		<official-title>To amend the Internal Revenue Code of 1986 to allow
		  individuals to designate that their income, estate, or gift tax payments be
		  spent other than for purposes of supporting the war in Iraq and to provide that
		  amounts so designated shall be used to provide funding for Head Start, to
		  reduce the national debt, and to provide college funding for children of Iraq
		  war veterans.</official-title>

		<section id="HA6BFA4096DEE4BE7BF2379009DA0C624" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Opt Out of Iraq War Act of
			 2007</short-title></quote>.</text>
		</section><section id="H2B7E74EDD5E04C99976FF1BF7E7D474F"><enum>2.</enum><header>Tax payments to
			 future fund</header>
			<subsection id="H1EE2496AFC774E8E8E94F62DD8F7ECBA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter A of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/61">chapter 61</external-xref> of the Internal Revenue Code of 1986 (relating to information and
			 returns) is amended by adding at the end the following new part:</text>

							<toc-entry level="section">Sec. 6097. Opt out of Iraq
				  war.</toc-entry>
						</toc>
						<section id="HE9D0082D977D4E1B8BE8CCEA9F5DC8A4"><enum>6097.</enum><header> Opt out of
				iraq war</header>
							<subsection id="HAF2DD87A44064AA1AEEA5E006B13A0EC"><enum>(a)</enum><header>Designation of
				tax payments to future fund</header><text display-inline="yes-display-inline">Every individual may designate that the
				following amounts be paid into the Future Fund established by section
				9511.</text>
								<paragraph id="H058D2C4755B846368D7BD218DAE39577"><enum>(1)</enum><header>Income
				tax</header><text>Such individual’s income tax payment for a taxable
				year.</text>
								</paragraph><paragraph id="H54F91E8769A94EC58699DC97A7304CBA"><enum>(2)</enum><header>Gift
				tax</header><text>Such individual’s payment of the tax imposed by section
				2501.</text>
								</paragraph><paragraph id="HC856B866DF5A41A7A962A878E5FBFBED"><enum>(3)</enum><header>Estate
				tax</header><text>The payment of the imposed by section 2001 on the estate of
				such individual.</text>
								</paragraph></subsection><subsection id="HFE2876A266384B3E8CF39F2B1E43B0D0"><enum>(b)</enum><header>Limitation</header>
								<paragraph id="H301D3CAC3E754FB4B32D63E113ABCF0"><enum>(1)</enum><header>In
				general</header><text>The amount of any payment which may be designated under
				this section shall not exceed the Iraq war funding percentage of such
				payment.</text>
								</paragraph><paragraph id="H9B6E5DFF30DF4CA7A7B0BB5BCD105214"><enum>(2)</enum><header>Iraq war funding
				percentage</header>
									<subparagraph id="H7689A4457B7E41FEB6908B7EBF42D52"><enum>(A)</enum><header>In
				general</header><text>For purposes of this subsection, the Iraq war funding
				percentage, with respect to any payment made during a fiscal year, is the
				percentage (determined by the Comptroller of the United States) of the Federal
				budget which was spent during the preceding fiscal year on the war in
				Iraq.</text>
									</subparagraph><subparagraph id="H0DB4FB9FF42B415EB051A96C1503A4DF"><enum>(B)</enum><header>Certain spending
				not taken into account</header><text>For purposes of subparagraph (A), the
				amount determined to be spent on the war in Iraq during the preceding year
				shall be reduced by the amount which the Comptroller of the United States
				estimates will be spent during the fiscal year for which the percentage is
				being determined—</text>
										<clause id="H21AD297691F041C7B6A4CB365CE24E66"><enum>(i)</enum><text display-inline="yes-display-inline">to provide Iraq with humanitarian and other
				non-military assistance, and</text>
										</clause><clause id="HBE6D4364D5A64989AD1C5470ADF66987"><enum>(ii)</enum><text>to provide for
				the withdrawal of United States infrastructure and personnel from Iraq.</text>
										</clause></subparagraph><subparagraph id="H4E594EE1945F435E91F40151586584C"><enum>(C)</enum><header>Exclusion of
				certain trust funds from budget</header><text>For purposes of this paragraph,
				none of the trust funds established under the Social Security Act or this title
				shall be treated as included in the Federal budget.</text>
									</subparagraph></paragraph></subsection><subsection id="HB7A2193304A24F7293112B332CA55BF9"><enum>(c)</enum><header>Special rules
				relating to income tax payments</header><text>For purposes of this
				section—</text>
								<paragraph id="H20F713A1F0BA4F9E87AAC3345BD80160"><enum>(1)</enum><header>Income tax
				payment</header><text display-inline="yes-display-inline">The term <term>income
				tax payment</term> means the amount of tax imposed by chapter 1 and paid by or
				withheld for any taxable year to the extent not in excess of the taxpayer's
				income tax liability.</text>
								</paragraph><paragraph id="H4D9CD530677E42B48582F69451F76C32"><enum>(2)</enum><header>Income tax
				liability</header><text display-inline="yes-display-inline">The term
				<term>income tax liability</term> means the amount of the tax imposed by
				chapter 1 on a taxpayer for any taxable year (as shown on such taxpayer's tax
				return) reduced by the sum of—</text>
									<subparagraph id="HAA996FBB16D14C498074A582108DC8C1"><enum>(A)</enum><text>the credits (as
				shown in such return) allowable under part IV of subchapter A of chapter 1
				(other than subpart C thereof), and</text>
									</subparagraph><subparagraph id="HFFB1A3B58AAE460CB5CB37ACD017C36"><enum>(B)</enum><text>the amount
				designated under section 6096.</text>
									</subparagraph></paragraph><paragraph id="H172EDA12CB2B49C4871D2DA71130BF6D"><enum>(3)</enum><header>Joint
				returns</header><text display-inline="yes-display-inline">A designation may be
				made on a joint return only if both spouses make the designation.</text>
								</paragraph></subsection><subsection id="H9D56887CCBE3470B85C258924EC8DAA2"><enum>(d)</enum><header>Designation of
				estate tax payments</header><text display-inline="yes-display-inline">The
				designation under subsection (a)(3) may be made by the executor of the estate
				under written authority of the decedent.</text>
							</subsection><subsection id="HAF294EEAE4B54AB1A79559D02E3CB38F"><enum>(e)</enum><header>Manner and time
				of designations</header><text display-inline="yes-display-inline">A designation
				under subsection (a) may be made—</text>
								<paragraph id="H16BFD03D29384B6F8C8136E9E0071980"><enum>(1)</enum><text>at the time of
				filing the return of the tax to which the designation relates, or</text>
								</paragraph><paragraph id="H17993B8F763C4C2C8FB399E9BBF92B68"><enum>(2)</enum><text>at any other time
				(after the time of filing such return) specified in regulations prescribed by
				the Secretary.</text>
								</paragraph><continuation-text continuation-text-level="subsection">Such
				designation shall be made in such manner as the Secretary prescribes by
				regulations except that, if such designation is made at the time described in
				paragraph (1), such designation shall be made on the page bearing the filer’s
				signature.</continuation-text></subsection><subsection id="HD9F568C0E78E4BB3A57CEB7E98AA9101"><enum>(f)</enum><header>Explanation of
				future fund purposes</header><text display-inline="yes-display-inline">Each
				publication of general instructions accompanying an income, estate, or gift tax
				return shall include—</text>
								<paragraph id="H56CB68C71B4C4BEF939C995134D8745D"><enum>(1)</enum><text>an explanation of
				the purpose of the Future Fund, and</text>
								</paragraph><paragraph id="HBB86285C7ACC4AADAE1298805CCFFC4B"><enum>(2)</enum><text>an explanation of
				the process for making the designations under this section.</text>
								</paragraph></subsection><subsection id="HF4A124737BE6401B9E8EA6EBF8A72FD8"><enum>(g)</enum><header>Termination</header><text>This
				section shall not apply to payments made during any period that fewer than
				25,000 members of the Armed Forces of the United States are serving in
				Iraq.</text>
							</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB67958555A9543A7A9B7175CB2B000F8"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of parts for such subchapter A is amended by
			 adding at the end the following new item:</text>

					<toc-entry level="part"><quote>Part IX. Opt Out of Iraq
				War.</quote>.</toc-entry>
				</toc>
			</subsection></section><section id="H33A97057043B497BAE6392F16729D478"><enum>3.</enum><header>Future
			 fund</header>
			<subsection id="HDE2595A1C0084DE5B17F79CFDFE605C6"><enum>(a)</enum><header>Creation of
			 trust fund</header><text>Subchapter A of chapter 98 of the Internal Revenue
			 Code of 1986 (relating to trust fund code) is amended by adding at the end the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H3E16595DE8E74D7999D892768ADEAD3" style="OLC">
					<section id="HD3F6EDA75598436BB36687D4C2D483BA"><enum>9511.</enum><header>Future
				fund</header>
						<subsection id="H22FEA4A1310B4907B38D39E2FDE5F03F"><enum>(a)</enum><header>Creation of
				trust fund</header><text>There is established in the Treasury of the United
				States a trust fund to be known as the <quote>Future Fund</quote>, consisting
				of such amounts as may be appropriated or credited into such Fund as provided
				in this section and section 9602(b).</text>
						</subsection><subsection id="H3880C068FF1845609CA5AFECD6FA36B"><enum>(b)</enum><header>Transfers to
				future fund of amounts equivalent to certain taxes</header><text>There are
				hereby appropriated to the Future Fund amounts equivalent to the sum of the
				amounts designated under section 6097 for payment into the Fund.</text>
						</subsection><subsection id="HDB5B93833280416E89DC967FAD005D92"><enum>(c)</enum><header>Expenditures
				from future fund</header><text>Amounts in the Future Fund shall be available as
				follows:</text>
							<paragraph id="HC957A38DC91B417E903EB08C8357BD95"><enum>(1)</enum><header>Head
				start</header><text>One-third of such amounts shall be available, as provided
				in appropriation Acts, to carry out the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831</external-xref>).</text>
							</paragraph><paragraph id="HFED9CF3DD1444CAB967C855E63338EF3"><enum>(2)</enum><header>Reduction of
				national debt</header><text>One-third of such amounts shall be available for
				reducing the national debt in accordance with subsection (d).</text>
							</paragraph><paragraph id="H089B46EF192A46298B5DA311AF000018"><enum>(3)</enum><header>Children of iraq
				war veterans college fund</header><text>One-third of such amounts shall be
				transferred to the Children of Iraq War Veterans College Fund in accordance
				with subsection (e).</text>
							</paragraph></subsection><subsection id="HD987A64557024A33B39201DDAE197629"><enum>(d)</enum><header>Reduction of
				national debt</header><text display-inline="yes-display-inline">The Secretary
				of the Treasury shall, from time to time, transfer to the special account
				established by <external-xref legal-doc="usc" parsable-cite="usc/31/3113">section 3113(d)</external-xref> of title 31, United States Code, the amounts
				described in subsection (c)(2).</text>
						</subsection><subsection id="HB2E7519C01D84BBA955334CBA5B046BE"><enum>(e)</enum><header>Children of iraq
				war veterans college fund</header>
							<paragraph id="H1140ECA94E834681BEE985921E67CF95"><enum>(1)</enum><header>Creation of
				college fund</header><text display-inline="yes-display-inline">There is
				established in the Future Fund a separate account to be known as the
				<quote>Children of Iraq War Veterans College Fund</quote>, consisting of
				amounts transferred or credited to the Children of Iraq War Veterans College
				Fund as provided in this section and section 9602(b).</text>
							</paragraph><paragraph id="HF35952DE13574E2E9696A59F334D5D9"><enum>(2)</enum><header>Expenditures from
				college fund</header><text>Amounts in the Children of Iraq War Veterans College
				Fund shall be available, as provided in appropriation Acts, to pay the
				qualified tuition and related expenses (as defined in section 117(b)(2)) of any
				individual if either parent of such individual served as a member of the Armed
				Forces of the United States in Iraq during any portion of the period that Iraq
				is designated as a combat zone for purposes of section 112 and—</text>
								<subparagraph id="H723B564E7A3D41148CF3F471DF0069D1"><enum>(A)</enum><text>such portion is at
				least 180 days,</text>
								</subparagraph><subparagraph id="HD4014EEEE0F7485C83FCE9D988D5BFAE"><enum>(B)</enum><text display-inline="yes-display-inline">such parent died as a result of wounds,
				disease, or injury incurred while so serving, or</text>
								</subparagraph><subparagraph id="H786F252FF71D410B887873FD4E360416"><enum>(C)</enum><text display-inline="yes-display-inline">as a result of wounds, disease, or injury
				incurred while so serving, such parent was hospitalized and unable to return to
				duty in such
				zone.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6AD225FC1A504C8D87841581FA81AC52"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for such subchapter A is amended
			 by adding at the end the following new item:</text>
