		<section id="H4B0D0EB5782E4D21BEFC062378E9E635" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hydrographic Services Improvement Act
			 Amendments of 2008</short-title></quote>.</text>
		</section><section id="H2E22CEA20BD448F4BA9388A88F2541E4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 302 of the Hydrographic Services
			 Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/892">33 U.S.C. 892</external-xref>) is amended—</text>
			<paragraph id="H953A8DDD7F57428B972F32E0B3582498"><enum>(1)</enum><text>by amending
			 paragraph (3) to read as follows:</text>
				<quoted-block id="H9898BBC1B29546EBAD3182D912BB000" style="OLC">
					<paragraph id="HC2ED81879ECC447C9D3776A234301AB"><enum>(3)</enum><header>Hydrographic
				data</header><text>The term <quote>hydrographic data</quote> means information
				that—</text>
						<subparagraph id="HD89484220217483095163F54173FEDDA"><enum>(A)</enum><text>is acquired
				through—</text>
							<clause id="HD03D872643CE4608BABF352339981145"><enum>(i)</enum><text display-inline="yes-display-inline">hydrographic, bathymetric, photogrammetric,
				lidar, radar, remote sensing, or shoreline and other ocean- and coastal-related
				surveying;</text>
							</clause><clause id="H4AAD526576B642AD973D4125874F8889"><enum>(ii)</enum><text>geodetic,
				geospatial, or geomagnetic measurements;</text>
							</clause><clause id="HF70F0609D24D4C9785B59DF727C93205"><enum>(iii)</enum><text>tide, water
				level, and current observations; or</text>
							</clause><clause id="H92D8B70EABB245CFA4E4CB9FC6BD996"><enum>(iv)</enum><text>other methods;
				and</text>
							</clause></subparagraph><subparagraph id="H181F407750CC4939009044A149C8974F"><enum>(B)</enum><text>is used in
				providing hydrographic
				services.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3AFECF12D11E480DB4C5FEF1C55E805C"><enum>(2)</enum><text>by amending
			 paragraph (4)(A) to read as follows:</text>
				<quoted-block id="HE7909C41E61844CEBAA4A46E42FAC627" style="OLC">
					<subparagraph id="H914D85A4E42E405E90D6C11962BFAD23"><enum>(A)</enum><text>the management,
				maintenance, interpretation, certification, and dissemination of bathymetric,
				hydrographic, shoreline, geodetic, geospatial, geomagnetic, and tide, water
				level, and current information, including the production of nautical charts,
				nautical information databases, and other products derived from hydrographic
				data;</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H99BC5F70939A4186A776499D60E79420"><enum>(3)</enum><text>by striking
			 paragraph (5).</text>
			</paragraph></section><section id="HBA79621AFCC3477CB400886C3DA29DC"><enum>3.</enum><header>Functions of the
			 Administrator</header><text display-inline="no-display-inline">Section 303 of
			 the Hydrographic Services Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/892a">33 U.S.C. 892a</external-xref>) is
			 amended—</text>
			<paragraph id="H7EF9FD4D08CF4BBEB95019DBF5FA2C5C"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H40641D008C074BED958628B5D081013"><enum>(A)</enum><text>by striking
			 <quote>the Act of 1947,</quote> and inserting <quote>the Coast and Geodetic
			 Survey Act (<external-xref legal-doc="usc" parsable-cite="usc/33/883a">33 U.S.C. 883a et seq.</external-xref>)</quote>; and</text>
				</subparagraph><subparagraph id="H352C407AD5564D6195C896003C23A3DC"><enum>(B)</enum><text>in paragraph (1)
			 by striking <quote>data;</quote> and inserting <quote>data and provide
			 hydrographic services;</quote>;</text>
				</subparagraph></paragraph><paragraph id="HB5E07976806D42EA00972222E96B57D9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph id="HBE08B606189240AFBCF000005473F00"><enum>(A)</enum><text>by striking
			 <quote>the Act of 1947,</quote> and inserting <quote>the Coast and Geodetic
			 Survey Act (<external-xref legal-doc="usc" parsable-cite="usc/33/883a">33 U.S.C. 883a et seq.</external-xref>)</quote>;</text>
				</subparagraph><subparagraph id="H17E88829F1054369B4DFD03416C36C3B"><enum>(B)</enum><text>in paragraph (3)
			 by striking <quote>title IX of the Federal Property and Administrative Services
			 Act of 1949; and</quote> and inserting <quote>subchapter VI of chapter 10 of
			 title 40, United States Code;</quote>;</text>
				</subparagraph><subparagraph commented="no" id="HB772C3F70CAF48CA00EAEEB2D84D1C32"><enum>(C)</enum><text>in paragraph (4)
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph id="H2AEBBC98597E4892971C2E1904169560"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H2B0DE8B6E2D14B74927BDD198DCE254D" style="OLC">
						<paragraph id="H91EE1C8A530C42D994EB014BF60AD61"><enum>(5)</enum><text>may create,
				support, and maintain a Joint Hydrographic
				Institute.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HEE8F571313DC4D6CA46B529B3F193116"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block id="H69756CA8F85643CAB92DAF02F9A2F8C6" style="OLC">
					<subsection id="H586F33462598437FB67CECA5C4BE4604"><enum>(c)</enum><header>Acquisition of
				hydrographic data and provide hydrographic services</header><text>To the extent
				that it does not detract from the promotion of safe and efficient navigation,
				the Administrator may acquire hydrographic data and provide hydrographic
				services to—</text>
						<paragraph id="HBC8CAF11EFB544F194811CBF5DED3027"><enum>(1)</enum><text>support the
				conservation and management of coastal and ocean resources;</text>
						</paragraph><paragraph id="H93729AB895FA4469B079BBE03EFBE54"><enum>(2)</enum><text>save and protect
				life and property;</text>
						</paragraph><paragraph id="HEE64B1CB28344156B03BB15A08B6FD1"><enum>(3)</enum><text>support the
				resumption of commerce in response to emergencies, natural disasters, and
				man-made disasters; and</text>
						</paragraph><paragraph id="H0457EBEEEE67451880A9C408B405100"><enum>(4)</enum><text>meet homeland
				security and maritime domain awareness needs, including carrying out mission
				assignments (as that term is defined in section 641 of the Post-Katrina
				Emergency Management Reform Act of 2006 (6 U.S.C.
				741).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HD6CB403785D844A08E56D49D554BED1F"><enum>4.</enum><header>Hydrographic
			 services review panel</header><text display-inline="no-display-inline">Section
			 305 of the Hydrographic Services Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/892c">33 U.S.C. 892c</external-xref>) is
			 amended—</text>
			<paragraph id="H034AC69E014B4A199043D1B3800B500"><enum>(1)</enum><text>in
			 subsection (c)(1)(A) by striking <quote>Director</quote> and inserting
			 <quote>Co-directors</quote>;</text>
			</paragraph><paragraph id="H4202D3107F144DD6B63300ABE6CFAD00"><enum>(2)</enum><text>in subsections
			 (c)(1)(C), (c)(3), and (e) by striking <quote>Secretary</quote> each place it
			 appears and inserting <quote>Administrator</quote>; and</text>
			</paragraph><paragraph id="H35C830D3346F4EA49ED821D5356503F"><enum>(3)</enum><text>by
			 amending subsection (d) to read as follows:</text>
				<quoted-block id="H81612F2F01664C538C9ECE710955A5C5" style="OLC">
					<subsection id="H2B211E5A3A0D4A48A0B61BA4703D56A3"><enum>(d)</enum><header>Compensation</header><text>Voting
				members of the panel shall be reimbursed for actual and reasonable expenses,
				including travel and per diem, incurred in the performance of duties for the
				panel.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H53AEA9C97916482400BDA03C24DA0048"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">Section 306 of
			 the Hydrographic Services Improvement Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/33/892d">33 U.S.C. 892d</external-xref>) is amended
			 to read as follows:</text>

				<section id="H3C46A4B3A6EB4CBB8223E72F7F3FFDAF"><enum>306.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated to the Administrator the following:</text>
					<paragraph id="H14BB632471994256972E701D60005405"><enum>(1)</enum><text>To carry out
				nautical mapping and charting functions under sections 303 and 304, except for
				conducting hydrographic surveys—</text>
						<subparagraph id="H7E88AA5E5B434C6098CF1800AEF02134"><enum>(A)</enum><text>$55,000,000 for
				fiscal year 2009;</text>
						</subparagraph><subparagraph id="HB826B426051C472FB8E0DA1B631CCA29"><enum>(B)</enum><text>$56,000,000 for
				fiscal year 2010;</text>
						</subparagraph><subparagraph id="HD1F7770FBFC24DD8A0CF5BBEF740CEA4"><enum>(C)</enum><text>$57,000,000 for
				fiscal year 2011; and</text>
						</subparagraph><subparagraph id="H29443C6733A041D88893280000969621"><enum>(D)</enum><text>$58,000,000 for
				fiscal year 2012.</text>
						</subparagraph></paragraph><paragraph id="H7C70B4D87FEE4E16B11862BBF4BF24E"><enum>(2)</enum><text>To contract for
				hydrographic surveys under section 303(b)(1), including the leasing or time
				chartering of vessels—</text>
						<subparagraph id="H49D18D7444074AE5B26E532D40C5E07E"><enum>(A)</enum><text>$32,130,000 for
				fiscal year 2009;</text>
						</subparagraph><subparagraph id="HD727D56BE6D143448849918643CE1BD6"><enum>(B)</enum><text>$32,760,000 for
				fiscal year 2010;</text>
						</subparagraph><subparagraph id="HE54AFAAFBEDA4964AA558541DAAC4008"><enum>(C)</enum><text>$33,390,000 for
				fiscal year 2011; and</text>
						</subparagraph><subparagraph id="H28C120E9B4AA4C1EA9E46369D752CAC"><enum>(D)</enum><text>$34,020,000 for
				fiscal year 2012.</text>
						</subparagraph></paragraph><paragraph id="H5EFAEAF6F98645CCB0D17486463B57A9"><enum>(3)</enum><text>To operate
				hydrographic survey vessels owned by the United States and operated by the
				Administration—</text>
						<subparagraph id="HDA30BFED36304968A834AAE800A37D72"><enum>(A)</enum><text>$25,900,000 for
				fiscal year 2009;</text>
						</subparagraph><subparagraph id="H1CB8CCA7DF14464FBB23EAB0570E56B"><enum>(B)</enum><text>$26,400,000 for
				fiscal year 2010;</text>
						</subparagraph><subparagraph id="H499255855E6C4BBF8FCB23C2FB7700D3"><enum>(C)</enum><text>$26,900,000 for
				fiscal year 2011; and</text>
						</subparagraph><subparagraph id="HB936675359B74239A03EE500FA06A4A8"><enum>(D)</enum><text>$27,400,000 for
				fiscal year 2012.</text>
						</subparagraph></paragraph><paragraph id="H8C56A7724CFD4BAABDD058900643BA41"><enum>(4)</enum><text>To carry out
				geodetic functions under this title—</text>
						<subparagraph id="H2D60CD22461341E699C45134A2007FFE"><enum>(A)</enum><text>$32,640,000 for
				fiscal year 2009;</text>
						</subparagraph><subparagraph id="HEF0A31CDC27743A09F18982BFDEF0425"><enum>(B)</enum><text>$32,280,000 for

						</subparagraph><subparagraph id="H8508098B98C640E6ADC0C21570E5EBF9"><enum>(C)</enum><text>$33,920,000 for
				fiscal year 2011; and</text>
						</subparagraph><subparagraph id="H9F3EAA98D7764BABAA12B2F26089437F"><enum>(D)</enum><text>$34,560,000 for
				fiscal year 2012.</text>

				and current measurement functions under this title—</text>

				survey vessel capable of staying at sea continuously for at least 30 days
				$75,000,000.</text>

			 title to existing law</header><text display-inline="no-display-inline">The Act
			 of August 6, 1947 (chapter 504; <external-xref legal-doc="usc" parsable-cite="usc/33/883a">33 U.S.C. 883a et seq.</external-xref>) is amended by adding at
			 the end the following:</text>
