<section display-inline="no-display-inline" id="HB94746239A0D4C3695667F63C372B6F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Infrastructure Improvement Act of 2007</short-title></quote>.</text> </section>
<section id="HBD1F86578587420E9E55E270A200BA3C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="H6C7584BE3E7F427B8517F77C331C0099"><enum>(1)</enum><header>Acquisition</header><text>The term <term>acquisition</term> includes any necessary activities for siting a facility, equipment, structures, or rolling stock by purchase, lease-purchase, trade, or donation.</text> </paragraph>
<paragraph id="H816DAEE66DC044A49136AAE91D4E7423"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the National Commission on the Infrastructure of the United States established by section 3(a).</text> </paragraph>
<paragraph id="H39654FB225C8419680B00C87E0000F3"><enum>(3)</enum><header>Construction</header><text>The term <term>construction</term> means—</text> 
<subparagraph id="HF7A7C4CC537745A593C13D2F5D6440D6"><enum>(A)</enum><text>the design, planning, and erection of new infrastructure;</text> </subparagraph>
<subparagraph id="HD9AF5C489F53420789B37ED35DE2B54"><enum>(B)</enum><text>the expansion of existing infrastructure;</text> </subparagraph>
<subparagraph id="H6C4C7CE02DED4DE5A3FC8D9DC1C7E066"><enum>(C)</enum><text>the reconstruction of an infrastructure project at an existing site; and</text> </subparagraph>
<subparagraph id="H238E965619E641A69DED83D4BC04188"><enum>(D)</enum><text>the installation of initial or replacement infrastructure equipment.</text> </subparagraph></paragraph>
<paragraph id="HB48A458794BF421490D03C5000C132B6"><enum>(4)</enum><header>Infrastructure</header> 
<subparagraph id="HA943D5464B83424A95EC175C36E10091"><enum>(A)</enum><header>In general</header><text>The term <term>infrastructure</term> means a nonmilitary structure or facility and any equipment and any nonstructural elements associated with such a structure or facility.</text> </subparagraph>
<subparagraph id="HE7A2013BAA444E41B4C976BB2522BCDD"><enum>(B)</enum><header>Inclusions</header><text>The term <term>infrastructure</term> includes—</text> 
<clause id="H470A5FBE4AC94864AA39722B268F72AB"><enum>(i)</enum><text>a surface transportation facility (such as a road, bridge, highway, public transportation facility, and freight and passenger rail), as the Commission, in consultation with the National Surface Transportation Policy and Revenue Study Commission established by section 1909(b)(1) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (119 Stat. 1471), determines to be appropriate;</text> </clause>
<clause id="H6274D6D2398E4237B0F6DE72E4845835"><enum>(ii)</enum><text>a mass transit facility;</text> </clause>
<clause id="H57BFC317F1C34907A36726E9CC54C313"><enum>(iii)</enum><text>an airport or airway facility;</text> </clause>
<clause id="HF36BDB4BF74E4FE2AC4BF74545D360F3"><enum>(iv)</enum><text>a resource recovery facility;</text> </clause>
<clause id="H890851B9E0394BEB0014A03EC991BBA0"><enum>(v)</enum><text>a water supply and distribution system;</text> </clause>
<clause id="HBC17E28B8CFB4D3B9190D51392BB6BDF"><enum>(vi)</enum><text>a wastewater collection, conveyance, or treatment system and related facilities;</text> </clause>
<clause id="H4A4E15203AEE4DD9A8004E076E37D137"><enum>(vii)</enum><text>a stormwater treatment system to manage, reduce, treat, or reuse municipal stormwater;</text> </clause>
<clause id="H2FE3CEF1F3EF4A3DA71B8283BC8310F7"><enum>(viii)</enum><text>waterways, locks, dams, and associated facilities;</text> </clause>
<clause id="HCFC5611D8B684BAE908D09C9617CCBCF"><enum>(ix)</enum><text>a levee and any related flood damage reduction facility;</text> </clause>
<clause id="HDED248EFF88E4B5C8E00B966D975CEFC"><enum>(x)</enum><text>a dock or port; and</text> </clause>
<clause id="HCF4C0F0B69E2478586A31C1C8D01C804"><enum>(xi)</enum><text>a solid waste disposal facility.</text> </clause></subparagraph></paragraph>
<paragraph id="H96391E3E278B426FAD994C1B3C69ECB0"><enum>(5)</enum><header>Nonstructural elements</header><text>The term <term>nonstructural elements</term> includes—</text> 
<subparagraph id="H12647CA243C84F05967E7E2287331D3B"><enum>(A)</enum><text>any feature that preserves and restores a natural process, a landform (including a floodplain), a natural vegetated stream side buffer, wetland, or any other topographical feature that can slow, filter, and naturally store storm water runoff and flood waters;</text> </subparagraph>
<subparagraph id="HD0A87C0B075D419FACF98682C37889C8"><enum>(B)</enum><text>any natural design technique that percolates, filters, stores, evaporates, and detains water close to the source of the water; and</text> </subparagraph>
<subparagraph id="H1B876EFC7C584D41B72FD65BEA7B258D"><enum>(C)</enum><text>any feature that minimizes or disconnects impervious surfaces to slow runoff or allow precipitation to percolate.</text> </subparagraph></paragraph>
<paragraph id="HA76D7829278A4C7286424B69B100F210"><enum>(6)</enum><header>Maintenance</header><text>The term <term>maintenance</term> means any regularly scheduled activity, such as a routine repair, intended to ensure that infrastructure continues to operate efficiently and as intended.</text> </paragraph>
<paragraph id="H121F256F59784EAC977153590615ECE6"><enum>(7)</enum><header>Rehabilitation</header><text>The term <term>rehabilitation</term> means an action to extend the useful life or improve the effectiveness of existing infrastructure, including—</text> 
<subparagraph id="HAAC9FCBD6991475FA6BF6EBC3D6B35A3"><enum>(A)</enum><text>the correction of a deficiency;</text> </subparagraph>
<subparagraph id="H49DE079E7B514F42B9EABB9441EFBEA"><enum>(B)</enum><text>the modernization or replacement of equipment;</text> </subparagraph>
<subparagraph id="HBE778C8208A84462B221CAF147E13E25"><enum>(C)</enum><text>the modernization of, or replacement of parts for, rolling stock relating to infrastructure;</text> </subparagraph>
<subparagraph id="HB45F1B9AAFAD4E7084EA789506A00172"><enum>(D)</enum><text>the use of nonstructural elements; and</text> </subparagraph>
<subparagraph id="H3E129542EB604AC785AB40072A24F84"><enum>(E)</enum><text>the removal of infrastructure that is deteriorated or no longer useful.</text> </subparagraph></paragraph></section>
<section id="H23CA9E4ACE344752B1A8209FD80190EC"><enum>3.</enum><header>Establishment of commission</header> 
<subsection id="HC746A8CAA7CB4498B700A159CC49344E"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the <quote>National Commission on the Infrastructure of the United States</quote> to ensure that the infrastructure of the United States—</text> 
<paragraph id="H4F444135F5A24F6D8F64034CA8DCB14"><enum>(1)</enum><text>meets current and future demand;</text> </paragraph>
<paragraph id="H150F8034262F48B1B2944F39BFB36400"><enum>(2)</enum><text>facilitates economic growth;</text> </paragraph>
<paragraph id="HD042CA39D89646AAB6D8303D04A73536"><enum>(3)</enum><text>is maintained in a manner that ensures public safety; and</text> </paragraph>
<paragraph id="H13C3B1AE6901418F958F5846EEAC3932"><enum>(4)</enum><text>is developed or modified in a sustainable manner.</text> </paragraph></subsection>
<subsection id="H2832CA30E62C458E00DAECDFB69C05CD"><enum>(b)</enum><header>Membership</header> 
<paragraph id="H625E9E35B38B49C59F89DF5F92CEDE51"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 8 members, of whom—</text> 
<subparagraph id="HFA6BF582A7634E6800BDB6B40E15289"><enum>(A)</enum><text>2 members shall be appointed by the President;</text> </subparagraph>
<subparagraph id="HE59614652E394D12A481F20E6587100"><enum>(B)</enum><text>2 members shall be appointed by the Speaker of the House of Representatives;</text> </subparagraph>
<subparagraph id="H0CF9B16106FB41758632A0AEF0E3A0EF"><enum>(C)</enum><text>1 member shall be appointed by the minority leader of the House of Representatives;</text> </subparagraph>
<subparagraph id="H272062AFED22481C95E56F293DD12FAF"><enum>(D)</enum><text>2 members shall be appointed by the majority leader of the Senate; and</text> </subparagraph>
<subparagraph id="H4D52134C3D0247F496BC011402009500"><enum>(E)</enum><text>1 member shall be appointed by the minority leader of the Senate.</text> </subparagraph></paragraph>
<paragraph id="HEDBDADFC30B34FC0894E43E0F3F86169"><enum>(2)</enum><header>Qualifications</header><text>Each member of the Commission shall—</text> 
<subparagraph id="H30C75C83513A4546A141F800239B79DB"><enum>(A)</enum><text>have experience in one or more of the fields of economics, public administration, civil engineering, public works, and construction and related design professions, planning, public investment financing, environmental engineering, or water resources engineering; and</text> </subparagraph>
<subparagraph id="H6A0A1DEE0BE94114835832CF03A207FF"><enum>(B)</enum><text>represent a cross-section of geographical regions of the United States.</text> </subparagraph></paragraph>
<paragraph id="HBE533027652E438C8583C673D7151524"><enum>(3)</enum><header>Date of appointments</header><text>The members of the Commission shall be appointed under paragraph (1) not later than 90 days after the date of enactment of this Act.</text> </paragraph></subsection>
<subsection id="H4B2E8197C15C472BB6C53870797B9DED"><enum>(c)</enum><header>Term; vacancies</header> 
<paragraph id="HF82526FE86FD414BA76D973150ECAAA6"><enum>(1)</enum><header>Term</header><text>A member shall be appointed for the life of the Commission.</text> </paragraph>
<paragraph id="HB42BABEC2CBF42138F463D82F6752050"><enum>(2)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text> 
<subparagraph id="HD092816EAD1D4B16AD431474F81D6707"><enum>(A)</enum><text>shall not affect the powers of the Commission; and</text> </subparagraph>
<subparagraph id="H73810664A3064CCB89CB3F407BBD5E4"><enum>(B)</enum><text>shall be filled, not later than 30 days after the date on which the vacancy occurs, in the same manner as the original appointment was made.</text> </subparagraph></paragraph></subsection>
<subsection id="H9AF07E040926436EBCD5EC05C3F3254F"><enum>(d)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Commission have been appointed, the Commission shall hold the initial meeting of the Commission.</text> </subsection>
<subsection id="H9436CB46B11343DC8B15F54ED5F6E36"><enum>(e)</enum><header>Meetings</header><text>The Commission shall meet at the call of the chairperson or the request of the majority of the Commission members.</text> </subsection>
<subsection id="H9B686FD5FFEF437DBB809118BAFE6FFA"><enum>(f)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</text> </subsection>
<subsection id="H94D5E8B5F4394F1A8C26BC25181D33DD"><enum>(g)</enum><header>Chairperson and vice chairperson</header><text>The Commission shall select a chairperson and vice chairperson from among the members of the Commission.</text> </subsection></section>
<section id="H0BB63059364F4000A712C79DF0D97529"><enum>4.</enum><header>Duties</header> 
<subsection id="H56B14E89064448BB99AA59D64C03CAE3"><enum>(a)</enum><header>Study</header> 
<paragraph id="H97B540E752344BCDA47DEA74A14B3FB0"><enum>(1)</enum><header>In general</header><text>Not later than February 15, 2009, the Commission shall complete a study of all matters relating to the state of the infrastructure of the United States.</text> </paragraph>
<paragraph id="H1A3BA24A90984E959F9B9E563CEBB5CE"><enum>(2)</enum><header>Matters to be studied</header><text>In carrying out paragraph (1), the Commission shall study matters, such as—</text> 
<subparagraph id="H7E3159D94E724E089886F39512793E41"><enum>(A)</enum><text>the capacity of infrastructure to sustain current and anticipated economic development and competitiveness, including long-term economic growth and the potential return to the United States economy on investments in new infrastructure as opposed to investments in existing infrastructure;</text> </subparagraph>
<subparagraph id="HFAED7C03D3A54FE098E45A39142FE37"><enum>(B)</enum><text>the age and condition of infrastructure (including congestion and changes in the condition of that infrastructure as compared with preceding years);</text> </subparagraph>
<subparagraph id="HB1E4B62FA1464323BAEC3B6617312287"><enum>(C)</enum><text>the methods used to finance the construction, acquisition, rehabilitation, and maintenance of infrastructure (including general obligation bonds, tax-credit bonds, revenue bonds, user fees, excise taxes, direct governmental assistance, and private investment);</text> </subparagraph>
<subparagraph id="HAD8B29E66DCE45D191876978B89E5EEB"><enum>(D)</enum><text>any trends or innovations in methods used to finance the construction, acquisition, rehabilitation, and maintenance of infrastructure;</text> </subparagraph>
<subparagraph id="H54B908013AE64E399DEFE4ABBE84999E"><enum>(E)</enum><text>investment requirements, by type of infrastructure, that are necessary to maintain the current condition and performance of the infrastructure and the investment needed (adjusted for inflation and expressed in real dollars) to improve infrastructure in the future;</text> </subparagraph>
<subparagraph id="H650AB8D3376A4CC4AA709B9BCA71E586"><enum>(F)</enum><text>based on the current level of expenditure (calculated as a percentage of total expenditure and in constant dollars) by Federal, State, and local governments—</text> 
<clause id="H3D938A5EDA2F43B991B3DEB9F9F14543"><enum>(i)</enum><text>the projected amount of need the expenditures will meet 5, 15, 30, and 50 years after the date of enactment of this Act; and</text> </clause>
<clause id="H6576A75C0A2F45D38E4B75E800476CC1"><enum>(ii)</enum><text>the levels of investment requirements identified under subparagraph (E);</text> </clause></subparagraph>
<subparagraph id="HFDFD69C6DA5C4A56BAF93E20C198D0CD"><enum>(G)</enum><text>any trends or innovations in infrastructure procurement methods;</text> </subparagraph>
<subparagraph id="HF5547383AB6D42470068D2A404BC6EF"><enum>(H)</enum><text>any trends or innovations in construction methods or materials for infrastructure;</text> </subparagraph>
<subparagraph id="HA7C209C7166748E7B9E9FB37F333FA68"><enum>(I)</enum><text>the impact of local development patterns on demand for Federal funding of infrastructure;</text> </subparagraph>
<subparagraph id="HD18212EC23C54C978C113D00EA6DE8F7"><enum>(J)</enum><text>the impact of deferred maintenance; and</text> </subparagraph>
<subparagraph commented="no" id="H01B63570D71D4D199000F630525F2EB3"><enum>(K)</enum><text>the collateral impact of deteriorated infrastructure.</text> </subparagraph></paragraph></subsection>
<subsection id="H1CE5FB5BF09A417B9F7F8CC13036D0C2"><enum>(b)</enum><header>Recommendations</header><text>The Commission shall develop recommendations—</text> 
<paragraph id="HAF07F0EDE1404889B6AED9E2AD3276AC"><enum>(1)</enum><text>on a Federal infrastructure plan that will detail national infrastructure program priorities, including alternative methods of meeting national infrastructure investment needs to effectuate balanced economic development;</text> </paragraph>
<paragraph id="HB7AD495C24A2469FB1A87E2226D69315"><enum>(2)</enum><text>on infrastructure improvements and methods of delivering and providing for infrastructure facilities;</text> </paragraph>
<paragraph id="H4342C718BCFF4CD7B008494F7B5D7DA7"><enum>(3)</enum><text>for analysis or criteria and procedures that may be used by Federal agencies and State and local governments in—</text> 
<subparagraph id="H359FF240DE2A457400BEC7D0C11FBFA1"><enum>(A)</enum><text>inventorying existing and needed infrastructure improvements;</text> </subparagraph>
<subparagraph id="HDC951F44077541F700AE24FBBC26CAC"><enum>(B)</enum><text>assessing the condition of infrastructure improvements;</text> </subparagraph>
<subparagraph id="H057F901B7E67420C9360892B7335AFCA"><enum>(C)</enum><text>developing uniform criteria and procedures for use in conducting the inventories and assessments; and</text> </subparagraph>
<subparagraph id="HB11295709D5A429DB732DC82514E86E4"><enum>(D)</enum><text>maintaining publicly accessible data; and</text> </subparagraph></paragraph>
<paragraph id="HC7DAD11556CC4DA1BCA151A44B09D23F"><enum>(4)</enum><text>for proposed guidelines for the uniform reporting, by Federal agencies, of construction, acquisition, rehabilitation, and maintenance data with respect to infrastructure improvements.</text> </paragraph></subsection>
<subsection id="H940A549C3C5A44C6B0B81BD540B623D4"><enum>(c)</enum><header>Statement and recommendations</header><text>Not later than February 15, 2010, the Commission shall submit to Congress—</text> 
<paragraph id="H53881AF608EC4A4292167700FDBE6FF"><enum>(1)</enum><text>a detailed statement of the findings and conclusions of the Commission; and</text> </paragraph>
<paragraph id="H7620D8601ADD4A5000A9DB6F3E700D7"><enum>(2)</enum><text>the recommendations of the Commission under subsection (b), including recommendations for such legislation and administrative actions for 5-, 15-, 30-, and 50-year time periods as the Commission considers to be appropriate.</text> </paragraph></subsection></section>
<section id="H1C059746EB5445BC93CE95CFAA287183"><enum>5.</enum><header>Powers of the commission</header> 
<subsection id="HD92F03ADB5FA401EBFF045F5794DFE8B"><enum>(a)</enum><header>Hearings</header><text>The Commission shall hold such hearings, meet and act at such times and places, take such testimony, administer such oaths, and receive such evidence as the Commission considers advisable to carry out this Act.</text> </subsection>
<subsection id="HBAEEDA1642E447528B4F5147DE1289E8"><enum>(b)</enum><header>Information from Federal agencies</header> 
<paragraph id="H7211305881EB4E1295488027D524FDA3"><enum>(1)</enum><header>In general</header><text>The Commission may secure directly from a Federal agency such information as the Commission considers necessary to carry out this Act.</text> </paragraph>
<paragraph id="H8FB8E96F310A4E9C9FBD1DA43633AF72"><enum>(2)</enum><header>Provision of information</header><text>On request of the chairperson of the Commission, the head of the Federal agency shall provide the information to the Commission.</text> </paragraph></subsection>
<subsection id="H89DA8452338B41A3B051338592AD312"><enum>(c)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text> </subsection>
<subsection id="H191C42ACFD084B79A6359D37288F7474"><enum>(d)</enum><header>Contracts</header><text>The Commission may enter into contracts with other entities, including contracts under which one or more entities, with the guidance of the Commission, conduct the study required under section 4(a).</text> </subsection>
<subsection id="H005029C3E2EA493B96A01D25ED1DEEC5"><enum>(e)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</text> </subsection></section>
<section id="H8DE648FB2CF64F3AA92441F105B6C522"><enum>6.</enum><header>Commission personnel matters</header> 
<subsection id="H9AB26BFB9D024EA993EE62479CA8DA2F"><enum>(a)</enum><header>Compensation of members</header><text>A member of the Commission shall serve without pay, but shall be allowed a per diem allowance for travel expenses, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text> </subsection>
<subsection id="HEA1FF95028C24835B942015E852E8621"><enum>(b)</enum><header>Staff</header> 
<paragraph id="H3F8D648F24224C11985793F47B3081F2"><enum>(1)</enum><header>In general</header><text>The chairperson of the Commission may, without regard to the civil service laws, including regulations, appoint and terminate an executive director and such other additional personnel as are necessary to enable the Commission to perform the duties of the Commission.</text> </paragraph>
<paragraph id="H2F916C3957E74EDBB357A7921004BF74"><enum>(2)</enum><header>Confirmation of executive director</header><text>The employment of an executive director shall be subject to confirmation by a majority of the members of the Commission.</text> </paragraph>
<paragraph id="H3B5DBC1154884EF1AF85822BFC399250"><enum>(3)</enum><header>Compensation</header> 
<subparagraph id="H70159E95BA624AEBB5FB21F14249C07C"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the chairperson of the Commission may fix the compensation of the executive director and other personnel without regard to the provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates.</text> </subparagraph>
<subparagraph id="HD61A266EC332484DA3592E15951580D4"><enum>(B)</enum><header>Maximum rate of pay</header><text>In no event shall any employee of the Commission (other than the executive director) receive as compensation an amount in excess of the maximum rate of pay for Executive Level IV under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code.</text> </subparagraph></paragraph></subsection>
<subsection id="H83C2DFAB8B4F4AB3BD8DAC1E74CDBF96"><enum>(c)</enum><header>Detail of Federal government employees</header> 
<paragraph id="HF5BCDCB7C7EB4FF185E73B3A99CAD7E"><enum>(1)</enum><header>In general</header><text>An employee of the Federal Government may be detailed to the Commission without reimbursement.</text> </paragraph>
<paragraph id="H8FCFD23F05474090A5EC338685BB2D5D"><enum>(2)</enum><header>Civil service status</header><text>The detail of a Federal employee shall be without interruption or loss of civil service status or privilege.</text> </paragraph></subsection>
<subsection id="H10C139C1E2EA4701BA627F4637C3D097"><enum>(d)</enum><header>Procurement of temporary and intermittent services</header><text>On request of the Commission, the Secretary of the Army, acting through the Chief of Engineers, shall provide, on a reimbursable basis, such office space, supplies, equipment, and other support services to the Commission and staff of the Commission as are necessary for the Commission to carry out the duties of the Commission under this Act.</text> </subsection></section>
<section id="H5D864EA9A36C4B2AB09E00D665C5BD66"><enum>7.</enum><header>Reports</header> 
<subsection id="HECEAA3E034F24C97927042CDC832E046"><enum>(a)</enum><header>Interim reports</header><text>Not later than one year after the date of the initial meeting of the Commission, the Commission shall submit an interim report containing a detailed summary of the progress of the Commission, including meetings and hearings conducted during the interim period, to—</text> 
<paragraph id="H10CFA50748194284A29B00327698FAEF"><enum>(1)</enum><text>the President;</text> </paragraph>
<paragraph id="HCA446D254CB04FA7A9474F49D047E1CF"><enum>(2)</enum><text>the Committees on Transportation and Infrastructure and Natural Resources of the House of Representatives; and</text> </paragraph>
<paragraph id="HCCFAD6F3BB764EB695E58712DA3089FD"><enum>(3)</enum><text>the Committees on Environment and Public Works, Energy and Natural Resources, and Commerce, Science, and Transportation of the Senate.</text> </paragraph></subsection>
<subsection id="H930CCEC7C062445EBC72F632008F556E"><enum>(b)</enum><header>Final report</header><text>On termination of the Commission under section 9, the Commission shall submit a final report containing a detailed statement of the findings and conclusions of the Commission and recommendations for legislation and other policies to implement those findings and conclusions, to—</text> 
<paragraph id="H491CD1DA28E7421200E0836F46B660BF"><enum>(1)</enum><text>the President;</text> </paragraph>
<paragraph id="H3B3C5AC6E94040969FFE9D02D3754174"><enum>(2)</enum><text>the Committees on Transportation and Infrastructure and Natural Resources of the House of Representatives; and</text> </paragraph>
<paragraph id="H12E098BA388941D3BBF000F67FDCCACD"><enum>(3)</enum><text>the Committees on Environment and Public Works, Energy and Natural Resources, and Commerce, Science, and Transportation of the Senate.</text> </paragraph></subsection>
<subsection id="HB932094717334F25AE4BEDA5CE222BBE"><enum>(c)</enum><header>Transparency</header><text>A report submitted under subsection (a) or (b) shall be made available to the public electronically, in a user-friendly format, including on the Internet.</text> </subsection></section>
<section id="H967B5FF6FFDD459C8EB051207CEF7BE0"><enum>8.</enum><header>Funding</header><text display-inline="no-display-inline">For each of fiscal years 2008 through 2010, upon request by the Commission—</text> 
<paragraph id="HA9A13ED6CD4C464EB0C3A92C0CBD689"><enum>(1)</enum><text display-inline="yes-display-inline">using amounts made available to the Secretary of Transportation from any source or account (other than the Highway Trust Fund), the Secretary of Transportation shall transfer to the Commission $750,000 for use in carrying out this Act;</text> </paragraph>
<paragraph id="H3A0CDFDB38AD4AC492E274E8FBBF542"><enum>(2)</enum><text>using amounts from the general expenses account of the Corps of Engineers (other than amounts in that account made available through the Department of Defense), the Secretary of the Army, acting through the Chief of Engineers, shall transfer to the Commission $250,000 for use in carrying out this Act; and</text> </paragraph>
<paragraph id="H5AD89671CC8143B89561A534251D91C3"><enum>(3)</enum><text>the Administrator of the Environmental Protection Agency shall transfer to the Commission $250,000 for use in carrying out this Act.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H8A7343C066DD4208B6DA4253EE129F60" section-type="subsequent-section"><enum>9.</enum><header>Termination of commission</header><text display-inline="no-display-inline">The Commission shall terminate on September 30, 2010.</text> </section>
