<official-title>To provide for a credit for employers of tipped employees in determining the minimum wage required in States that require employers to pay a minimum wage at a rate higher than the Federal rate.</official-title>

<section id="HE7B53801576641BE97DAFC1B3668BD8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Minimum Wage Fairness Act of 2007</short-title></quote>.</text></section> 
<section id="HE1B05C1E2DA6417286D8300635CCD054"><enum>2.</enum><header>Minimum Wage Tip Credit</header><text display-inline="no-display-inline">Section 3(m) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(m)</external-xref>) is amended—</text> 
<paragraph id="H9F6E4C9EEA6041A3A1DB74B027FAC91D"><enum>(1)</enum><text>in paragraph (2), by inserting before the period the following: <quote><italic>Provided,</italic> That the tips shall not be included as part of the wage paid to an employee to the extent they are excluded therefrom under the terms of a bona fide collective bargaining agreement applicable to the particular employee</quote>;</text></paragraph> 
<paragraph id="H1D784D9353B1417B97A35EB6F61BA9EB"><enum>(2)</enum><text>by striking <quote>(m) <quote>Wage</quote></quote> and inserting <quote>(m)(1) <quote>Wage</quote></quote>;</text></paragraph> 
<paragraph id="HB06F157F5E474809AF09C696F392E878"><enum>(3)</enum><text>by striking <quote>(1) the cash</quote> and inserting <quote>(A) the cash</quote>;</text></paragraph> 
<paragraph id="HE73526938CC54C439323E3BAB1CA00FA"><enum>(4)</enum><text>by striking <quote>(2) an additional</quote> and inserting <quote>(B) an additional</quote>; and</text></paragraph> 
<paragraph id="HE008961C1F434C85AEC592A5CF81C649"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text> 
<quoted-block style="traditional" id="H4269E4C63D7445489419F49E8B2712FD" display-inline="no-display-inline"> 
<paragraph id="HCF9B02500F584DCF009CEBB9BD1BDFE" indent="up1"><enum>(2)</enum><text>Notwithstanding any other provision of this Act, any State or political subdivision of a State which, on or after the date of enactment of the Minimum Wage Fairness Act of 2007, prohibits any portion of a tipped employee’s tips from being considered as wages in determining if such tipped employee has been paid the minimum wage rate, may not establish or enforce any such law, ordinance, regulation, or order with respect to tipped employees unless such law, ordinance, regulation, or order permits a tip credit in an amount not less than an amount equal to—</text> 
<subparagraph id="H2940B73B47F941A080F43BDF4DA611F6"><enum>(A)</enum><text>the cash wage paid such employee which is required under such law, ordinance, regulation, or order on the date of enactment of such Act; and</text></subparagraph> 
<subparagraph id="HFDDA2A7C8911432AB73C57D90F5A404"><enum>(B)</enum><text>an additional amount on account of tips received by such employee which amount is equal to the difference between such cash wage and the minimum wage rate in effect under such law, ordinance, regulation, or order or the minimum wage rate in effect under section 6, whichever is higher.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
