FC24515943670FE4E37B58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Weather Mitigation Research and
			 Technology Transfer Authorization Act of 2007</short-title></quote>.</text>
		</section><section id="HBA4A8A4455CF4890ABDAE914D7411FAC"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to develop and
			 implement a comprehensive and coordinated national weather mitigation policy
			 and a national cooperative Federal and State program of weather mitigation
			 research and development.</text>
		</section><section id="HEEBDF4D7E3D14B4186BDC82966E9E000"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H00F493ED41FF40F6BEF195993060FAA5"><enum>(1)</enum><header>Board</header><text>The
			 term <quote>Board</quote> means the Weather Mitigation Advisory and Research
			 Board.</text>
			</paragraph><paragraph id="HE073E6ECE467477FB82400994500598C"><enum>(2)</enum><header>Executive
			 director</header><text>The term <quote>Executive Director</quote> means the
			 Executive Director of the Weather Mitigation Advisory and Research
			 Board.</text>
			</paragraph><paragraph id="HF875E58CF92048F6A978801E0579B85B"><enum>(3)</enum><header>Research and
			 development</header><text>The term <quote>research and development</quote>
			 means theoretical analysis, exploration, experimentation, and the extension of
			 investigative findings and theories of scientific or technical nature into
			 practical application for experimental and demonstration purposes, including
			 the experimental production and testing of models, devices, equipment,
			 materials, and processes.</text>
			</paragraph><paragraph id="H5B17BE6417464EFFA57DBFB7E442DF2B"><enum>(4)</enum><header>Weather
			 mitigation</header><text>The term <quote>weather mitigation</quote> means
			 changing or controlling, or attempting to change or control, by artificial
			 methods the natural development of atmospheric cloud forms or precipitation
			 forms which occur in the troposphere. Examples include rain enhancement,
			 snowpack augmentation, and hail suppression.</text>
			</paragraph></section><section id="H6F702D49EE30412CA177975BC04F0000"><enum>4.</enum><header>Weather
			 mitigation advisory and research board established</header>
			<subsection id="H6D0405E02F724C04B7476DCDFB5927A8"><enum>(a)</enum><header>In
			 General</header><text>There is established in the Department of Commerce the
			 Weather Mitigation Advisory and Research Board.</text>
			</subsection><subsection id="H03CD6B813629468D98245B18E1E4119E"><enum>(b)</enum><header>Membership</header>
				<paragraph id="H126813EBB4584748BBF8BD9C2D3F71AF"><enum>(1)</enum><header>In
			 general</header><text>The Board shall consist of 11 members appointed by the
			 Secretary of Commerce, of whom—</text>
					<subparagraph id="H079306DAB1184F8380764F7CE8C475A0"><enum>(A)</enum><text>at least 1 shall
			 be a representative of the American Meteorological Society;</text>
					</subparagraph><subparagraph id="H5B2DD679C6844773BAF3DB8461AED8D4"><enum>(B)</enum><text>at least 1 shall
			 be a representative of the American Society of Civil Engineers;</text>
					</subparagraph><subparagraph id="H45EE9C25CD244A7AAD24924E783C742D"><enum>(C)</enum><text>at least 1 shall
			 be a representative of the National Academy of Sciences;</text>
					</subparagraph><subparagraph id="HE3AE98C681FC45AA89842CE6B83F3E32"><enum>(D)</enum><text>at least 1 shall
			 be a representative of the National Center for Atmospheric Research of the
			 National Science Foundation;</text>
					</subparagraph><subparagraph id="HDA29993B5527431EBEAD9F47F09F8BD6"><enum>(E)</enum><text>at least 2 shall
			 be representatives of the National Oceanic and Atmospheric Administration of
			 the Department of Commerce;</text>
					</subparagraph><subparagraph id="H282B68CC26464271A58712901852F8B6"><enum>(F)</enum><text>at least 1 shall
			 be a representative of institutions of higher education or research institutes;
			 and</text>
					</subparagraph><subparagraph id="H0C7549E51B024CC68C8F8EBF7050C5A7"><enum>(G)</enum><text>at least 1 shall
			 be a representative of a State that is currently supporting operational weather
			 mitigation projects.</text>
					</subparagraph></paragraph><paragraph id="HB0422365E7884EA59100CB6A14F3F52"><enum>(2)</enum><header>Tenure</header><text>A
			 member of the Board serves at the pleasure of the Secretary of Commerce.</text>
				</paragraph><paragraph id="H6C35F3C02E404CEEAF2F537508C713C"><enum>(3)</enum><header>Vacancies</header><text>Any
			 vacancy on the Board shall be filled in the same manner as the original
			 appointment.</text>
				</paragraph></subsection><subsection id="H307FC365C25C499990B6D3F382BF227B"><enum>(b)</enum><header>Advisory
			 Committees</header><text>The Board may establish advisory committees to advise
			 the Board and to make recommendations to the Board concerning legislation,
			 policies, administration, research, and other matters.</text>
			</subsection><subsection id="H37EE737CEC524AFBADE400FB99F4CF5"><enum>(c)</enum><header>Initial
			 Meeting</header><text>Not later than 30 days after the date on which all
			 members of the Board have been appointed, the Board shall hold its first
			 meeting.</text>
			</subsection><subsection id="HBA4916D893374311AAF7131409B3C97C"><enum>(d)</enum><header>Meetings</header><text>The
			 Board shall meet at the call of the Chair.</text>
			</subsection><subsection id="HB5B7C7EC4EF04FACB586D10096C78CF0"><enum>(e)</enum><header>Quorum</header><text>A
			 majority of the members of the Board shall constitute a quorum, but a lesser
			 number of members may hold hearings.</text>
			</subsection><subsection id="H4A004D7B3677458D0072FA27C3F47B43"><enum>(f)</enum><header>Chair and Vice
			 Chair</header><text>The Board shall select a Chair and Vice Chair from among
			 its members.</text>
			</subsection></section><section id="H4A1B25DA0FB24DECA9A7EF8457FBF800"><enum>5.</enum><header>Duties of the
			 board</header>
			<subsection id="H02AF6A9003C34414883703BD774BA08"><enum>(a)</enum><header>Promotion of
			 Research and Development</header><text>In order to assist in expanding the
			 theoretical and practical knowledge of weather mitigation, the Board shall
			 promote and fund research and development, studies, and investigations with
			 respect to—</text>
				<paragraph id="H0C6C966E6AB2439596FC00F5519000B5"><enum>(1)</enum><text>improved forecast
			 and decisionmaking technologies for weather mitigation operations, including
			 tailored computer workstations and software and new observation systems with
			 remote sensors; and</text>
				</paragraph><paragraph id="H1B0FA2E98AB24ED89100A1ED8E64E198"><enum>(2)</enum><text>assessments and
			 evaluations of the efficacy of weather mitigation, both purposeful (including
			 cloud-seeding operations) and inadvertent (including downwind effects and
			 anthropogenic effects).</text>
				</paragraph></subsection><subsection id="HB94FDDC50CFF4D31A56D9650C1D78496"><enum>(b)</enum><header>Financial
			 Assistance</header><text>Unless the use of the money is restricted or subject
			 to any limitations provided by law, the Board shall use amounts in the Weather
			 Mitigation Research and Development Fund—</text>
				<paragraph id="H87D347F5245B4D85006FBCF4EE02DD9C"><enum>(1)</enum><text>to pay its
			 expenses in the administration of this Act; and</text>
				</paragraph><paragraph id="H33F1E1184D2348989F11A331856D85B"><enum>(2)</enum><text>to
			 provide for research and development with respect to weather mitigation by
			 grants to, or contracts or cooperative arrangements with, public or private
			 agencies.</text>
				</paragraph></subsection><subsection id="H42D8A69C0CF140718CF4A453AB81A942"><enum>(c)</enum><header>Report</header><text>The
			 Board shall submit to the Secretary of Commerce biennially a report on its
			 findings and research results.</text>
			</subsection></section><section id="HEF4AED3442914A0EABD2530824729246"><enum>6.</enum><header>Powers of the
			 board</header>
			<subsection id="HB44C74F003384161AF8EDB6EC9D89C1F"><enum>(a)</enum><header>Studies,
			 Investigations, and Hearings</header><text>The Board may make any studies or
			 investigations, obtain any information, and hold any hearings necessary or
			 proper to administer or enforce this Act or any rules or orders issued under
			 this Act.</text>
			</subsection><subsection id="H3D74E167189D4BDDA8002987C1A0019C"><enum>(b)</enum><header>Personnel</header><text>The
			 Board may employ, as provided for in appropriations Acts, an Executive Director
			 and other support staff necessary to perform duties and functions under this
			 Act.</text>
			</subsection><subsection id="HAA51151E797D449381D1AF4CE04BAB5D"><enum>(c)</enum><header>Cooperation With
			 Other Agencies</header><text>The Board may cooperate with public or private
			 agencies to promote the purposes of this Act.</text>
			</subsection><subsection id="H8E47E4B1FF8C432698B01E367C2D7EBC"><enum>(d)</enum><header>Cooperative
			 Agreements</header><text>The Board may enter into cooperative agreements with
			 the head of any department or agency of the United States, an appropriate
			 official of any State or political subdivision of a State, or an appropriate
			 official of any private or public agency or organization for conducting weather
			 mitigation activities or cloud-seeding operations.</text>
			</subsection><subsection id="HAA4087B2FEF849ECB27C375E59E417CB"><enum>(e)</enum><header>Conduct and
			 Contracts for Research and Development</header><text>The Executive Director,
			 with the approval of the Board, may conduct and may contract for research and
			 development activities relating to the purpose described in section 2.</text>
			</subsection></section><section id="HF31AA430764F4EF386E2A92DF80005F"><enum>7.</enum><header>Cooperation with
			 the weather mitigation operations and research board</header><text display-inline="no-display-inline">The heads of the departments and agencies of
			 the United States and the heads of any other public or private agencies and
			 institutions that receive research funds from the United States shall, to the
			 extent possible, give full support and cooperation to the Board and to initiate
			 independent research and development programs that address weather
			 mitigations.</text>
		</section><section id="H58A2339D5D1748D7AF40D4F763862B05"><enum>8.</enum><header>Funding</header>
			<subsection id="H0A1737E5874F49428E6D008F954D3CAC"><enum>(a)</enum><header>In
			 General</header><text>There is established within the Treasury of the United
			 States the Weather Mitigation Research and Development Fund, which shall
			 consist of amounts appropriated pursuant to subsection (b) or received by the
			 Board under subsection (c).</text>
			</subsection><subsection id="HE1D6F387088F4AABA6AF2BDBB416B17"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Board for the purposes of carrying out this Act $10,000,000 for each of fiscal
			 years 2006 through 2015. Any sums appropriated under this subsection shall
			 remain available, without fiscal year limitation, until expended.</text>
			</subsection><subsection id="H78C64733E9E94546819290F73706DC60"><enum>(c)</enum><header>Gifts</header><text>The
			 Board may accept, use, and dispose of gifts or donations of services or
			 property.</text>
