<section id="H116CD51A0AEC4BC9B3B129EFB63752B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Pornography Elimination Act of 2007</short-title></quote>.</text> </section> 
<section id="H3DAE8CA270B34DA8B4E0C78BDEDECCCF"><enum>2.</enum><header>Mandatory minimum for possession of child pornography</header> 
<subsection id="HFBEEAC97C5B0412CB6BAD61D6DB870B9"><enum>(a)</enum><header>Sexual exploitation</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252">Section 2252(b)(2)</external-xref> of title 18, United States Code, is amended by striking <quote>or imprisoned not more than 10 years, or both</quote> and inserting <quote>and imprisoned not less than 2 years nor more than 15 years</quote>.</text></subsection> 
<subsection id="H6B82FD93A2BB45CE8CE842D17FC2CF5E"><enum>(b)</enum><header>Pornography</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252A">Section 2252A(b)(2)</external-xref> of title 18, United States Code, is amended by striking <quote>or imprisoned not more than 10 years, or both</quote> and inserting <quote>and imprisoned not less than 2 years nor more than 15 years</quote>.</text></subsection></section> 
<section id="HA5113E84408146FAA1DEB8984C7FB400" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Strengthening <external-xref legal-doc="usc" parsable-cite="usc/42/13032">section 13032</external-xref> of title 42, United States Code, to ensure that child pornography is effectively reported</header><text display-inline="no-display-inline">Section 227(b)(2) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032</external-xref>) is amended to read as follows:</text>

<paragraph id="H610F30484A294D439BFCD257F8AD7E13"><enum>(4)</enum><header>Failure to report</header> 
<subparagraph id="H39BDDF0C158048BE9FBFBD56C396749"><enum>(A)</enum><header>Knowingly</header><text>A provider of electronic communication services or remote computing services described in paragraph (1) who knowingly and willfully fails to make a report under that paragraph shall be fined—</text> 
<clause id="H09EB736D4909489694A8FA3B0005FE"><enum>(i)</enum><text>in the case of an initial failure to make a report, not more than $150,000; and</text></clause> 
<clause id="H03885EBD89D649718B108C5717F140EA"><enum>(ii)</enum><text>in the case of any second or subsequent failure to make a report, not more than $300,000.</text></clause></subparagraph> 
<subparagraph id="H937CE5D706864599B6F3982A104AF47"><enum>(B)</enum><header>Negligently</header><text>A provider of electronic communication services or remote computing services described in paragraph (1) who negligently fails to make a report under that paragraph shall be subject to a civil penalty of—</text> 
<clause id="H666CB93B0BA445148846D950F7817311"><enum>(i)</enum><text>in the case of an initial failure to make a report, not more than $50,000; and</text></clause> 
<clause id="HF6DD627C32C4452FA4F29EF188A7442C"><enum>(ii)</enum><text>in the case of any second or subsequent failure to make a report, not more than $100,000.</text></clause></subparagraph> 
<subparagraph id="HCF646D2A7B204D03872CDD26D2DEC8E8"><enum>(C)</enum><header>FCC authority</header><text>For the purposes of this paragraph, the Federal Communications Commission shall have the authority to levy civil penalties and shall promulgate regulations, in consultation with the Attorney General, to effectuate the purposes of this paragraph and to provide for appropriate administrative review of any civil penalties levied thereunder.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H1E653E6E73B440828888F8A9ADDD8E4F"><enum>4.</enum><header>Knowingly accessing child pornography</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2252">Section 2252(a)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="HA028167B2FAE4D99AC50D2C284C25FA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text> 
<subparagraph id="H7D1891A1C196423E87C258E9A6E265C1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting after <quote>possesses,</quote> the following: <quote>or knowingly accesses with intent to view,</quote>;</text></subparagraph> 
<subparagraph id="HB0F3D3D4E9084CD78C2851BE4EA6C1D4"><enum>(B)</enum><text>in subparagraph (B), by inserting after <quote>possesses,</quote> the following: <quote>or knowingly accesses with intent to view,</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H7C5B18547D184CD1BD9BDCE219FEF44"><enum>(2)</enum><text>in paragraph (5)—</text> 
<subparagraph id="H9650FE6E012644E58200E59D7ECD6C2D"><enum>(A)</enum><text>in subparagraph (A), by inserting after <quote>possesses,</quote> the following: <quote>or knowingly accesses with intent to view,</quote>; and</text></subparagraph> 
<subparagraph id="H40D17FE8EBC8493DB0DF00CC09FF1992"><enum>(B)</enum><text>in subparagraph (B), by inserting after <quote>possesses,</quote> the following: <quote>or knowingly accesses with intent to view,</quote>.</text></subparagraph></paragraph></section> 
<section id="HFB090F1CA386440D8377AD83F85225B"><enum>5.</enum><header>Conspiracy provision for chapter 77 offenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1594">Section 1594(a)</external-xref> of title 18, United States Code, is amended by inserting after <quote>attempts</quote> the following: <quote>or conspires to</quote>.</text></section> 
<section id="H9A0CE2EDF167410B93333DF829E17034"><enum>6.</enum><header>Mandatory restitution for certain child sex offenses</header> 
<subsection id="HE466AF4AF1DF44A19E117BD017BAEACF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/117">Chapter 117</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H430E476A447B446EABF48BB2784BB11C" style="USC"> 
<section id="H82BEF2A5E66D4117939C3100E1F8F8D0"><enum>2429.</enum><header>Mandatory restitution</header> 
<subsection id="H7E8DB7F0D42942AA9E007CDA0006F659"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 3663 or 3663A of this title, and in addition to any other civil or criminal penalty authorized by law, the court shall order restitution for any offense under this chapter.</text></subsection> 
<subsection id="H09C3A8F18D16445E961D4875D36187D7"><enum>(b)</enum><header>Scope and nature of order</header> 
<paragraph id="HE37E9CD6043341F0AAB5B3E38F3DEF1F"><enum>(1)</enum><header>Directions</header><text>The order of restitution under this section shall direct the defendant to pay the victim (through the appropriate court mechanism) the full amount of the victim’s losses as determined by the court pursuant to paragraph (2).</text></paragraph> 
<paragraph id="H27D6DA20CF2C45788700AA53CD6B2F"><enum>(2)</enum><header>Enforcement</header><text>An order of restitution under this section shall be issued and enforced in accordance with section 3664 in the same manner as an order under section 3663A.</text></paragraph> 
<paragraph id="H0415DC13C4944086BAB00011DBA810CB"><enum>(3)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>full amount of the victim’s losses</term> includes any costs incurred by the victim for—</text> 
<subparagraph id="H837FA3F82C6C4E3FBEBDA81C897CB2C5"><enum>(A)</enum><text>medical services relating to physical, psychiatric, or psychological care as a proximate result of the offense;</text></subparagraph> 
<subparagraph id="H337D29C427224CB18B6C94DEC03F41E3"><enum>(B)</enum><text>physical and occupational therapy or rehabilitation as a proximate result of the offense;</text></subparagraph> 
<subparagraph id="H77F6046C5DFC4F77BF40301027C401E1"><enum>(C)</enum><text>necessary transportation, temporary housing, and child care expenses as a proximate result of the offense;</text></subparagraph> 
<subparagraph id="H4601168B29DF456788C1A2F578178806"><enum>(D)</enum><text>lost income as a proximate result of the offense;</text></subparagraph> 
<subparagraph id="HF88C08C2EAB04A9E932B4E2D93F44D05"><enum>(E)</enum><text>attorney's fees, as well as other costs incurred as a proximate result of the offense; and</text></subparagraph> 
<subparagraph id="H3706A897DD4147ED8B88B111B31C12C0"><enum>(F)</enum><text>any other losses suffered by the victim as a proximate result of the offense.</text></subparagraph></paragraph> 
<paragraph id="H3AEE68547D104A99B774E2D5E63F49EA"><enum>(4)</enum><header>Order mandatory</header> 
<subparagraph id="H0B081FBC41C94BD18713ABC76F19B25D"><enum>(A)</enum><header>In general</header><text>The issuance of a restitution order under this section is mandatory.</text></subparagraph> 
<subparagraph id="H2472F81A3D5740DDBF3B2C02674EB46B"><enum>(B)</enum><header>Consideration</header><text>A court may not decline to issue an order under this section because of—</text> 
<clause id="H5915C13B602643698BA6E2C35F001400"><enum>(i)</enum><text>the economic circumstances of the defendant; or</text></clause> 
<clause id="HF456E38BFF7E4AD500FF16D2A02F2C6D"><enum>(ii)</enum><text>the fact that a victim has received, or is entitled to receive, compensation for his or her injuries from the proceeds of insurance or any other source.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HDD02C56C464C459DAA95808361100556"><enum>(c)</enum><header>Definition</header><text>For purposes of this section, the term <term>victim</term> means the individual harmed as a result of a commission of a crime under this chapter, including, in the case of a victim who is under 18 years of age, incompetent, incapacitated, or deceased, the legal guardian of the victim or representative of the victim’s estate, another family member, or any other person appointed as suitable by the court, but in no event shall the defendant be named as such representative or guardian.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCB82FA534E8946AF8477D2EB313CBB68"><enum>(b)</enum><header>Chapter analysis</header><text>The chapter analysis etc.</text></subsection></section> 
<section id="H107D108E57004EB6A461ACB0B71D942E"><enum>7.</enum><header>Amend definition of illicit sexual conduct</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2423">Section 2423(f)</external-xref> of title 18, United States Code, is amended by—</text> 
<paragraph id="HA8926A9450A544EE9C4ED1304C0081EC"><enum>(1)</enum><text>striking <quote>or</quote>; and</text></paragraph> 
<paragraph id="H823998AD56A54B9A86ABCC1699F4D85C"><enum>(2)</enum><text>striking the period at the end of the subsection and inserting <quote>; or (3) production of child pornography, as defined in section 2256(8).</quote>.</text></paragraph></section> 
<section id="H58F8279FA818442AA1097ED1B3493F37" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Expand the use of the sex trafficking statute</header> 
<subsection id="H00B6FD8893E045D4A594409439F0A493"><enum>(a)</enum><header>Sexual exploitation</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252">Section 2252(b)(2)</external-xref> of title 18, United States Code, is amended by inserting after <quote>this chapter,</quote> the following: <quote>section 1591,</quote>.</text></subsection> 
<subsection id="H98DBBFC5E21E44A38FB620E72E49A71C"><enum>(b)</enum><header>Pornography</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2252A">Section 2252A(b)(2)</external-xref> of title 18, United States Code, is amended by inserting after <quote>this chapter,</quote> the following: <quote>section 1591,</quote>.</text></subsection> 
<subsection id="HBF1DBE314CA848DD912C777FD549B292"><enum>(c)</enum><header>Repeat offenders</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2426">Section 2426(b)(1)(A)</external-xref> of title 18, United States Code, is amended by—</text> 
<paragraph id="H4962BB5A0C9A4D61A788A4D1595BA0ED"><enum>(1)</enum><text>striking <quote>or following 109A,</quote>; and</text></paragraph> 
<paragraph id="H88FD0E537A28449784F0A92C2E7793C8"><enum>(2)</enum><text>inserting after <quote>chapter 110</quote> the following <quote>or section 1591</quote>.</text></paragraph></subsection> 
<subsection id="H8A1DFD4D57C14298AE517732722F3318"><enum>(d)</enum><header>Release and detention</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3156">Section 3156(a)(4)(C)</external-xref> of title 18, United States Code, is amended by inserting after <quote>117</quote> the following: <quote>, or section 1591</quote>.</text></subsection>
