		<section display-inline="no-display-inline" id="HA2DC9ED29D7440C985DE6DF06CE96542" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Medicaid
			 Prostate Cancer Coverage Act of 2007</quote>.</text>
		</section><section display-inline="no-display-inline" id="H4A57499E5DF84A5DAFF2403CBBB03924" section-type="subsequent-section"><enum>2.</enum><header>Optional medicaid
			 coverage of certain prostate cancer patients</header>
			<subsection id="H288E524D166B4BBDBED9742CCA0061D2"><enum>(a)</enum><header>Coverage as
			 optional categorically needy group</header>
				<paragraph id="H82806C29A5954A80B37442DFCA4E4EA8"><enum>(1)</enum><header>In
			 general</header><text>Section 1902(a)(10)(A)(ii) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396a(a)(10)(A)(ii)) is amended—</text>
					<subparagraph id="H1561F945CB914A30B9841677B695C022"><enum>(A)</enum><text>in subclause
			 (XVIII), by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HC5FF81BBC45F470B8B48357E1870A31B"><enum>(B)</enum><text>in subclause
			 (XIX), by adding <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph id="HD1CFF7EBD2D54D148F3535467C36F306"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H7FD29F94021A43C7B725E2AFC879DE46">
							<subclause id="HF67556FBE136492FB45539FA21D8CB00"><enum>(XX)</enum><text>who are described
				in subsection (dd) (relating to certain prostate cancer
				patients);</text>
							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9729A5ED87054905B4F1AD966DE265BC"><enum>(2)</enum><header>Group
			 described</header><text>Section 1902 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended
			 by adding at the end the following:</text>
					<quoted-block act-name="Social Security Act" id="H590CFF52E6D945CDADDF59E16426D492">
						<item id="HC7075D0327084FECB32471BCC402CD03" indent="up5"><enum>(dd)</enum><text>Individuals described in this
				paragraph are individuals who—</text>
						</item><paragraph id="H18A2B4A2FF1D47248E962F51F2C55EC6"><enum>(1)</enum><text>are not described
				in subsection (a)(10)(A)(i);</text>
						</paragraph><paragraph id="HE7A5ACD5199346C1A7FAE0007D231374"><enum>(2)</enum><text>have not attained
				age 65;</text>
						</paragraph><paragraph id="H525179A913E04D3E89488514AD60D5B8"><enum>(3)</enum><text>have been screened
				for prostate cancer under section 317D of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-5">42 U.S.C. 247b–5</external-xref>),
				or any other prostate cancer screening program supported with Federal funds,
				and need treatment for prostate cancer;</text>
						</paragraph><paragraph id="HA27053A245234215B7AD8924C5611CCF"><enum>(4)</enum><text display-inline="yes-display-inline">are in families whose income does not
				exceed 250 percent of the income official poverty line (as defined by the
				Office of Management and Budget, and revised annually in accordance with
				section 673(2) of the Omnibus Budget Reconciliation Act of 1981) applicable to
				a family of the size involved; and</text>
						</paragraph><paragraph id="HCE3B526A532D4537BE115826BA189B70"><enum>(5)</enum><text>are not otherwise
				covered under creditable coverage, as defined in section 2701(c) of the
				<act-name parsable-cite="PHSA">Public Health Service Act</act-name> (45 U.S.C.
				300gg(c)).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB10CC571814C4D6390C25E2055477D7F"><enum>(3)</enum><header>Limitation on
			 benefits</header><text>Section 1902(a)(10) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)</external-xref>)
			 is amended in the matter following subparagraph (G)—</text>
					<subparagraph id="HECF0AE8D3B9C4B5FB6B014E6F987827"><enum>(A)</enum><text>by striking
			 <quote>and (XIV)</quote> and inserting <quote>(XIV)</quote>; and</text>
					</subparagraph><subparagraph id="H435D041206E24D7CB85239007137D200"><enum>(B)</enum><text>by inserting
			 <quote>, and (XV) the medical assistance made available to an individual
			 described in subsection (aa) who is eligible for medical assistance only
			 because of subparagraph (A)(10)(ii)(XX) shall be limited to medical assistance
			 provided during the period in which such an individual requires treatment for
			 prostate cancer</quote> before the semicolon.</text>
					</subparagraph></paragraph><paragraph id="H944CA34456B043AA81715DD0EE628778"><enum>(4)</enum><header>Conforming
			 amendments</header><text>Section 1905(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is
			 amended in the matter preceding paragraph (1)—</text>
					<subparagraph id="H76F6BE7117EF4946AF991897D8F3203F"><enum>(A)</enum><text>in clause (xii),
			 by striking <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph id="HB7C403395EDD43A38D637FCA33ABC987"><enum>(B)</enum><text>in clause (xiii),
			 by adding <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph id="HD9F30E0DBF70449DAFF11E2163F74327"><enum>(C)</enum><text>by inserting after
			 clause (xiii) the following:</text>
						<quoted-block id="HD93FE69ECA394BECB5CB17A4FF033BFE">
							<clause id="H609226C7F4264A4F88A083003E98BD5B" indent="up2"><enum>(xiv)</enum><text>individuals described in section
				1902(dd),</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H504536D2D257417480A970008997EB44"><enum>(b)</enum><header>Presumptive
			 eligibility</header>
				<paragraph id="H99004EF48C2549D1934405606E9308B"><enum>(1)</enum><header>In
			 general</header><text>Title XIX of the <act-name parsable-cite="SSA">Social
			 Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended by inserting after
			 section 1920B the following:</text>
					<quoted-block act-name="Social Security Act" id="HCE39BB4C496C4BDBB0BC590040F4DE84" style="traditional">
						<section id="H6F077F0DE80F410093B17ECFB42BFF5E"><enum>1920C.</enum><header>Presumptive eligibility for certain prostate cancer
		  patients</header><subsection commented="no" display-inline="yes-display-inline" id="HC203F7EE2AD34F2DA0A6B2BC61ABB442"><enum>(a)</enum><header>State
				option</header><text>A State plan approved under section 1902 may provide for
				making medical assistance available to an individual described in section
				1902(dd) (relating to certain prostate cancer patients) during a presumptive
				eligibility period.</text>
							</subsection><subsection id="HB685ADB1B64F4AA1862B65166270AE15"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
								<paragraph id="H08C86E24D280439495A1E2EF04DDCA79"><enum>(1)</enum><header>Presumptive
				eligibility period</header><text>The term <term>presumptive eligibility
				period</term> means, with respect to an individual described in subsection (a),
				the period that—</text>
									<subparagraph id="H725E28EDB2A14AB8B5AED1AF31C335DE"><enum>(A)</enum><text>begins with the
				date on which a qualified entity determines, on the basis of preliminary
				information, that the individual is described in section 1902(dd); and</text>
									</subparagraph><subparagraph id="HCE296D71D028426DA292E3563848F96F"><enum>(B)</enum><text>ends with (and
				includes) the earlier of—</text>
										<clause id="H493DA6BE8D9144800000A7DCF145F266"><enum>(i)</enum><text>the day on which a
				determination is made with respect to the eligibility of such individual for
				services under the State plan; or</text>
										</clause><clause id="HD00AE613158B49248F00F8AC59D5FB19"><enum>(ii)</enum><text>in the case of
				such an individual who does not file an application by the last day of the
				month following the month during which the entity makes the determination
				referred to in subparagraph (A), such last day.</text>
										</clause></subparagraph></paragraph><paragraph id="HEB915B2740CF464E90DCC034238B4C76"><enum>(2)</enum><header>Qualified
				entity</header>
									<subparagraph id="H8F416911F4224348A37FE1DCDE04EB12"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), the term <term>qualified
				entity</term> means any entity that—</text>
										<clause id="H4191E8A8F5DB45E9AFD69D00822CDD00"><enum>(i)</enum><text>is
				eligible for payments under a State plan approved under this title; and</text>
										</clause><clause id="HBDA808AB43ED400BA27500BAA79884E"><enum>(ii)</enum><text>is
				determined by the State agency to be capable of making determinations of the
				type described in paragraph (1)(A).</text>
										</clause></subparagraph><subparagraph id="H8891CE121FC144F2A68B3250D24EC7A2"><enum>(B)</enum><header>Regulations</header><text>The
				Secretary may issue regulations further limiting those entities that may become
				qualified entities in order to prevent fraud and abuse and for other
				reasons.</text>
									</subparagraph><subparagraph id="HD7473A5F2C0E4EEE805458FB96F3C047"><enum>(C)</enum><header>Rule of
				construction</header><text>Nothing in this paragraph shall be construed as
				preventing a State from limiting the classes of entities that may become
				qualified entities, consistent with any limitations imposed under subparagraph
				(B).</text>
									</subparagraph></paragraph></subsection><subsection id="HCA4E43A7841C46BC9BAFB0C027CDE3B5"><enum>(c)</enum><header>Administration</header>
								<paragraph id="H1EBF425E6A554789818784E165228168"><enum>(1)</enum><header>In
				general</header><text>The State agency shall provide qualified entities
				with—</text>
									<subparagraph id="H8A1CA4AAC9F24988ACFE61014EA8CC36"><enum>(A)</enum><text>such forms as are
				necessary for an application to be made by an individual described in
				subsection (a) for medical assistance under the State plan; and</text>
									</subparagraph><subparagraph id="HDCC3F9AEDFFF4EA1BB2773C4C718FD00"><enum>(B)</enum><text>information on how
				to assist such individuals in completing and filing such forms.</text>
									</subparagraph></paragraph><paragraph id="H663A8B4EEAD64D6B8E5BC022E7CE761B"><enum>(2)</enum><header>Notification
				requirements</header><text>A qualified entity that determines under subsection
				(b)(1)(A) that an individual described in subsection (a) is presumptively
				eligible for medical assistance under a State plan shall—</text>
									<subparagraph id="HD674152CFE3D4BE19B9E2025458E37C0"><enum>(A)</enum><text>notify the State
				agency of the determination within 5 working days after the date on which
				determination is made; and</text>
									</subparagraph><subparagraph id="H5451CB0C3B7A420F9013D10026676473"><enum>(B)</enum><text>inform such
				individual at the time the determination is made that an application for
				medical assistance under the State plan is required to be made by not later
				than the last day of the month following the month during which the
				determination is made.</text>
									</subparagraph></paragraph><paragraph id="H1FC3DF4C5E294C39ADBE0764B8D2EC91"><enum>(3)</enum><header>Application for
				medical assistance</header><text>In the case of an individual described in
				subsection (a) who is determined by a qualified entity to be presumptively
				eligible for medical assistance under a State plan, the individual shall apply
				for medical assistance under such plan by not later than the last day of the
				month following the month during which the determination is made.</text>
								</paragraph></subsection><subsection id="H850E379D6CE34BA295005F8B118F3313"><enum>(d)</enum><header>Payment</header><text>Notwithstanding
				any other provision of this title, medical assistance that—</text>
								<paragraph id="HBE3893758B1F41F4946F7C69DC53B9D4"><enum>(1)</enum><text>is furnished to an
				individual described in subsection (a)—</text>
									<subparagraph id="H24C88FFAB7954891006F373347DAEE86"><enum>(A)</enum><text>during a
				presumptive eligibility period;</text>
									</subparagraph><subparagraph id="HB08FED3FFB8246448530EDF59F6453FC"><enum>(B)</enum><text>by an entity that
				is eligible for payments under the State plan; and</text>
									</subparagraph></paragraph><paragraph id="H24E06E366CC04BE29DEC12B5E47C9F1F"><enum>(2)</enum><text>is included in the
				care and services covered by the State plan;</text>
								</paragraph><continuation-text continuation-text-level="subsection">shall be
				treated as medical assistance provided by such plan for purposes of section
				1903(a)(5)(B).</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H9D6E5D7FCE5941479525D6BAE06479"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="H6FE27D0EE59741B6975BFBC423EC78CE"><enum>(A)</enum><text>Section
			 1902(a)(47) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(47)</external-xref>) is amended—</text>
						<clause id="H21554D1902B946B4A5001DB1FFC2B18"><enum>(i)</enum><text>by
			 striking <quote>and provide</quote> and inserting <quote>, provide</quote>;
			 and</text>
						</clause><clause id="HDE00BED6F6774FF6884400B2DDCA8D69"><enum>(ii)</enum><text>by
			 inserting before the semicolon at the end the following: <quote>, and provide
			 for making medical assistance available to individuals described in subsection
			 (a) of section 1920C during a presumptive eligibility period in accordance with
			 such section</quote>.</text>
						</clause></subparagraph><subparagraph id="HED4F7F67E21C46199BB6E7B2C17B0018"><enum>(B)</enum><text>Section
			 1903(u)(1)(D)(v) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(u)(1)(D)(v)</external-xref>) is amended—</text>
						<clause id="H39CBFEB0C3984EEA9DE3498971F0E14B"><enum>(i)</enum><text>by
			 striking <quote>or for</quote> and inserting <quote>, for</quote>; and</text>
						</clause><clause id="H5A880668011547549D214BD5F69B9EFE"><enum>(ii)</enum><text>by
			 inserting before the period the following: <quote>, or for medical assistance
			 provided to an individual described in subsection (a) of section 1920C during a
			 presumptive eligibility period under such section</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H831DC0A9F9C747FCBDFB0696F5C453A1"><enum>(c)</enum><header>Enhanced
			 match</header><text>Section 1903(a)(5) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(a)(5)</external-xref>) is
			 amended—</text>
				<paragraph id="HC026C7AF62FF4EE29FEC9DFFDE50692C"><enum>(1)</enum><text>by striking
			 <quote>an</quote> and inserting <quote>(A) an</quote>;</text>
				</paragraph><paragraph id="HC95A4B7BAD9D48A592686795EB5033D7"><enum>(2)</enum><text>by adding
			 <quote>plus</quote> after the semicolon; and</text>
				</paragraph><paragraph id="H90C911BF0DD249C700B2A9D77100A239"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H80045A1339BF4BB79D6979E866156CFA">
						<subparagraph id="H481E66AC04974C4FB2F14CA16FF783BC" indent="up1"><enum>(B)</enum><text>an amount equal to 75 percent of the
				sums expended during such quarter which are attributable to the offering,
				arranging, and furnishing (directly or on a contract basis) of prostate
				cancer-related treatment services;
				plus</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HC6CD82446138476697BDA142B755DF1C"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section apply to medical
			 assistance furnished on or after the date of the enactment of this Act, without
			 regard to whether final regulations to carry out such amendments have been
			 promulgated by such date.</text>
