		<section id="H8F6AF2D08E8E49339DDB00A060A50030" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keep Our Waterfronts Working Act of
			 2007</short-title></quote>.</text>
		</section><section id="H6AA2CA5A33F4425C924743BE3C7014AD"><enum>2.</enum><header>Working
			 waterfront program</header><text display-inline="no-display-inline">The Coastal
			 Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HC9C686885AC94517877EB8C39BB53E46" style="OLC">
				<section id="HF734B94D20BD4F32B1FB3CE213D20192"><enum>320.</enum><header>Working
				Waterfront Grant Program</header>
					<subsection display-inline="no-display-inline" id="HC3F36B243DC74D6DA111BA5EEDFE00FB"><enum>(a)</enum><header>Findings and
				purpose</header>
						<paragraph id="HE8EED9AA1E5B4501981C5839E9715C22"><enum>(1)</enum><text>The Congress finds
				the following:</text>
							<subparagraph id="H746A4DF884554C73A296DB962433C281"><enum>(A)</enum><text>Water-dependent
				commercial activities are the economic and cultural heart of many coastal
				communities. These activities include commercial fishing, recreational fishing,
				tourism, aquaculture, boat-building, transportation, and many other
				water-dependent businesses.</text>
							</subparagraph><subparagraph id="H5D3259266D3C4FF88554D299E000B3C2"><enum>(B)</enum><text>Water-dependent
				commercial activities depend on coastal access in the form of docks, wharfs,
				lifts, wet and dry marinas, boat ramps, boat hauling, repair, and construction
				facilities, commercial fishing facilities, and other support structures on,
				over, or adjacent to navigable bodies of water.</text>
							</subparagraph><subparagraph id="HB1F9359D4E9D44C997C09EA475A0D0D0"><enum>(C)</enum><text>The coastal zone
				across the United States is experiencing rising property values and taxes, and
				related development pressure, as more people move to the coastal zone, and as
				coastal areas experience a demographic shift favoring older and wealthier
				citizens.</text>
							</subparagraph><subparagraph id="HC2E6BE3687BD40C8A5C9E66836FC59F8"><enum>(D)</enum><text>Privately owned
				access areas for water-dependent commercial activity in many States are under
				increasing threat from private residential development and other
				conversion.</text>
							</subparagraph><subparagraph id="H54431FC110A748ABA89EE1855CB6BA4"><enum>(E)</enum><text>Loss of access for
				water-dependent commercial activity would have economically and culturally
				devastating consequences for many coastal communities.</text>
							</subparagraph></paragraph><paragraph id="H0D3E7ACFCABB439D898D1B775353DA7B"><enum>(2)</enum><text>The purpose of
				this section is to preserve, protect, and expand coastal access for persons
				engaged in water-dependent commercial activities including commercial fishing,
				recreational fishing, aquaculture, boat-building, or other water-dependent
				coastal-related businesses.</text>
						</paragraph></subsection><subsection id="HDDE2C009BD834B6A928B685B58F35EA"><enum>(b)</enum><header>Grant
				program</header>
						<paragraph id="H13DE997281B248208F74010500A6A146"><enum>(1)</enum><text>The Secretary
				shall establish a Working Waterfront Grant Program, in cooperation with
				appropriate State, regional, and other units of government, under which the
				Secretary may make a grant to any coastal state for the purpose of implementing
				a working waterfront plan approved by the Secretary under subsection
				(c).</text>
						</paragraph><paragraph id="H72C4EDD232974365AC7C2CFE7B00326B"><enum>(2)</enum><text display-inline="yes-display-inline">Subject to the availability of
				appropriations, the Secretary shall award matching grants under the program
				through a regionally equitable, competitive funding process.</text>
						</paragraph><paragraph id="H4F681E36A9ED45A4A5F1AB95C157D85C"><enum>(3)</enum><text>In awarding a
				grant to an eligible coastal State, the Secretary shall consider—</text>
							<subparagraph id="H307A28E0130B4BAAA682B17260B74839"><enum>(A)</enum><text>the economic and
				cultural significance of working waterfront to the coastal state;</text>
							</subparagraph><subparagraph id="H5041516E9D914FCBA71244DD005389C"><enum>(B)</enum><text>the working
				waterfront and needs of the coastal state as outlined in the working waterfront
				plan submitted by the coastal state under subsection (c);</text>
							</subparagraph><subparagraph id="H0ED71FD6B43A4175AE34AA2A0137417"><enum>(C)</enum><text>the demonstrated
				working waterfront needs of the coastal state as outlined by a working
				waterfront plan approved for the coastal state under subsection (c), and the
				value of the proposed project for the implementation of such Plan;</text>
							</subparagraph><subparagraph id="HD80FCFC95F5B4A71A685B4CFD982233"><enum>(D)</enum><text>the ability to
				successfully leverage funds among participating entities, including Federal
				programs, regional organizations, State and other government units, landowners,
				corporations, or private organizations;</text>
							</subparagraph><subparagraph id="H0895A59BFA244B21B43B57F804CD2BD6"><enum>(E)</enum><text>the potential for
				rapid turnover in the ownership of working waterfront in the coastal state, and
				where applicable the need for coastal states to respond quickly when properties
				in existing or potential working waterfront areas or public access areas as
				identified in the working waterfront plan submitted by the coastal state come
				under threat or become available; and</text>
							</subparagraph><subparagraph id="H93EE6D0C06984998003F3F377F604EC5"><enum>(F)</enum><text display-inline="yes-display-inline">the impact of the proposed project on the
				coastal ecosystem.</text>
							</subparagraph></paragraph><paragraph id="H6469ED106CC34079822C643EAE69E9DC"><enum>(4)</enum><text>The Secretary
				shall approve or reject an application for such a grant within 30 days after
				receiving an application for the grant.</text>
						</paragraph></subsection><subsection id="H54FD9C45A9614B47A1B8C74CFD3FF492"><enum>(c)</enum><header>working
				waterfront plans</header>
						<paragraph id="HD434DCEC536A4E569303295CAEBD106B"><enum>(1)</enum><text>To qualify for a
				grant under subsection (b), a coastal state must submit and have approved by
				the Secretary a comprehensive working waterfront plan in accordance with this
				subsection.</text>
						</paragraph><paragraph id="HAFAF148C581D43D7BBCDF2C6077DBA3F"><enum>(2)</enum><text>Such plan—</text>
							<subparagraph id="H862F184F0AAE4A35B2D804809D1D49C9"><enum>(A)</enum><text>must provide for
				preservation and expansion of access to coastal waters to persons engaged in
				commercial fishing, recreational fishing, or other water-dependent
				coastal-related business;</text>
							</subparagraph><subparagraph id="H3D169658577B4D09B56D7B404CB09790"><enum>(B)</enum><text>shall
				include—</text>
								<clause id="H6C75FFB3235A4ED28B87A436A231B49D"><enum>(i)</enum><text>an
				assessment of the economic, social, and cultural value of working waterfront to
				the coastal state;</text>
								</clause><clause id="H901A198417DD40CFB9C365DF29A98188"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of relevant State and local
				laws and regulations affecting working waterfront in the geographic areas
				identified in the working waterfront plan;</text>
								</clause><clause id="H6F833A947F794BC990F58496CCD263FC"><enum>(iii)</enum><text>identification
				of geographic areas where working waterfronts are currently under threat of
				conversion to uses incompatible with commercial fishing, recreational fishing,
				or other water-dependent coastal-related business, and the level of that
				threat;</text>
								</clause><clause id="H23435A15C8324690A2AF121F79C28582"><enum>(iv)</enum><text display-inline="yes-display-inline">identification of geographic areas
				appropriate for working waterfronts where working waterfronts are not currently
				available, and, where appropriate, an assessment of the environmental impacts
				of any expansion or new development of working waterfronts on the coastal
				ecosystem;</text>
								</clause><clause id="H7E9DBF948D2B4D99B8E72F78C33F6A5"><enum>(v)</enum><text display-inline="yes-display-inline">identification of other working waterfront
				needs including improvements to existing working waterfronts and working
				waterfront areas;</text>
								</clause><clause id="H15D9A88A722C4802BEEC42A137F1A5B3"><enum>(vi)</enum><text>for areas
				identified under clauses (iii), (iv) and (v), identification of current
				availability and potential for expansion of public access to coastal
				waters;</text>
								</clause><clause id="H113FA08049AA4C23AA5795C1E2225D9F"><enum>(vii)</enum><text>a strategic and
				prioritized plan for the preservation, expansion, and improvement of working
				waterfronts in the coastal state, including where appropriate provisions for
				the preservation and expansion of public access to coastal waters; and</text>
								</clause><clause id="H62EBD6193E3D46DDA0F331AF3376D47E"><enum>(viii)</enum><text>a description
				of the degree of community support for such strategic plan; and</text>
								</clause></subparagraph><subparagraph id="HA9F5C379879E4BC7838300421D9B79EF"><enum>(C)</enum><text>may be part of the
				management program approved under section 306.</text>
							</subparagraph></paragraph><paragraph id="H2A9846545E9445FFBFDC88C2CE6D6AD"><enum>(3)</enum><text>A working
				waterfront plan—</text>
							<subparagraph id="HF9EFCF5257034A8200F8E6532BA92E26"><enum>(A)</enum><text>shall be effective
				for purposes of this section for the 5-year period beginning on the date it is
				approved by the Secretary; and</text>
							</subparagraph><subparagraph id="H2417A3744D3C45A6B11D9C7708DE71FF"><enum>(B)</enum><text>must be updated
				and re-approved by the Secretary before the end of such period.</text>
							</subparagraph></paragraph><paragraph id="H922F8157079A406CB77CEB2C767EBB8C"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary may award planning grants to
				coastal states for the purpose of developing or revising comprehensive working
				waterfront plans.</text>
						</paragraph></subsection><subsection id="H50D30F6D37044D83AA1CF5421E21009E"><enum>(d)</enum><header>Uses, terms, and
				conditions</header>
						<paragraph id="HF99D210F50944D8EB2FD83E84E5C2C12"><enum>(1)</enum><text>Each grant made by
				the Secretary under this section shall be subject to such terms and conditions
				as may be appropriate to ensure that the grant is used for purposes consistent
				with this section.</text>
						</paragraph><paragraph id="H77BF70C57C8A4A42A22152C875B9F728"><enum>(2)</enum><text>A grant under this
				section may be used—</text>
							<subparagraph id="HACAC2AFD2C1E43D58B91FBC5C9F05461"><enum>(A)</enum><text>to acquire a
				working waterfront, or an interest in a working waterfront; or</text>
							</subparagraph><subparagraph id="H7837C4B4FFDC4C09ADF49D6E58038177"><enum>(B)</enum><text>to make
				improvements to a working waterfront, including the construction or repair of
				wharfs, boat ramps, or related facilities.</text>
							</subparagraph></paragraph></subsection><subsection id="HE32D929BD1734965AF9201B6AA26F8EB"><enum>(e)</enum><header>Public access
				requirement</header><text>A working waterfront project funded by grants made
				under this section must provide for expansion or improvement of public access
				to coastal waters at or in the vicinity of a working waterfront, except for
				commercial fishing or other industrial access points where the coastal state
				determines that public access would be unsafe.</text>
					</subsection><subsection id="HF7E1EF335AAD484188ED479584BB1E7C"><enum>(f)</enum><header>Limitations</header>
						<paragraph id="H3C56BBCCB4A740F29E00D19100D8C3D9"><enum>(1)</enum><text>Except as provided
				in paragraph (2), a grant awarded under this section may be used to purchase
				working waterfront or an interest in working waterfront, including an easement,
				only from a willing seller and at fair market value.</text>
						</paragraph><paragraph id="H1B91CCC2CF17469E9D5E614ED8FEA8AB"><enum>(2)</enum><text display-inline="yes-display-inline">A grant awarded under this section may be
				used to acquire working waterfront or an interest in working waterfront at less
				than fair market value only if the owner certifies to the Secretary that the
				sale is being entered into willingly and without coercion.</text>
						</paragraph><paragraph id="HC2E8D889968745C3937F31A3485641A5"><enum>(3)</enum><text>No Federal, State,
				or local entity may exercise the power of eminent domain to secure title to any
				property or facilities in connection with a project carried out under this
				section.</text>
						</paragraph></subsection><subsection id="HE5601AC050AA49F9902200349C5F1702"><enum>(g)</enum><header>Allocation of
				grants to local governments and other entities</header>
						<paragraph id="H1A8533823B6F463BADB26332AC9C3655"><enum>(1)</enum><text>Subject to the
				approval of the Secretary, a coastal state may, as part of an approved working
				waterfront plan, designate as a qualified holder any unit of local government
				or nonprofit organization.</text>
						</paragraph><paragraph id="HA302EEEB055A47618BA04E56A7353374"><enum>(2)</enum><text>A coastal state or
				a qualified holder designated by a coastal state that is the recipient of a
				grant made under this section may allocate to a unit of local government,
				non-profit organization, fishing cooperative, or other entity, a portion of any
				grant made under this section for the purpose of carrying out this section,
				except that such an allocation shall not relieve the coastal state of the
				responsibility for ensuring that any funds so allocated are applied in
				furtherance of the coastal state's approved working waterfront plan.</text>
						</paragraph><paragraph id="H20B7565EDDAF44DFADCFF6995DF1B3DE"><enum>(3)</enum><text>A qualified holder
				may hold title to or interest in property acquired under this section, except
				that—</text>
							<subparagraph id="H42E2D49AAE2B419F82AFABD0F2EF81F"><enum>(A)</enum><text>all persons holding
				title to or interest in working waterfront affected by a grant under this
				section, including a qualified holder, private citizen, private business,
				non-profit organization, fishing cooperative, or other entity, shall enter into
				a working waterfront covenant;</text>
							</subparagraph><subparagraph id="HCCA8D4012A4B42B1A8E8AE5F44F3BEF3"><enum>(B)</enum><text>such covenant
				shall be held by the coastal state or a qualified holder designated under
				paragraph (1);</text>
							</subparagraph><subparagraph id="H2127F3543E1C4AED984FBC31BA6EE415"><enum>(C)</enum><text>if the coastal
				state determines, on the record after an opportunity for a hearing, that the
				working waterfront covenant has been violated—</text>
								<clause id="H8286B77D8E824680BA91FCF6CD84C9B6"><enum>(i)</enum><text>all right, title,
				and interest in and to the working waterfront covered by such covenant shall,
				except as provided in subparagraph (D), revert to the coastal state; and</text>
								</clause><clause id="HAFA3A095EE49402E92229DFEB082F5D6"><enum>(ii)</enum><text>the coastal state
				shall have the right of immediate entry onto the working waterfront.</text>
								</clause></subparagraph><subparagraph id="H6BA76FACCDEE46ADAC174C270083FFF1"><enum>(D)</enum><text display-inline="yes-display-inline">If a Coastal State makes a determination
				under subparagraph (C), the Coastal State may convey or authorize the qualified
				holder to convey the working waterfront or interest in working waterfront to
				another qualified holder.</text>
							</subparagraph></paragraph></subsection><subsection id="H56E5A294ACF44773AA3BA9EEC4B331C"><enum>(h)</enum><header>Matching
				contributions</header>
						<paragraph id="H20202E5250494AD7BA968CBB5653008F"><enum>(1)</enum><text>Except as provided
				in paragraph (2), the Secretary shall require that each coastal state that
				receives a grant under this section, or a qualified holder designated by that
				coastal state under subsection (e), shall provide matching funds in an amount
				equal to at least 25 percent of the total cost of the project carried out with
				the grant.</text>
						</paragraph><paragraph id="H783F46FD96CD42DA8F877F08C9372811"><enum>(2)</enum><text>The Secretary may
				waive the application of paragraph (1) for any qualified holder that is an
				underserved community, a community that has an inability to draw on other
				sources of funding because of the small population or low income of the
				community, or for other reasons the Secretary considers appropriate.</text>
						</paragraph><paragraph id="H294C8AC37D814A5AA9977BB5F1B66BCF"><enum>(3)</enum><text>As a condition of
				receipt of a grant under this section, the Secretary shall require that a
				coastal state provide to the Secretary such assurances as the Secretary
				determines are sufficient to demonstrate that the share of the cost of each
				eligible project that is not funded by the grant awarded under this section has
				been secured.</text>
						</paragraph><paragraph id="H28EAC15A3A3343A9A237D8F000564591"><enum>(4)</enum><text>If financial
				assistance under this section represents only a portion of the total cost of a
				project, funding from other Federal sources may be applied to the cost of the
				project. Each portion shall be subject to match requirements under the
				applicable provision of law.</text>
						</paragraph><paragraph id="H01F25C04A2214B78864194C32B3699E0"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall treat as non-Federal
				match the value of a working waterfront or interest in a working waterfront,
				including conservation and other easements, that is held in perpetuity by a
				qualified holder, if the working waterfront or interest is identified in the
				application for the grant and acquired by the qualified holder within 3 years
				before submission of the application, or within 3 years after the submission of
				the application and before the end of the grant award period. Such value shall
				be determined by an appraisal performed at such time before the award of the
				grant as the Secretary considers appropriate.</text>
						</paragraph><paragraph id="HF6CACEAB9F464563BC927C3EBB2BDFE2"><enum>(6)</enum><text>The Secretary
				shall treat as non-Federal match the costs associated with acquisition of a
				working waterfront or an interest in a working waterfront, and the costs of
				restoration, enhancement, or other improvement to a working waterfront, if the
				activities are identified in the project application and the costs are incurred
				within the period of the grant award, or, for working waterfront described in
				paragraph (5), within the same time limits described in that paragraph. These
				costs may include either cash or in-kind contributions.</text>
						</paragraph></subsection><subsection id="H51E9A2EB05154C81A622003F5BD26949"><enum>(i)</enum><header>Limit on
				administrative costs</header><text>No more than 5 percent of the funds made
				available to the Secretary under this section may be used by the Secretary for
				planning or administration of the program under this section</text>
					</subsection><subsection id="H4FD0D901C5814A5BB74657B7B582D122"><enum>(j)</enum><header>Other technical
				and financial assistance</header><text>The Secretary shall–—</text>
						<paragraph id="H045459EECC014F07998D17F13916D02"><enum>(1)</enum><text display-inline="yes-display-inline">assist coastal states in identifying and
				obtaining other sources of available Federal technical and financial assistance
				for the development and revision of a working waterfront plan and the
				implementation of an approved working waterfront plan; and</text>
						</paragraph><paragraph id="HDB0DB02D10D743578F23D6BC4B9052F9"><enum>(2)</enum><text>provide technical
				assistance to States for the development and revision of comprehensive working
				waterfront plans, which may include, subject to the availability of
				appropriations, planning grants and assistance and feasibility studies.</text>
						</paragraph></subsection><subsection id="HC617483FDB3D4506AF130016E53C22B7"><enum>(k)</enum><header>Reports</header>
						<paragraph id="H348C5A93A29E46AA884E26F706D55223"><enum>(1)</enum><text>The Secretary
				shall—</text>
							<subparagraph id="H89329834247847AFBCE2EAB2189579D3"><enum>(A)</enum><text display-inline="yes-display-inline">develop performance measures to evaluate
				and report on the effectiveness of the program under this section in
				accomplishing the purpose of this section; and</text>
							</subparagraph><subparagraph id="HA039F595C01044D6A8502CA395735B6E"><enum>(B)</enum><text display-inline="yes-display-inline">submit to Congress a biennial report that
				includes such evaluations, an account of all expenditures, and descriptions of
				all projects carried out using grants awarded under this section.</text>
							</subparagraph></paragraph><paragraph id="H058BD796CD974A5AA84F9F525CBACC1B"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may submit the biennial
				report under paragraph (1)(B) by including it in the biennial report required
				under section 316.</text>
						</paragraph></subsection><subsection id="H89D64E82EBF043349F44A1DB7D1795BB"><enum>(l)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Secretary to carry out this section
				$25,000,000 for fiscal year 2008, $50,000,000 for fiscal year 2009, and
				$75,000,000 for fiscal year 2010.</text>
					</subsection><subsection id="H9CE06CCC7AE34720B287594DA8817400"><enum>(m)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H7FCEFD5F4C404AA1AB17D7C3A916BBAF"><enum>(1)</enum><text>The term
				<term>qualified holder</term> means a coastal state or a unit of local or
				coastal state government or a non-profit organization designated by a coastal
				state under subsection (e).</text>
						</paragraph><paragraph id="HF5C6AF7677D442E788C6367472F870DA"><enum>(2)</enum><text>The term
				<term>Secretary</term> means the Secretary, acting through the National Oceanic
				and Atmospheric Administration.</text>
						</paragraph><paragraph id="H158408F2ED0F4978BC7EE8DC025BA735"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>working waterfront</term>
				means real property (including support structures over water and other
				facilities) that provides access to coastal waters to persons engaged in
				commercial fishing, recreational fishing business, or other water-dependent
				coastal-related business and is used for, or that supports, commercial fishing,
				recreational fishing, or other water-dependent coastal-related business.</text>
						</paragraph><paragraph id="H387BFF6A8B5A43DB9BE2FD6125522CA2"><enum>(4)</enum><text>The term
				<term>working waterfront covenant</term> means an agreement in recordable form
				between the owner of working waterfront and one or more qualified holders, that
				provides such assurances as the Secretary may require that—</text>
							<subparagraph id="H506480762C674C22898F272ED320F6CC"><enum>(A)</enum><text>the title to or
				interest in the working waterfront will be held by a grant recipient or
				qualified holder in perpetuity, except as provided in subparagraph (C);</text>
							</subparagraph><subparagraph id="H01401A0ED2AB43BDAEE33351A02300C0"><enum>(B)</enum><text display-inline="yes-display-inline">the working waterfront will be managed in a
				manner that is consistent with the purposes for which the property is acquired
				pursuant to this section, and the property will not be converted to any use
				that is inconsistent with the purpose of this section;</text>
							</subparagraph><subparagraph id="H20C9C728A4AC497490099640996F74C0"><enum>(C)</enum><text display-inline="yes-display-inline">if the title to or interest in the working
				waterfront is sold or otherwise exchanged—</text>
								<clause id="HF8A5DBD537584D4D84F98FC9B4598F76"><enum>(i)</enum><text display-inline="yes-display-inline">all working waterfront owners and qualified
				holders involved in such sale or exchange shall accede to such agreement;
				or</text>
								</clause><clause id="H8E4899E46FA04CD08E6467ADE7D44DBC"><enum>(ii)</enum><text display-inline="yes-display-inline">funds equal to the fair market value of the
				working waterfront or interest in working waterfront shall be paid to the
				Secretary by parties to the sale or exchange, and such funds shall, at the
				discretion of the Secretary, be paid to the coastal state in which the working
				waterfront is located for use in the implementation of the working waterfront
				plan of the State approved by the Secretary under this section; and</text>
								</clause></subparagraph><subparagraph id="H67F25907DF0F4361BF77DD00BC84A980"><enum>(D)</enum><text>such covenant is
				subject to enforcement and oversight by the coastal state or by another person
				as determined appropriate by the
				Secretary.</text>
