		<section display-inline="no-display-inline" id="HC28FBDDCA8F344D483474BC1EA687E51" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dam Rehabilitation and Repair Act of
			 2007</short-title></quote>.</text>
		</section><section id="HADB719D58A4A472A95663D79F40817E3"><enum>2.</enum><header>Rehabilitation
			 and repair of deficient dams</header>
			<subsection id="H12B05384A0704EB0A952F603E8FACD9F"><enum>(a)</enum><header>Definitions</header><text>Section
			 2 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467">33 U.S.C. 467</external-xref>) is amended—</text>
				<paragraph id="H2917C70EBB144649A692AD88051AE7C"><enum>(1)</enum><text>by
			 redesignating paragraphs (3), (4), (5), (6), (7), (8), (9), (10), (11), (12),
			 and (13) as paragraphs (4), (5), (6), (7), (8), (9), (10), (12), (13), (14),
			 and (15), respectively;</text>
				</paragraph><paragraph id="H7A52FB7F231245F9ADDF4D79F0000CB"><enum>(2)</enum><text>by
			 inserting after paragraph (2) the following:</text>
					<quoted-block id="H730D151C405844DCBC98A332C4BEC2ED">
						<paragraph id="H61DC757522B34DF5BFD5EE3700589E72"><enum>(3)</enum><header>Deficient
				dam</header><text>The term <term>deficient dam</term> means a dam that the
				State within the boundaries of which the dam is located determines—</text>
							<subparagraph id="H25C2F3F23F6A4230B8402CA73B3EB2DC"><enum>(A)</enum><text>fails to meet
				minimum dam safety standards of the State; and</text>
							</subparagraph><subparagraph id="H95072B02D5D2487C96AA3032F1C0D4B5"><enum>(B)</enum><text>poses an
				unacceptable risk to the public.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H927F124F91CD4A4884EB93005538A652"><enum>(3)</enum><text>by inserting after
			 paragraph (10) (as redesignated by paragraph (1)) the following:</text>
					<quoted-block id="H6C428A7C8E384B9DAF93A8E7F8CC400">
						<paragraph id="HE2C369109C71496FA6FE93CBBCB10030"><enum>(11)</enum><header>Rehabilitation</header><text>The
				term <term>rehabilitation</term> means the repair, replacement, reconstruction,
				or removal of a dam that is carried out to meet applicable State dam safety and
				security
				standards.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9AD0302B4F9F4E59ABF5FF2DEAF1903B"><enum>(b)</enum><header>Program for
			 rehabilitation and repair of deficient dams</header><text>The National Dam
			 Safety Program Act is amended by inserting after section 8 (<external-xref legal-doc="usc" parsable-cite="usc/33/467f">33 U.S.C. 467f</external-xref>) the
			 following:</text>

					<section id="H3408F4F2F85F4A1E89A7242E6FEEB9D"><enum>8A.</enum><header>Rehabilitation
				and repair of deficient dams</header>
						<subsection id="H32E35EB9D44A4490B742A719D7CED4D6"><enum>(a)</enum><header>Establishment of
				program</header><text>The Director shall establish, within FEMA, a program to
				provide grant assistance to States for use in rehabilitation of publicly-owned
				deficient dams.</text>
						</subsection><subsection id="HCE3ADA10175D43BA996845D1E8A0ABD3"><enum>(b)</enum><header>Award of
				grants</header>
							<paragraph id="HDE8BCEB84FDF471FA1D29740CBCC1EC2"><enum>(1)</enum><header>Application</header><text>A
				State interested in receiving a grant under this section may submit to the
				Director an application for such grant. Applications submitted to the Director
				under this section shall be submitted at such times, be in such form, and
				contain such information, as the Director may prescribe by regulation.</text>
							</paragraph><paragraph id="H9454A0B0EC6E4A7F9C9E160964005383"><enum>(2)</enum><header>In
				general</header><text>Subject to the provisions of this section, the Director
				may make a grant for rehabilitation of a deficient dam to a State that submits
				an application for the grant in accordance with the regulations prescribed by
				the Director. The Director shall enter into a project grant agreement with the
				State to establish the terms of the grant and the project, including the amount
				of the grant.</text>
							</paragraph><paragraph id="H7CB5C8B763E94ABABC43ED0070CAE4F9"><enum>(3)</enum><header>Applicability of
				standards</header><text>The Director shall require States that apply for grants
				under this section to comply with the standards of section 611(j)(9) of the
				Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
				5196(j)(9)), as in effect on the date of enactment of this section, with
				respect to projects assisted under this section in the same manner as
				recipients are required to comply in order to receive financial contributions
				from the Director for emergency preparedness purposes.</text>
							</paragraph></subsection><subsection id="HFE11494687464E9900FDB14E77CEFAFD"><enum>(c)</enum><header>Priority
				system</header><text>The Director, in consultation with the Board, shall
				develop a risk-based priority system for use in identifying deficient dams for
				which grants may be made under this section.</text>
						</subsection><subsection id="H6AC95A793C6D4D2FA2C47CEEB9C11DBC"><enum>(d)</enum><header>Allocation of
				funds</header><text>The total amount of funds appropriated pursuant to
				subsection (f)(1) for a fiscal year shall be allocated for making grants under
				this section to States applying for such grants for that fiscal year as
				follows:</text>
							<paragraph id="HF92C8C84A3C24D72966492EC11C19D63"><enum>(1)</enum><text>One-third divided
				equally among applying States.</text>
							</paragraph><paragraph id="HBBEB9B03FCBB45C8A01550BEFA48F9A7"><enum>(2)</enum><text>Two-thirds among
				applying States based on the ratio that—</text>
								<subparagraph id="HF6A3B3C45FC44DD19B9367B59E68038"><enum>(A)</enum><text>the number of
				non-Federal publicly-owned dams that the Secretary of the Army identifies in
				the national inventory of dams maintained under section 6 as constituting a
				danger to human health and that are located within the boundaries of the State;
				bears to</text>
								</subparagraph><subparagraph id="HCE2B429DDECB479BAA54792277AF09A5"><enum>(B)</enum><text>the number of
				non-Federal publicly-owned dams that are so identified and that are located
				within the boundaries of all applying States.</text>
								</subparagraph></paragraph></subsection><subsection id="HEAAC8F571AF44F62B4D0CCAE7843A2D"><enum>(e)</enum><header>Cost
				sharing</header><text>The Federal share of the cost of rehabilitation of a
				deficient dam for which a grant is made under this section may not exceed 65
				percent of the cost of such rehabilitation.</text>
						</subsection><subsection id="H523D236188D2431EB020F8F3F6E4D500"><enum>(f)</enum><header>Authorization of
				appropriations</header>
							<paragraph id="H690CA70C1A1742B1AB8F07F12DC5EDF2"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated to carry out this
				section—</text>
								<subparagraph id="H132F8D5ED31449B2007BFE7116B53C2"><enum>(A)</enum><text>$10,000,000 for
				fiscal year 2008;</text>
								</subparagraph><subparagraph id="H59D7ABC172D44529A0AD6CEE9C597C62"><enum>(B)</enum><text>$15,000,000 for
				fiscal year 2009;</text>
								</subparagraph><subparagraph id="HD9010ED3EA1743A593613C58FC5CE1F0"><enum>(C)</enum><text>$25,000,000 for
				fiscal year 2010;</text>
								</subparagraph><subparagraph id="H3233762C57D34768BC69CFF2385D33E0"><enum>(D)</enum><text>$50,000,000 for
				fiscal year 2011; and</text>
								</subparagraph><subparagraph id="H4204A9D346EE409EAB3B8B33D7F42BFE"><enum>(E)</enum><text>$100,000,000 for
				fiscal year 2012.</text>
								</subparagraph></paragraph><paragraph id="H050E52BFA6EA45C4B028AA441CF40589"><enum>(2)</enum><header>Staff</header><text>There
				are authorized to be appropriated to provide for the employment of such
				additional staff of FEMA as are necessary to carry out this section $400,000
				for each of fiscal years 2008 through 2010.</text>
							</paragraph><paragraph id="H780678148C884A0F951EE6060486EFB5"><enum>(3)</enum><header>Period of
				availability</header><text>Sums appropriated pursuant to this section shall
				remain available until
				expended.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H644A6DC419BB478B9D811BDD2070D9C2"><enum>3.</enum><header>Rulemaking</header>
			<subsection id="HB62557E9BEF24E35B36923EFF5CFEB38"><enum>(a)</enum><header>Proposed
			 rulemaking</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Director of the Federal Emergency Management Agency shall issue a
			 notice of proposed rulemaking regarding the amendments made by section 2 to the
			 National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467">33 U.S.C. 467 et seq.</external-xref>).</text>
			</subsection><subsection id="H30D8BF7372EB423FAC2FAD40FDF922E0"><enum>(b)</enum><header>Final
			 rule</header><text>Not later than 120 days after the date of enactment of this
			 Act, the Director of the Federal Emergency Management Agency shall issue a
			 final rule regarding such amendments.</text>
