<legis-type>A BILL</legis-type> 
<official-title>To amend the Animal Welfare Act to prohibit dog fighting ventures.</official-title> 
</form> 
<legis-body id="HC78BCB947A4348F0BDCF551293F9A4D0"> 
<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Dog Protection Act</short-title></quote>.</text> </section>
<section id="idA629DB14BA2E41EF9BCE95247A264E09" section-type="subsequent-section"><enum>2.</enum><header>Prohibitions on dog fighting ventures</header> 
<subsection id="id4D149AC9635B4AB48A247D0A4D32A228"><enum>(a)</enum><header>In general</header><text>Section 26 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2156">7 U.S.C. 2156</external-xref>) is amended to read as follows:</text> 
<paragraph id="H208BFD26E6BF4826A16EE8A7423CE237"><enum>(1)</enum><text>in subsection (a)(1)—</text> 
<subparagraph id="H1290A8D8C1694C5DAE845DFDA32D89B8"><enum>(A)</enum><text>by striking <quote>any person to knowingly sponsor</quote> and inserting “any person—</text> 
<quoted-block display-inline="no-display-inline" id="idE737AD859D934E2CBC067ACAD77645AF" style="OLC"> 
<subparagraph id="idBA316DC4EDF449C98EB4D6412900C892"><enum>(A)</enum><text>to knowingly sponsor</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="H935FC55D9B3E434EA4DBAB9E8463ADCE"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; or</quote> and</text> </subparagraph>
<subparagraph id="H2A31959CF2A04B3194EB71008E152DEE"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id83666ED13B22443E8399332CE7EED2F3" style="OLC"> 
<subparagraph id="id1CC36D8A62D84A0D902F2B01AC2399E4"><enum>(B)</enum><text>to knowingly sponsor or exhibit an animal in, or knowingly attend, a dog fighting venture.</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="idDF457EA1F9CF43208B9B047EA73CEE7D"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="id3D9D956520714B5A879B041F776D4AEA"><enum>(A)</enum><text>by striking <quote>any person to knowingly sell</quote> and inserting “any person—</text>

<subparagraph id="id88E764BDD3874991AE528D42448971D5"><enum>(A)</enum><text>to knowingly sell</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="idAF4235241D244B889EBB125CDC26D0C4"><enum>(B)</enum><text>by striking the period at the end and inserting <quote>; or</quote> and</text> </subparagraph>
<subparagraph id="id3823C4A423DD43C29359540E9F0EEA42"><enum>(C)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id2D8B1CBE97AD4F63859368FD38B0FB26" style="OLC"> 
<subparagraph id="id926A42C36AA14083A6CEF1B5257D0244"><enum>(B)</enum><text>to knowingly sell, buy, possess, train, transport, deliver, or receive for purposes of transportation, any dog or other animal, for the purposes of having the dog or other animal, or offspring of the dog or other animal, participate in a dog fighting venture.</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="idB266D131CB5B4FA7A67FCC5FBD64CC4F"><enum>(3)</enum><text>by striking subsection (c) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="id69BFB2298CC9433CBDB64AC657FCB640" style="OLC"> 
<subsection id="id528259D936624EE9816509E9E93EF65C"><enum>(c)</enum><text>Use of Postal Service or other interstate instrumentality</text> </subsection>
<quoted-block-continuation-text quoted-block-continuation-text-level="section">It shall be unlawful for any person to knowingly use the mail service of the United States Postal Service or any instrumentality of interstate commerce for commercial speech that promotes, or in any other manner furthers, the actions prohibited by subsections (a), (b), or (e).</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="idAA7AAE1728CA4311B231EBA81EB623D7"><enum>(4)</enum><text>in subsection (f) by striking <quote>by the United States</quote> before <quote>for care of animals seized and forfeited</quote>.;</text> </paragraph>
<paragraph id="id3DFD998E7C424C688CA67BD362D932B1"><enum>(5)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="id05BE09FEF498481E971D6E0E3336F5F5"><enum>(A)</enum><text>by redesignating subsections (g), (h), and (i) as subsections (h), (i), and (j), respectively; and</text> </subparagraph>
<subparagraph id="id7E66CC182D314B2F8097480A60855113" indent="up1"><enum>(B)</enum><text>by inserting before subsection (h) (as so redesignated) the following:</text> 
<quoted-block display-inline="no-display-inline" id="idF2FF639C312B4092B5A5F2E320CB5FB0" style="OLC"> 
<subsection id="idE70B3FF99ADC4EC083A431DF2D03A300"><enum>(g)</enum><header>Supplemental Enforcement</header> 
<paragraph id="id32FBEF4F6F544E6EB190663993C9C41A"><enum>(1)</enum><text>Except as provided in paragraph (2) of this subsection, any animal control agency, humane society, or society for the prevention of cruelty to animals may commence a civil suit to enjoin any private party who is alleged to be in violation of any provision of this section concerning animal fighting.</text> </paragraph>
<paragraph id="id37EEFF7C7E27482D8E44654A6649DAEA"><enum>(2)</enum><text>No action may be commenced under this subsection prior to sixty days after written notice of the violation has been given to the Secretary of Agriculture and to any alleged violator of any provision of this section, except that such action may be brought immediately after such notification in the case of an action under this subsection respecting an emergency posing an immediate risk of death or grievous suffering to the well-being of any animal covered by this section.</text> </paragraph>
<paragraph id="id0623D5DB24994EF1B01D4A842E4C1428"><enum>(3)</enum><text>In any suit under this subsection in which the United States is not a party, the Attorney General, at the request of the Secretary, may intervene on behalf of the United States as a matter of right.</text> </paragraph>
<paragraph id="id0CE9E918E6FD4A1A97AED76A9C4EC7FB"><enum>(4)</enum><text>The court, in issuing any final order in any suit under this subsection, may award costs of litigation to any party, whenever the court determines such award is appropriate.</text> </paragraph>
<paragraph id="idA352B74F9C954E42973F4F502192A322"><enum>(5)</enum><text>The injunctive relief provided by this subsection shall not restrict any right which any person may have under any statute or common law to seek enforcement of any standard or limitation or to seek any other relief.</text> </paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="idA678D9EE45E64FA78EF33817706BB6FF"><enum>(6)</enum><text>in subsection (h) (as so redesignated)—</text> 
<subparagraph id="id8F1C099B9798485596EAC45005FDD06F"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text> </subparagraph>
<subparagraph id="idF69BCF18A5674C93A7DB38FE42B65C92"><enum>(B)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text> </subparagraph>
<subparagraph id="id9AAA366686AD487EA2BFA8BCE758A349"><enum>(C)</enum><text>by inserting after paragraph (5) the following:</text> 
<quoted-block display-inline="no-display-inline" id="id94BBA58D7DDD45A0AC17C23C5F1994BC" style="OLC"> 
<paragraph id="idB956282536854411B5D26130294E2500"><enum>(6)</enum><text>the term <term>dog fighting venture</term>—</text> 
<subparagraph id="id250636B514DD4D1997E008BC13554EB7"><enum>(A)</enum><text>means any event that—</text> 
<clause id="id8610B1343A6F440DA0EEB74FB9F232EB"><enum>(i)</enum><text>involves a fight between at least 2 animals;</text> </clause>
<clause id="id5C5A9FD2160B48C0A2D4D31EEC15A1FB"><enum>(ii)</enum><text>includes at least one dog; and</text> </clause>
<clause id="id103F55E17CAF4B8F99A13DA7415EFCC7"><enum>(iii)</enum><text>is conducted for purposes of sport, wagering, or entertainment; and</text> </clause></subparagraph>
<subparagraph id="idE478E2A6379E40ADA730719757C06F14"><enum>(B)</enum><text>does not include any activity the primary purpose of which involves the use of 1 or more animals to hunt another animal.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection>
<subsection id="id21B03E99E2E34692955359B50174D402"><enum>(b)</enum><header>Enforcement of animal fighting prohibitions</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/49">Section 49</external-xref> of title 18, United States Code, is amended by inserting <quote>(or in the case of a dog fighting venture (as defined in section 26(g) of that Act) not more than 5 years)</quote> before <quote>, or both</quote>.</text> </subsection></section>
