		<official-title>To terminate the national security waiver that has been
		  used to deny the payment of the high-deployment allowance to members of the
		  Armed Forces serving lengthy or numerous deployments since September 11, 2001,
		  and to extend the allowance to members who have been deployed since that date
		  in excess of the rotation frequencies for reserve component members of one year
		  mobilized to five years demobilized and for regular component members of one
		  year deployed to two years at the permanent duty station, and for other
		  purposes.</official-title>

		<section id="H9E0EBDD53EEA4994909D2F3F89716EF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair Pay for America’s Troops
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HA3C9AA863216484CBF6C77807641702E" section-type="subsequent-section"><enum>2.</enum><header>Activation of
			 high-deployment allowance for members of the Armed Forces and expansion of
			 allowance to cover deployments in excess of rotation frequencies</header>
			<subsection id="H89A7BF6087E94D20005C7C3CA0001503"><enum>(a)</enum><header>Termination of
			 national security waiver</header><text>Subsection (f) of section 436 of title
			 37, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H72147F952AC84D21B3B16E3C67C890C7" style="OLC">
					<subsection id="H6E9812424F28437200EC60A8F555B3AC"><enum>(f)</enum><header>Inapplicability
				of national security waiver</header><text display-inline="yes-display-inline">The fact that the applicability of section
				991 of title 10 to a member is suspended under subsection (d) of that section
				may not be used to deny the payment of a high-deployment allowance to the
				member if the member otherwise satisfies the eligibility requirements of
				subsection
				(a).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6B80B250903C4862A6E308CF9206FA9E"><enum>(b)</enum><header>Removal of
			 discretion regarding rate of allowance</header><text>Subsection (c) of such
			 section is amended by striking <quote>determined by the Secretary concerned,
			 not to exceed $1,000 per month</quote> and inserting <quote>equal to $1,000 per
			 month</quote>.</text>
			</subsection><subsection id="HAB77C7D9F4E34DE4974439F60592ADAD"><enum>(c)</enum><header>Repeal of
			 Authority to Exclude Certain Duty Assignments</header><text>Such section is
			 further amended—</text>
				<paragraph id="H40F0169FA72E4BA294AF2EE079BB88F"><enum>(1)</enum><text>by
			 striking subsection (g); and</text>
				</paragraph><paragraph id="H551F6D453A474B299B68F40040C01699"><enum>(2)</enum><text>by redesignating
			 subsection (h) as subsection (g).</text>
				</paragraph></subsection><subsection id="H753CE17EFE36410190829948CBF1168F"><enum>(d)</enum><header>Violation of
			 rotation frequencies</header><text display-inline="yes-display-inline">Subsection (a)(2) of such section is
			 amended—</text>
				<paragraph id="H87D63356C73E42EC9000A51B4F266C3D"><enum>(1)</enum><text>by striking
			 <quote>or</quote> at the end of subparagraph (B);</text>
				</paragraph><paragraph id="H090AB6F95C7D475F9F77C4C22F02968C"><enum>(2)</enum><text>in subparagraph
			 (C)—</text>
					<subparagraph id="H8DBDD2B7D0B0444B8BFB669828979714"><enum>(A)</enum><text>by striking
			 <quote>or</quote> at the end of clause (i);</text>
					</subparagraph><subparagraph id="H808323DFBE1F495B8232B12B330860B1"><enum>(B)</enum><text>by striking the
			 period at the end of clause (ii) and inserting <quote>; or</quote>; and</text>
					</subparagraph><subparagraph id="H6909778C40DF45EFB3CC3605FE0D9C"><enum>(C)</enum><text>by adding at the end
			 the following new clause:</text>
						<quoted-block display-inline="no-display-inline" id="H65D2083F43AB4E33BEFE0010D07EB569" style="OLC">
							<clause id="H6A69A4FDD7364BAA9ED3C5560372D3AC"><enum>(iii)</enum><text display-inline="yes-display-inline">under a call or order to active duty for a
				period of more than 30 days that results in the member serving on active duty
				in excess of the rotation frequency for reserve component members of one year
				mobilized to five years demobilized; or</text>
							</clause><after-quoted-block>; and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9108F00ED5F245189E37964FFED32501"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H883EF2068ADA41618CEF5FA8780862A0" style="OLC">
						<subparagraph id="HAAA26ADB4C4B4E1683A102321E9C79EA"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of a member of a regular
				component, is otherwise deployed in excess of the rotation frequency for
				regular component members of one year deployed to two years assigned to duty at
				the permanent duty station of the
				member.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H156989CBA095451FAC51327985FA27E8"><enum>(e)</enum><header>Retroactive
			 application</header>
				<paragraph id="H802A2DBC54E74DC5A594E0C45E87F4E2"><enum>(1)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the amendments made by this section shall take effect on the
			 first day of the first month beginning more than 20 days after the date of the
			 enactment of this Act. Service performed by members of the Armed Forces before
			 the effective date shall be counted for purposes of determining the eligibility
			 of members for the high-deployment allowance under <external-xref legal-doc="usc" parsable-cite="usc/37/436">section 436</external-xref> of title 37,
			 United States Code, as amended by this section, on and after that date.</text>
				</paragraph><paragraph id="H5AA5FF0C3F14473FBDADD7C91BBD5882"><enum>(2)</enum><header>Retroactive
			 application</header><text display-inline="yes-display-inline">On the basis of
			 the information maintained pursuant to <external-xref legal-doc="usc" parsable-cite="usc/10/991">section 991</external-xref> of title 10, United States
			 Code, regarding members of the Armed Forces deployed since September 11, 2001,
			 the Secretary of each military department shall pay a high-deployment allowance
			 under <external-xref legal-doc="usc" parsable-cite="usc/37/436">section 436</external-xref> of title 37, United States Code, as amended by this section,
			 to each member of the Armed Forces for each month since that date through the
			 effective date specified in paragraph (1) during which the member satisfied the
			 eligibility requirements for the allowance under subsection (a) of such section
			 436. In the case of a member who is deceased as of the effective date specified
			 in paragraph (1), the high-deployment allowance shall be paid to the
			 next-of-kin of the member.</text>
