<enum>I</enum><header>911 Services and IP–Enabled Voice Service Providers</header> <section id="HC26B624994594E56A9F4A0A1A763D212"><enum>101.</enum><header>Duty to provide 911 and E–911 service</header><text display-inline="no-display-inline">The Wireless Communications and Public Safety Act of 1999 is amended—</text> <paragraph id="H799928FDA763478487DBBE929CD1652F"><enum>(1)</enum><text>by redesignating section 6 (<external-xref legal-doc="usc" parsable-cite="usc/47/615b">47 U.S.C. 615b</external-xref>) as section 7;</text> </paragraph><paragraph id="H0E2F7CD3CF474B319CCCF43B4E2F5DD6"><enum>(2)</enum><text>by inserting after section 5 the following new section:</text> <quoted-block id="HCD9E0B40267A41FA8664E53D19EF16C9"> <section id="H6992DA8030D6494FB21DB23C5CC67985"><enum>6.</enum><header>Duty to provide 911 and E–911 service</header> <subsection id="H996152AB9AB049D09100A27EB1E1DCE4"><enum>(a)</enum><header>Duties</header><text>It shall be the duty of every IP-enabled voice service provider engaged in interstate communication to provide 911 service and E–911 service to its subscribers in accordance with the regulations of Federal Communications Commission (in this section referred to as the <quote>Commission</quote>), as such orders may be modified by the Commission from time to time.</text> </subsection><subsection id="H0D4E27A2B7584439B29354E38074E5F"><enum>(b)</enum><header>Access to 911 components</header> <paragraph id="H4F2A25C869014379A500FF115BFC9277"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">Within 90 days after the date of enactment of the <short-title>911 Modernization and Public Safety Act of 2007</short-title>, the Commission shall issue regulations granting IP-enabled voice service providers right of access to 911 components that are necessary to provide 911 service, including enhanced 911 service, on the same rates, terms, and conditions that are provided commercial mobile services providers. In promulgating the regulations, the Commission shall take into account any technical, network security, or information privacy issues that are specific to IP-enabled voice services.</text> </paragraph><paragraph id="H34E274A1742C410FB453F3DCD67F828C"><enum>(2)</enum><header>Delegation of enforcement to State commissions</header><text>The Commission may delegate authority to enforce the regulations issued under <internal-xref idref="H4F2A25C869014379A500FF115BFC9277" legis-path="6.(b)(1)">paragraph (1)</internal-xref> to State commissions or other State agencies or programs with jurisdiction over emergency communications.</text> </paragraph></subsection><subsection id="H0E1DB165B3474AC38865B8B1C41728C1"><enum>(c)</enum><header>Implementation</header> <paragraph id="H2CA04FC9C0EC40CAACEE2F9981A9396E"><enum>(1)</enum><header>Deadline</header><text>The Commission shall prescribe regulations to implement this section within 90 days after the date of enactment of the <short-title>911 Modernization and Public Safety Act of 2007</short-title>.</text> </paragraph><paragraph id="H144FDBAEFB904CE9A8F6125E4F5CD136"><enum>(2)</enum><header>Limitation</header><text>Nothing in this section shall be construed to permit the Commission to issue regulations that require or impose a specific technology or technology standard.</text> </paragraph><paragraph id="H3F5194F9BFFD43C3931DBCC96C11445"><enum>(3)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The Commission shall enforce this section as if this section was a part of the Communications Act of 1934. For purposes of this section, any violations of this section, or any regulations promulgated under this section, shall be considered to be a violation of the Communications Act of 1934 or a regulation promulgated under that Act, respectively.</text> </paragraph></subsection><subsection id="HE105975BEE9247BB9B40DCE7A6E03D3C"><enum>(d)</enum><header>State authority over fees</header> <paragraph id="H156BC6372EC241A29E5BCC767755003C"><enum>(1)</enum><header>Authority</header><text>A fee or charge applicable to commercial mobile services or IP-enabled voice services specifically designated by a State, political subdivision thereof, or Indian tribe for the support or implementation of 911 or E–911 services that are subject to or authorized by this Act, the Communications Act of 1934 (47 U.S.C. 151 et seq.), the <short-title>911 Modernization and Public Safety Act of 2007</short-title>, or any Federal Communications Commission regulation or order may be obligated or expended only in support of 911 and E–911 services, or enhancements of such services, or other emergency communications services as specified in the provision of State or local law adopting the fee or charge. For IP-enabled voice services, the fee or charge may not exceed the amount of any such fee or charge applicable to telecommunications services</text> </paragraph><paragraph id="HFA3FC5FBE6384BF28CA6CDCD5654A85"><enum>(2)</enum><header>Fee accountability report</header><text display-inline="yes-display-inline">To ensure efficiency, transparency, and accountability in the collection and expenditure of 911 fees, the Commission shall submit a report within 1 year after the date of enactment of the <short-title>911 Modernization and Public Safety Act of 2007</short-title>, and annually thereafter, to the Committee on Commerce, Science and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives detailing the status in each State of the collection and distribution of 911 fees, and including findings on the amount of revenues obligated or expended by each State or political subdivision thereof for any purpose other than the purpose for which any fee or charges are presented.</text> </paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="HF7583F1E8E6446178CF082008067D988"><enum>(3)</enum><text>in section 7 (as redesignated by <internal-xref idref="H799928FDA763478487DBBE929CD1652F" legis-path="101.(1)">paragraph (1) of this section</internal-xref>) by adding at the end the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="H01AE05AC98B54FC1AE85DFFA8FBDA000" style="OLC"> <paragraph id="H0FF9967F64DB47E2B51304BB481FFFCD"><enum>(7)</enum><header>IP-enabled voice service</header><text display-inline="yes-display-inline">The term <term>IP-enabled voice service</term> has the meaning given the term <term>interconnected VoIP service</term> by section 9.3 of the Commission’s regulation (47 CFR 9.3).</text> </paragraph><paragraph id="H5EF8473CA40844B4879BC0C888BC5B12"><enum>(8)</enum><header>Necessary 911 component</header><text display-inline="yes-display-inline">The term <term>necessary 911 component</term> means any equipment, network, databases (including automatic location information databases and master street address guides), interface, selective router, trunkline, non-dialable p-ANI numbers, or other related facility necessary as determined by the Commission for the delivery and completion of 911 or E–911 calls and information related to such calls.</text> </paragraph><paragraph id="H2B17449AADF642E8BE74E572D435B5F"><enum>(9)</enum><header>IP-enabled 911 services</header><text display-inline="yes-display-inline">The term <term>IP-enabled 911 service</term> means any 911 service provide by an IP-enabled voice service provider, including enhanced IP-enabled 911 service.</text> </paragraph><paragraph id="H10C2570FA45A4E0482AE36BBC723568"><enum>(10)</enum><header>Enhanced IP-enabled 911 services</header><text>The term <term>enhanced IP-enabled 911 service</term> means any enhanced 911 service so designated by the Federal Communications Commission in its Report and Order in WC Docket Nos. 04–36 and 05–196, or any successor proceeding.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section><section id="H6A82AA91509D48428EF3A6A281760CB"><enum>102.</enum><header>Migration to IP-enabled emergency network</header> <subsection id="HB01D2CEBE02A40C0BA815F402BCF69FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 158 of the National Telecommunications and Information Administration Organization Act (47 U.S.C. 942) is amended—</text> <paragraph id="HB1833A7AE8FA404000B416900048D8C"><enum>(1)</enum><text>in subsection (b)(1), by inserting before the period at the end the following: <quote>and for migration to an IP-enabled emergency network.</quote>;</text> </paragraph><paragraph id="HEE7E2F29898844969BEB154182D6BCC7"><enum>(2)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text> </paragraph><paragraph id="HA75B1D44D3FA46DFB2AA566876E7D5E"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H9D58B6818C25448A8D1C45F300559DF7" style="OLC"> <subsection id="HA0AB0A07D1E44762A639CD2FBEEAEB31"><enum>(d)</enum><header>Migration Plan Required</header> <paragraph id="HFFFDB334EA794635B1EC4575CFFCCF89"><enum>(1)</enum><header>National plan required</header><text>No more than 270 days after the date of the enactment of the <short-title>911 Modernization and Public Safety Act of 2007</short-title>, the Office shall develop and report to Congress on a national plan for migrating to a national IP-enabled emergency network capable of receiving and responding to all citizen activated emergency communications and improving information sharing among all emergency response entities.</text> </paragraph><paragraph id="H694C5AC0B8964F6A8E8713FBC94E1408"><enum>(2)</enum><header>Contents of plan</header><text>The plan required by <internal-xref idref="HFFFDB334EA794635B1EC4575CFFCCF89" legis-path="(d)(1)">paragraph (1)</internal-xref> shall—</text> <subparagraph id="H6FFC2EB402694A72B1DC6001AEC98B17"><enum>(A)</enum><text>outline the potential benefits of such a migration;</text> </subparagraph><subparagraph id="H9A8E7D0BAEB3483382788DC14B9E35D3"><enum>(B)</enum><text>identify barriers that must be overcome and funding mechanisms to address those barriers;</text> </subparagraph><subparagraph id="H3B260D21D31F4921BA931870076B131C"><enum>(C)</enum><text>include a proposed timetable, an outline of costs, and potential savings;</text> </subparagraph><subparagraph id="H2656CE9DF7BE41EE8189B486DE77091D"><enum>(D)</enum><text>provide specific legislative language, if necessary, for achieving the plan;</text> </subparagraph><subparagraph id="HEB7D4D79513B41E995379545EA965CA"><enum>(E)</enum><text>provide recommendations on any legislative changes, including updating definitions, to facilitate a national IP-enabled emergency network;</text> </subparagraph><subparagraph id="H7E0459B77801474F87B5046BAFA2692C"><enum>(F)</enum><text>assess, collect, and analyze the experiences of the PSAPs and related public safety authorities who are conducting trial deployments of IP-enabled emergency networks as of the date of enactment of the <short-title>911 Modernization and Public Safety Act of 2007</short-title>;</text> </subparagraph><subparagraph id="H9D99B684998D4CCE8798D308998C8408"><enum>(G)</enum><text display-inline="yes-display-inline">identify solutions for providing 911 and E–911 access to those with disabilities and needed steps to implement such solutions, including a recommended timeline; and</text> </subparagraph><subparagraph id="HC3B1D4BCACDF4A3D98BE08CDB29435F"><enum>(H)</enum><text>analyze efforts to provide automatic location and recommendations on needed regulatory or legislative changes that are necessary to achieve automatic location for E–911 purposes.</text> </subparagraph></paragraph><paragraph id="HF7DFDB5CB93A4F15BFE62864E7F71394"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the plan required by <internal-xref idref="HFFFDB334EA794635B1EC4575CFFCCF89" legis-path="(d)(1)">paragraph (1)</internal-xref>, the Office shall consult with representatives of the public safety community, groups representing those with disabilities, technology and telecommunications providers, IP-enabled voice service providers, Telecommunications Relay Service providers, and other emergency communications providers and others it deems appropriate.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HEFC62903F8684E6AB468E11847D87623"><enum>(b)</enum><header>Availability of PSAP information</header><text display-inline="yes-display-inline">The Federal Communications Commission may compile a list of public safety answering point contact information, selective router contact information, testing procedures, and classes and types of services supported by public safety answering points, or other information concerning necessary 911 components, for the purpose of assisting providers in complying with this section, and may make any portion of such information available to the public if such availability would improve public safety.</text> </subsection></section>

and</text> </subparagraph><subparagraph id="HC3B1D4BCACDF4A3D98BE08CDB29435F"><enum>(H)</enum><text>analyze efforts to provide automatic location and recommendations on needed regulatory or legislative changes that are necessary to achieve automatic location for E–911 purposes.</text> </subparagraph></paragraph><paragraph id="HF7DFDB5CB93A4F15BFE62864E7F71394"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the plan required by <internal-xref idref="HFFFDB334EA794635B1EC4575CFFCCF89" legis-path="(d)(1)">paragraph (1)</internal-xref>, the Office shall consult with representatives of the public safety community, groups representing those with disabilities, technology and telecommunications providers, IP-enabled voice service providers, Telecommunications Relay Service providers, and other emergency communications providers and others it deems appropriate.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HEFC62903F8684E6AB468E11847D87623"><enum>(b)</enum><header>Availability of PSAP information</header><text display-inline="yes-display-inline">The Federal Communications Commission may compile a list of public safety answering point contact information, selective router contact information, testing procedures, and classes and types of services supported by public safety answering points, or other information concerning necessary 911 components, for the purpose of assisting providers in complying with this section, and may make any portion of such information available to the public if such availability would improve public safety.</text> </subsection></section><enum>II</enum><header>Parity of Protection</header> <section id="HC396D4462CF543B0B606051219FA96E1"><enum>201.</enum><header>Liability</header> <subsection id="H510DE87484FA4FD0879E7EE3B03B7BFB"><enum>(a)</enum><header>Amendments</header><text>Section 4 of the Wireless Communications and Public Safety Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/47/615a">47 U.S.C. 615a</external-xref>) is amended—</text> <paragraph id="H8F538E16F25A481883247DE60052FC5C"><enum>(1)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Parity of protection for provision or use of wireless service</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Service provider parity of protection</header-in-text></quote>;</text> </paragraph><paragraph id="H1F46CD1AEFDC461C90D0710019CCE022"><enum>(2)</enum><text>in subsection (a)—</text> <subparagraph id="HC4C7FF6156D04F668D6567B300CBC5F7"><enum>(A)</enum><text>by striking <quote>wireless carrier,</quote> and inserting <quote>wireless carrier, IP-enabled voice service provider, or other emergency communications provider,</quote>;</text> </subparagraph><subparagraph id="H86C5D09EA425483691ADEA0D606CBBE"><enum>(B)</enum><text>by striking <quote>its officers</quote> the first place it appears and inserting <quote>their officers</quote>;</text> </subparagraph><subparagraph id="H52AB215BF45C409C9FBF9681992B79DF"><enum>(C)</enum><text>by striking <quote>emergency calls or emergency services</quote> and inserting <quote>emergency calls, emergency services, or other emergency communications services</quote>;</text> </subparagraph></paragraph><paragraph id="HF129168FDA5541B1B571447E196466ED"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph id="H9E15A1D2905A4991B68C1BDFD200DF40"><enum>(A)</enum><text>by striking <quote>using wireless 9–1–1 service shall</quote> and inserting <quote>using wireless 9–1–1 service, or making 9–1–1 communications via IP-enabled voice service or other emergency communications service, shall</quote>; and</text> </subparagraph><subparagraph id="HD6583B54166D4A8DAAC90492FF4E611D"><enum>(B)</enum><text>by striking <quote>that is not wireless</quote> and inserting <quote>that is not via wireless 9–1–1 service, IP-enabled voice service, or other emergency communications service</quote>; and</text> </subparagraph></paragraph><paragraph id="H0EE2B15B90464C8190CB1F6794F24254"><enum>(4)</enum><text>in subsection (c)—</text> <subparagraph id="H3DF8D9383BF947508FD0C246A73F7BB5"><enum>(A)</enum><text>by striking <quote>wireless 9–1–1 communications, a PSAP</quote> and inserting <quote>9–1–1 communications via wireless 9–1–1 service, IP-enabled voice service, or other emergency communications service, a PSAP</quote>; and</text> </subparagraph><subparagraph display-inline="no-display-inline" id="HED69AFDED6984C19B4A83F3F67B1ED3D"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>that are not wireless</quote> and inserting <quote>that are not via wireless 9–1–1 service, IP-enabled voice service, or other emergency communications service</quote>.</text> </subparagraph></paragraph></subsection><subsection id="HA09070591539433E00A13234BD206833"><enum>(b)</enum><header>Definition</header><text>Section 7 of the Wireless Communications and Public Safety Act of 1999 (as redesignated by <internal-xref idref="H799928FDA763478487DBBE929CD1652F" legis-path="z:101.(1)">section 101(1) of this Act</internal-xref>) is further amended by adding at the end the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="HC502DD391CD14045BB5F77BF8E1325E2" style="OLC"> <paragraph id="H89DAA668F6E245F99E6DE7296C3BD876"><enum>(11)</enum><header>Other emergency communications service</header><text display-inline="yes-display-inline">The term <term>other emergency communications service</term> means the provision of emergency information to a public safety answering point via wire or radio communications, and may include 911 and enhanced 911 services.</text> </paragraph><paragraph id="HB6743B9A771544FB88971F9DA1F3B6A9"><enum>(12)</enum><header>Other emergency communications service provider</header><text>The term <term>other emergency communications service provider</term> means—</text> <subparagraph id="H6C9FD209D4AA41C8A3BEA2AFC2E78C22"><enum>(A)</enum><text>an entity other than a local exchange carrier, wireless carrier, or an IP-enabled voice service provider that is required by the Commission consistent with the Commission’s authority under the Communications Act of 1934 to provide other emergency communications services; or</text> </subparagraph><subparagraph id="HCA39272ADB804514BD75AEEF86000965"><enum>(B)</enum><text>in the absence of a Commission requirement as described in subsection 8(A), an entity that voluntarily elects to provide other emergency communications services and is specifically authorized by the appropriate local or State 911 governing authority to provide other emergency communications services.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section><enum>III</enum><header>Authority to Provide Customer Information for 911 Purposes</header> <section id="HC02D4FE61E894B95B91DC62F313F1BE8"><enum>301.</enum><header>Authority to provide customer information</header><text display-inline="no-display-inline">Section 222 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>) is amended—</text> <paragraph id="H24BB4F9B94B74BBB9DBE27DE9C4BD9E"><enum>(1)</enum><text>by inserting <quote>or the user of an IP-enabled voice service (such as the term is defined section 7 of the Wireless Communications and Public Safety Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/47/615b">47 U.S.C. 615b</external-xref>))</quote> after <quote>section 332(d))</quote> each place it appears in subsections (d)(4) and (f)(1);</text> </paragraph><paragraph id="HBCF78F10FBE443079B537DE62EFBA7E0"><enum>(2)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">wireless</header-in-text></quote> in the heading of subsection (f); and</text> </paragraph><paragraph id="HAD11A05A22FD4B8396D5DAB25604FFE9"><enum>(3)</enum><text>in subsection (g)—</text> <subparagraph id="HA47077F4BF6D46E78596F70059E3587"><enum>(A)</enum><text>by inserting <quote>or a provider of IP-enabled voice service (as such term is defined in section 7 of the Wireless Communications and Public Safety Act of 1999 (47 U.S.C. 615b))</quote> after <quote>telephone exchange service</quote>;</text> </subparagraph><subparagraph id="H676D410E8DBC4C179B2B86A2FF5BEDC6"><enum>(B)</enum><text>by striking <quote>Notwithstanding subsections (b)</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HC119F6097CE944F8BB785E807C69E49" style="OLC"> <paragraph id="H8799622365514AE688A22774D033C8E6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsections (b)</text> </paragraph><after-quoted-block>; and.</after-quoted-block></quoted-block> </subparagraph><subparagraph id="H8C59D00582674DE6B0A22484D52F8F2B"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="H5A562261B6A74EF3ACEFD5B1EEB59CE" style="OLC"> <paragraph id="HA6891FDCB76544ABA5395DEB6BC392C4"><enum>(2)</enum><header>Use of automatic location information and master street address guides exclusively for emergency services</header><text display-inline="yes-display-inline">No telecommunications carrier or provider of IP-enabled voice service (as such term is defined in section 7 of the Wireless Communications and Public Safety Act of 1999 (<external-xref legal-doc="usc" parsable-cite="usc/47/615b">47 U.S.C. 615b</external-xref>)) that provides 911, E–911, or other emergency communications service, and no administrator of any database used for the purpose of facilitating the provision of emergency services, may use specific or aggregated information contained in or gathered from automatic location information databases and master street address guides that are utilized for the specific purpose of providing emergency services for any purpose other than providing emergency services.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></section>
