		<section id="H91B83647B5DD4C2480516C004C905CA1" section-type="section-one"><enum>1.</enum><header>Short title, findings, and
			 purpose</header>
			<subsection id="H22613E9691E24E76BCBB5CAEC7BC0E8"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>U.S. Participation in Cuban
			 Energy Exploration Act of 2007</short-title></quote>.</text>
			</subsection><subsection id="H1234E08DFD794FA8BA239ECF30BC70F2"><enum>(b)</enum><header>Findings</header><text>The
			 Congress finds:</text>
				<paragraph id="HADB7C8977380433900D25367FAEB74A3"><enum>(1)</enum><text>Current Federal
			 laws and policies bar United States nationals, including United States
			 companies, from taking part in exploration for and development of energy
			 resources in areas where such activities are controlled by the Government of
			 Cuba.</text>
				</paragraph><paragraph id="HC601427B4A9F43B5ABDCD62282283755"><enum>(2)</enum><text>Other countries do
			 not impose the same restriction on people and companies subject to their
			 jurisdiction, so the restriction penalizes United States nationals and
			 companies without affecting the ability of the Cuban Government to benefit from
			 those exploration and development activities.</text>
				</paragraph><paragraph id="H5B9BA0E8E5F24949AA3B78A61FEC55"><enum>(3)</enum><text>It
			 is in the national interest for United States nationals, including United
			 States companies, to be able to compete for the opportunity to develop those
			 resources if the Government of Cuba decides to allow such development and if
			 the development is done in a manner consistent with protection of the
			 environment.</text>
				</paragraph></subsection><subsection id="H4CB4B231C8C947CC93D609D5E9EBA9AF"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to allow United
			 States nationals, including United States companies, to take part in
			 exploration for and development of energy resources in offshore areas near Cuba
			 and in other similar offshore areas outside of but contiguous to the exclusive
			 economic zone of the United States.</text>
			</subsection></section><section id="HE7E8E719122F48829D5C5F0955E0AA31"><enum>2.</enum><header>Authorization of
			 activities and exports involving hydrocarbon resources by united states
			 persons</header>
			<subsection id="HC0FEF7DA7DA3423F9073CD73EF8CC200"><enum>(a)</enum><header>Authorization</header><text>Notwithstanding
			 the provisions of law referred to in subsection (b), and subject to subsection
			 (c), United States persons (including agents and affiliates of those United
			 States persons) may—</text>
				<paragraph id="H2697A0ECE8D8479C8C1D1413B3438DB0"><enum>(1)</enum><text>engage in any
			 transaction necessary for the exploration for and extraction of hydrocarbon
			 resources from any portion of a foreign exclusive economic zone that is
			 contiguous to the exclusive economic zone of the United States;</text>
				</paragraph><paragraph id="H9632ACBC5FE44CCA819FF717FAB502D0"><enum>(2)</enum><text>export without
			 license authority all equipment necessary for the exploration for or extraction
			 of hydrocarbon resources described in paragraph (1); and</text>
				</paragraph><paragraph commented="no" id="H41F2139EC36D4BF09CEECFAC6E3B480"><enum>(3)</enum><text>import into the
			 United States hydrocarbon resources extracted under the authority of this
			 section, and products thereof.</text>
				</paragraph></subsection><subsection id="HD21199561FA54B589968D8BCC9446F52"><enum>(b)</enum><header>Provisions of
			 law inapplicable</header><text>The provisions of law referred to in subsection
			 (a) are—</text>
				<paragraph id="HE3863606BF3442108EE152646D36DF"><enum>(1)</enum><text>section 620(a) of
			 the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2370">22 U.S.C. 2370(a)</external-xref>);</text>
				</paragraph><paragraph id="HBEAB790231484927964D72A4E6CBD4A4"><enum>(2)</enum><text>the Cuban Liberty
			 and Democratic Solidarity (LIBERTAD) Act of 1996 (22 U.S.C. 6021 et
			 seq.);</text>
				</paragraph><paragraph id="H4D84C4076569440C80FFDBE06D08009D"><enum>(3)</enum><text>the Cuban
			 Democracy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/22/6001">22 U.S.C. 6001 et seq.</external-xref>);</text>
				</paragraph><paragraph id="H2C24FB2F185E473DB76BD90029174232"><enum>(4)</enum><text>part 515 of title
			 31, Code of Federal Regulations (Cuban Assets Control Regulations); and</text>
				</paragraph><paragraph id="H4249A0F369BE45CAB638531926C926DE"><enum>(5)</enum><text>any other law,
			 Executive order, or regulation prohibiting exports to or imports from Cuba, or
			 transactions in property in which a Cuban national has an interest.</text>
				</paragraph></subsection><subsection id="H1F1E0E2EDF594C1C003DA5D8ADF5561"><enum>(c)</enum><header>Applicability of
			 environmental laws</header><text>Any exploration for or extraction of
			 hydrocarbon resources by a United States person within an area described in
			 subsection (a)(1) shall be subject to the same laws, rules, and regulations for
			 the protection of fish, wildlife, and the environment that are applicable to
			 such activities within the exclusive economic zone of the United States.</text>
			</subsection></section><section id="H95A434355DF34D210064001D60066742"><enum>3.</enum><header>Travel in
			 connection with authorized hydrocarbon exploration and extraction
			 activities</header>
			<subsection id="H723CB0B18AFB4124815351EDA783B76C"><enum>(a)</enum><header>General License
			 Authority for Travel-Related Expenditures by Persons Engaging in Hydrocarbon
			 Exploration and Extraction Activities</header><text>The Secretary of the
			 Treasury shall authorize under a general license the travel-related
			 transactions listed in <external-xref legal-doc="usc" parsable-cite="usc/31/515">section 515.560(c)</external-xref> of title 31, Code of Federal
			 Regulations, for travel to, from, or within Cuba in connection with exploration
			 for and the extraction of hydrocarbon resources in any part of a foreign
			 maritime exclusive economic zone that is contiguous to the exclusive economic
			 zone of the United States.</text>
			</subsection><subsection id="HD995D4E77F034D5E9068089F9D3FFB4D"><enum>(b)</enum><header>Persons
			 authorized</header><text>Persons authorized to travel to Cuba under this
			 section include full-time employees, executives, agents, and consultants of
			 producers, distributors, and shippers of hydrocarbon resources.</text>
			</subsection></section><section id="H80AEB45B3F71425CB503AA2EAEFAA3E"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="HA0C0A279EDAB42D291EBC700AEC32001"><enum>(1)</enum><text>the term
			 <term>exclusive economic zone of the United States</term> means the exclusive
			 economic zone of the United States established by Proclamation 5030 of March
			 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note);</text>
			</paragraph><paragraph id="H6DEFE64773B94E959E02CA3C12E116F4"><enum>(2)</enum><text>the term
			 <term>foreign exclusive economic zone</term> means an economic zone contiguous
			 to the territorial sea of a foreign country that is asserted by the government
			 of that country; and</text>
			</paragraph><paragraph id="H75BBEC2D41EA49DCBFA7F0075D7C6EB"><enum>(3)</enum><text>the term
			 <term>United States person</term> means—</text>
				<subparagraph display-inline="no-display-inline" id="HD37FD94AC283443F82E7FAB225C31E9F"><enum>(A)</enum><text>any United States
			 citizen or alien lawfully admitted for permanent residence in the United
			 States; and</text>
				</subparagraph><subparagraph id="HBF1B256915A64A1E81AEB0256FA66C2"><enum>(B)</enum><text>any person other
			 than an individual, if 1 or more individuals described in subparagraph (A) own
			 or control at least 51 percent of the securities or other equity interest in
			 that person.</text>
