		<section id="H65C42C843D884C97A4CA53936135C107" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Native American Challenge
			 Demonstration Project Act of 2007</short-title></quote>.</text>
		</section><section id="H0E29455ACA354FC385392FF300CC9200"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="H46539867E711459AB10049D0D49DF2F0"><enum>(1)</enum><text display-inline="yes-display-inline">adapt the lessons of foreign aid to
			 underdeveloped economies, such as the experience of the Millennium Challenge
			 Corporation, to the provision of Federal economic development assistance to
			 similarly situated remote Native American communities;</text>
			</paragraph><paragraph id="H219316E8E03E4864BE7131EF25F86881"><enum>(2)</enum><text display-inline="yes-display-inline">provide Federal economic development
			 assistance for Native communities through the Native American Challenge
			 Demonstration Project;</text>
			</paragraph><paragraph id="H877DE5A0032A4D9187E242AAAA7FDCF9"><enum>(3)</enum><text display-inline="yes-display-inline">administer Federal economic development
			 assistance in a manner that promotes economic growth and the elimination of
			 poverty and strengthens good governance, entrepreneurship, and investment in
			 Native communities;</text>
			</paragraph><paragraph id="H41970892B393460DBF57EA61DAC72A6"><enum>(4)</enum><text display-inline="yes-display-inline">improve the effectiveness of Federal
			 economic development assistance by encouraging the integration and coordination
			 of such assistance in Native American communities;</text>
			</paragraph><paragraph id="HFEF0DD99EA76414A9E7F1BD26C260090"><enum>(5)</enum><text display-inline="yes-display-inline">promote sustainable economic growth and
			 poverty reduction policies in Native American communities in a manner that
			 promotes self-determination and self-sufficiency among remote Native American
			 communities while preserving their cultural values; and</text>
			</paragraph><paragraph id="HA0885ED9CC4141BDB3061CC2F42FE135"><enum>(6)</enum><text display-inline="yes-display-inline">establish a demonstration project which, if
			 successful, may be broadly applied to other Native American communities in the
			 United States.</text>
			</paragraph></section><section id="HF644C271B460499EBA0085F5B9C84F15"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H5A01EA6C453D477E002CFE7490D88EB"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <term> eligible entity</term> means—</text>
				<subparagraph id="HD9377707A15242B9A398A964395C46D"><enum>(A)</enum><text>the Association of
			 Village Council Presidents, the Bristol Bay Native Association, and the Alaska
			 Federation of Natives applying jointly;</text>
				</subparagraph><subparagraph id="H1D3062186A354F369203BFDA8FD4800"><enum>(B)</enum><text>in the State of
			 Hawaii, a consortia of local Native Hawaiian community organizations to be
			 determined by the Secretary in consultation with the Secretary of Interior and
			 the Office of Hawaiian Affairs; and</text>
				</subparagraph><subparagraph id="H17948EFD98DA4B55002D07424827E738"><enum>(C)</enum><text>in the contiguous
			 states, up to three organizations to be determined by the Secretary in
			 consultation with the Secretary of the Interior, which organizations may be
			 Indian tribes, consortia of Indian tribes, or nongovernmental entities
			 authorized by one or more Indian tribes.</text>
				</subparagraph></paragraph><paragraph id="HB1FFC2A4EB534607AD95059F28DDA574"><enum>(2)</enum><header>Compact</header><text>The
			 term <term>compact</term> means a binding agreement with the United States
			 pursuant to this Act.</text>
			</paragraph><paragraph id="HCC0F7B5B4107497DBEACCAAEF7DA82D6"><enum>(3)</enum><header>Economic
			 development strategy of the eligible entity</header><text>The term
			 <term>economic development strategy of the eligible entity</term> means a
			 strategy written by the eligible entity and designed to achieve sustainable
			 economic growth and reduce poverty over a defined period, developed in
			 consultation with public and private sector entities as appropriate to the
			 geographic area and intended beneficiaries of the compact.</text>
			</paragraph><paragraph id="H667BFDAFE6DC4584976403763FC141CF"><enum>(4)</enum><header>Indian
			 tribe</header><text display-inline="yes-display-inline">The term <term>Indian
			 tribe</term> shall have the meaning given the term in section 4(e) of the
			 Indian Self Determination and Education Assistance Act (25 U.S.C. 450 et
			 seq.).</text>
			</paragraph><paragraph id="HCD0618D0863B4BD7A67D055C4737F722"><enum>(5)</enum><header>Renewal</header><text>The
			 term <term>renewal</term> means the negotiated extension of a compact.</text>
			</paragraph><paragraph id="H8413F83BC3DE494E8BE37081CCF94214"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce, Office of the
			 Secretary.</text>
			</paragraph></section><section id="H5EEF4F56EF03429AA54592B5116CE2D"><enum>4.</enum><header>Native American
			 Millennium Challenge Demonstration Project</header>
			<subsection id="HDE2985F49ABE400FA01C9FBD66BD3903"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall establish and implement a demonstration project in the
			 Department of Commerce.</text>
			</subsection><subsection id="H795618A234454D2E8EAFD1DC9B13A04F"><enum>(b)</enum><header>Authorization of
			 assistance</header><text>The Secretary may provide assistance under this
			 section to an eligible entity that enters a compact with the United States
			 pursuant to this Act.</text>
			</subsection><subsection id="H7BB3DD33D8824408A374AE4DE5F8147"><enum>(c)</enum><header>Form of
			 assistance</header><text display-inline="yes-display-inline">Assistance under
			 this section—</text>
				<paragraph id="HFE7A44797C78441EB527F0B562F5B162"><enum>(1)</enum><text>shall be provided
			 in the form of funding agreements established by the compacts;</text>
				</paragraph><paragraph id="HB1EABDEF091540FD8EEC00C6C976332B"><enum>(2)</enum><text>may not be
			 provided in the form of loans; and</text>
				</paragraph><paragraph id="HDCBFA3920A80401389AEEFF572E82F48"><enum>(3)</enum><text>may not be used
			 for gaming activities pursuant to the Indian Gaming Regulatory Act (25 USC 2701
			 et seq.).</text>
				</paragraph></subsection><subsection commented="no" id="HD2A31B7FCE4340FBAE2837C2F5BB3C4E"><enum>(d)</enum><header>Coordination</header>
				<paragraph commented="no" id="H707F432D7154435CA305075062CAA5AB"><enum>(1)</enum><header>In
			 general</header><text>The provision of assistance under this section shall be
			 coordinated with other Federal economic development assistance programs for
			 Native Americans.</text>
				</paragraph><paragraph commented="no" id="HB60E7966A6EF4AF381F5FE823D379187"><enum>(2)</enum><header>Integrated
			 funding</header><text display-inline="yes-display-inline">The Secretary, in
			 cooperation with other Secretaries as appropriate, shall, upon execution of a
			 compact with an eligible entity, authorize the eligible entity to coordinate
			 its federally funded economic development assistance programs in a manner that
			 integrates the program services into a single, coordinated program.</text>
				</paragraph><paragraph commented="no" id="HC91D555B40064A66B4C9D32BA10164DE"><enum>(3)</enum><header>Agencies and
			 Departments</header><text display-inline="yes-display-inline">The Federal
			 agencies and departments administering economic development assistance programs
			 for Native Americans are the following:</text>
					<subparagraph commented="no" id="HACD8B914AA784A7BB741A80259D9DDCF"><enum>(A)</enum><text display-inline="yes-display-inline">Department of Agriculture.</text>
					</subparagraph><subparagraph commented="no" id="H6FC752CF7A6B4368BDEC1058F3D9A7BA"><enum>(B)</enum><text display-inline="yes-display-inline">Department of Commerce.</text>
					</subparagraph><subparagraph commented="no" id="H4BBB51C4B5AE460200FCDBC68F6DFB0"><enum>(C)</enum><text display-inline="yes-display-inline">Department of Energy.</text>
					</subparagraph><subparagraph commented="no" id="H6F53C8729121451BA50092051273BF4C"><enum>(D)</enum><text display-inline="yes-display-inline">Department of Health and Human
			 Services.</text>
					</subparagraph><subparagraph commented="no" id="HE274645EAA74471C92CA80BAC72CB172"><enum>(E)</enum><text display-inline="yes-display-inline">Department of Housing and Urban
			 Development.</text>
					</subparagraph><subparagraph commented="no" id="H28F91C15134E4944AA262DADD935C6E5"><enum>(F)</enum><text display-inline="yes-display-inline">Department of the Interior.</text>
					</subparagraph><subparagraph commented="no" id="H8D630E5309F1498E9828CA1BE94152EA"><enum>(G)</enum><text display-inline="yes-display-inline">Small Business Administration.</text>
					</subparagraph><subparagraph commented="no" id="H2735485DFA924C3F990542B4003840EF"><enum>(H)</enum><text display-inline="yes-display-inline">Such other Federal agencies and
			 instrumentalities as the Secretary determines appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="HC50594EC36954F0799AF614995A19DF7"><enum>(e)</enum><header>Programs
			 Affected</header><text display-inline="yes-display-inline">The programs that
			 may be integrated pursuant to this Act shall include any program under which an
			 Indian tribe is eligible for receipt of funds under a statutory or
			 administrative formula for economic development purposes.</text>
			</subsection><subsection id="H70FB5CBC2C9A4706BE0145C00997644"><enum>(f)</enum><header>Waiver
			 Authority</header><text display-inline="yes-display-inline">Upon receipt of the
			 executed compact, the Secretary shall consult with the eligible entity and the
			 Secretary of each Federal agency or department providing funds to be used to
			 implement the compact in order to identify any waivers of statutory
			 requirements or applicable regulations, policies, or procedures necessary to
			 enable the eligible entity to implement its compact.</text>
			</subsection></section><section id="H8B17A78FCB75491397007ED1FE07F217"><enum>5.</enum><header>Native American
			 Challenge Compacts</header>
			<subsection id="HD61276063E434771B408BF8FDAE42272"><enum>(a)</enum><header>Compacts</header><text display-inline="yes-display-inline">The Secretary shall develop and recommend
			 procedures for considering proposals for compacts submitted by eligible
			 entities. The Secretary may provide assistance to an eligible entity only if
			 the eligible entity enters into an agreement with the United States, to be
			 known as a <quote>Native American Challenge Compact</quote>, that establishes a
			 multi-year plan for achieving development objectives in furtherance of the
			 purposes of this Act.</text>
			</subsection><subsection id="HEAADFDDF492D4A4F00109B3531ADF9DA"><enum>(b)</enum><header>Eligible
			 entities-Criteria for Selection</header><text>The Secretary shall develop an
			 application process and criteria for selecting the eligible entities, taking
			 into account—</text>
				<paragraph id="H2060EEC4948348A7B4E3C81C6CB8E6BA"><enum>(1)</enum><text>the purposes of
			 this Act;</text>
				</paragraph><paragraph id="H4F62DF2F8C2E45D8B9B0FD9D5CE5C559"><enum>(2)</enum><text>the economic
			 development strategy of the eligible entity;</text>
				</paragraph><paragraph id="H4CF76F7D55E94E8AAB06C314FBADC7C"><enum>(3)</enum><text>the remoteness of
			 the reservation or community to be served;</text>
				</paragraph><paragraph id="H4214E1EE036D46078589C0C316B5F12"><enum>(4)</enum><text>its general
			 economic status;</text>
				</paragraph><paragraph id="H352A481B8D314478B4C4E6006D2FFE01"><enum>(5)</enum><text>poverty rates;
			 and</text>
				</paragraph><paragraph id="HFF18A3A8559848FB9864CEDB04AA9589"><enum>(6)</enum><text>the capacity of
			 the applicant.</text>
				</paragraph></subsection><subsection id="H044C94608796487499008DE4D8E27974"><enum>(c)</enum><header>Assistance for
			 development of a compact</header><text>To the extent that funds have been
			 appropriated in advance and are available for this section, the Secretary may
			 enter into contracts with or make grants to any eligible entity for the
			 purposes of facilitating the development and implementation of a compact
			 between the United States and the eligible entity.</text>
			</subsection><subsection id="H96B12DFDC631484989295C30F5D1BA1C"><enum>(d)</enum><header>Duration and
			 extension</header><text>The term of an initial compact may not exceed five
			 years. An eligible entity and the United States may enter into one or more
			 subsequent compacts in accordance with the requirements of this Act. If a
			 compact is nearing its expiration or has expired, the eligible entity and the
			 United States may renegotiate or extend the compact for as many periods as the
			 parties agree, with each period not exceeding 10 years.</text>
			</subsection><subsection id="HAA40B563C47A4943A3528712D20493AB"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">The Secretary shall develop and recommend
			 procedures for considering proposals for compacts submitted by eligible
			 entities.</text>
			</subsection><subsection id="H94075D2C3E8E47180069C2F2D765ED38"><enum>(f)</enum><header>Elements</header><text>In
			 furtherance of the economic development strategy of the eligible entity, the
			 compact shall contain—</text>
				<paragraph id="H8E94243D50674D09B2E2BDE13B7FBC3B"><enum>(1)</enum><text>a
			 description of the specific objectives for sustainable economic development and
			 the reduction of poverty that the eligible entity and the United States expect
			 to achieve during the term of the compact;</text>
				</paragraph><paragraph id="HC45CC7FC9D5345F5A5B0F8886D018705"><enum>(2)</enum><text>a
			 description of the respective roles and responsibilities of the eligible entity
			 and the United States in the achievement of such objectives;</text>
				</paragraph><paragraph id="H1FB5A9018E30466AB80329AD00271294"><enum>(3)</enum><text>a
			 list and description of regular benchmarks to measure progress toward achieving
			 such objectives;</text>
				</paragraph><paragraph id="HFC3D54023BF8491697B832078273CB6B"><enum>(4)</enum><text>an identification
			 of the intended beneficiaries, disaggregated by income level, gender, and age,
			 to the maximum extent practical; and</text>
				</paragraph><paragraph id="H768101ADBE31414986F33D58BD3FC99"><enum>(5)</enum><text>a
			 multi-year financial plan to guide the implementation of the compact, including
			 the estimated level of funding and other contributions by the United States and
			 the eligible entity, proposed mechanisms to execute the plan, and periodic
			 assessments to determine whether the requirements of subparagraphs (1) through
			 (4) are being met.</text>
				</paragraph></subsection><subsection id="HCE0AA885B9594126817135F82B24EAE"><enum>(g)</enum><header>Suspension and
			 Termination of Assistance</header>
				<paragraph id="H5D94E00CBFBB499CA37D97C8E7592DE"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may suspend or terminate assistance in
			 whole or in part for an entity that has entered a compact with the United
			 States if the Secretary determines that—</text>
					<subparagraph id="HCDEA60110F8249A48592A7480927F33"><enum>(A)</enum><text>the entity has
			 failed to adhere to its responsibilities under the compact, or</text>
					</subparagraph><subparagraph id="HF99BDEC27F984CD79E003E60B7C514AE"><enum>(B)</enum><text>the entity has
			 engaged in a pattern of actions inconsistent with the purposes of this
			 Act.</text>
					</subparagraph></paragraph></subsection><subsection id="H3BCCDDD2C9154B1B8BBE4553D51DB92F"><enum>(h)</enum><header>Reinstatement</header><text>The
			 Secretary may reinstate assistance for an entity only if the Secretary
			 determines that the entity has demonstrated a commitment to correcting each
			 condition for which assistance was suspended or terminated under subsection
			 (f).</text>
			</subsection></section><section id="H61288471C56C40D08945A6CFC151608"><enum>6.</enum><header>Authorization of
			 Appropriations</header>
			<subsection id="H645C7A9769DB46209EAE05C2EFF8D4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to carry out this Act $20,000,000 for each of fiscal years
			 2008 through 2012. Any funds authorized but not appropriated may be
			 appropriated in subsequent fiscal years, provided that the cumulative level of
			 funds authorized to be appropriated for Fiscal Year 2008 through 2012 shall not
			 exceed $100,000,000. Sums appropriated under this section shall remain
			 available until expended.</text>
			</subsection><subsection commented="no" id="H1D90E7E8F1E1481BA51E3E74AF67FECD"><enum>(b)</enum><header>Administrative
			 Funds</header><text>Of the funds made available by this Act, no more than 5
			 percent may be used by the Secretary for administrative expenses and program
			 oversight.</text>
			</subsection></section><section id="H9257B43EE8284517B51847EABB03F6A4"><enum>7.</enum><header>Program
			 Assessments and Reports</header>
			<subsection id="H3E81CC2CC4094582BA9DCFD69C3A268"><enum>(a)</enum><header>Reports of
			 Eligible Entities</header><text>Not later than March 15, 2008, and annually
			 thereafter, each the eligible entity shall prepare and submit to the Secretary
			 a written report regarding the assistance provided under this Act during the
			 previous fiscal year.</text>
			</subsection><subsection id="H79DEB356ED314B25A67E59F87257A8BF"><enum>(b)</enum><header>Report
			 contents</header><text>A report required under subsection (a) shall include the
			 following:</text>
				<paragraph id="H806264B9E0C14DA7815164E0E72956D7"><enum>(1)</enum><text>The amount of
			 obligations and expenditures for assistance provided during the prior fiscal
			 year.</text>
				</paragraph><paragraph id="H8DD3BF1193584E12AE64871F5B48F5E4"><enum>(2)</enum><text>A
			 description of the programs and activities conducted by the entity in
			 furtherance of its economic development strategy and the purposes of this
			 Act.</text>
				</paragraph><paragraph id="H5FD5212B940549BDBC57086279C2C0E3"><enum>(3)</enum><text>An assessment of
			 the effectiveness of the assistance provided and progress made by the entity
			 toward achieving its economic development strategy and the purposes of this
			 Act.</text>
				</paragraph><paragraph id="H1A07C7F9919548CAA7385F88E043009B"><enum>(4)</enum><text>Other information
			 the eligible entity considers relevant considering the purposes of this
			 Act.</text>
				</paragraph></subsection><subsection id="H474C319DA77F46DDB39F775B00BBB6C3"><enum>(c)</enum><header>Transmittal to
			 congress</header><text display-inline="yes-display-inline">Not later than May
			 15, 2008, and annually thereafter, the Secretary shall transmit reports
			 required under subsection (a), with such other information the Secretary
			 considers relevant, to the Committee on Energy and Commerce and the Committee
			 on Natural Resources in the House of Representatives, and the Committee on
			 Indian Affairs, the Committee on Commerce, Science, and Transportation, and the
			 Committee on Energy and Natural Resources in the Senate.</text>
			</subsection></section></legis-body>
