<section display-inline="no-display-inline" id="HD1B30B5CBAD54513AA14FCC95B5E44CD" section-type="section-one"><enum>1.</enum><header>Boundary adjustment and land conveyances, Roosevelt National Forest, Colorado</header> 
<subsection id="HE977577BA0F54D90BCF6B4B5D0C35B11"><enum>(a)</enum><header>Boundary adjustment</header><text display-inline="yes-display-inline">The boundaries of Roosevelt National Forest, Colorado, are hereby modified to exclude from the national forest a parcel of real property consisting of approximately 7 acres within the Crystal Lakes Subdivision as depicted on the map entitled <quote>Crystal Lakes Encroachment, HR 3299</quote> and dated July 15, 2008.</text></subsection> 
<subsection id="HB5007F9B0A6F45809803C7442D1E6678"><enum>(b)</enum><header>Conveyance of land removed from national forest</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall use the authority provided by <external-xref legal-doc="public-law" parsable-cite="pl/97/465">Public Law 97–465</external-xref> (commonly known as the Small Tracts Act; 16 U.S.C. 521c-521i) to convey all right, title, and interest of the United States in and to the real property excluded from the boundaries of Roosevelt National Forest under subsection (a) to the landowners whose real property adjoins the excluded land and who, as of the date of the enactment of this Act, occupy the excluded land.</text></subsection> 
<subsection id="H863FF7B2BCC146ED918CA2069700E853"><enum>(c)</enum><header>Consideration</header><text>The conveyances required by subsection (b) shall be made without consideration.</text></subsection> 
<subsection id="HD6FB3F5A46F0468EA5F8DCB882929719"><enum>(d)</enum><header>Description of real property</header><text display-inline="yes-display-inline">The exact acreage and legal description of the land excluded from the boundaries of Roosevelt National Forest under subsection (a) and conveyed under subsection (b) shall be determined by a survey satisfactory to the Secretary.</text></subsection></section> 
<section id="H86A12FAA6A774CBF8DED63A85C28C351" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Sale or exchange of NOAA property in Norfolk, Virginia</header> 
<subsection id="HAEEA8AD781DF44FB8DEC42F769B011B7"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Secretary of Commerce may sell or exchange to the City of Norfolk, Virginia, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/13">chapter 13</external-xref> of title 40, United States Code, real property under the administrative jurisdiction of the National Oceanic and Atmospheric Administration (in this section referred to as <quote>NOAA</quote>), including land and improvements thereon, located at 538 Front Street, Norfolk, Virginia, consisting of approximately 3.78 acres, if the Secretary—</text> 
<paragraph id="H9120BC284F33454F9D155F6139524D9D"><enum>(1)</enum><text>determines that the conveyance is in the best interests of NOAA and the Federal Government; and</text></paragraph> 
<paragraph id="H71BC43E165FB46A687C5FA8C5F49E3C9"><enum>(2)</enum><text>has provided prior notification to the Committee on Natural Resources and the Committee on Appropriations of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Appropriations of the Senate.</text></paragraph></subsection> 
<subsection id="H9C6A49E644B84EB1BE0342917C8D9447"><enum>(b)</enum><header>Consideration</header><text></text> 
<paragraph id="HE893BD277B6D4989A2294D39E91CAFC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For any conveyance under this section the Secretary shall require the City of Norfolk to provide consideration to the United States that is not less than the fair market value of the property conveyed by the United States.</text></paragraph> 
<paragraph id="HA09D17168D9D4B0E912528327D51C1A4"><enum>(2)</enum><header>Form</header><text>Consideration under this subsection may include any combination of—</text> 
<subparagraph id="HD4CC6A0FEF1C45959FFEDBDC669EAD17"><enum>(A)</enum><text>cash or cash equivalents;</text></subparagraph> 
<subparagraph id="H3B4C017B0C954273810001B2E8C6BA23"><enum>(B)</enum><text>other property (either real or personal); and</text></subparagraph> 
<subparagraph id="H47575FC724F044CCBB49756794E7B3FA"><enum>(C)</enum><text>consideration in-kind, including—</text> 
<clause id="H56034C08764C4054B17265071CABB23B"><enum>(i)</enum><text>provision of space, goods, or services of benefit to NOAA including construction, repair, remodeling, or other physical improvements of NOAA property;</text></clause> 
<clause id="H09708AA9D46B450D92BD8F66E6D338D1"><enum>(ii)</enum><text>maintenance of NOAA property; </text></clause> 
<clause id="H5B14ED889F5245B987B1D95BD20A1E3"><enum>(iii)</enum><text>provision of office, storage, or other useable space; or</text></clause> 
<clause id="HB7089ABCBDBC4BB4AA3B991416B453B7"><enum>(iv)</enum><text display-inline="yes-display-inline">relocation services associated with conveyance of property under this section.</text></clause></subparagraph></paragraph> 
<paragraph id="HE7A711520EDE4218A9A51D82211EFF5"><enum>(3)</enum><header>Determination of fair market value</header><text display-inline="yes-display-inline">The Secretary shall determine fair market value for purposes of paragraph (1) based upon a highest- and best-use appraisal of the property conveyed under subsection (a) conducted in conformance with the Uniform Appraisal Standards for Professional Appraisal Practice.</text></paragraph></subsection> 
<subsection id="H4C8D8CCA1EC74F8CA5C3834112DEE"><enum>(c)</enum><header>Use of Proceeds</header><text display-inline="yes-display-inline">Amounts received under subsection (b)(2)(A) by the United States as proceeds of any conveyance under this section shall be available to the Secretary, subject to appropriation, for—</text> 
<paragraph id="H693D6C443AF541FC9DE2631F6BC4D7C"><enum>(1)</enum><text>activities related to the operations of, or capital improvements, to NOAA property; or</text></paragraph> 
<paragraph id="H962C47B7B08345F6804C143F15359163"><enum>(2)</enum><text>relocation and other costs associated with the sale or exchange.</text></paragraph></subsection> 
<subsection id="HF22015BDB2CB4AA2912FDC7F762781AC"><enum>(d)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The Secretary may require such additional terms and conditions in connection with the conveyance of property by the United States under subsection (a) as the Secretary considers appropriate to protect the interest of the United States, including the recoupment of any profit the City of Norfolk may realize within three years after the date of conveyance to the City due to resale of the property</text></subsection> 
<subsection id="HE5088103D1304BBCB1538B37B2825FA3"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The authority granted to the Secretary under subsections (a) and (b) shall terminate at the end of the 24-month period beginning on the date of enactment of this Act if no contract for sale or exchange under subsection (a) has been entered into by the City of Norfolk and the United States.</text></subsection></section>
