<official-title>To amend title 5, United States Code, to prohibit agencies from enforcing rules that result in a specified economic impact until the requirements of those rules are enacted into law by an Act of Congress, and for other purposes.</official-title>

<section id="HDD42865374594562BDD1AF706C981DC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Responsibility and Accountability Act</short-title></quote>.</text></section> 
<section id="HE7C6F9A41D214503828478007DB0645D"><enum>2.</enum><header>Rules that result in a specified economic impact</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/553">Section 553</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="HADA07397984A4B8AA9669547CAF6B99B" display-inline="no-display-inline"> 
<subsection id="HE405B39A7F5C48A885F8F2C0811CCA7E"><enum>(f)</enum> 
<paragraph id="H7625ED60B0D044BCA156D04EE94439A4" display-inline="yes-display-inline"><enum>(1)</enum><text>Before adoption of a rule, each agency shall determine whether compliance with the rule will result in a specified economic impact. If an agency determines that a rule will result in a specified economic impact, the agency shall provide notification and shall not enforce the rule until the requirements of the rule are enacted into law by an Act of Congress.</text> </paragraph> 
<paragraph id="HE0C1D2DFAB114DB88611784E1618732D" indent="up1"><enum>(2)</enum><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, each agency shall determine whether any rule of that agency has resulted in a specified economic impact in the preceding year. If an agency determines that a rule has resulted in a specified economic impact in the preceding year, the agency shall provide notification and, not later than 365 days after making such determination, shall no longer enforce the rule until the requirements of the rule are enacted into law by an Act of Congress.</text> </paragraph> 
<paragraph id="HDBFFADAD4CEF4C93BC4BDA4100856C97" indent="up1"><enum>(3)</enum><text>In this subsection:</text> 
<subparagraph id="H948FC74BE4644DEE92C5111643C6CB16"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>provide notification</quote> means transmit the rule determined to result in a specified economic impact and the findings supporting such a determination, including relevant public comments in the case of a proposed rule, to the Federal Register for publication and to the Committees on Appropriations of the House of Representatives and the Senate, not later than 30 days after a determination is made in the case of a proposed rule and not later than 60 days after a determination is made in the case of an existing rule.</text></subparagraph> 
<subparagraph id="H9809FAC759524BEB8F8D3B4E51CBF7B1"><enum>(B)</enum><text>The term <quote>a specified economic impact</quote> means any of the following:</text> 
<clause id="HB1E561A7B1E344E5B603363FFEBB27A"><enum>(i)</enum><text>Costs to any individual of $5,000 or more in a year.</text></clause> 
<clause id="H2646DE5E07FC4F40BD95FB4D9EA1D66C"><enum>(ii)</enum><text>Costs to any partnership, corporation, association, or public or private organization, but not including the Federal Government or a State government, of $25,000 or more in a year.</text></clause> 
<clause id="H88E0EE1D8BC54A2C89BDCD3F6F73D5D3"><enum>(iii)</enum><text>Costs to all persons in the aggregate, but not including the Federal Government or a State government, of $250,000 or more in a year.</text></clause> 
<clause id="HE91F2BCEA3FF4D90AE22D3493C002F41"><enum>(iv)</enum><text>The loss by 1 or more United States citizens of existing employment in a year.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
