		<legis-type>A BILL</legis-type>
		<official-title>To provide that 8 of the 12 weeks of parental leave made
		  available to a Federal employee under subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5,
		  United States Code, shall be paid leave, and for other
		  purposes.</official-title>

		<section id="HDEDB5679A61845BF925DBC2C240906AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Employees Paid Parental Leave
			 Act of 2006</short-title></quote>.</text>
		</section><section id="H2EF41261DEF448A2BD6E1585413F4D1D"><enum>2.</enum><header>Paid parental
			 leave</header><text display-inline="no-display-inline">Subsection (d) of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/6382">section 6382</external-xref> of title 5, United States Code, is amended to read as
			 follows:</text>
			<quoted-block id="H0D8AE780465041E397D62E6274BC3047" style="OLC">
				<subsection id="H206032B495C742F2B7FB2CADCE9EC9"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H61559DB8A53347DEAAF9BA0009B2A351"><enum>(1)</enum><text>An employee may elect to
				substitute for any leave without pay under subparagraph (A), (B), (C), or (D)
				of subsection (a)(1) any paid leave which is available to such employee for
				that purpose.</text>
					</paragraph><paragraph id="H215BF84A951046ECBC5DA42474FECF39" indent="up1"><enum>(2)</enum><text>The paid leave that is available to
				an employee for purposes of paragraph (1) is—</text>
						<subparagraph id="H877892299FB646E48963B8705E643356"><enum>(A)</enum><text>to the extent that subparagraph (A) or
				(B) of subsection (a)(1) is the basis for the entitlement to leave under this
				subchapter—</text>
							<clause id="H679D5D5CEA9F4114AA00E39FEC818300"><enum>(i)</enum><text>8 administrative workweeks of paid
				leave under this clause in connection with the birth or placement involved;
				and</text>
							</clause><clause id="H20750F3A836D4223BFC284B36FAA2BD6"><enum>(ii)</enum><text>any annual or sick leave accrued
				or accumulated by such employee under subchapter I; and</text>
							</clause></subparagraph><subparagraph id="H691BBAF36EA94501A9E357FF3D90000"><enum>(B)</enum><text>to the extent that subparagraph (C) or
				(D) of subsection (a)(1) is the basis for the entitlement to leave under this
				subchapter, any annual or sick leave accrued or accumulated by such employee
				under subchapter I.</text>
						</subparagraph></paragraph><paragraph id="HC6B840D076894A09BE3CB38230DB0400" indent="up1"><enum>(3)</enum><text>Nothing in this subchapter shall be
				considered to require—</text>
						<subparagraph id="H8AF5D254BC074A008B8620DC5FD3900"><enum>(A)</enum><text>that an employing agency provide paid
				sick leave in any situation in which such employing agency would not normally
				be required to provide such leave; or</text>
						</subparagraph><subparagraph id="H3CF6356CB55C4A10A9931EDD9372FC8C"><enum>(B)</enum><text>in a circumstance to which
				subparagraph (A) of paragraph (2) applies, that an employee first use all or
				any portion of the leave described in clause (ii) of such subparagraph before
				being allowed to use leave described in clause (i) of such subparagraph.</text>
						</subparagraph></paragraph><paragraph id="HAE76F9F4101D4B2594F2CE3F14F86500" indent="up1"><enum>(4)</enum><text>Leave under paragraph
				(2)(A)(i)—</text>
						<subparagraph id="HA464148E43794DE08CFF78120002DD31"><enum>(A)</enum><text>shall be payable from any
				appropriation or fund available for salaries or expenses for positions within
				the employing agency;</text>
						</subparagraph><subparagraph id="HADF533B25EC34B5E9E9BA598B36595A1"><enum>(B)</enum><text>shall not be considered to be annual
				or vacation leave for purposes of section 5551 or 5552 or for any other
				purpose; and</text>
						</subparagraph><subparagraph id="H67300554E5904337B8EDE5BB3B81F6A8"><enum>(C)</enum><text>if not used by the employee before the
				end of the 12-month period (as referred to in subsection (a)(1)) to which it
				relates, shall not accumulate for any subsequent use.</text>
						</subparagraph></paragraph><paragraph id="H61E7E925D0824E17A726090042582F19" indent="up1"><enum>(5)</enum><text>The Office shall prescribe any
				regulations necessary to carry out this subsection, including, subject to
				paragraph (3)(B), the manner in which an employee may designate any day or
				other period as to which such employee wishes to use leave described in
				paragraph
				(2)(A)(i).</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE100EA35E20C4AB1A3FCDF6BDA08F3A1"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall not be effective with respect to any birth or placement
			 occurring before the end of the 6-month period beginning on the date of the
			 enactment of this Act.</text>
