<section id="HFA0994249A164EEDA1558C00543CFEE7"><enum>2.</enum><header>The Corporation for Travel Promotion</header> 
<subsection id="H076812A7AC794DDC95857CC168585964"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Corporation for Travel Promotion is established as a nonprofit corporation. The Corporation shall not be an agency or establishment of the United States Government. The Corporation shall be subject to the provisions of the District of Columbia Nonprofit Corporation Act (sec. 29–301.01 et seq., D.C. Official Code), to the extent that such provisions are consistent with this section, and shall have the powers conferred upon a nonprofit corporation by that Act to carry out its purposes and activities.</text></subsection> 
<subsection id="HA82591BD7443413EB0D6B23E8B45486C"><enum>(b)</enum><header>Board of Directors</header> 
<paragraph id="H37A19AC8430E4ADF98EC609107A9E4A8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Corporation shall have a board of directors of 15 members, appointed by the Secretary of Commerce, but not before consultation with the Secretaries of Homeland Security, State, and Education, as appropriate, each of whom is a United States citizen, and of whom—</text> 
<subparagraph id="H54C8482EEC134013BBDA74B25459845"><enum>(A)</enum><text>one shall have appropriate expertise and experience in the hotel accommodations sector;</text></subparagraph> 
<subparagraph id="HFD4DFEEBAEFC403F80112C74F2EC442"><enum>(B)</enum><text>one shall have appropriate expertise and experience in the restaurant sector;</text></subparagraph> 
<subparagraph id="HF082172BDFDF4EF59B08E33976C89465"><enum>(C)</enum><text display-inline="yes-display-inline">one shall have appropriate expertise and experience in the retail sector, or in associations representing that sector;</text></subparagraph> 
<subparagraph id="H7C5FE876EC234245AC24572751871848"><enum>(D)</enum><text>one shall have appropriate expertise and experience in the small business sector, or in associations representing that sector;</text></subparagraph> 
<subparagraph id="H207A8D2350944325BEC4716DBBE17849"><enum>(E)</enum><text>one shall have appropriate expertise and experience in the advertising sector;</text></subparagraph> 
<subparagraph id="H692920444B3143278C77E65D77415F78"><enum>(F)</enum><text>one shall have appropriate expertise and experience in the attractions sector;</text></subparagraph> 
<subparagraph id="H70D4655B26324849A600655BB9A009E"><enum>(G)</enum><text>one shall have appropriate expertise and experience in the recreation sector;</text></subparagraph> 
<subparagraph id="HBBAA561D9D574D088CCBCBD0FCD316FD"><enum>(H)</enum><text>one shall have appropriate expertise and experience in the research, development, or manufacturing sector;</text></subparagraph> 
<subparagraph id="H65C5E7782BCC4DD88E1569179CC64871"><enum>(I)</enum><text>one shall have appropriate expertise and experience in the financial services sector;</text></subparagraph> 
<subparagraph id="HE36D895D1C114F8595B9CD168B4C2F79"><enum>(J)</enum><text>one shall have appropriate expertise and experience in the passenger air sector;</text></subparagraph> 
<subparagraph id="HA46EADFE6A78485C84DA00F4596C8914"><enum>(K)</enum><text>one shall have appropriate expertise and experience in the car rental sector;</text></subparagraph> 
<subparagraph id="H81F8F62904614A61AEB7E0D2DA230065"><enum>(L)</enum><text>one shall have appropriate expertise and experience as an official at the state and municipal level, or in associations of such officials;</text></subparagraph> 
<subparagraph id="H4E3AFB09B4B44555859D54005F129926"><enum>(M)</enum><text>one shall have appropriate expertise and experience in the higher education sector and in coordinating international scholarly conferences in the United States; </text></subparagraph> 
<subparagraph id="H5D5B612BB1154EDD863089F229CE6C8F"><enum>(N)</enum><text>one shall have appropriate expertise and experience in immigration law and policy, including visa requirements and United States entry procedures; and</text></subparagraph> 
<subparagraph id="H7E37D9803449491D809363D7AC750819"><enum>(O)</enum><text display-inline="yes-display-inline">one shall have appropriate expertise in matters relating to homeland security policy, including border and travel security and facilitation programs.</text> </subparagraph></paragraph> 
<paragraph id="HF4C57D817E9F440A00B98D8E20E1CE91"><enum>(2)</enum><header>Incorporation</header><text display-inline="yes-display-inline">The members of the initial board of directors shall serve as incorporators and shall take whatever actions are necessary to establish the Corporation under the District of Columbia Nonprofit Corporation Act (sec. 29–301.01 et seq.).</text></paragraph> 
<paragraph id="HB50499E682D54BD9A284B1AFF6B873B7"><enum>(3)</enum><header>Term of office</header><text>The term of office of each member of the board appointed by the Secretary shall be 3 years, except that, of the members first appointed—</text> 
<subparagraph id="H6016DC090F0743B791067560A23B5FD1"><enum>(A)</enum><text>3 shall be appointed for terms of 1 year;</text></subparagraph> 
<subparagraph id="HB723D40D6887484B8C60D74860529939"><enum>(B)</enum><text>4 shall be appointed for terms of 2 years; and</text></subparagraph> 
<subparagraph id="H4A7E2DC36A324D4F80F76F2B6D220000"><enum>(C)</enum><text>4 shall be appointed for terms of 3 years.</text></subparagraph></paragraph> 
<paragraph id="HDB6DD0B7BF4E49D8AB00B0303500B355"><enum>(4)</enum><header>Vacancies</header><text>Any vacancy in the board shall not affect its power, but shall be filled in the manner required by this section. Any member whose term has expired may serve until the member’s successor has taken office, or until the end of the calendar year in which the member’s term has expired, whichever is earlier. Any member appointed to fill a vacancy occurring prior to the expiration of the term for which that member’s predecessor was appointed shall be appointed for the remainder of the predecessor’s term. No member of the board shall be eligible to serve more than 2 consecutive full terms.</text></paragraph> 
<paragraph id="H4793B3C8E5B1426BAA78278E70D5E5AA"><enum>(5)</enum><header>Election of chairman and vice chairman</header><text>Members of the board shall annually elect one of their members to be chairman and elect 1 or more of their members as a vice chairman or vice chairmen.</text></paragraph> 
<paragraph id="H26A4EC75CCB64AD288282836CD86ABB8"><enum>(6)</enum><header>Status as federal employees</header><text>Notwithstanding any provision of law to the contrary, no member of the board may be considered to be a Federal employee of the United States by virtue of his or her service as a member of the board.</text></paragraph> 
<paragraph id="H2DB2D98702E949C386CE722FF97C681"><enum>(7)</enum><header>Compensation; expenses</header><text display-inline="yes-display-inline">No member of the board shall receive any compensation from the Federal Government or the Corporation by virtue of his or her service as a member of the board. Each member of the board shall be paid actual travel expenses and per diem in lieu of subsistence expenses when away from his or her usual place of residence, in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703</external-xref> of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="HA2C7D60D7A874827912713121DAE2FB"><enum>(c)</enum><header>Officers and Employees</header> 
<paragraph id="H3518F2A2EC3D4046BC42861EA5117839"><enum>(1)</enum><header>In general</header><text>The Corporation shall have a President, and such other officers as may be named and appointed by the board for terms and at rates of compensation fixed by the board. No individual other than a citizen of the United States may be an officer of the Corporation. The corporation may hire and fix the compensation of such employees as may be necessary to carry out its purposes. No officer or employee of the Corporation may receive any salary or other compensation (except for compensation for services on boards of directors of other organizations that do not receive funds from the Corporation, on committees of such boards, and in similar activities for such organizations) from any sources other than the Corporation for services rendered during the period of his or her employment by the Corporation. Service by any officer on boards of directors of other organizations, on committees of such boards, and in similar activities for such organizations shall be subject to annual advance approval by the board and subject to the provisions of the Corporation’s Statement of Ethical Conduct. All officers and employees shall serve at the pleasure of the board.</text></paragraph> 
<paragraph id="HD5F45A45276D47B0B8395F920532A2E7"><enum>(2)</enum><header>Nonpolitical nature of appointment</header><text>No political test or qualification shall be used in selecting, appointing, promoting, or taking other personnel actions with respect to officers, agents, or employees of the Corporation.</text></paragraph></subsection> 
<subsection id="HD355F22727A94B47A4D7C7661DF75C57"><enum>(d)</enum><header>Nonprofit and Nonpolitical Nature of Corporation</header> 
<paragraph id="HD296E67FF9904451A8C1BBE03157D3E0"><enum>(1)</enum><header>Stock</header><text>The Corporation shall have no power to issue any shares of stock, or to declare or pay any dividends.</text></paragraph> 
<paragraph id="H3596F4F179984598B8A2E1646D139ED3"><enum>(2)</enum><header>Profit</header><text>No part of the income or assets of the Corporation shall inure to the benefit of any director, officer, employee, or any other individual except as salary or reasonable compensation for services.</text></paragraph> 
<paragraph id="H829A988F0C2D414FBFBC5C87D4CA6CE"><enum>(3)</enum><header>Politics</header><text>The Corporation may not contribute to or otherwise support any political party or candidate for elective public office.</text></paragraph> 
<paragraph id="HF89A7F4E77D04386AC3C1500AF1C10B"><enum>(4)</enum><header>Sense of Congress regarding lobbying activities</header><text>It is the sense of Congress that the Corporation established under this Act should not engage in any lobbying activities with any employee or branch of the Federal Government in favor of or in opposition to any political issue.</text></paragraph></subsection> 
<subsection id="H0D28A32BC8744F3C9355B890F8439949"><enum>(e)</enum><header>Duties and Powers</header> 
<paragraph id="HDC939FB101744865A4518F41EAADD050"><enum>(1)</enum><header>In general</header><text>The Corporation shall develop and execute a plan to—</text> 
<subparagraph id="HD6E9AFAD40914993B371C7859188A1AC"><enum>(A)</enum><text display-inline="yes-display-inline">provide useful information to foreign tourists, business people, students, scholars, scientists and others interested in traveling to the United States, including the distribution of material provided by the Federal Government concerning entry requirements, required documentation, fees, and processes, to prospective travelers, travel agents, tour operators, meeting planners, foreign governments, travel media and other international stakeholders;</text></subparagraph> 
<subparagraph id="H86EA806DA8024FB2A2E400800477DC14"><enum>(B)</enum><text display-inline="yes-display-inline">identify and address perceptions in other countries regarding United States entry policies that tend to limit attempts to travel to the United States;</text></subparagraph> 
<subparagraph id="HD697447C46FF4B30B3FFE1F735A7008D"><enum>(C)</enum><text>maximize the economic and diplomatic benefits of travel to the United States by promoting the United States of America to world travelers through the use of, but not limited to, all forms of advertising, outreach to trade shows, and other appropriate promotional activities; and</text></subparagraph> 
<subparagraph id="H70EDA46E8B3845459DDFC4ECB478BC3E"><enum>(D)</enum><text display-inline="yes-display-inline">identify opportunities and strategies to promote tourism to rural and urban areas equally.</text></subparagraph> </paragraph> 
<paragraph id="HB1942CF00A2D4F5ABA2E9F00BA4D0035"><enum>(2)</enum><header>Specific powers</header><text>In order to carry out the purposes of this section, the Corporation may—</text> 
<subparagraph id="HA0414685A24A41F8B44B7DDAE800222F"><enum>(A)</enum><text>obtain grants from and make contracts with individuals and private companies, State, and Federal agencies, organizations, and institutions;</text></subparagraph> 
<subparagraph id="HE448A5EA939C480DA3005C2C82125D8D"><enum>(B)</enum><text>hire or accept the voluntary services of consultants, experts, advisory boards, and panels to aid the Corporation in carrying out its purposes; and</text></subparagraph> 
<subparagraph id="H2DDF70DB6E074A5580A1988DF21D87F5"><enum>(C)</enum><text>take such other actions as may be necessary to accomplish the purposes set forth in this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H56D9962D3A864F0F8B2DCEB7F2756227"><enum>(f)</enum><header>Open Meetings</header><text>Meetings of the board of directors of the Corporation, including any committee of the board, shall be open to the public. The board may, by majority vote, close any such meeting only for the time necessary to preserve the confidentiality of commercial or financial information that is privileged or confidential, to discuss personnel matters, or to discuss legal matters affecting the Corporation, including pending or potential litigation.</text></subsection> 
<subsection id="H314E624E5F5041C69896BF35DF8BABD3"><enum>(g)</enum><header>Major campaigns</header><text>The board may not authorize the Corporation to obligate or expend more than $25,000,000 on any advertising campaign, promotion, or related effort unless—</text> 
<paragraph id="H34188E27A36345D200D874F0DB627E2C"><enum>(1)</enum><text>the obligation or expenditure is approved by an affirmative vote of at least <fraction>2/3</fraction> of the members of the board present at the meeting;</text></paragraph> 
<paragraph id="H986FB956EE084BADAC69E95395551E03"><enum>(2)</enum><text>at least 8 members of the board are present at the meeting at which it is approved; and</text></paragraph> 
<paragraph id="HDBF4D1ADEAB04D7A998C53B683033397"><enum>(3)</enum><text>each member of the board has been given at least 3 days advance notice of the meeting at which the vote is to be taken and the matters to be voted upon at that meeting.</text></paragraph></subsection> 
<subsection id="H326A26B869FC4B9DB9AC28F3A8D154FB"><enum>(h)</enum><header>Fiscal accountability</header> 
<paragraph id="H93AD430B87414E319F8CB6F513083B3"><enum>(1)</enum><header>Fiscal year</header><text>The Corporation shall establish as its fiscal year the 12-month period beginning on October 1.</text></paragraph> 
<paragraph id="HEF2FE5C0F8864064BB675994D16187C5"><enum>(2)</enum><header>Budget</header><text>The Corporation shall adopt a budget for each fiscal year.</text></paragraph> 
<paragraph id="H8D8AB89A9D154A1EBBAC639DC3AC511D"><enum>(3)</enum><header>Annual audits</header><text>The Corporation shall engage an independent accounting firm to conduct an annual financial audit of the Corporation’s operations and shall publish the results of the audit.</text></paragraph></subsection></section> 
<section id="HBD02EF2AB233419C8CAE82F1237F29F4"><enum>3.</enum><header>Accountability measures</header> 
<subsection id="HA559888E90F64A419DA707F7D437645"><enum>(a)</enum><header>Objectives</header><text>The Board shall establish annual objectives for the Corporation for each fiscal year subject to approval by the Secretary, in consultation with the Secretary of Homeland Security and the Secretary of State. The Corporation shall establish a marketing plan for each fiscal year not less than 60 days before the beginning of that year and provide a copy of the plan, and any revisions thereof, to the Secretary.</text></subsection> 
<subsection id="HE1285714AB2E4442BBEF91C4837B015"><enum>(b)</enum><header>Budget</header><text>The board shall transmit a copy of the Corporation’s budget for the forthcoming fiscal year to the Secretary not less than 60 days before the beginning of each fiscal year, together with an explanation of any expenditure provided for by the budget in excess of $5,000,000 for the fiscal year. The Corporation shall make a copy of the budget and the explanation available to the public and shall provide public access to the budget and explanation on the Corporation’s website.</text></subsection> 
<subsection id="HD90EC8B6A9834F49B08C43A062706329"><enum>(c)</enum><header>Annual Report to Congress</header><text>The Corporation shall submit an annual report for the preceding fiscal year to the Secretary of Commerce and the Secretary of Homeland Security for transmittal to Congress on or before the 15th day of May of each year. The report shall include—</text> 
<paragraph id="HCBA038E0BABA48AC97EDD947C519659B"><enum>(1)</enum><text>a comprehensive and detailed report of the Corporation’s operations, activities, financial condition, and accomplishments under this Act;</text></paragraph> 
<paragraph id="HB5E2CD824336470AB300C25D753D6E64"><enum>(2)</enum><text>a comprehensive and detailed inventory of amounts obligated or expended by the Corporation during the preceding fiscal year;</text></paragraph> 
<paragraph id="H7CFAE32601D74961B88B5D9FBBB45392"><enum>(3)</enum><text display-inline="yes-display-inline">a detailed description of each in-kind contribution, its fair market value, the individual or organization responsible for contributing, its specific use, and a justification for its use within the context of the Corporation's mission;</text></paragraph> 
<paragraph id="H12AED60ADEC04F4A8BDC8DCCEA0A0EF"><enum>(4)</enum><text>an objective and quantifiable measurement of its progress, on an objective-by-objective basis, in meeting the objectives established by the board;</text></paragraph> 
<paragraph id="H6F0E4A3CAE474F4DA545E138E20633FE"><enum>(5)</enum><text>an explanation of the reason for any failure to achieve an objective established by the board, and any revisions or alterations to the Corporation’s objectives under subsection (a);</text></paragraph> 
<paragraph id="HA5C95D0F2AF541DEAE70CAA73161EA00"><enum>(6)</enum><text display-inline="yes-display-inline">a comprehensive and detailed report of the Corporation’s operations and activities to promote tourism in rural and urban areas; and</text></paragraph> 
<paragraph id="H217CD02F47D74706AB2E7F61BA41D32E"><enum>(7)</enum><text>such recommendations as the Corporation deems appropriate.</text></paragraph></subsection></section> 
<section id="H7FAE2BBE9F814071A28906AA96DE4FED"><enum>4.</enum><header>Matching public and private funding</header> 
<subsection id="H7D8910686D1C4AE2907D988F3ED46FD0"><enum>(a)</enum><header>Establishment of Travel Promotion Fund</header><text>There is hereby established in the Treasury a fund which shall be known as the <quote>Travel Promotion Fund</quote>.</text></subsection> 
<subsection id="H4CA58903B2B94410BF6200FF00BE90A0"><enum>(b)</enum><header>Funding</header> 
<paragraph id="H1CE2F0EB55074F3687E4626152A600EA"><enum>(1)</enum><header>First year</header><text display-inline="yes-display-inline">For fiscal year 2009, the Secretary of the Treasury, not earlier than October 1, 2008, and not before the Secretary has appointed all members of the Corporation’s board of directors, may transfer to the Corporation such sums as may be necessary, but not to exceed $10,000,000, subject to the availability of appropriations to carry out this section to cover its initial expenses and activities under this Act. At the earliest practicable date, the Corporation shall reimburse the Treasury any such amounts borrowed from the Treasury, with at least 50 percent reimbursed before October 1, 2011, and the remainder reimbursed before October 1, 2013. Reimbursement shall include interest at a rate determined by the Treasury taking into consideration current market yields on outstanding Treasury securities of comparable maturities and including any additional charges determined by the Secretary of the Treasury to cover any probable losses and reasonable administrative costs. The Secretary of the Treasury shall determine and assess penalties to be applied for late payments of principal or interest and other Federal credit terms designed to minimize Federal exposure to loss, consistent with the Federal Credit Reform Act and other applicable Federal credit policies.</text></paragraph> 
<paragraph id="HFA775ADC20A8441CABCB5524038BDD74"><enum>(2)</enum><header>Subsequent years</header><text display-inline="yes-display-inline">For each of fiscal years 2010 through 2013, from amounts deposited in the general fund of the Treasury during the preceding fiscal year from fees under section 5, the Secretary of the Treasury shall transfer not more than $100,000,000 to the Fund, which shall be made available to the Corporation, subject to subsections (c), (d), and (e), to carry out its functions under this Act. Transfers shall be made by the Secretary of the Treasury at least quarterly on the basis of estimates by the Secretary of the Treasury, determined in consultation with the Board, of contributions made to the Corporation by non-Federal sources, and proper adjustments shall be made in amounts subsequently transferred to the extent prior estimates were in excess or less than actual contributions from non-Federal sources.</text></paragraph></subsection> 
<subsection id="H63568F54D7834875A4956BA764708B8"><enum>(c)</enum><header>Matching Requirement</header> 
<paragraph id="HFE52DCD4F53144CDBB02E84ED0A2EE8C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall make available to the Corporation from amounts available in the Travel Promotion Fund—</text> 
<subparagraph id="H8387ACE6336B494DA65272DD2635656B"><enum>(A)</enum><text>for fiscal year 2010, twice the amount that will be collected from non-Federal sources by the Corporation pursuant to section 4(b)(2) of this Act and not to exceed $100,000,000; and</text></subparagraph> 
<subparagraph id="H02F0F6E5C7BC4647AC4459E19B2B9DF7"><enum>(B)</enum><text>for subsequent fiscal years, an amount equal to the amount that will be collected from non-Federal sources by the Corporation pursuant to section 4(b)(2) of this Act and not to exceed $100,000,000.</text> </subparagraph></paragraph> 
<paragraph id="H059F90F7FEC54D8D8F51D27DF3EE00C2"><enum>(2)</enum><header>Goods and services</header><text>For the purpose of determining the amount of matching funds, other than money, available to the Corporation—</text> 
<subparagraph id="H8947CD52B78A404AA1DB42063F25AD7D"><enum>(A)</enum><text display-inline="yes-display-inline">the fair market value, as determined by the Corporation, of goods and services (including advertising) contributed to the Corporation for use under this Act may be included in the determination; but</text></subparagraph> 
<subparagraph id="H75AB291CB68C4E519856B7BF190023E8"><enum>(B)</enum><text>the fair market value of such goods and services may not account for more than 65 percent of the matching requirement for the Corporation in any fiscal year.</text></subparagraph></paragraph> 
<paragraph id="H23AB782C289D46A8B416B11F6FE9E76E"><enum>(3)</enum><header>Right of refusal</header><text>The Corporation may decline to accept any contribution in kind that it determines to be inappropriate, not useful, or commercially worthless.</text></paragraph> </subsection> 
<subsection id="HD0795CE314BB4C7CABEAB33D8B4AD69"><enum>(d)</enum><header>Grant offset</header><text display-inline="yes-display-inline">For a given fiscal year, the Secretary of the Treasury shall reduce the total amount of funding to be transferred to the Corporation from the Travel Promotion Fund by the amount of grants received by the Corporation pursuant to section 2(e)(2)(A) to be used during that fiscal year.</text></subsection> 
<subsection id="HE5AE3D3980364DF4ACF831BA94C65408"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Corporation shall not expend funds or obligate to expend funds that will exceed total amounts received by the Corporation for a given fiscal year.</text></subsection></section> 
<section id="H0A165256ECC04E84A11E72A1F00B6C"><enum>5.</enum><header>Travel Promotion Fund fees</header><text display-inline="no-display-inline">Section 217(h)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(h)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="HDDABE9EED5DD4631805CA0AE357BB3B3"><enum>(1)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph> 
<paragraph id="H464F839015F84051BEB7EB063FC68766"><enum>(2)</enum><text>in clause (ii), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H65CE7BE0FCF840278C5E481B472033AA"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H34254732C75444BC8755990525802C3E" display-inline="no-display-inline"> 
<clause id="HFBE61E539A454D4E9B2E7FD47F35E605"><enum>(iii)</enum><text display-inline="yes-display-inline">set for an amount that includes an additional amount of not less than $10 above the amount set under clause (i).</text></clause> 
<quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">The additional amount required under clause (iii) shall be transferred to the Treasury for the purpose of offsetting appropriations made to the Corporation for Travel Promotion established in section 2 of the Travel Promotion Act of 2008, according to the requirements of section 4 of such Act. Such additional amount may be reduced if the secretary of the Treasury determines that the additional amount is not necessary to ensure that the Corporation is fully funded.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H119275C148A245919EEF806542EF749E"><enum>6.</enum><header>Investment of Funds</header><text display-inline="no-display-inline">Pending disbursement pursuant to a program, plan, or project, the Corporation may invest funds received by the Corporation only in obligations of the United States or any agency thereof, in general obligations of any State or any political subdivision thereof, in any interest-bearing account or certificate of deposit of a bank that is a member of the Federal Reserve System, or in obligations fully guaranteed as to principal and interest by the United States. The Secretary of the Treasury shall reduce the total amount of funding for a given fiscal year to be transferred from the Travel Promotion Fund to the Corporation by the amount of interest earned by the Corporation as a result of its investments pursuant to this section for the preceding fiscal year.</text></section> 
<section id="H8A38129E8DDB415F829C3D252E42308E"><enum>7.</enum><header>Prohibition on use of funds</header><text display-inline="no-display-inline">No funds raised by the Treasury Department’s Travel Promotion Fund or the Corporation for Travel Promotion may be used to directly promote or advertise a specific corporation.</text></section> 
<section id="H978164845C7149BFBEA7DC87DA177967"><enum>8.</enum><header>Amendments to the International Travel Act of 1961</header> 
<subsection id="H77F5F61F66F944BAA124015FD0D51884"><enum>(a)</enum><header>Powers and duties of Secretary of Commerce</header><text display-inline="yes-display-inline">Section 201 of the International Travel Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2122">22 U.S.C. 2122</external-xref>) is amended—</text> 
<paragraph id="H243D867CCC934A730071F4D6002426A7"><enum>(1)</enum><text>in the first sentence of the matter preceding paragraph (1)—</text> 
<subparagraph id="H0FA9AD790DDC4B7C979CFAB4B5C42DE6"><enum>(A)</enum><text>by striking <quote>and by the United States National Tourism Organization Act of 1996</quote>; and</text></subparagraph> 
<subparagraph id="HB385B9C4C5974EEFBA87496C625132E7"><enum>(B)</enum><text>by striking <quote>United States National Tourism Organization</quote> and inserting <quote>Corporation for Travel Promotion (established by section 3 of the Travel Promotion Act of 2008)</quote>; </text></subparagraph></paragraph> 
<paragraph id="H16E5485EF2E64CFD9F89A510F2AA49F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>United States National Tourism Organization</quote> and inserting <quote>Corporation for Travel Promotion</quote>; and</text></paragraph>

<section id="H79894E5CA41147EC91492E7408438DBF"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="HC19B1F6D7D1D4594967685B62FFAE8BB"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the board of directors of the Corporation.</text></paragraph> 
<paragraph id="H60B11EAD036844E4820066EEFCA641F1"><enum>(2)</enum><header>Corporation</header><text>The term <term>Corporation</term> means the Corporation for Travel Promotion established by section 2.</text></paragraph> 
<paragraph id="HBA2CEABF0440432FBF3221DCAC24DDD0"><enum>(3)</enum><header>Fund</header><text>The term <term>Fund</term> means the Travel Promotion Fund established by section 4.</text></paragraph> 
<paragraph id="H27FDC9E15F4A4137A4893CF09C631654"><enum>(4)</enum><header>Secretary</header><text>Except as otherwise expressly provided, the term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section> 
<section id="HBB6D6BB0E2A84784A78456FD88328CB"><enum>10.</enum><header>G.A.O. study</header> 
<subsection id="H5E5ABEC18AD0419FA4FE545F461760FF"><enum>(a)</enum><header>In General</header><text>Not later than 90 days after the date of enactment of this Act, the Government Accountability Office shall initiate a study to assess barriers to entry into the United States by foreign travelers. The GAO shall consult with the Department of Homeland Security, including U.S. Immigration and Customs Enforcement and Customs and Border Protection, the Department of Commerce, and the Department of the Treasury, as necessary. </text></subsection> 
<subsection id="HF638AEEE83234886A9E2F536F77D1D0"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the GAO shall report the findings to the appropriate Congressional committees. The report shall include— </text> 
<paragraph id="HE10C59B7E8D44C38BCC1FB3DDDC3CD4"><enum>(1)</enum><text>the GAO’s findings on specific barriers to entry into the United States by foreign travelers; and </text></paragraph> 
<paragraph id="H3660B17D86E44541BE17FC97DCCCC100"><enum>(2)</enum><text>recommendations for initiatives that may reduce those barriers. </text></paragraph></subsection></section>
