<section id="H432E8726D67A4157A539007E057C98CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jackson Gulch Rehabilitation Act of 2008</short-title></quote>.</text> </section> 
<section id="H1220D21269EE4A1D0007663EED007C41"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HDCB0E3F171A14E1FB6FB859EC1F828B0"><enum>(1)</enum><header>Assessment</header><text>The term <quote>assessment</quote> means the engineering document that is—</text> 
<subparagraph id="HF4E21805041B480BA641CB845FC68B06"><enum>(A)</enum><text>entitled <quote>Jackson Gulch Inlet Canal Project, Jackson Gulch Outlet Canal Project, Jackson Gulch Operations Facilities Project: Condition Assessment and Recommendations for Rehabilitation</quote>;</text> </subparagraph> 
<subparagraph id="HC04448E441A043800077F417EE00257B"><enum>(B)</enum><text>dated February 2004; and</text> </subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H547F260BCC0D4D2898B0BBE566124DFC"><enum>(C)</enum><text>on file with the Bureau of Reclamation.</text> </subparagraph></paragraph> 
<paragraph id="H683C698022D54BDDB2D9CC98DC00AAB5"><enum>(2)</enum><header>District</header><text>The term <quote>District</quote> means the Mancos Water Conservancy District established under the Water Conservancy Act (Colo. Rev. Stat. 37–45–101 et seq.).</text> </paragraph> 
<paragraph id="H3782991C060349DAA92B1E94EC0690B9"><enum>(3)</enum><header>Project</header><text>The term <quote>Project</quote> means the Jackson Gulch rehabilitation project, a program for the rehabilitation of the Jackson Gulch Canal system and other infrastructure in the State, as described in the assessment.</text> </paragraph> 
<paragraph id="H7B5A917A558741F385009C8D24DE0212"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text> </paragraph> 
<paragraph id="H8FC367A3054548E29889C175FC53934C"><enum>(5)</enum><header>State</header><text>The term <quote>State</quote> means the State of Colorado.</text> </paragraph></section> 
<section id="HCF6971F26D2C4809A5BC4BB6B57371E"><enum>3.</enum><header>Authorization of Jackson Gulch Rehabilitation Project</header> 
<subsection id="H9752A61680704BABA676F9DF8FE047D7"><enum>(a)</enum><header>In general</header><text>Subject to the reimbursement requirement described in subsection (c), the Secretary shall pay the Federal share of the total cost of carrying out the Project.</text> </subsection> 
<subsection id="H1404EBB40D954EA6870037F2F8BCDFB5"><enum>(b)</enum><header>Use of existing information</header><text>In preparing any studies relating to the Project, the Secretary shall, to the maximum extent practicable, use existing studies, including engineering and resource information provided by, or at the direction of—</text> 
<paragraph id="H062CF33F6F3A49E800DD8938578224A6"><enum>(1)</enum><text>Federal, State, or local agencies; and</text> </paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H92E3C11AD559406CBCB2043C4366AD78"><enum>(2)</enum><text>the District.</text> </paragraph></subsection> 
<subsection id="H63579A003B294FB0863B9DD64E318597"><enum>(c)</enum><header>Reimbursement requirement</header> 
<paragraph id="H005A5DCE7BE64EFA96186C2998AE393C"><enum>(1)</enum><header>Amount</header><text>The Secretary shall recover from the District as reimbursable expenses the lesser of—</text> 
<subparagraph id="HEFB7957F2B9642EB901249B000999647"><enum>(A)</enum><text>the amount equal to 35 percent of the cost of the Project; or</text> </subparagraph> 
<subparagraph id="H0EB6FEDA487A46C6A3815F55218DE51B"><enum>(B)</enum><text>$2,900,000.</text> </subparagraph></paragraph> 
<paragraph id="HF8EBD2150A454C458BF5FFC68D89B92"><enum>(2)</enum><header>Manner</header><text>The Secretary shall recover reimbursable expenses under paragraph (1)—</text> 
<subparagraph id="H274CAA24D29D40D59B6EAE7529320000"><enum>(A)</enum><text>in a manner agreed to by the Secretary and the District;</text> </subparagraph> 
<subparagraph id="HBA524027CED24803BCFD08F7638F6460"><enum>(B)</enum><text>over a period of 15 years; and</text> </subparagraph> 
<subparagraph id="H8B32BF3EF4494986932C6DD37303E03E"><enum>(C)</enum><text>with no interest.</text> </subparagraph></paragraph> 
<paragraph id="H94F2172A40DA4B570032ABE78F239587"><enum>(3)</enum><header>Credit</header><text display-inline="yes-display-inline">In determining the exact amount of reimburseable expenses to be recovered from the District, the Secretary shall credit the District for any amounts it paid before the date of the enactment of this Act for engineering work and improvements directly associated with the Project.</text> </paragraph></subsection> 
<subsection id="H86E38DF61B8F406CBBA21C5AEBE2865"><enum>(d)</enum><header>Prohibition on Operation and Maintenance costs</header><text>The District shall be responsible for the operation and maintenance of any facility constructed or rehabilitated under this Act.</text> </subsection> 
<subsection id="H22BA3F2F0E6B4058BC9450A8D604F88"><enum>(e)</enum><header>Liability</header><text>The United States shall not be liable for damages of any kind arising out of any act, omission, or occurrence relating to a facility rehabilitated or constructed under this Act.</text> </subsection> 
<subsection id="H10B7DA0F16DE49A09108C080B42FC619"><enum>(f)</enum><header>Effect</header><text>An activity provided Federal funding under this Act shall not be considered a supplemental or additional benefit under—</text> 
<paragraph id="H4675A96C922A41F49B87D6DB0661A790"><enum>(1)</enum><text>the reclamation laws; or</text> </paragraph> 
<paragraph id="H6D2CBC6931F341FE002B8CC69E1EF0E9"><enum>(2)</enum><text>the Act of August 11, 1939 (<external-xref legal-doc="usc" parsable-cite="usc/16/590y">16 U.S.C. 590y et seq.</external-xref>).</text> </paragraph></subsection> 
<subsection id="HAA2F0BEC270144C987ADF725F5B1FA72"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to pay the Federal share of the total cost of carrying out the Project $8,250,000.</text> </subsection></section>
