		</section><section id="ID8F2354551F2E420F818A36D72C0CDB68"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="ID726B25D5E64143B0B116726080A3333D"><enum>(1)</enum><text>update certain provisions
			 codified in title 46, United States Code, by <external-xref legal-doc="public-law" parsable-cite="pl/109/304">Public Law 109–304</external-xref>, to reflect
			 amendments enacted after the cutoff date specified in section 18(a) of that
			 law, which amendments were to provisions restated and repealed by that
			 law;</text>
			</paragraph><paragraph id="ID671C05C9B58A453C87C7E3D9641672C7"><enum>(2)</enum><text>improve certain
			 provisions codified by that law to reflect public comments submitted too late
			 to be reflected in that law; and</text>
			</paragraph><paragraph id="ID96F5D28B302B44C48F26DBBD2E5D0A8B"><enum>(3)</enum><text>correct technical errors
			 in that law.</text>
			</paragraph></section><section id="ID74E85EA3EE184F0CA4CB868EF5648B14"><enum>3.</enum><header>Personal injury to or
			 death of seamen</header>
			<subsection id="ID7624C66B4BFA4D679EDBA3B4C5343AC7"><enum>(a)</enum><header>Amendment</header><text>Section
			 30104 of title 46, United States Code, is amended by—</text>
				<paragraph id="id63E50DA70E034060B18E8993EA6FEAA2"><enum>(1)</enum><text>striking “(a)
			 <header-in-text level="subsection">Cause of Action.—</header-in-text>”;
			 and</text>
				</paragraph><paragraph id="id526A3AC4383746A3805C46B2D6451533"><enum>(2)</enum><text>by striking subsection
			 (b).</text>
				</paragraph></subsection><subsection id="IDCD3E551BA58E4E10A5F6E903968B85B7"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall be effective as
			 if included in the enactment of <external-xref legal-doc="public-law" parsable-cite="pl/109/304">Public Law 109–304</external-xref>.</text>

			 <enum-in-header>537</enum-in-header> based on <external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref></header>
			<subsection id="ID9C811401659447BE827FB473CA460668"><enum>(a)</enum><header>Amendments</header><text>Title
			 46, United States Code, is amended as follows:</text>
				<paragraph id="ID6F0EE247E324436F8E10DA39DAF6AA54"><enum>(1)</enum><text>Section 53701 is amended
			 by—</text>
					<subparagraph id="ID9D1A234A31B94E239FFA9A2254A81A3A"><enum>(A)</enum><text>redesignating paragraphs
			 (2)–(13) as paragraphs (3)–(14), respectively;</text>
					</subparagraph><subparagraph id="ID64A13108369E4A439CC66505D0134D15"><enum>(B)</enum><text>inserting after paragraph
			 (1) the following:</text>

				Vessels</header>
							<paragraph id="ID8D84983CD2A64A049AE652BF71DF8FF5"><enum>(1)</enum><header>Vessels</header><text>In
				guaranteeing or making a commitment to guarantee an obligation under this
				chapter, the Administrator shall give priority to—</text>
								<subparagraph id="IDF85DF34ECACA4EC88DDF617BDF8BFF0F"><enum>(A)</enum><text>a vessel that is
				otherwise eligible for a guarantee and is constructed with assistance under
				subtitle D of the Maritime Security Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/46/53101">46 U.S.C. 53101</external-xref> note);
				and</text>
								</subparagraph><subparagraph id="IDE602C0A52B904CA3AAE78644649B72EB"><enum>(B)</enum><text>after applying
				subparagraph (A), a vessel that is otherwise eligible for a guarantee and that
				the Secretary of Defense determines—</text>
									<clause id="IDAB06D549EF024E099EAEB34A55E0F61E"><enum>(i)</enum><text>is suitable for service
				as a naval auxiliary in time of war or national emergency; and</text>
									</clause><clause id="ID4F3B1541C1074CB9B96910F1E5A0A783"><enum>(ii)</enum><text>meets a shortfall in
				sealift capacity or capability.</text>
									</clause></subparagraph></paragraph><paragraph id="ID82410953FAFB4740AFED7812A4B17D89"><enum>(2)</enum><header>Time for
				determination</header><text>The Secretary of Defense shall determine whether a
				vessel satisfies paragraph (1)(B) not later than 30 days after receipt of a
				request from the Administrator for such a
				determination.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID4E1F7ADA57B94F0486900BE23638D64F"><enum>(3)</enum><text>Section 53707 is amended
			 in—</text>
					<subparagraph id="ID67658229E2C746E0BFEC3F0E293E82F9"><enum>(A)</enum><text>subsections (a) and (d),
			 by inserting <quote>or Administrator</quote> after <quote>Secretary</quote>
			 each place it appears;</text>
					</subparagraph><subparagraph id="ID05A70092728C4A519DB5607D1FB7DDDC"><enum>(B)</enum><text>subsection (b), by
			 striking <quote>Secretary of Transportation</quote> and inserting
			 <quote>Administrator</quote>;</text>
					</subparagraph><subparagraph id="ID146CC50B9892425896EBB521F8C1CBFE"><enum>(C)</enum><text>subsection (c), by
			 striking <quote>of Commerce</quote>; and</text>
					</subparagraph><subparagraph id="ID5929E8CAD06B433586F1F8865D79BAB0"><enum>(D)</enum><text>subsection (d)(2),
			 by—</text>
						<clause id="IDD7F1FA21BAA243C6A0D92890AC44C960"><enum>(i)</enum><text>inserting <quote>if the
			 Secretary or Administrator considers necessary,</quote> before <quote>the
			 waiver</quote>; and</text>
						</clause><clause id="ID713F2F72F32B470C902F76F55EBBD847"><enum>(ii)</enum><text>striking <quote>the
			 increased</quote> and inserting <quote>any significant increase
			 in</quote>.</text>

			 in—</text>

			 striking <quote>Secretary</quote> and <quote>Secretary of
			 Transportation</quote> each place they appear in the heading and in text and
			 inserting <quote>Administrator</quote>;</text>
					</subparagraph><subparagraph id="IDF7BC19F5CD89453695ACCC468D426047"><enum>(B)</enum><text>subsections (b) and (c),
			 by striking <quote>of Commerce</quote> each place it appears in a heading and
			 in text;</text>

			 <quote>financial structures, or other risk factors identified by the Secretary.
			 Any independent analysis conducted under this subsection shall be performed by
			 a party chosen by the Secretary.</quote> and inserting <quote>or financial
			 structures. A third party independent analysis conducted under this subsection
			 shall be performed by a private sector expert in assessing such risk factors
			 who is selected by the Secretary or Administrator.</quote>; and</text>
						</clause></subparagraph><subparagraph id="IDADBE67032CE14834BBA93FE1EE5624B2"><enum>(D)</enum><text>subsection (e),
			 by—</text>
						<clause id="IDCF0F4EA60F354A6494C9689763575336"><enum>(i)</enum><text>inserting <quote>or
			 Administrator</quote> after <quote>Secretary</quote> the first place it
			 appears; and</text>
						</clause><clause id="ID5ACF3F4C8EC645DC93B3A2084C25E1A4"><enum>(ii)</enum><text>striking
			 <quote>financial structures, or other risk factors identified by the
			 Secretary</quote> and inserting <quote>or financial structures</quote>.</text>
						</clause></subparagraph></paragraph><paragraph id="ID675EF35AE1C64E4D8AED23353F586A92"><enum>(5)</enum><text>Section 53710(b)(1) is
			 amended by striking <quote>Secretary’s</quote> and inserting
			 <quote>Administrator’s</quote>.</text>
				</paragraph><paragraph id="ID9A9137E79B144AF1995B4901CE073D34"><enum>(6)</enum><text>Section 53712(b) is
			 amended by striking the last sentence and inserting <quote>If the Secretary or
			 Administrator has waived a requirement under section 53707(d) of this title,
			 the loan agreement shall include requirements for additional payments,
			 collateral, or equity contributions to meet the waived requirement upon the
			 occurrence of verifiable conditions indicating that the obligor’s financial
			 condition enables the obligor to meet the waived requirement.</quote>.</text>
				</paragraph><paragraph id="IDE8F4EA400F95416FAA0743C1EFDCFDC8"><enum>(7)</enum><text>Subsections (c) and (d)
			 of section 53717 are amended by striking <quote>of Commerce</quote> each place
			 it appears in a heading and in text.</text>
				</paragraph><paragraph id="ID9BBBE35ABA8D435CB03EA3BC5E183BBA"><enum>(8)</enum><text>Section 53732(e)(2) is

			 46, United States Code, is amended as follows:</text>
				<paragraph id="ID70DFB94721084075862D06F032715C98"><enum>(1)</enum><text>Chapters 513 and 515 are
			 amended by striking <quote>Naval Reserve</quote> each place it appears in
			 analyses, headings, and text and inserting <quote>Navy Reserve</quote>.</text>
				</paragraph><paragraph id="IDFEAFC69E55974F21B17B00D17204B47E"><enum>(2)</enum><text>Section 51504(f) is
			 amended to read as follows:</text>

				amounts</header><text>The amount of the payment to a State maritime academy
				under paragraph (1) may not exceed—</text>

				2006;</text>
								</subparagraph><subparagraph id="IDB2A0FF40B29B4438AF7A83F0D03BE739"><enum>(B)</enum><text>$200,000 for fiscal year
				2007; and</text>
								</subparagraph><subparagraph id="IDBBC992CB22BA43D2B43CB376DD0ED158"><enum>(C)</enum><text>$300,000 for fiscal year
				2008 and each fiscal year
				thereafter.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID80B3AE435BB44E3D801BF03AB048F7D4"><enum>(3)</enum><text>Section 51505(b)(2)(B) is
			 amended by striking <quote>$200,000</quote> and inserting <quote>$300,000 for
			 fiscal year 2006, $400,000 for fiscal year 2007, and $500,000 for fiscal year
			 2008 and each fiscal year thereafter</quote>.</text>

				mobile offshore drilling unit located over the outer Continental Shelf that is

				of obligated service of an individual graduate of the Academy upon request of
				the Secretary; and</text>

				notify the Secretary of any failure of the graduate to perform the graduate’s
				duties, either on active duty or in the Ready Reserve component of their
				respective service, or as a commissioned officer of the National Oceanic and
				Atmospheric Administration or the Public Health Service, respectively.</text>
								</subparagraph></paragraph><paragraph id="ID6F7BD32200524B3EA5B794EC64E12D5B"><enum>(2)</enum><header>Information to be
				provided</header><text>A report or notice under paragraph (1) shall identify
				any graduate determined to have failed to comply with service obligation
				requirements and provide all required information as to why such graduate
				failed to comply.</text>

				default</header><text>Upon receipt of such a report or notice, such graduate

			 repealed.</text>
				</paragraph><paragraph id="IDAE2D5C3FFF574C7D8BCA895A1647B9D8"><enum>(2)</enum><header>Intended
			 Effect</header><text>The provisions repealed by paragraph (1) shall be treated
			 as if never enacted.</text>
				</paragraph></subsection><subsection id="id166E3E44803646D9B3FA92A874C1B94B"><enum>(d)</enum><header>Large Passenger Vessel
			 Crew Requirements</header><text><external-xref legal-doc="usc" parsable-cite="usc/46/8103">Section 8103(k)(3)(C)(iv)</external-xref> of title 46, United
			 States Code, is amended by inserting <quote>and section 252 of the Immigration
			 and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1282">8 U.S.C. 1282</external-xref>)</quote> after <quote>of such
