		<official-title display="yes">To amend the Foreign Service Act of 1980 to
		  extend comparability pay adjustments to members of the Foreign Service assigned
		  to posts abroad, and to amend the provision relating to the death gratuity
		  payable to surviving dependents of Foreign Service employees who die as a
		  result of injuries sustained in the performance of duty
		  abroad.</official-title>

		<section id="H51206505D2034C70AAF58554D67CA37" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign Service Overseas Pay Equity
			 Act of 2008</short-title></quote>.</text>
		</section><section id="H426DD2A299EB458B8035E400626CBDB1"><enum>2.</enum><header>Overseas comparability
			 pay adjustment</header>
			<subsection id="H87D2DB4044384B818C47025D596352AC"><enum>(a)</enum><header>Overseas comparability
			 pay adjustment</header>
				<paragraph id="HE0FF6191A15647C0945EFB6C3F154982"><enum>(1)</enum><header>In
			 general</header><text>Chapter 4 of the <act-name parsable-cite="FSA80">Foreign
			 Service Act of 1980</act-name> (22 U.S.C. 3961 and following) is amended by
			 adding at the end the following:</text>
					<quoted-block act-name="Foreign" changed="added" committee-id="HFA00" id="HB7AD6D6D3BF74C1D00456B206C89B97F" reported-display-style="italic" style="OLC">
						<section id="H55E41547362F4184A5CB37BC0028FE29"><enum>415.</enum><header>Overseas comparability
				pay adjustment</header>
							<subsection id="H60E6FF70E0AF43A283986C95324406C"><enum>(a)</enum><header>In
				general</header><text>A member of the Service who is designated class 1 or
				below for purposes of section 403 and whose official duty station is neither in
				the continental United States nor in a non-foreign area shall receive, in
				accordance with the phase-in schedule set forth in subsection (c), the same
				locality-based comparability payment under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United
				States Code (stated as a percentage) as would be payable to such member if such
				member’s official duty station were in the District of Columbia.</text>
							</subsection><subsection id="HD8402623A34C43EC8F914CD133E3D54E"><enum>(b)</enum><header>Treatment as basic
				pay</header><text>The amount of any locality-based comparability payment which
				is payable to a member of the Service by virtue of this section—</text>
								<paragraph id="H848A8A8B13DA4F14B366075743AB7628"><enum>(1)</enum><text>shall be considered to be
				part of the basic pay of such member—</text>
									<subparagraph id="HD478950164AA40C8007553AEC937FD71"><enum>(A)</enum><text>for the same purposes as
				provided for under <external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304(c)(2)(A)</external-xref> of title 5, United States Code;
				and</text>
									</subparagraph><subparagraph id="HDF580E7CD26A46A39DD196589C9CCD3D"><enum>(B)</enum><text>for purposes of chapter
				8; and</text>
									</subparagraph></paragraph><paragraph id="H5D0A114D40CA4597A71FCD24B6CBA9"><enum>(2)</enum><text>shall be subject to any
				limitations on pay applicable to locality-based comparability payments under
				<external-xref legal-doc="usc" parsable-cite="usc/5/5304">section 5304</external-xref> of title 5, United States Code.</text>
								</paragraph></subsection><subsection id="HDD4B9F97C5F44D7B8BC11B8FAB524D4"><enum>(c)</enum><header>Phase-In</header><text>The
				locality-based comparability payment payable to a member of the Service under
				this section shall—</text>
								<paragraph id="HC1DAF7BBC1DD48458400E72709D9145E"><enum>(1)</enum><text display-inline="yes-display-inline">beginning on the first day of the first pay
				period beginning on or after the date that fiscal year 2009 appropriations are
				made available by enactment of the Department of State, Foreign Operations, and
				Related Programs Appropriations Act, 2009, or April 1, 2009, whichever is
				earlier, be equal to 33.33 percent of the payment which would otherwise apply
				under subsection (a);</text>
								</paragraph><paragraph id="H0F78658F11FD46F4836B4FD4FCF95E8"><enum>(2)</enum><text display-inline="yes-display-inline">beginning on the first day of the first pay
				period in fiscal year 2010, be equal to 66.67 percent of the payment which
				would otherwise apply under subsection (a); and</text>
								</paragraph><paragraph id="H2FF9DB2AFF6043109C254EF7902B479E"><enum>(3)</enum><text display-inline="yes-display-inline">beginning on the first day of the first pay
				period in fiscal year 2011 and each subsequent fiscal year, be equal to the
				payment determined under subsection (a).</text>
								</paragraph></subsection><subsection id="HAC0FA67C0B5C4EF5A9D6DC885519A17B"><enum>(d)</enum><header>Non-foreign area
				defined</header><text>For purposes of this section, the term <term>non-foreign
				area</term> has the same meaning as is given such term in regulations carrying
				out <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5, United States
				Code.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA085B71DA33841A4A2A93D9BEE7D4359"><enum>(2)</enum><header>Conforming
			 amendment</header><text>The table of contents set forth in section 2 of such
			 Act is amended by inserting after the item relating to section 414 the
			 following:</text>

				</paragraph></subsection><subsection id="H9F5A3DF33C0B41FB96F1A140A600C279"><enum>(b)</enum><header>Conforming amendments
			 relating to the Foreign Service Retirement Systems</header>
				<paragraph id="H1E2CCA731463472DBD5EBAD356CD5800"><enum>(1)</enum><header>Contributions to the
			 fund</header><text>Effective as of the first pay period beginning on or after
			 October 1, 2010, section 805(a) of the Foreign Service Act of 1980 (22 U.S.C.
			 4045(a)) is amended—</text>
					<subparagraph id="HF3DFD6F3C3DB41E5A24F8843E1104B4"><enum>(A)</enum><text>in paragraph (1)—</text>
						<clause id="H1396FFF3ADB241F8B3C6F49420723777"><enum>(i)</enum><text>in the first sentence, by
			 striking <quote>7.25 percent</quote> and inserting <quote>7 percent</quote>;
			 and</text>
						</clause><clause id="H1718C232F73A4AE19DC29944639571F7"><enum>(ii)</enum><text>in the second sentence,
			 by striking <quote>The contribution by the employing agency</quote> through
			 <quote>and shall be made</quote> and inserting <quote>An equal amount shall be
			 contributed by the employing agency</quote>;</text>
						</clause></subparagraph><subparagraph id="H30F8D9E5B2964D638FBCC57CE1E22A1"><enum>(B)</enum><text>in paragraph (2)—</text>
						<clause id="H54C7647D9C584E19B4997EFDF79B8B4B"><enum>(i)</enum><text>in subparagraph (A), by
			 striking <quote>, plus an amount equal to .25 percent of basic pay</quote>;
			 and</text>
						</clause><clause id="H1B182E2E90C24C2A8FF1646846ECF7EE"><enum>(ii)</enum><text>in subparagraph (B), by
			 striking <quote>, plus an amount equal to .25 percent of basic pay</quote>;
			 and</text>
						</clause></subparagraph><subparagraph id="H2B95E5FE8F824863BC10A57525646327"><enum>(C)</enum><text>in paragraph (3), by
			 striking all that follows <quote>Code</quote> and inserting a period.</text>
					</subparagraph></paragraph><paragraph id="HB661EB460ACF4253AF36F4DD00C5AF60"><enum>(2)</enum><header>Computation of
			 annuities</header><text>Section 806(a)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4046">22 U.S.C. 4046(a)(9)</external-xref>) is
			 amended by striking <quote>is outside the continental United States
			 shall</quote> and inserting <quote>was outside the continental United States
			 during the period beginning on December 29, 2002, and ending on the day before
			 the first day of the first pay period beginning on or after October 1, 2010 (or
			 during any portion thereof) shall, to the extent that such computation is based
			 on the basic salary or basic pay of such member for such period (or portion
			 thereof),</quote>.</text>
				</paragraph><paragraph id="H3367B578F31748ACB7046650CEAE022"><enum>(3)</enum><header>Entitlement to
			 annuity</header><text display-inline="yes-display-inline">Section 855(a)(3) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/4071d">22 U.S.C. 4071d(a)(3)</external-xref>) is amended—</text>
					<subparagraph id="H029B33F24DD9422A8EDBAB65A6AE2C92"><enum>(A)</enum><text>by striking
			 <quote>section 8414</quote> and inserting <quote>section 8415</quote>;
			 and</text>
					</subparagraph><subparagraph id="H2119A5CC02514EFB851E48C1E93EA5ED"><enum>(B)</enum><text>by striking <quote>is
			 outside the continental United States shall</quote> and inserting <quote>was
			 outside the continental United States during the period beginning on December
			 29, 2002, and ending on the day before the first day of the first pay period
			 beginning on or after October 1, 2010 (or during any portion thereof) shall, to
			 the extent that such computation is based on the basic salary or basic pay of
			 such member for such period (or portion thereof),</quote>.</text>
					</subparagraph></paragraph><paragraph id="H91B422DC9AEE4A01AB2242F6962DB7D"><enum>(4)</enum><header>Deductions and
			 withholdings from pay</header><text>Section 856(a)(2) of such Act (22 U.S.C.
			 4071e(a)(2)) is amended to read as follows:</text>
					<quoted-block changed="added" committee-id="HFA00" id="H405EBCF4DD33499F89EA44EBB25953C1" reported-display-style="italic" style="OLC">
						<paragraph id="H9C2475F56F8E449581C80475B36EFE4E" indent="up1"><enum>(2)</enum><text>The applicable percentage
				under this subsection shall be as follows:</text>

				</paragraph></subsection><subsection id="H217594F1BC844493B4016EC8E3266540"><enum>(c)</enum><header>Reporting
			 requirements</header>
				<paragraph id="H6C71FED1D4EC456AA802F65931701BC6"><enum>(1)</enum><header>In
			 general</header><text>Not later than October 1, 2010, the Secretary of State
			 shall submit to the appropriate congressional committees an assessment of all
			 allowances provided to members of the Foreign Service under the Foreign Service
			 Act of 1980 or under title 5, United States Code, and in particular, how such
			 allowances have been or will be affected by the amendments to the Foreign
			 Service Act of 1980 made by this Act.</text>
				</paragraph><paragraph id="HE0C4A38A92754393BBA4D261EEFD28E3"><enum>(2)</enum><header>Definition</header><text>For
			 purposes of this subsection, the term <term>appropriate congressional
			 committees</term> means the Committee on Foreign Affairs of the House of
			 Representatives and the Committee on Foreign Relations of the Senate.</text>
				</paragraph></subsection></section><section id="H6FDA67D2EA034B928254A9966593F25F"><enum>3.</enum><header>Death
			 gratuity</header><text display-inline="no-display-inline">The first sentence of
			 section 413(a) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3973">22 U.S.C. 3973(a)</external-xref>) is
			 amended by striking <quote>at the time of death</quote> and inserting <quote>at
			 level II of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5313">section 5313</external-xref> of title 5, United States
			 Code, at the time of death, except that for employees compensated under local
			 compensation plans established under section 408, the amount shall be equal to
			 the greater of 1 year’s salary at the time of death or 1 year’s salary at the
			 highest step of the highest grade on the local compensation plan from which the
			 employee was being paid at the time of death</quote>.</text>
