<section id="HA3C749076D0C476988BBC63FEC86001E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Combating Terrorism Financing Act of 2007</short-title></quote>.</text></section> 
<section id="H80FFB28B1BCF4B589FFBF20087326564"><enum>2.</enum><header>Interstate transportation of criminal proceeds and <quote>reverse</quote> money laundering</header> 
<subsection id="H5FE5ABD9B8E9429295559DF1F7B48E05"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957(a)</external-xref> of title 18, United States Code, is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="HBB28AA3A2E5C4C2D85CC00792464E589" style="OLC"> 
<subsection id="H647E004766694AE4BB7C9EB90085504E"><enum>(a)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H4FE698A614C140FD99CC7941DD9CB1A3"><enum>(1)</enum><text>Whoever, in any of the circumstances set forth in subsection (d)—</text> 
<subparagraph id="H1BF55926FF0141CA83BB005FF0703082" indent="up1"><enum>(A)</enum><text>conducts or attempts to conduct a monetary transaction involving property of a value greater than $10,000 that is derived from specified unlawful activity, knowing that the property is derived from some form of unlawful activity; or</text></subparagraph> 
<subparagraph id="H60CBCDA395F044E49CDF001C8743B1D5" indent="up1"><enum>(B)</enum><text>conducts or attempts to conduct a monetary transaction involving property of a value greater than $10,000, with the intent to promote the carrying on of specified unlawful activity,</text></subparagraph><continuation-text continuation-text-level="paragraph" indent="subsection">shall be punished as provided in subsection (b).</continuation-text></paragraph> 
<paragraph id="HF2A9AAD8C8E5482CAF2BA1E74D08FA1F" indent="up1"><enum>(2)</enum><text>Whoever, in the any of the circumstances set forth in subsection (d), transports, attempts to transport, or conspires to transport more than $10,000 in currency in interstate commerce—</text> 
<subparagraph id="H4C025866B9DE469E9BC29502E4EE5724"><enum>(A)</enum><text>knowing that the currency was derived from some form of unlawful activity; or</text></subparagraph> 
<subparagraph id="H03A594E37B3F494487A376E80914C0AA"><enum>(B)</enum><text>knowing that the currency was intended to be used to promote some form of unlawful activity,</text></subparagraph><continuation-text continuation-text-level="paragraph" indent="subsection">shall be punished as provided in subsection (b).</continuation-text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1DFB394304AB4EF98E24C13328787512"><enum>(b)</enum><header>Penalty</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957(b)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H51C9C7FD2EFA46728E9EECA6010A6DF"><enum>(1)</enum><text>in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>; and</text></paragraph> 
<paragraph id="H2B355156BC414AABAB35E53E5D8CE295"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA0EDC282712149D89FD127BAAF13BD61" style="OLC"> 
<paragraph id="HBB5CA30AFF8D4CB7A1C5BE0091F05D6C" indent="up1"><enum>(3)</enum><text>The maximum period of incarceration for a person convicted of an offense under subsection (a)(1)(B) must not exceed the statutory maximum for the offense being promoted.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H45A92243BAE144079D76D347204FAE2"><enum>(c)</enum><header>Conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957(f)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H7E03324AFD3243E3AA00AD0016E107C6"><enum>(1)</enum><text>in paragraph (2) by striking <quote>and</quote> after the semicolon;</text></paragraph> 
<paragraph id="HA895D26D28374456001E79F6FA3EC508"><enum>(2)</enum><text>in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H35FF51433A2A45AFB5D6DDF21159FCD8"><enum>(3)</enum><text>by inserting at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H36CC48BC7FF542839EC3ABD0FDE9BD48" style="OLC"> 
<paragraph id="H1B367950E1A240DE9F3EE2F914ABD38"><enum>(4)</enum><text>the term <term>conducts</term> has the same meaning as it does for purposes of section 1956 of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7FFE826B33794E7FA0B17EC7DC000570"><enum>(d)</enum><header>Heading</header> 
<paragraph id="H0A4B658F113642F081319F82AF47B1B8"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957</external-xref> of title 18, United States Code, is amended in the heading by inserting <quote>or in support of criminal activity</quote> after <quote>specified unlawful activity</quote>.</text></paragraph> 
<paragraph id="H83F614D8B65545BA9F03AC1BEB6B3427"><enum>(2)</enum><header>Chapter analysis</header><text>The item relating to section 1957 in the chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/95">chapter 95</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<section id="H179990F2D98C48E491D0CEFF7BAF8F8"><enum>3.</enum><header>Freezing bank accounts of persons arrested for offenses involving the movement of money across international borders</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/981">Section 981(b)</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDE2C84A180144A209C7DB511A318695D" style="OLC"> 
<paragraph id="H58BA16E4A376480F96E639B3DE30F247"><enum>(5)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H88176067209B4952B0B060C5E2E93ED4"><enum>(A)</enum><text>If a person is arrested or charged in connection with an offense described in subparagraph (C) involving the movement of funds into or out of the United States, the Attorney General may apply to any Federal judge or magistrate judge in the district in which the arrest is made or the charges are filed for an ex parte order restraining any account held by the person arrested or charged for not more than 30 days, except that the time may be extended for good cause shown at a hearing conducted in the manner provided in rule 43(e) of the Federal Rules of Civil Procedure. The court may receive and consider evidence and information submitted by the Government that would be inadmissible under the Federal Rules of Evidence.</text></subparagraph> 
<subparagraph id="HF20268F8687A4E9D9EC1E992797B83AE" indent="up1"><enum>(B)</enum><text>The application for the restraining order referred to in subparagraph (A) shall—</text> 
<clause id="H25719662332B4BE49892F8DF8379A303"><enum>(i)</enum><text>identify the offense for which the person has been arrested or charged;</text></clause> 
<clause id="HB05FE2D9FFD64B32B52876FA5FC73937"><enum>(ii)</enum><text>identify the location and description of the accounts to be restrained; and</text></clause> 
<clause id="H153AEFE4F8D34E7CA7DD61C0E32BCE00"><enum>(iii)</enum><text>state that the restraining order is needed to prevent the removal of the funds in the account by the person arrested or charged, or by others associated with such person, during the time needed by the Government to conduct such investigation as may be necessary to establish whether there is probable cause to believe that the funds in the accounts are subject to forfeiture in connection with the commission of any criminal offense.</text></clause></subparagraph> 
<subparagraph id="HA1CA8F75431E43FA008C12A46DFFA900" indent="up1"><enum>(C)</enum><text>A restraining order may be issued pursuant to subparagraph (A) if a person is arrested or charged with any offense for which forfeiture is authorized under this title, title 31, or the Controlled Substances Act.</text></subparagraph> 
<subparagraph id="H532D0F7126AD490CB290978D7DEA91A8" indent="up1"><enum>(D)</enum><text>For purposes of this paragraph—</text> 
<clause id="H76EEEF809C9348DE95D5DEEF2F00DA39"><enum>(i)</enum><text>the term <term>account</term> includes any safe deposit box and any account (as defined in section 5318A(e)(1) and (e)(2)) at any financial institution;</text></clause> 
<clause id="HBD4C0C5CDE1948ACB6CEA06CA70AE74"><enum>(ii)</enum><text>the term <term>account held by the person arrested or charged</term> includes an account held in the name of such person, and any account over which such person has effective control as a signatory or otherwise.</text></clause></subparagraph> 
<subparagraph id="HD96C96E4703E4B109D9FC12B459D1984" indent="up1"><enum>(E)</enum><text>Restraint pursuant to this paragraph shall not be deemed a seizure for purposes of sub<external-xref legal-doc="usc" parsable-cite="usc/18/983">section 983(a)</external-xref> of this title.</text></subparagraph> 
<subparagraph id="H56C8F180B30344D9AA10B4336816699D" indent="up1"><enum>(F)</enum><text>A restraining order issued pursuant to this paragraph may be executed in any district in which the subject account is found, or transmitted to the central authority of any foreign state for service in accordance with any treaty or other international agreement.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4FFF1E0C25204E478ED67100B3A321E4"><enum>4.</enum><header>Using blank checks in bearer form to smuggle money</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/5316">Section 5316</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H543A81FDF9774784B68019456094CB2E" style="OLC"> 
<subsection id="HC0DF9304F09141849962E7954D6DD6C7"><enum>(e)</enum><header>Monetary instruments with amount left blank</header><text>For purposes of this section, a monetary instrument that has the amount left blank shall be considered to have a value in excess of $10,000 if the instrument was drawn on an account that contained or was intended to contain more than $10,000 at the time the instrument was being transported, or at the time it was negotiated or was intended to be negotiated.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H12E620D295344C3DA5AA77BE18AEFE4"><enum>5.</enum><header>Prohibiting money laundering through hawalas, other informal value transfer systems, and closely related transactions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956(a)(1)</external-xref> of title 18, United States Code, is amended by striking <quote>For purposes of this paragraph, a financial transaction</quote> and inserting <quote>For purposes of this paragraph and section 1957, a financial transaction or a monetary transaction</quote>.</text></section> 
<section id="H1CC54C25781A46318C157E07CB000034"><enum>6.</enum><header>Section 1957 violations involving commingled funds and structured transactions</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1957">Section 1957</external-xref> of title 18, United States Code, is amended by adding after subsection (f) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4473C4019ADB45B5BC7FCF986932D020" style="OLC"> 
<subsection id="HB100F29B74B14E61AC6E1EBEFAECF6C"><enum>(g)</enum><text>The Government may satisfy the $10,000 requirement in subsection (a)(1) by showing that—</text> 
<paragraph id="H2AB579653AB64FD29197BF5C9B70F6D3"><enum>(1)</enum><text>the monetary transaction involved the transfer, withdrawal, encumbrance, or other disposition of more than $10,000 from an account in which more than $10,000 in proceeds of specified unlawful activity was commingled with other funds; or</text></paragraph> 
<paragraph id="HB018444EA1C14B3FA3CE4232E773FB7"><enum>(2)</enum><text>the defendant conducted a series of monetary transactions in amounts under $10,000 that exceeded $10,000 in the aggregate and that were closely related to each other in terms of such factors as time, the identity of the parties involved, the nature or purpose of the transactions or the manner in which they are conducted.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
