		<official-title>To enable States to acquire hybrid motor vehicles to
		  satisfy certain fleet acquisition requirements.</official-title>

		<section id="H133A44BCC3144A0BBE0491F39F6C36DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>New Opportunities for Fuel Efficient
			 Fleets Act</short-title></quote>.</text>
		</section><section id="HC91CB644639E4143AD3448D827275221" section-type="subsequent-section"><enum>2.</enum><header>Hybrid motor vehicle
			 acquisition by States</header><text display-inline="no-display-inline">Section
			 507(o) of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13257">42 U.S.C. 13257(o)</external-xref>) is amended by
			 adding at the end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H5525F945723340029000B62BFACB1BE" style="OLC">
				<paragraph id="H53D1CFCCA9C54B06BD77B94135D2C16B" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0E5B715512E54D608DB9F66DF5B66BF2"><enum>(A)</enum><text>For purposes of this
				subsection, a hybrid motor vehicle shall be considered an alternative fueled
				vehicle when acquired by a State if publicly available fueling facilities that
				dispense E85 fuel are not convenient or accessible in the State.</text>
					</subparagraph><subparagraph id="H1C1CA3E28E0A4750A3D336E9792F7104" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the
				term <term>hybrid motor vehicle</term> means a new qualified hybrid motor
				vehicle, as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/30B">section 30B(d)(3)</external-xref> of the Internal Revenue Code of 1986
				that—</text>
						<clause id="H2BFEC073F5A94D889C1CA873CC9F96E5"><enum>(i)</enum><text>achieves at least 25 percent better
				fuel economy ratings than comparable gasoline fueled vehicles, as determined by
				the Secretary; or</text>
						</clause><clause id="H452781930D3248D790B61FD7A1E24ECE"><enum>(ii)</enum><text display-inline="yes-display-inline">achieves at least 10 percent better fuel
				economy ratings than comparable gasoline fueled vehicles, and is determined by
				the Secretary to be appropriate for consideration as an alternative fueled
				vehicle under this paragraph, on the basis of improved emissions, availability,
				or technological
				innovation.</text>
