		  excise tax on State revenues from tolls first imposed during calendar year

		<section display-inline="no-display-inline" id="H0D14C947C3AF4892008D92FD00F5E557" section-type="section-one"><enum>1.</enum><header>Excise tax on State revenues
			 from tolls imposed on Federally-financed interstate highways</header>
			<subsection id="HC06729950385441C8897A34C78251077"><enum>(a)</enum><header>In
			 General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/36">Chapter 36</external-xref> of the Internal Revenue Code of 1986 (relating
			 to certain other excise taxes) is amended by inserting after subchapter D the
			 following new subchapter:</text>

					<subchapter id="H23826BC5A1DD4E85A1009D1E09BF14FA"><enum>E</enum><header>Tax on Tolls on
				Federally-Financed Interstate Highways</header>

							<toc-entry level="section">Sec. 4486. Imposition of
				  tax.</toc-entry>
						</toc>
						<section id="H426760E4747547C2A78BBCE798DB0835"><enum>4486.</enum><header>Imposition of
				tax</header>
							<subsection id="H3001A0A555AC4679A4A1CA53A009F5A0"><enum>(a)</enum><header>General
				Rule</header><text>In the case of any toll for the use of any Federal-aid
				interstate highway first imposed during the period beginning on January 1,
				2009, and ending on December 31, 2009, there is hereby imposed an excise tax on
				the amount received by any State (or agency or instrumentality thereof) from
				such toll.</text>
							</subsection><subsection id="HD0C8EF802F7240D489DD36A8F2336FC6"><enum>(b)</enum><header>Amount of
				Tax</header><text>The amount of the tax imposed by subsection (a) shall be an
				amount equal to the toll.</text>
							</subsection><subsection id="H478B258570354176935DADA8ADE9D4C2"><enum>(c)</enum><header>Limitation</header><text>No
				tax shall be imposed by subsection (a) on any toll for the use of any highway
				after the date that the Secretary estimates that the aggregate tax imposed on
				tolls for the use of such highway equals the aggregate amount withdrawn from
				the Highway Trust Fund for such highway.</text>
							</subsection><subsection id="H56D718FE5CC04E94A34ECD57E892FB24"><enum>(d)</enum><header>Federal-Aid
				Interstate Highway</header><text>For purposes of this section, the term
				<term>Federal-aid interstate highway</term> means any Federal-aid highway on
				the Interstate System (as defined in <external-xref legal-doc="usc" parsable-cite="usc/23/101">section 101(a)</external-xref> of title 23, United States
				Code) which is funded in whole or in part from amounts in the Highway Trust
				Fund.</text>
							</subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H03F236542D8547B495D26800C7E8B460"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of subchapters for chapter 36 of such Code is
			 amended by adding at the end the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF1E143DFDCA741EA93E333AAB6B72E10"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply to tolls
			 imposed after December 31, 2008.</text>
			</subsection></section><section id="H79DAE4F8FE0A433C9906BC7560D7A712"><enum>2.</enum><header>Highway toll tax
			 funds made available for trade adjustment assistance programs</header><text display-inline="no-display-inline">There are hereby appropriated to the
			 Secretary of Labor amounts equivalent to the taxes received in the Treasury
			 under <external-xref legal-doc="usc" parsable-cite="usc/26/4486">section 4486</external-xref> of the Internal Revenue Code of 1986 (relating to tax on
			 tolls on Federally-financed interstate highways) for use in carrying out the
			 trade adjustment assistance program under chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2271 et
			 seq.).</text>
