		<section display-inline="no-display-inline" id="H5DE594A5AC624A149C00AFABB464EE7D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Family and Medical Leave
			 Act</short-title></quote>.</text>
		</section><section id="HC8C70D35C2514B779EE8166BB38CC6C5"><enum>2.</enum><header>Military family
			 and medical leave</header>
			<subsection id="HD0FE2B22F8774615B4DF91BC006CBAF6"><enum>(a)</enum><header>Definitions</header><text>Section
			 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended by
			 adding at the end the following:</text>
				<quoted-block id="HDCB691D5DDF848998E35BB63B9666E8B" style="OLC">
					<paragraph id="H335D2C032F024CF297E86C3296915082"><enum>(14)</enum><header>Active
				duty</header><text>The term <term>active duty</term> means duty under a call or
				order to active duty under a provision of law referred to in section
				101(a)(13)(B) of title 10, United States Code.</text>
					</paragraph><paragraph id="H8DEB0C137A3847E68648A239210013D7"><enum>(15)</enum><header>Covered
				servicemember</header><text>The term <term>covered servicemember</term> means a
				member of the Armed Forces, including a member of the National Guard or a
				Reserve, who is undergoing medical treatment, recuperation, or therapy, or is
				otherwise in medical hold or medical holdover status, for a serious injury or
				illness.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB3D577D1ED934033B8C657DD4560189D"><enum>(16)</enum><header>Medical hold or
				medical holdover status</header><text>The term <term>medical hold or medical
				holdover status</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H0BE7FB7AD0C74BA2B3BA4B60C1887CB9"><enum>(A)</enum><text>the status of a
				member of the Armed Forces, including a member of the National Guard or a
				Reserve, assigned or attached to a military hospital for medical care;
				and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB979785D1D1C4A48A9AFEFA3B0808866"><enum>(B)</enum><text>the status of a
				member of a reserve component of the Armed Forces who is separated, whether
				pre-deployment or post-deployment, from the member's unit while in need of
				health care based on a medical condition identified while the member is on
				active duty in the Armed Forces.</text>
						</subparagraph></paragraph><paragraph id="HAED84C49B0D34E1986A5E06447B041D3"><enum>(17)</enum><header>Serious injury
				or illness</header><text>The term <term>serious injury or illness</term>, in
				the case of a member of the Armed Forces, means an injury or illness incurred
				by the member in line of duty on active duty in the Armed Forces that may
				render the member medically unfit to perform the duties of the member’s office,
				grade, rank, or
				rating.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA59BE9DD22A34F91A5FBFFA43FB984A9"><enum>(b)</enum><header>Military family
			 and medical leave</header>
				<paragraph id="HE129970C62864B98B6F35885009934F6"><enum>(1)</enum><header>Entitlement to
			 leave</header><text>Section 102(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended
			 by adding at the end the following:</text>
					<quoted-block id="H4FF44D88E0934A11A7A47498E803C5A9" style="OLC">
						<paragraph id="H8D2B8B368F7D467500EFEEA83262DC15"><enum>(3)</enum><header>Military family
				and medical leave</header><text>Subject to section 103, an eligible employee
				shall be entitled to a total of 26 workweeks of leave during a 12-month period
				to care for a covered servicemember who is the spouse, son, daughter, or parent
				of the employee. The leave described in this paragraph shall only be available
				during a single 12-month period.</text>
						</paragraph><paragraph id="HBEC88456343048DDBEEC8C8244A000F9"><enum>(4)</enum><header>Combined leave
				total</header><text>During the single 12-month period described in paragraph
				(3), an eligible employee shall be entitled to a combined total of 26 workweeks
				of leave under paragraphs (1) and (3). Nothing in this paragraph shall be
				construed to limit the availability of leave under paragraph (1) during any
				other 12-month
				period.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3808415BB2D245F8AE22656F7B01EA10"><enum>(2)</enum><header>Schedule</header><text>Section
			 102(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)</external-xref>) is amended—</text>
					<subparagraph id="H537DD243ABFD4D85A3402BC18D05D8EC"><enum>(A)</enum><text>in paragraph (1),
			 in the second sentence—</text>
						<clause id="H737920873B0D4D928FCA8FF71C6789B"><enum>(i)</enum><text>by
			 striking <quote>section 103(b)(5)</quote> and inserting <quote>subsection
			 (b)(5) or (f) (as appropriate) of section 103</quote>; and</text>
						</clause><clause id="HF0D44F1494EE438784E6C5D881DFB81B"><enum>(ii)</enum><text>by
			 inserting <quote>or under subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>; and</text>
						</clause></subparagraph><subparagraph id="H69E66BAD029A4A11AA64D59DE130D802"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>or under subsection (a)(3)</quote> after <quote>subsection
			 (a)(1)</quote>.</text>
					</subparagraph></paragraph><paragraph id="H0F700A5FE4B14256BEAD385023225EBC"><enum>(3)</enum><header>Substitution of
			 paid leave</header><text>Section 102(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)</external-xref>) is
			 amended—</text>
					<subparagraph id="HA9E3F208D2B14CF0A5AC950069C7B027"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="HF0DF439924AC4B1285A9981D81852595"><enum>(i)</enum><text>by
			 inserting <quote>(or 26 workweeks in the case of leave provided under
			 subsection (a)(3))</quote> after <quote>12 workweeks</quote> the first place it
			 appears; and</text>
						</clause><clause id="H1DE9A5B2B6214B13ABA9A043BF5465BF"><enum>(ii)</enum><text>by
			 inserting <quote>(or 26 workweeks, as appropriate)</quote> after <quote>12
			 workweeks</quote> the second place it appears; and</text>
						</clause></subparagraph><subparagraph id="H1AD39F7381404E289200A0D924E0656B"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="H7750ADBA22B4426DA8DBBBA2208C3DED"><enum>(i)</enum><text>in
			 subparagraph (A), by adding at the end the following: <quote>An eligible
			 employee may elect, or an employer may require the employee, to substitute any
			 of the accrued paid vacation leave, personal leave, or family leave of the
			 employee for leave provided under subsection (a)(3) for any part of the 26-week
			 period of such leave under such subsection.</quote>; and</text>
						</clause><clause id="H0DB53A2087C4469CB82B1ED113C18530"><enum>(ii)</enum><text>in
			 subparagraph (B), by adding at the end the following: <quote>An eligible
			 employee may elect, or an employer may require the employee, to substitute any
			 of the accrued paid vacation leave, personal leave, or medical or sick leave of
			 the employee for leave provided under subsection (a)(3) for any part of the
			 26-week period of such leave under such subsection.</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="H9157B50715CF4DBF83DBA4D88160080"><enum>(4)</enum><header>Notice</header><text>Section
			 102(e)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)(2)</external-xref>) is amended by inserting <quote>or
			 under subsection (a)(3)</quote> after <quote>subsection (a)(1)</quote>.</text>
				</paragraph><paragraph id="HC2F29E2B28E348DCB83BB9591B7529AA"><enum>(5)</enum><header>Spouses employed
			 by same employer</header><text>Section 102(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(f)</external-xref>)
			 is amended—</text>
					<subparagraph id="HD38A5076EA1B4D30AB234224DF70FAB6"><enum>(A)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), and aligning the margins
			 of the subparagraphs with the margins of section 102(e)(2)(A);</text>
					</subparagraph><subparagraph id="H6CC984E70A6A4CFCBE7B8FE0D7EA3F79"><enum>(B)</enum><text>by striking
			 <quote>In any</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H83D21F3C95954BF495776DC41CB95196" style="OLC">
							<paragraph id="HB9D05E1007854CD988E56EDABAB1FCEB"><enum>(1)</enum><header>In
				general</header><text>In any</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H62FB9A57D4FF402394B7ED00EB03AB3E"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H3BC4F675347D4755A3D502FA30CFED6" style="OLC">
							<paragraph id="HFE82638F8A9E4E029221205F66C4F7FD"><enum>(2)</enum><header>Military family
				and medical leave</header>
								<subparagraph id="HE00CCCAAEDCA4F50B68D5E5597277BF7"><enum>(A)</enum><header>In
				general</header><text>The aggregate number of workweeks of leave to which both
				that husband and wife may be entitled under subsection (a) may be limited to 26
				workweeks during the single 12-month period described in subsection (a)(3) if
				the leave is—</text>
									<clause id="H4E29CCD3711049689C6834EF3188BCE1"><enum>(i)</enum><text>leave under
				subsection (a)(3); or</text>
									</clause><clause id="H8970641E35614EDD995C96CF235DE710"><enum>(ii)</enum><text>a
				combination of leave under subsection (a)(3) and leave described in paragraph
				(1).</text>
									</clause></subparagraph><subparagraph id="HB6E9B2F8A3504F32A7C4A6567CF19813"><enum>(B)</enum><header>Both limitations
				applicable</header><text>If the leave taken by the husband and wife includes
				leave described in paragraph (1), the limitation in paragraph (1) shall apply
				to the leave described in paragraph
				(1).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H35E9AD6748304CD899911D2682478075"><enum>(c)</enum><header>Certification</header><text>Section
			 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block id="H997443764C1049C395340011BB470078" style="OLC">
					<subsection id="H4008EAFB4CFF4F63B433AA2FEC42ABCB"><enum>(f)</enum><header>Certification
				for Military Family and Medical Leave</header><text>An employer may require
				that a request for leave under section 102(a)(3) be supported by a
				certification issued at such time and in such manner as the Secretary may by
				regulation
				prescribe.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7EAF829655954EFCBD3D54B25C81D281"><enum>(d)</enum><header>Failure To
			 return</header><text>Section 104(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is
			 amended—</text>
				<paragraph id="H6C7A1982D45642CDBCC19EEEE168B9D8"><enum>(1)</enum><text>in paragraph
			 (2)(B)(i), by inserting <quote>or under section 102(a)(3)</quote> before the
			 semicolon; and</text>
				</paragraph><paragraph id="HE1F17C0895A944089B112600E2A4F5E3"><enum>(2)</enum><text>in paragraph
			 (3)(A)—</text>
					<subparagraph id="H874B6B0D18A74B85B6F7599F4C63FDB"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HCED904A0FC584274BCF833A3D8205709"><enum>(B)</enum><text>in clause (ii), by
			 striking the period and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="HD92A739C15D544F481B4A21EEFF3B242"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H099AE4C6B77348F000ED07D8209B3CE7" style="OLC">
							<clause id="H3E2684D065B1468C9D09F3E7CF00DAC0"><enum>(iii)</enum><text>a certification
				issued by the health care provider of the son, daughter, spouse, or parent of
				the employee, as appropriate, in the case of an employee unable to return to
				work because of a condition specified in section
				102(a)(3).</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HAF5A25B3F5684C2DBEF866A60765B6E"><enum>(e)</enum><header>Enforcement</header><text>Section
			 107 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617</external-xref>) is amended, in subsection (a)(1)(A)(i)(II), by
			 inserting <quote>(or 26 weeks, in a case involving leave under section
			 102(a)(3))</quote> after <quote>12 weeks</quote>.</text>
			</subsection><subsection id="H6372F2A353854DABB3E95F39524EEA80"><enum>(f)</enum><header>Instructional
			 employees</header><text>Section 108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2618">29 U.S.C. 2618</external-xref>) is amended, in
			 subsections (c)(1), (d)(2), and (d)(3), by inserting <quote>or under section
			 102(a)(3)</quote> after <quote>section 102(a)(1)</quote>.</text>
