		<section id="H5C498AB77FD547F2A81CAFE016D61DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Counter-Terrorism and National
			 Security Act of 2007</short-title></quote>.</text>
		</section><section id="H9F9D1DCC9112442CAC1C208C68749ECA"><enum>2.</enum><header>Providing
			 material support to facilitate, reward, or encourage acts of terrorism</header>
			<subsection id="HE337DA9D37AC4B26ABCFD144A9D6DBA3"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0B37C7BF467C47339F145C5206CA7633" style="USC">
					<section id="HC50E9A381BA7454F802124C824A12D01"><enum>2339E.</enum><header>Providing
				material support to facilitate, reward, or encourage acts of terrorism</header>
						<subsection id="H6F4F4BC8FC8F4802AAD1C6B76BB2C04"><enum>(a)</enum><header>Prohibition</header><text>Whoever,
				in a circumstance provided in subsection (b) provides, or attempts or conspires
				or agrees to provide, material support or resources to the perpetrator of an
				act of international terrorism, to a family member of such perpetrator, or to
				any other person, with the intent to facilitate, reward, or encourage that act
				or other acts of international terrorism, shall be fined under this title or
				imprisoned not more than 15 years, or both, and, if death results, shall be
				imprisoned for any term of years or for life.</text>
						</subsection><subsection id="HA08E231B3F764C799B395E043426A071"><enum>(b)</enum><header>Jurisdictional
				bases</header><text>A circumstance referred to in subsection (a) is—</text>
							<paragraph id="H53450C36DC9A4E5C982C61B20545BD34"><enum>(1)</enum><text>the offense occurs
				in or affects interstate or foreign commerce;</text>
							</paragraph><paragraph id="H8EDECCFCE4E249DF9C5D7F3FED4C7891"><enum>(2)</enum><text>the offense
				involves the use of the mails or a facility of interstate or foreign
				commerce;</text>
							</paragraph><paragraph id="H1B9D4FD477B84D29008F1B479308BC8B"><enum>(3)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that affects interstate or foreign commerce or would have affected interstate
				or foreign commerce had it been consummated;</text>
							</paragraph><paragraph id="H2A339176CEE140D6AD2B997932D17285"><enum>(4)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that violates the criminal laws of the United States;</text>
							</paragraph><paragraph id="H611B050B0D9B4C9C902CA25C1E7F0080"><enum>(5)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that is designed to influence the policy or affect the conduct of the United
				States Government;</text>
							</paragraph><paragraph id="H44665A5C359043FA998CA99840D24CA7"><enum>(6)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that occurs in part within the United States and is designed to influence the
				policy or affect the conduct of a foreign government;</text>
							</paragraph><paragraph id="HDFD8400E803741B0B448352463976B98"><enum>(7)</enum><text>an offender
				intends to facilitate, reward, or encourage an act of international terrorism
				that causes or is designed to cause death or serious bodily injury to a
				national of the United States while that national is outside the United States,
				or substantial damage to the property of a legal entity organized under the
				laws of the United States (including any of its States, districts,
				commonwealths, territories, or possessions) while that property is outside of
				the United States;</text>
							</paragraph><paragraph id="HFBED6AE814F64966B516D232791482E3"><enum>(8)</enum><text>the offense occurs
				in whole or in part within the United States, and an offender intends to
				facilitate, reward, or encourage an act of international terrorism that is
				designed to influence the policy or affect the conduct of a foreign government;
				or</text>
							</paragraph><paragraph id="HE33877450FC24476B224AE89E0FA5D4B"><enum>(9)</enum><text>the offense occurs
				in whole or in part outside of the United States, and an offender is a national
				of the United States, a stateless person whose habitual residence is in the
				United States, or a legal entity organized under the laws of the United States
				(including any of its States, districts, commonwealths, territories, or
				possessions).</text>
							</paragraph></subsection><subsection id="H7F3E3C60D1F2403081D0C20611649A5"><enum>(c)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
							<paragraph id="HA06326F5B4B1414BAA19A310D6421775"><enum>(1)</enum><text>the term
				<term>material support or resources</term> has the same meaning as in section
				2339A(b) of this title;</text>
							</paragraph><paragraph id="HA85E5095AB8F469CB8B3C9E50E2CA5E"><enum>(2)</enum><text>the term <term>the
				perpetrator of an act</term> includes—</text>
								<subparagraph id="HE5A79D115BC84E45AE6C7113D2802B7E"><enum>(A)</enum><text>any person who
				commits the act;</text>
								</subparagraph><subparagraph id="H9807243188AE450AB912B564AC39903F"><enum>(B)</enum><text>any person who
				aids, abets, counsels, commands, induces, or procures its commission;
				and</text>
								</subparagraph><subparagraph id="HD2B2A02C61264FD08991967C37190030"><enum>(C)</enum><text>any person who
				attempts, plans, or conspires to commit the act;</text>
								</subparagraph></paragraph><paragraph id="HE6DC8504CE0E4155B9788E6CBE5FF5E"><enum>(3)</enum><text>the term
				<term>international terrorism</term> has the same meaning as in section 2331 of
				this title;</text>
							</paragraph><paragraph id="HFB7E06B7444F4AE0A9035707C2A87D84"><enum>(4)</enum><text>the term
				<term>facility of interstate or foreign commerce</term> has the same meaning as
				in section 1958(b)(2) of this title;</text>
							</paragraph><paragraph id="H9A0821F4F6BE449481AA6F0C8B89E52"><enum>(5)</enum><text>the term
				<term>serious bodily injury</term> has the same meaning as in section 1365 of
				this title; and</text>
							</paragraph><paragraph id="HE9DF974395554F419C28BA848266C846"><enum>(6)</enum><text>the term
				<term>national of the United States</term> has the same meaning as in section
				101(a)(22) of the Immigration and Nationality Act (8 U.S.C.
				1101(a)(22)).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3D3E9F00641C43E3AF04653557FEBE7E"><enum>(b)</enum><header>Chapter
			 analysis</header><text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H040B490A52FA4F9DA0A2152DE47B861B" style="OLC">
					<toc>
						<toc-entry bold="off" level="section">2339D. Receiving military-type
				training from a foreign terrorist organization.</toc-entry>
						<toc-entry bold="off" level="section">2339E. Providing material
				support to facilitate, reward, or encourage acts of
				terrorism.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5CFE1F0FF59D40A5882B4B5756053610"><enum>(c)</enum><header>Definitions</header><text>Section
			 2332b(g)(5)(B)(i) of title 18, United States Code is amended by striking all
			 following <quote>2339C</quote> and inserting the following: <quote>(relating to
			 financing of terrorism), 2339E (relating to providing material support to
			 facilitate, reward, or encourage acts of terrorism), or 2340A (relating to
			 torture) of this title;</quote>.</text>
			</subsection></section><section id="H220EE77C7C0A4AB29204277EBDB60428"><enum>3.</enum><header>Prohibiting
			 attempts and conspiracies to obtain military-type training from a foreign
			 terrorist organization</header><text display-inline="no-display-inline">Section
			 2339D(a) of title 18, United States Code, is amended by inserting <quote>, or
			 attempts or conspires to do so,</quote> after <quote>foreign terrorist
			 organization</quote>.</text>
		</section><section id="H6DF814C8FC84419280D352CD7D04194C"><enum>4.</enum><header>Kidnapping and
			 rape overseas</header><text display-inline="no-display-inline">Section 2332 of
			 title 18, United States Code, is amended by—</text>
			<paragraph id="H2FE16B3AF0124821A721417C19004F61"><enum>(1)</enum><text>redesignating the
			 subsections (c) and (d) as subsections (d) and (e), respectively;</text>
			</paragraph><paragraph id="H662CCD70545C419CAD664300CE16E1BC"><enum>(2)</enum><text>inserting the
			 following new subsection (c):</text>
				<quoted-block display-inline="no-display-inline" id="H01987FD836D449619D377745F471CCF4" style="OLC">
					<subsection id="H68561F1118B748F584003EE4DAE3F1AE"><enum>(c)</enum><header>Kidnapping</header><text>Whoever
				outside the United States unlawfully seizes, confines, inveigles, decoys,
				kidnaps, abducts, or carries away, or attempts or conspires to seize, confine,
				inveigle, decoy, kidnap, abduct, or carry away, a national of the United
				States, shall be fined under this title, punished by imprisonment for any term
				of years or for life, or both, and if the death of any person results, shall be
				fined under this title, punished by death or imprisonment for any term of years
				or for life, or both.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H3DEF54C2414F4BD2B06DCDE6FC7D0095"><enum>(3)</enum><text>in subsection (d)
			 (as redesignated), by—</text>
				<subparagraph id="HF8AF7B60523F4C4582657E265C00A862"><enum>(A)</enum><text>inserting
			 <quote>(as defined in section 1365 of this title, including any conduct that,
			 if the conduct occurred in the special maritime and territorial jurisdiction of
			 the United States, would violate section 2241 or 2242 of this title)</quote>
			 after <quote>injury</quote> in paragraphs (1) and (2); and</text>
				</subparagraph><subparagraph id="H41898FC512C04B36A81900A9AFCD50B1"><enum>(B)</enum><text>striking
			 <quote>ten</quote> and inserting <quote>25</quote>.</text>
				</subparagraph></paragraph></section><section id="HA82A0ACE26DB453CAD670017DAF07D8C"><enum>5.</enum><header>Hostage
			 taking</header><text display-inline="no-display-inline">Section 1203 of title
			 18, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H126CB529D09949118F232691B609BE2C" style="USC">
				<section id="H8EDC5478484D4B0B99EDC73740E0F173"><enum>1203.</enum><header>Hostage
				taking</header>
					<subsection id="H84546FBBDA354263B8E0B1E8CB2C814E"><enum>(a)</enum><text>Whoever, whether
				inside or outside the United States, seizes or detains and threatens to kill,
				to injure, or to continue to detain without lawful authority—</text>
						<paragraph id="HA770067301A443FDBBB2AAE89E3634A2"><enum>(1)</enum><text>any officer or
				employee of the United States or of any agency in any branch of the United
				States Government (including any member of the uniformed services) while such
				officer or employee is engaged in or on account of the performance of official
				duties, or any person assisting such an officer or employee in the performance
				of such duties or on account of that assistance, or whoever attempts or
				conspires to do so; or</text>
						</paragraph><paragraph id="H328C0F44BDD24640AFED45A929FF1CAC"><enum>(2)</enum><text>except as provided
				in subsection (b) of this section, another person in order to compel a third
				person or a governmental organization to do or abstain from doing any act as an
				explicit or implicit condition for the release of the person detained, or
				whoever attempts or conspires to do so,</text>
						</paragraph><continuation-text continuation-text-level="subsection">shall be
				punished by imprisonment for any term of years or for life and, if the death of
				any person results, shall be punished by death or life imprisonment.</continuation-text></subsection><subsection id="H95A052117F10425BB6EFE659A657CF1C"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H3BD71C2038894BF792F119C58EE6D5"><enum>(1)</enum><text>It is not an offense under
				subsection (a)(2) if the conduct required for the offense occurred outside the
				United States unless—</text>
							<subparagraph id="H0A3E305E26C944B5B2E8C187E2E9CFA2" indent="up1"><enum>(A)</enum><text>the offender or the person seized or
				detained is a national of the United States;</text>
							</subparagraph><subparagraph id="HE8E0A3B95DEB4340BEDB120953A85D83" indent="up1"><enum>(B)</enum><text>the offender is found in the United
				States; or</text>
							</subparagraph><subparagraph id="HEB0391DEC88C4628B1B1E900AB3D04ED" indent="up1"><enum>(C)</enum><text>the governmental organization sought
				to be compelled is the Government of the United States.</text>
							</subparagraph></paragraph><paragraph id="H8E43AD4B3EB548E09279830697F475F0" indent="up1"><enum>(2)</enum><text>It is not an offense under subsection
				(a)(2) if the conduct required for the offense occurred inside the United
				States, each alleged offender and each person seized or detained are nationals
				of the United States, and each alleged offender is found in the United States,
				unless the governmental organization sought to be compelled is the Government
				of the United States.</text>
						</paragraph></subsection><subsection id="HEDD10CA51740426F8F3457C7458DB46"><enum>(c)</enum><text>As used in this
				section, the term <term>national of the United States</term> has the meaning
				given such term in section 101(a)(22) of the Immigration and Nationality Act (8
				U.S.C.
				1101(a)(22)).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2E8363EAA7794D9E83BFBED4E2BAA694"><enum>6.</enum><header>Interference with
			 flight crew or threat to safety of aircraft</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/46504">Section 46504</external-xref> of title 49, United States
			 Code, is amended by—</text>
			<paragraph id="H2D3658FCED454B0FA66BC4E79149218E"><enum>(1)</enum><text display-inline="yes-display-inline">amending the heading for such section to
			 read as follows: <quote>Interference with flight crew or threat to safety of
			 aircraft.</quote>; and</text>
			</paragraph><paragraph id="HABA425ED03564EF8ACCD083BFD00EA00"><enum>(2)</enum><text display-inline="yes-display-inline">designating the existing language as
			 subsection (a), and adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H1C9F5DE017B342AB9BCCCF4BCBA73D6D" style="OLC">
					<subsection id="HC02B02F8380540C4A7A84E9A2AF7379"><enum>(b)</enum><text>An individual on an
				aircraft in the special aircraft jurisdiction of the United States who
				knowingly or recklessly takes any action that poses a serious threat to the
				safety of the aircraft or other individuals on the aircraft, shall be fined
				under title 18, imprisoned for not more than 10 years, or
				both.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB23A3673CCA545950032E21763ACE538"><enum>7.</enum><header>Increased
			 penalties for providing material support to terrorists</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2339D">Section 2339D</external-xref> of title 18, United States
			 Code, is amended by striking <quote>or imprisoned for ten years, or
			 both.</quote> and inserting <quote>and imprisoned for not less than 3 years and
			 not more than 15 years.</quote>.</text>
		</section><section id="H1786EE29EDDE4630AD1980897183C5F"><enum>8.</enum><header>Denial of Federal
			 benefits to convicted terrorists</header>
			<subsection id="H9D3C74929419436CACC6F19B35195484"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">Chapter 113B</external-xref> of title 18, United States Code, as amended
			 by this title, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H950C8DC4D69C47DAB21EFE1C0110B2AB" style="OLC">
					<section id="HEFCE737D8F104B548655772DFF8000CF"><enum>2339F.</enum><header>Denial of
				Federal benefits to terrorists</header>
						<subsection id="H3E17FD512D87415E855BB4EB42DA205C"><enum>(a)</enum><header>In
				general</header><text>Any individual who is convicted of a Federal crime of
				terrorism (as defined in section 2332b(g)) shall, as provided by the court on
				motion of the Government, be ineligible for any or all Federal benefits for any
				term of years or for life.</text>
						</subsection><subsection id="H97A7F0702AD447ECBAF1DFA62E2628B"><enum>(b)</enum><header>Federal benefit
				defined</header><text>In this section, <term>Federal benefit</term> has the
				meaning given that term in section 421(d) of the Controlled Substances Act (21
				U.S.C.
				862(d)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H30017404EEA7444289CE627D01CACFEC"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="H769833502D5D4DC5005FF77F5D5E14D0"><enum>9.</enum><header>Improve
			 investigation of terrorist crimes</header>
			<subsection id="HA3B3A317976241CAB905DCAEB0E089A2"><enum>(a)</enum><header>Multidistrict
			 search warrants in terrorism investigations</header><text>Rule 41(b)(3) of the
			 Federal Rules of Criminal Procedure is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HA9FAD7C396F543568093F83CFC84F575" style="OLC">
					<paragraph id="H9A64FD8C8CAE49F9B3C59DE21C54EA8"><enum>(3)</enum><text>a magistrate
				judge—in an investigation of—</text>
						<subparagraph id="H35850E48086949DF96C0BF1DBCCDEFB9"><enum>(A)</enum><text>international
				terrorism or domestic terrorism (as those terms are defined in section 2331 of
				title 18, United States Code), or a Federal crime of terrorism (as defined in
				<external-xref legal-doc="usc" parsable-cite="usc/18/2332b">section 2332b(g)(5)</external-xref> of title 18, United States Code); or</text>
						</subparagraph><subparagraph id="H522084BD97C343B78FF386D8871C34B"><enum>(B)</enum><text>an offense under
				section <external-xref legal-doc="usc" parsable-cite="usc/18/1001">1001</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/18/1505">1505</external-xref> of title 18, United States Code, relating to information
				or purported information concerning a Federal crime of terrorism (as defined in
				<external-xref legal-doc="usc" parsable-cite="usc/18/2332b">section 2332b(g)(5)</external-xref> of title 18, United States Code), having authority in any
				district in which activities related to the Federal crime of terrorism or
				offense may have occurred, may issue a warrant for a person or property within
				or outside that
				district.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF8DF1476DC2B4EFA9BD5E773D456CB1E"><enum>(b)</enum><header>Increased
			 penalties for obstruction of justice in terrorism cases</header><text>Sections
			 1001(a) and 1505 of title 18, United States Code, are amended by striking
			 <quote>8 years</quote> and inserting <quote>10 years</quote>.</text>
			</subsection></section><section id="H90BADD7DAA794DBBADEFF951463B3964"><enum>10.</enum><header>Solicitation to
			 commit a crime of violence or terrorism</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/373">Section 373</external-xref> of title 18, United States Code,
			 is amended—</text>
			<paragraph id="H06D0BB2702AE40678F0014BBA24E2B9E"><enum>(1)</enum><text>in subsection (a),
			 by—</text>
				<subparagraph id="HDA76082A329942CBA0CBEF17C888B568"><enum>(A)</enum><text>inserting
			 <quote>or a Federal crime of terrorism as defined in section
			 2332b(g)(5),</quote> after <quote>in violation of the laws of the United
			 States,</quote>; and</text>
				</subparagraph><subparagraph id="H864E95E11E05497D89CDE5BB796100A8"><enum>(B)</enum><text>inserting
			 <quote>or persons</quote> after <quote>another person</quote>;</text>
				</subparagraph></paragraph><paragraph id="H76F06E81CC6D4A129C5BD1797094D5BB"><enum>(2)</enum><text>in subsection (c),
			 by—</text>
				<subparagraph id="H9CF749A340534A0EB5586028EC330007"><enum>(A)</enum><text>inserting
			 <quote>or persons</quote> after <quote>the person</quote>;</text>
				</subparagraph><subparagraph id="H6A3144AC4CEA4E0B971CD092EA963EDF"><enum>(B)</enum><text>striking
			 <quote>he</quote> and inserting <quote>they</quote> in the phrase
			 <quote>because he lacked</quote>;</text>
				</subparagraph><subparagraph id="HB48DEF5009154FE9AF43FABDDF8504D0"><enum>(C)</enum><text>striking <quote>he
			 was</quote> and inserting <quote>they were</quote> in the phrase <quote>because
			 he was incompetent</quote>;</text>
				</subparagraph><subparagraph id="H311EB55A2AE94CBE9FA14158A92D80FD"><enum>(D)</enum><text>striking <quote>he
			 is</quote> and inserting <quote>they are</quote> in the phrase <quote>because
			 he is immune</quote>; and</text>
				</subparagraph><subparagraph id="HB9D961943ED244B782A4C4C60E2DD5B"><enum>(E)</enum><text>striking
			 <quote>is</quote> from <quote>is not subject to prosecution</quote>; and</text>
				</subparagraph></paragraph><paragraph id="H79C913DE839B41958304F283DA2D5848"><enum>(3)</enum><text>in the title by
			 inserting the words <quote><header-in-text level="section" style="OLC">or

			</paragraph></section><section id="HE4EB74F64DA9449D857C25C9B6E16D6F"><enum>11.</enum><header>Terrorist
			 offense resulting in death</header>
			<subsection id="H63F564E15B624A0E8DF222D1FD8400C1"><enum>(a)</enum><header>New
			 offense</header><text display-inline="yes-display-inline">Chapter 113B of title
			 18, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="HD90A8B947993418AA4FE1FBCA500FE00" style="USC">
					<section id="H5CF33C868C8D4B2197DFB6E165D26832"><enum>2339E.</enum><header>Terrorist
				offenses resulting in death</header>
						<subsection id="H8697B5822A604D1DADA4008CF7018F3"><enum>(a)</enum><text>Whoever, in the
				course of committing a terrorist offense, engages in conduct that results in
				the death of a person, shall be punished by death or imprisoned for any term of
				years or for life.</text>
						</subsection><subsection id="H41F028F90A87431D9149964385E1D8D3"><enum>(b)</enum><text>As used in this
				section, the term <quote>terrorist offense</quote> means—</text>
							<paragraph id="H93D400B960544608BF4E00A945E59063"><enum>(1)</enum><text>a felony offense
				that is—</text>
								<subparagraph id="H8158EF6639CA4E88BC6CF51AABA5BAA"><enum>(A)</enum><text>a Federal crime of
				terrorism as defined in section 2332b(g), other than an offense under section
				1363; or</text>
								</subparagraph><subparagraph id="H7DE44B57AFA04E39925440588B2F9B2C"><enum>(B)</enum><text>an offense under
				this chapter, section 175, 175b, 229, or 831, or section 236 of the Atomic
				Energy Act of 1954; or</text>
								</subparagraph></paragraph><paragraph id="H9BB639E92A5E421AAD629FA2E558C3D"><enum>(2)</enum><text>a Federal offense
				that is an attempt or conspiracy to commit an offense described in paragraph
				(1).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1E5E5D774D9C4644A1B6925E7855AA62"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 113B
			 of title 18, United States Code, is amended by adding at the end the following
			 new item:</text>

			<subsection id="H464C318509DA4BE5B12C61BB627B43D3"><enum>(a)</enum><header>Participation in
			 nuclear and weapons of mass destruction threats to the United
			 States</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/832">Section 832(c)</external-xref> of title 18, United States Code, is amended
			 by inserting <quote>punished by death if death results to any person from the
			 offense, or</quote> after <quote>shall be</quote>.</text>
			</subsection><subsection id="H83D0708D4F4F4C8BA0040969724D76FC"><enum>(b)</enum><header>Missile systems
			 To destroy aircraft</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332g">Section 2332g(c)(3)</external-xref> of title 18, United
			 States Code, is amended by inserting <quote>punished by death or</quote> after
			 <quote>shall be</quote>.</text>
			</subsection><subsection id="H6C8FEA6B55D74B22B9FF3C8902958C95"><enum>(c)</enum><header>Atomic
			 weapons</header><text>The last sentence of section 222 b. of the Atomic Energy
			 Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2272">42 U.S.C. 2272</external-xref>) is amended by inserting <quote>death or</quote>
			 before <quote>imprisonment for life</quote> the last place it appears.</text>
			</subsection><subsection id="HB4745F110916416185B577F093A8CEFA"><enum>(d)</enum><header>Radiological
			 dispersal devices</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2332h">Section 2332h(c)(3)</external-xref> of title 18, United States
			 Code, is amended by inserting <quote>death or</quote> before
			 <quote>imprisonment for life</quote>.</text>
			</subsection><subsection id="H6AF603D603304C8584EE08AAB319AD82"><enum>(e)</enum><header>Variola
			 virus</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/175c">Section 175c(c)(3)</external-xref> of title 18, United States Code, is
			 amended by inserting <quote>death or</quote> before <quote>imprisonment for
			 life</quote>.</text>

			 certain penalties</header>

			 title 18, United States Code, is amended by striking <quote>20 years</quote>
			 and inserting <quote>30 years</quote>.</text>
			</subsection><subsection id="H25DBC6FA3A6B4D43B7828F1E74E61DCD"><enum>(b)</enum><header>Section
			 2332<enum-in-header>(c)</enum-in-header></header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2332">Section 2332(c)</external-xref> of title 18, United States
			 Code, is amended by striking <quote>ten years</quote> and inserting <quote>20
			 years</quote>.</text>
			</subsection><subsection id="H95B8916957E34F3E8EB1CFB6052CF195"><enum>(c)</enum><header>Section
			 2339C<enum-in-header>(d)</enum-in-header></header><text>Section 2339C(d) of
			 title 18, United States Code, is amended—</text>
				<paragraph id="H2C283193F81149DA83EF9423B872E259"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>20 years</quote> and inserting <quote>30 years</quote>;
			 and</text>
				</paragraph><paragraph id="H692A2BEED9594077957C15BBC411D9E4"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>10 years</quote> and inserting <quote>20
			 years</quote>.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H84C97896025043A2959330E954A825E" section-type="subsequent-section"><enum>14.</enum><header>Modernization of
			 state of mind requirement for section 2339C offenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2339C">Section 2339C</external-xref> of title 18, United States
			 Code, is amended by striking <quote>unlawfully and wilfully</quote> and
			 inserting <quote>knowingly</quote>.</text>
		</section><section id="H0A641F9E438E4E1288A2D490FCFE7C5F"><enum>15.</enum><header>Wiretap
			 predicate</header><text display-inline="no-display-inline">Section 2516(q) of
			 title 18, United States Code, is amended by striking <quote>section
			 2332</quote> and all that follows through <quote>2339C</quote> and inserting
			 <quote>chapter 113B</quote>.</text>
