		<official-title>To amend the Internal Revenue Code of 1986 to require the
		  use of Federally insured intermediaries for nonrecognition treatment on
		  like-kind exchanges involving cash to be used to acquire the replacement
		  property.</official-title>

		<section id="HC02960939E604044A17C29ADCD9BE825" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>1031
			 Regulation Act of 2007</quote>.</text>
		</section><section id="H0FDC80473A5643ECBA62D871FB024D9F"><enum>2.</enum><header>Federally insured
			 intermediaries required for like-kind exchanges involving cash to be used to
			 acquire replacement property</header>
			<subsection id="H9CC30DA4E77F497BBB8E85E888B11E24"><enum>(a)</enum><header>In
			 general</header><text>Subsection (a) section 1031 of the Internal Revenue Code
			 of 1986 (relating to exchange of property held for productive use or
			 investment) is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HC16645D16B2B4B20A8A5A200B398C823" style="OLC">
					<paragraph id="H75CC76AB0C014F01BE7604CD44E4D3F2"><enum>(4)</enum><header>Required use of
				federally insured intermediaries for exchanges involving cash to be used to
				acquire replacement property</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to any
				exchange as part of which cash is received by the taxpayer which is to be used
				to acquire like-kind property unless such cash is at all times before being so
				used held as a deposit in—</text>
						<subparagraph id="H868E4297D4CB4364B568580054A4514"><enum>(A)</enum><text display-inline="yes-display-inline">any insured depository institution (as
				defined in section 3 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C. 1813</external-xref>)),
				or</text>
						</subparagraph><subparagraph id="H67B0556E5C8A4174868F1C359D5393CF"><enum>(B)</enum><text>any insured credit
				union (as defined in section 101 of the Federal Credit Union Act (12 U.S.C.
				1752)).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA4E053700BCF429ABCBB368945E2C5E9"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to transfers
			 after the date of the enactment of this Act in taxable years ending after such
			 date.</text>
