			 relating to compensation system</header>
			<section display-inline="no-display-inline" id="H6C6DD92913E84C2182172D00C1FD4083"><enum>101.</enum><header>Foreign Service
			 performance-based compensation system</header>
				<subsection id="H9B2E4BB336C540C190208740FF6EAD00"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of this title are—</text>
					<paragraph id="HCEAF9C22C82E4129B5E8F1F3C550D3DD"><enum>(1)</enum><text>to improve the
			 recruitment and retention of high-performing Foreign Service members;</text>
					</paragraph><paragraph id="HA4B9BF5CBE9D408C8C87C800ED24BA5C"><enum>(2)</enum><text>to ensure
			 performance management that effectively communicates performance expectations
			 and makes meaningful distinctions based upon relative performance; and</text>
					</paragraph><paragraph id="HB9C062FCE0FD465A8BD9D700942327A4"><enum>(3)</enum><text>to institute a
			 worldwide pay system for the Foreign Service.</text>
					</paragraph></subsection><subsection id="H0F79A936177849E0A215FE30E27BE289"><enum>(b)</enum><header>Foreign Service
			 Schedule</header><text display-inline="yes-display-inline">Section 403 of the
			 Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3963">22 U.S.C. 3963</external-xref>) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="HDAE418CBBA7D4A8CBF8132F100DB16F7" style="OLC">
						<section id="H8BCD1EA881AE4120BDC3CBC3133CE73"><enum>403.</enum><header>Foreign Service
				Schedule</header>
							<subsection id="HA5289AE571A64FAFB648001D3D3D02A7"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President shall
				establish, review on an annual basis, and periodically adjust a Foreign Service
				Schedule, which shall consist of 9 salary classes that apply to members of the
				Service who are citizens of the United States and for whom salary rates are not
				otherwise provided under this chapter. The annual review under this subsection
				shall include consideration of pertinent economic measures, including but not
				limited to changes in the Employment Cost Index (within the meaning of section
				5302(2) of title 5, United States Code).</text>
							</subsection><subsection id="HDF06CD0833B24528A6F7623FD8A6D729"><enum>(b)</enum><header>Limit</header><text>The
				maximum salary rate for the highest class established under this section, which
				shall be designated class 1, may not exceed the rate of basic pay for level IV
				of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States
				Code.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H016416B69B3849A9851F503435E900EF"><enum>(c)</enum><header>Within-Class
			 salary increases</header><text>Section 406 of the Foreign Service Act of 1980
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/3966">22 U.S.C. 3966</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HF8AA8C837D1E43229006FA7FAEDBD561" style="OLC">
						<section id="HF2DFE32D5A2347858365C55929983771"><enum>406.</enum><header>Within-class
				salary increases</header>
							<subsection id="H33EC28619DA640A2AE6FCFF95B9D3C73"><enum>(a)</enum><header>Determination</header><text>The
				Secretary shall determine, on at least an annual basis, the size of any salary
				adjustment (expressed as a percentage or otherwise) which shall be made with
				respect to any members within a salary class in the Foreign Service Schedule,
				taking into account individual performance, contribution to the mission of the
				Department, or both, under a performance management system that—</text>
								<paragraph id="HBA388572BEA34B39B39C371169C6519F"><enum>(1)</enum><text>makes meaningful
				distinctions based upon relative performance; and</text>
								</paragraph><paragraph id="HD10FE861CB5D43B480FAB80085CAF762"><enum>(2)</enum><text>clearly links
				individual salary and performance under precepts prescribed by the
				Secretary.</text>
								</paragraph><continuation-text continuation-text-level="subsection">The
				Secretary shall determine the date as of which any salary adjustment under this
				subsection shall take effect.</continuation-text></subsection><subsection display-inline="no-display-inline" id="HE19F894C47DC4ED686BDC3E3442DE14C"><enum>(b)</enum><header>Limitation</header><text>A
				performance-based salary adjustment under subsection (a) may not be made with
				respect to any member of the Service whose performance does not meet the
				standards of performance for the salary class of the member for the applicable
				evaluation period.</text>
							</subsection><subsection id="H8E8EA594FD124BE69148D6E54BA33CD4"><enum>(c)</enum><header>Equal basic
				salary adjustments</header><text>Notwithstanding subsection (a), the Secretary
				may provide equal basic salary adjustments, on a percentage basis, for career
				candidates or other members of the Service—</text>
								<paragraph id="H365628B1B0F84AEBAECB23EDB87B42C1"><enum>(1)</enum><text>whose performance
				has not been reviewed by a selection board under section 602; and</text>
								</paragraph><paragraph id="HCA170003CB724C12BE67B2F64784EC50"><enum>(2)</enum><text>who are found to
				meet the standards of performance for their class.</text>
								</paragraph><continuation-text continuation-text-level="subsection">The
				Secretary shall determine the date as of which any salary adjustment under this
				subsection shall take effect.</continuation-text></subsection><subsection id="H688FEA939C5C4AD1941FAEFD8711C252"><enum>(d)</enum><header>Funding for
				performance-based salary adjustments</header>
								<paragraph id="H7E8171DC7A83484CBA3CDFD4CD30256"><enum>(1)</enum><header>In
				general</header><text>In order to provide funding for adjustments in basic
				salary rates under this section, the Secretary shall allocate an amount equal
				to or greater than the sum of—</text>
									<subparagraph commented="no" id="HC752BDF09C16449E8BAA03BB2C999813"><enum>(A)</enum><text>an amount that
				would be sufficient to fund—</text>
										<clause commented="no" id="H2B3BBB7F883B4412AE9E3BC894F22D1C"><enum>(i)</enum><text>within-class
				salary step increases under this section, as such increases would have occurred
				absent the amendments made pursuant to the <short-title>Foreign Service Global Compensation Act of
				2007</short-title>; and</text>
										</clause><clause commented="no" id="H8FAB869459DF4651BF23DC8500B34DBE"><enum>(ii)</enum><text display-inline="yes-display-inline">increases in salary rates under the Foreign
				Service Schedule in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/5303">section 5303</external-xref> of title 5, United States
				Code, as such increases would have occurred absent the amendments made pursuant
				to the <short-title>Foreign Service Global Compensation
				Act of 2007</short-title>; and</text>
										</clause></subparagraph><subparagraph id="H70B47A02345C402594DE57920308CD71"><enum>(B)</enum><text>the amount
				necessary to provide for salary adjustments based on mission requirements,
				labor market conditions, salary adjustments received by employees of other
				Federal agencies, and any other relevant factors.</text>
									</subparagraph></paragraph><paragraph id="H37EE206EA8DE401C848439703E3510BF"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The formula set forth in paragraph (1)
				shall ensure that members of the Service who are covered by the Foreign Service
				Schedule established under section 403, in the aggregate, are not disadvantaged
				in terms of the overall amount of salary available as a result of conversion to
				the performance-based compensation system authorized by this
				section.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF4D199DEB2304EE6A68CC05C4EF149A2"><enum>(d)</enum><header>Cessation of
			 certain payments</header>
					<paragraph id="H50EDEC01710348C1B2E8B34F136358B2"><enum>(1)</enum><header>Locality
			 payments</header><text display-inline="yes-display-inline">A member of the
			 Foreign Service may not receive a locality-based comparability payment under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States Code, for service performed on or after
			 the effective date set forth in subsection (f).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2694917685CE40B0A1859C7F6EE56490"><enum>(2)</enum><header>Nonforeign area
			 allowance</header><text display-inline="yes-display-inline">Except as provided
			 in section 103(d), a member of the Foreign Service may not receive a nonforeign
			 area allowance under <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5, United States Code, for service
			 performed on or after the effective date set forth in subsection (f).</text>
					</paragraph></subsection><subsection id="H5352AB6CA12F4073BA57C846C4D77E39"><enum>(e)</enum><header>Reporting
			 requirement</header><text>Not later than February 1, 2011, and February 1 of
			 each of the 4 years thereafter, the Secretary of State shall submit to the
			 appropriate congressional committees a report on the implementation of this
			 section. Each such report shall include—</text>
					<paragraph id="H3B66A338C84C429786E9DF4156C6373F"><enum>(1)</enum><text>an assessment as
			 to whether the purposes of this section are being accomplished;</text>
					</paragraph><paragraph id="HF95AA86E50C946B2944BE44F185B4EC4"><enum>(2)</enum><text>the Foreign
			 Service Schedule established under section 403 of the Foreign Service Act of
			 1980 (as amended by this section) with respect to the period covered by the
			 report;</text>
					</paragraph><paragraph id="H72DBDBB90AD0439AAF018D9589ED2E00"><enum>(3)</enum><text>any regulations
			 and guidelines adopted to determine salary adjustments under section 406 of the
			 Foreign Service Act of 1980 (as amended by this section);</text>
					</paragraph><paragraph id="HB3A38144F81B4595B7AE009C5B665864"><enum>(4)</enum><text>the allocation
			 last made by the Secretary of State for purposes of section 406(d)(1) of the
			 Foreign Service Act of 1980 (as amended by this section);</text>
					</paragraph><paragraph id="H1AC0A63D505C4F78BC36A2F92CC07CB0"><enum>(5)</enum><text>a
			 detailed description of the calculations made to determine the allocation
			 described in paragraph (4);</text>
					</paragraph><paragraph commented="no" id="H143E295B145443FB9BB75C5B99006749"><enum>(6)</enum><text>an assessment of
			 all allowances provided to members of the Service under the Foreign Service Act
			 of 1980 or under title 5, United States Code, and in particular, how such
			 allowances have been or will be affected by the amendments to sections 403 and
			 406 of the Foreign Service Act of 1980 made by this section;</text>
					</paragraph><paragraph id="H6C5157E980CA4DBF970097E00064F167"><enum>(7)</enum><text display-inline="yes-display-inline">a detailed description of the size and
			 distribution of any salary adjustments under section 406(a) of the Foreign
			 Service Act of 1980 granted with respect to members within each salary class
			 during the period covered by the report; and</text>
					</paragraph><paragraph id="H3E702022BB524BC897ECA539364E1FBF"><enum>(8)</enum><text>an explanation of
			 the rationale for the size and distribution of the salary adjustments referred
			 to in paragraph (7).</text>
					</paragraph><continuation-text continuation-text-level="subsection">For
			 purposes of this subsection, the term <term>appropriate congressional
			 committees</term> means the Committee on Foreign Affairs, the Committee on
			 Oversight and Government Reform, and the Committee on Appropriations of the
			 House of Representatives, and the Committee on Foreign Relations, the Committee
			 on Homeland Security and Governmental Affairs, and the Committee on
			 Appropriations of the Senate.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="HAFB76DED5A324A89BB8F57486FA50090"><enum>(f)</enum><header>Effective
			 date</header><text>This section and the amendments made by this section shall
			 take effect on the first day of the first pay period beginning on or after
			 April 1, 2010.</text>
				</subsection></section><section id="H205EF70174844B8AB07236C1C7F2CF36" section-type="subsequent-section"><enum>102.</enum><header>Transition to
			 performance-based compensation system</header>
				<subsection id="HB3D9DC70F0C94055B58E7CF858D0E51B"><enum>(a)</enum><header>Applicability</header><text>This
			 section applies with respect to the period—</text>
					<paragraph id="HA6BBE79DD37B467CB06EA049E00F95"><enum>(1)</enum><text>beginning on the
			 first day of the first pay period beginning on or after April 1, 2009;
			 and</text>
					</paragraph><paragraph id="HD4E654F6E3A44DECA28534AC143BCCA"><enum>(2)</enum><text>ending on the day
			 before the effective date described in section 101(f).</text>
					</paragraph></subsection><subsection id="HD914A4D5A8E041C1B96326AA8978B1FF"><enum>(b)</enum><header>Rules for
			 determining basic salary rate during period to which this section
			 applies</header>
					<paragraph id="H1AFADE68448A46A598D710CA7DC50039"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the basic salary
			 rate of any member of the Foreign Service designated class 1 or below shall,
			 for purposes of computing salary payable for service performed during the
			 period described in subsection (a), be determined in the same manner as if this
			 title had not been enacted.</text>
					</paragraph><paragraph id="HE5C61D13284E4640AA92A400F1A04272"><enum>(2)</enum><header>Interim schedule
			 for certain members</header>
						<subparagraph id="HA0922FEFB1AA4DF88E55FDB9DD7CA609"><enum>(A)</enum><header>In
			 general</header><text>In the case of any member of the Foreign Service
			 designated class 1 or below whose official duty station is located in an area
			 for which members of the Foreign Service receive neither payments under section
			 5304 of title 5, United States Code, nor payments under section 5941 of such
			 title, the basic salary rate payable to such member shall be determined by
			 reference to the interim schedule established under subparagraph (B), rather
			 than the Foreign Service Schedule (as established under section 403 of the
			 Foreign Service Act of 1980).</text>
						</subparagraph><subparagraph id="H176CD7A208244222844E08EF6490CBF8"><enum>(B)</enum><header>Interim
			 schedule</header><text display-inline="yes-display-inline">In order to carry
			 out subparagraph (A), the Secretary of State shall establish (before the start
			 of the period described in subsection (a)) and update (as necessary to reflect
			 any adjustment to the Foreign Service Schedule taking effect after the start of
			 such period) an interim schedule of basic salary rates which shall consist
			 of—</text>
							<clause id="H70D93F372AE6442BA2E7C508E896CFDB"><enum>(i)</enum><text>the
			 same classes and steps as those set forth in the Foreign Service Schedule (as
			 established under such section 403); and</text>
							</clause><clause id="HDFE3F12CF20A4DD58DEE99CCB7451181"><enum>(ii)</enum><text>rates that are
			 equal to—</text>
								<subclause id="H1276D439B4BD416E87FB78C3DDBACE"><enum>(I)</enum><text>the
			 rates for the corresponding classes and steps under the Foreign Service
			 Schedule (as so established or adjusted), uniformly increased by</text>
								</subclause><subclause id="H943D9493997E44558E45AD60B3931EE9"><enum>(II)</enum><text>9 percent, or
			 such other percentage as the President may determine in lieu thereof.</text>
								</subclause></clause></subparagraph><subparagraph id="HE309EF3297154AADA4CF89149EA2E9CB"><enum>(C)</enum><header>Treatment</header><text>A
			 basic salary rate determined under this subsection shall, for all purposes
			 (except subparagraph (B)(ii)(I)), be treated in the same way as if it were a
			 basic salary rate under the Foreign Service Schedule under such section
			 403.</text>
						</subparagraph></paragraph></subsection><subsection id="H8E8BE0CF270144FEB400029338EAAA3"><enum>(c)</enum><header>Conversion
			 rules</header><text display-inline="yes-display-inline">The Secretary, as
			 defined by section 102(10) of the Foreign Service Act of 1980 (hereinafter in
			 this title referred to as the <quote>Secretary concerned</quote>) shall
			 establish salary conversion rules which shall apply in the case of any member
			 who, during the period with respect to which this section applies, transfers
			 between duty stations that are subject to the provisions of subsections (b)(1)
			 and (b)(2), respectively.</text>
				</subsection></section><section id="HA9B18FD0083143C68F8FBE34F4604D00"><enum>103.</enum><header>Uniform
			 compensation for worldwide service</header>
				<subsection id="HCEDBED348C5847C5BCC6D953AD61A9EC"><enum>(a)</enum><header>Initial
			 adjustment in salaries of members</header><text>Effective as of the first day
			 of the first pay period beginning on or after April 1, 2010, the basic salary
			 rate of each member of the Foreign Service designated class 1 or below who, as
			 of the day before such first day, was receiving a basic salary rate determined
			 under section 102 shall become subject to the Foreign Service Schedule
			 established under section 403 of the Foreign Service Act of 1980 (as amended by
			 section 101), and shall receive an initial rate under such Schedule (as so
			 amended) which shall be determined in accordance with the following:</text>
					<paragraph id="H34FB4DB8CD2D4AEABDC17DFCADAB9304"><enum>(1)</enum><text>Except as provided
			 in paragraph (2) or (3), the initial rate shall be fixed so as to be equal to
			 the sum of—</text>
						<subparagraph id="H9A97CCEA595F40C6006D4453BAF9AC06"><enum>(A)</enum><text display-inline="yes-display-inline">the basic salary rate under the Foreign
			 Service Schedule for the class and step held by such member as of the day
			 before such first day (determined by applying the Foreign Service Schedule as
			 last in effect under section 403 of the Foreign Service Act of 1980 before the
			 first day of the first pay period beginning on or after April 1, 2010, and
			 disregarding any rates established under section 102(b)(2)); and</text>
						</subparagraph><subparagraph id="HDF1F49293B6A458497F2F3DCD667B101"><enum>(B)</enum><text display-inline="yes-display-inline">the amount derived by multiplying the rate
			 determined under subparagraph (A) by the locality-based comparability
			 percentage that, as of such first day, is in effect under section 5304 of title
			 5, United States Code, with respect to General Schedule positions within the
			 locality that includes the District of Columbia.</text>
						</subparagraph></paragraph><paragraph id="H6BC53927AA744D46B1AB2CC8EFE45FC0"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of any member who, effective as
			 of the first day of the first pay period beginning on or after April 1, 2010,
			 would otherwise have been advanced to a higher step in such member’s class by
			 reason of section 406(a) of the Foreign Service Act of 1980 (determined by
			 applying the provisions of such Act as last in effect before such first day),
			 paragraph (1)(A) shall be applied by using the step to which such member would
			 have been so advanced as of such first day, rather than the step described in
			 paragraph (1)(A).</text>
					</paragraph><paragraph id="H0DA2DDEC2B834268BEE9F900F60916D3"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary concerned shall by regulation
			 determine how effect shall be given to any salary adjustment (whether in
			 connection with a promotion, a step increase under section 406(b) of the
			 Foreign Service Act of 1980 for especially meritorious service, or otherwise)
			 which, if this title had not been enacted, would otherwise have become
			 effective beginning on such first day, subject to paragraph (2).</text>
					</paragraph><paragraph commented="no" id="HAE0DEBA0B9B24740A0F973EAC317457F"><enum>(4)</enum><text>All payments under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States Code, and, except to the extent provided
			 in subsection (d), all payments under section 5941 of such title shall cease to
			 be payable with respect to any member of the Foreign Service, as required by
			 section 101(d).</text>
					</paragraph></subsection><subsection id="HED953C5CB46E44D799E120116DCD00D3"><enum>(b)</enum><header>Minimum and
			 maximum rates initially established</header><text>The minimum and maximum rates
			 initially established under section 403 of the Foreign Service Act of 1980 (as
			 amended by section 101) for each of the respective salary classes of the
			 Foreign Service Schedule shall be established in a manner consistent with the
			 requirements of subsection (a)(1).</text>
				</subsection><subsection commented="no" id="H2A3FF465EF9C4F9F899300DF38B0DCD3"><enum>(c)</enum><header>One-time
			 adjustment in basic salary rates of certain other members</header>
					<paragraph commented="no" id="H7E90548DAD10418D0056DB988503C2DF"><enum>(1)</enum><header>Applicability</header><text>This
			 subsection applies with respect to any career candidate or other member of the
			 Foreign Service—</text>
						<subparagraph commented="no" id="H50DAAEED545A4EFBB1103E8B06073763"><enum>(A)</enum><text>whose performance
			 has not been reviewed by a selection board under section 602 of the Foreign
			 Service Act of 1980; and</text>
						</subparagraph><subparagraph commented="no" id="H51FB8CB0350C436892CD82828F788D68"><enum>(B)</enum><text>who, if this title
			 had not been enacted, would otherwise have been eligible to receive a
			 within-class step increase under section 406(a) of the Foreign Service Act of
			 1980 (determined by applying the provisions of such Act as last in effect
			 before the first day of the first pay period beginning on or after April 1,
			 2010), effective as of a date occurring within the period that—</text>
							<clause commented="no" id="H332C852D5B9E48B48854F6A20000CE7F"><enum>(i)</enum><text>begins on the
			 first day of the first pay period beginning on or after April 1, 2010;
			 and</text>
							</clause><clause commented="no" id="H99A9EDBA585646C3B4370417D7FCEB86"><enum>(ii)</enum><text>ends as of
			 September 30, 2010.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" id="H4A138E1E00D643298C9F5CCB2E3ED4E8"><enum>(2)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary concerned may provide for a
			 one-time adjustment under this subsection in the basic salary rate of any
			 member of the Foreign Service with respect to whom this subsection
			 applies.</text>
					</paragraph><paragraph commented="no" id="HF9F3CEC529364653003513EAD066621E"><enum>(3)</enum><header>Conditions</header><text>An
			 adjustment under this subsection in the basic salary rate of any member—</text>
						<subparagraph commented="no" id="H98E88B82B6EC48649D39C7188042824"><enum>(A)</enum><text>shall become
			 effective as of the first day of the first pay period beginning on or after
			 April 1, 2010; and</text>
						</subparagraph><subparagraph commented="no" id="HB31F6AEC30E34F93A17E017CEFBCB161"><enum>(B)</enum><text display-inline="yes-display-inline">shall be equal to an amount determined by
			 the Secretary concerned, but not more than the dollar amount equivalent of the
			 step increase described in paragraph (1)(B), prorated to reflect the ratio
			 that—</text>
							<clause commented="no" id="HCF0C8769A5E24F9591210388C105CD20"><enum>(i)</enum><text>the number of
			 weeks toward such step increase completed by such member as of the day before
			 the first day referred to in paragraph (1)(B)(i), bears to</text>
							</clause><clause commented="no" id="HDF2B74764DAC44BEA2E900346914BE8F"><enum>(ii)</enum><text>the total number
			 of weeks that would have been required in order for such member to qualify for
			 the full step increase.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="HB608A20F241146BDB211DA68E008322"><enum>(d)</enum><header>Special
			 transitional rules</header>
					<paragraph id="H6EC708DCF7134B7C9BB04FD2583BB275"><enum>(1)</enum><header>Applicability</header><text>This
			 subsection applies to any member of the Foreign Service who, as of the first
			 day of the first pay period beginning on or after April 1, 2010, is serving at
			 a duty station for which, if this title had not been enacted, such member
			 would, as of such first day, have been eligible to receive—</text>
						<subparagraph id="HB390EC44E2054FA192C01CA0B6B8EAEF"><enum>(A)</enum><text>a locality-based
			 comparability payment under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States Code, equal
			 to a percentage greater than the percentage described in subsection (a)(1)(B);
			 or</text>
						</subparagraph><subparagraph id="HD9DBF7C70E2E44B991BC554936FD8F3"><enum>(B)</enum><text display-inline="yes-display-inline">an allowance under <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5,
			 United States Code, equal to a percentage greater than the percentage described
			 in subsection (a)(1)(B).</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">Any
			 determination of eligibility under this paragraph shall be made applying the
			 same criteria, requirements, and other terms or conditions as were in effect,
			 with respect to the payment or allowance involved, at the end of the last pay
			 period before the pay period referred to in the preceding sentence.</continuation-text></paragraph><paragraph id="H853D7FEDE1A643E996D063E115229291"><enum>(2)</enum><header>Nonreduction
			 rules</header><text display-inline="yes-display-inline">The Secretary concerned
			 shall by regulation provide for the following:</text>
						<subparagraph id="H00651C0A66484301877D5FB8E7379127"><enum>(A)</enum><header>Locality-based
			 comparability payment</header><text display-inline="yes-display-inline">A
			 member of the Foreign Service to whom this subsection applies by virtue of
			 paragraph (1)(A) shall be entitled to a temporary supplement equal to the
			 amount necessary to prevent a reduction in pay at the time of conversion to the
			 Foreign Service Schedule established on the date described in section 101(f).
			 The temporary supplement shall be expressed as an annual rate and paid
			 biweekly. The temporary supplement shall be considered basic pay for the same
			 purposes as a locality-based comparability payment under section 5304 of title
			 5, United States Code. The amount of the temporary supplement shall be fixed
			 and not subject to adjustment, but shall be discontinued under the conditions
			 set forth in paragraph (3).</text>
						</subparagraph><subparagraph id="H9FA44C0B836849CAB6A8F5FEBC5910AA"><enum>(B)</enum><header>Nonforeign area
			 allowance</header><text display-inline="yes-display-inline">A member of the
			 Foreign Service to whom this subsection applies by virtue of paragraph (1)(B)
			 shall be entitled to a temporary allowance equal to the amount necessary to
			 prevent a reduction in pay at the time of conversion to the Foreign Service
			 Schedule established on the date described in section 101(f). The temporary
			 allowance shall be expressed as an annual rate and paid biweekly. The temporary
			 allowance shall be treated, for all purposes, as if it were an allowance under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5, United States Code. The amount of the temporary
			 allowance shall be fixed and not subject to adjustment, but shall be
			 discontinued under the conditions set forth in paragraph (3).</text>
						</subparagraph></paragraph><paragraph id="HD85EDED73F8C4549BA1322F137A7D007"><enum>(3)</enum><header>Conditions for
			 continued applicability</header><text>The provisions of this subsection shall
			 remain in effect with respect to a member only for so long as such member
			 remains—</text>
						<subparagraph id="HEF2B36B9EE544F1700D024781F01AFAA"><enum>(A)</enum><text display-inline="yes-display-inline">continuously assigned to the same duty
			 station (as described in paragraph (1)); and</text>
						</subparagraph><subparagraph id="H269EC3B868EB4D648DBFE025B89198B7"><enum>(B)</enum><text display-inline="yes-display-inline">subject to the Foreign Service Schedule
			 established under section 403 of the Foreign Service Act of 1980 (as amended by
			 section 101).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAE016FABEC414B6E8D799262992F17D8"><enum>(e)</enum><header>Management
			 right</header><text>Adjustments made under section 102(c) and subsections
			 (a)(3), (c), and (d) of this section—</text>
					<paragraph commented="no" id="H21513E5F5FBD4FC09B2FB6F21B9DC6C2"><enum>(1)</enum><text>shall be
			 considered a management right under section 1005(a) of the Foreign Service Act
			 of 1980; and</text>
					</paragraph><paragraph commented="no" id="HA8C2209D0DC643F1AC79B5BC3558E4DB"><enum>(2)</enum><text>are not grievances
			 under section 1101(b) of such Act.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H085BCAE7E1084E5D92D9B900743FD327" section-type="subsequent-section"><enum>104.</enum><header>Technical and
			 conforming amendments</header>
				<subsection id="H770914F9F19340D7A42D8E31985E052C"><enum>(a)</enum><header>Foreign Service
			 Act of <enum-in-header>1980</enum-in-header></header><text>The Foreign Service
			 Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3901">22 U.S.C. 3901 et seq.</external-xref>) is amended—</text>
					<paragraph id="HF1FC774DE8354CAB94695CC82631A3BD"><enum>(1)</enum><text>in section
			 402(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/22/3962">22 U.S.C. 3962(a)(2)</external-xref>), by inserting <quote>under precepts prescribed
			 by the Secretary</quote> after <quote>system</quote>;</text>
					</paragraph><paragraph id="H2771386A3A564776A8CFEE4D1C7859AD"><enum>(2)</enum><text>in section 602(a)
			 (<external-xref legal-doc="usc" parsable-cite="usc/22/4002">22 U.S.C. 4002(a)</external-xref>), by amending paragraph (3) to read as follows:</text>

				</subsection></section></title><title id="H05878630ED324617B2D002FD4E8900D1"><enum>II</enum><header>Provisions
			 relating to death gratuity</header>
			<section id="H6402B528A7984256BE19C9E96170CCCC"><enum>201.</enum><header>Death
			 gratuity</header>
				<subsection id="HB95289F0B3B54FE3A0E5ADC17ECCAB24"><enum>(a)</enum><header>In
			 general</header><text>Section 413(a) of the <act-name parsable-cite="FSA80">Foreign Service Act of 1980</act-name> (22 U.S.C.
			 3973(a)) is amended—</text>
					<paragraph id="H6BDE81DB168143429F2DAC0802622CEE"><enum>(1)</enum><text>by striking
			 <quote>(a)</quote> and inserting <quote>(a)(1)</quote>; and</text>
					</paragraph><paragraph id="H552C1A02A995403FB99E7D3EC8CB1424"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H875A3EFB77D04981AF819FD801A0F783" style="traditional">
							<paragraph id="H351E943552524F39822400D2EACFF86" indent="up1"><enum>(2)</enum><text>For purposes of any computation under
				this section, the rate of basic salary payable to a Foreign Service employee at
				time of death shall—</text>
								<subparagraph id="H39C7FFCC3EA742A4AB3238CE7528B1DA"><enum>(A)</enum><text>except as provided in subparagraph
				(B), be deemed to have been equal to the rate that was then payable for level
				II of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5313">section 5313</external-xref> of title 5, United States Code;
				or</text>
								</subparagraph><subparagraph id="HA8857A5AAE6748AEA10089D953905D89"><enum>(B)</enum><text>if the decedent was subject to a local
				compensation plan under section 408 at time of death, be deemed to have been
				equal to the highest basic salary rate that was then payable under such
				plan.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="HB299F9A4F69C49E58503F71D51FAED4E"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply with
			 respect to deaths occurring on or after the date of the enactment of this Act.</text>
