		<section display-inline="no-display-inline" id="H6EF7B8EB60E146E89DDB218012A3B7A1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Lead Poisoning Reduction Act of
			 2007</short-title></quote>.</text>
		</section><section id="H3EFF28BFE836476BA547D2AA4527C761"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H971E3E9E18704AA18B6D2E003EC81B79"><enum>(1)</enum><text>the number of
			 children suffering from lead poisoning remains unacceptably high;</text>
			</paragraph><paragraph id="H6494EC4BDFFA48F596760873C3FD081"><enum>(2)</enum><text>children younger
			 than 6 years of age are much more likely to suffer the devastating effects of
			 lead poisoning;</text>
			</paragraph><paragraph id="H957C4C84F5B34F4284F46DBBDC7BC344"><enum>(3)</enum><text>the health of
			 children may be impacted at lower levels of lead exposure than previously
			 thought;</text>
			</paragraph><paragraph id="HBDBA918759D446DFB6461B9C45E5F7DD"><enum>(4)</enum><text>lead poisoning can
			 lead to organ damage, as well as serious developmental, learning, and
			 behavioral problems in children;</text>
			</paragraph><paragraph id="H3E5362A5395E4236948E9000ED420364"><enum>(5)</enum><text>owners and
			 managers of childcare and pre-school facilities constructed before 1978 need
			 guidance with respect to protecting children of the United States from exposure
			 to lead; and</text>
			</paragraph><paragraph id="H054CF372D4AE4978AB10DDEA60361732"><enum>(6)</enum><text>the Administrator
			 of the Environmental Protection Agency has the authority, but, as of the date
			 of enactment of this Act, has elected not, to promulgate regulations pursuant
			 to section 402 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2682">15 U.S.C. 2682</external-xref>) to reduce
			 lead exposure in child-occupied facilities.</text>
			</paragraph></section><section id="H5F38FAD6A4684399938D7EA422BDBA8D"><enum>3.</enum><header>Lead assessment
			 in child-occupied facilities</header><text display-inline="no-display-inline">Section 402 of the
			 <act-name parsable-cite="TSCA">Toxic Substances Control Act (15 U.S.C.
			 2682)</act-name> is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H03798EAB30FF49FE8FCE68306ED18D4B" style="OLC">
				<subsection id="HDFB3513F834C43D3AD589C10D69C4C67"><enum>(d)</enum><header>Child-occupied
				facilities</header>
					<paragraph id="H66A38EF66D6B4D838143FC4F754251A7"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="HD2852CF866984C8791593BC9744F8BC1"><enum>(A)</enum><header>Child-occupied
				facility</header>
							<clause id="H1BE51DC7DDA949C8B28845516962CA48"><enum>(i)</enum><header>In
				general</header><text>The term <term>child-occupied facility</term> means a
				facility described in clause (ii) that was constructed before January 1, 1978,
				and that is visited regularly by a child of not more than 6 years old for at
				least 2 days within any week for not less than—</text>
								<subclause id="H5F1986D9D99849BABC31D9AEBD7FAC54"><enum>(I)</enum><text>3 hours each
				visit;</text>
								</subclause><subclause id="HFA9FD655F15244DA94B298DAFE5616D1"><enum>(II)</enum><text>6 hours each
				week; and</text>
								</subclause><subclause id="HC13BE72769DB45C3BCF85500B61429F6"><enum>(III)</enum><text>60 hours each
				calendar year.</text>
								</subclause></clause><clause id="H39F85FBEC32B49D2B443E0A335B3422"><enum>(ii)</enum><header>Description of
				facility</header><text>A facility referred to in clause (i) is—</text>
								<subclause id="H9D25C409005B43ADB4CC938278B94CB7"><enum>(I)</enum><text>a childcare
				center;</text>
								</subclause><subclause id="HA366B84A124147A4B02BD8B43D5C8180"><enum>(II)</enum><text>a pre-school or
				kindergarten classroom; or</text>
								</subclause><subclause id="H24DBDEDFAF9E4E42812CE24DD39C4BDF"><enum>(III)</enum><text>except as
				provided in clause (iii), any other facility (including a facility used for a
				Head Start program or a similar program) at which a childcare provider receives
				compensation or a subsidy for services provided.</text>
								</subclause></clause><clause id="H65C925F80CD14981A1009469A9FB2E55"><enum>(iii)</enum><header>Exclusion</header><text>The
				term <term>child-occupied facility</term> does not include a home-based
				childcare facility.</text>
							</clause></subparagraph><subparagraph id="HF821D52FFFB340E8A88723DC8ED39562"><enum>(B)</enum><header>Exposure
				pathway</header><text>The term <term>exposure pathway</term> includes, with
				respect to lead—</text>
							<clause id="H0E7C169F494E4090934726138F3C0600"><enum>(i)</enum><text>lead-based paint
				and lead-based paint hazards; and</text>
							</clause><clause id="H3579C60F6FDF44B7A48EB5B2D124C43B"><enum>(ii)</enum><text>lead contained
				in—</text>
								<subclause id="H9E2C97DBACB74837B5ED0715C7251BAB"><enum>(I)</enum><text>drinking water
				plumbing and fixtures;</text>
								</subclause><subclause id="H6959674CC1DD4FA4A766CC4355E1CFD2"><enum>(II)</enum><text>furniture,
				fixtures, and playground equipment; and</text>
								</subclause><subclause id="H66E57979F20C4F7B8DEEC769976F505B"><enum>(III)</enum><text>products used by
				or for children.</text>
								</subclause></clause></subparagraph><subparagraph id="HB96EC432608E4F8A8E546285ABF9D6E4"><enum>(C)</enum><header>Home-based
				childcare facility</header><text>The term <term>home-based childcare
				facility</term> means an owner-occupied or rental housing unit—</text>
							<clause id="HD3F7A57B95084EC083801900C946F55B"><enum>(i)</enum><text>at
				which 1 or more individuals reside; and</text>
							</clause><clause id="H6B333774182E41439ECEEB8970224EBA"><enum>(ii)</enum><text>that meets the
				requirements under clauses (i) and (ii) of subparagraph (A) for a
				child-occupied facility.</text>
							</clause></subparagraph><subparagraph id="H019758A00B3641FC80321B543FA00FA"><enum>(D)</enum><header>Select
				Group</header><text>The term <term>Select Group</term> means the Select Group
				on Lead Exposure established by paragraph (2)(A).</text>
						</subparagraph></paragraph><paragraph id="H459837A5D9EB43AFB1681506E68027F8"><enum>(2)</enum><header>Select Group on
				Lead Exposure</header>
						<subparagraph id="H2AA58D4F99384C99AE931D9323794B24"><enum>(A)</enum><header>Establishment</header><text>There
				is established a Select Group on Lead Exposure, to be composed of—</text>
							<clause id="H44C4A1317A6C44388EF5A5A3733976CA"><enum>(i)</enum><text>the Secretary of
				Education (or a designee);</text>
							</clause><clause id="H83607EE79D4448E1B344DA1848C6B883"><enum>(ii)</enum><text>the Director of
				the Centers for Disease Control and Prevention (or a designee);</text>
							</clause><clause id="H591BAE9D610E47EFAAA8B100EE17FBF"><enum>(iii)</enum><text>the Director of
				the National Institute of Environmental Health Science (or a designee);</text>
							</clause><clause id="H20BDED3942D9424D861000DD421D1BEA"><enum>(iv)</enum><text>the Assistant
				Secretary of the Administration for Children and Families (or a
				designee);</text>
							</clause><clause id="H755689B64ED8443E892C86FBC2C048C"><enum>(v)</enum><text>the
				Director of the National Institute of Child Health and Human Development (or a
				designee); and</text>
							</clause><clause id="H79A959BCB7F24EFA9C393FA4A0401E73"><enum>(vi)</enum><text>the head of any
				other Federal agency (or a designee), as the Administrator determines to be
				appropriate.</text>
							</clause></subparagraph><subparagraph id="H6963688A8EAD4DF88D14928EC707B535"><enum>(B)</enum><header>Duties</header><text>The
				Select Group shall advise the Administrator on actions necessary to carry out
				this subsection and related activities.</text>
						</subparagraph><subparagraph id="HC8850AF6918644E0942BBA7B5487EADA"><enum>(C)</enum><header>Compensation of
				members</header><text>A member of the Select Group shall serve without
				compensation.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4493B0DA56041FDBBFA2B6501985DE6"><enum>(D)</enum><header>Travel
				expenses</header><text>A member of the Select Group shall be allowed travel
				expenses, including per diem in lieu of subsistence, at rates authorized for an
				employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United
				States Code, while away from the home or regular place of business of the
				member in the performance of the duties of the Select Group.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDC2DA502F3948FAA4F56DF350B4B1E4"><enum>(3)</enum><header>Baseline
				standards and model program</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="H6D6023C2DABE4883AE809F23B1FD5E"><enum>(A)</enum><header>Study</header><text>Not
				later than 180 days after the date of enactment of this subsection, the Select
				Group shall conduct a study of State, tribal, and local programs the purpose of
				which is to protect children from exposure to lead at child-occupied
				facilities.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E6807F64C894A89A57DC985A535001F"><enum>(B)</enum><header>Standards and
				program</header>
							<clause commented="no" display-inline="no-display-inline" id="HE8660049A29C463EAF3D5217DB14C3A3"><enum>(i)</enum><header>Development</header><text>Not
				later than 1 year after the date of enactment of this subsection, the Select
				Group shall develop—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H10AAE5138D7F4889976F4B97E1098758"><enum>(I)</enum><text>baseline standards
				with which a State, tribal, or local program described in subparagraph (A)
				shall comply to be eligible to receive a grant under paragraph (4); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H109FE0E8274D455FAF628869FF35C8FA"><enum>(II)</enum><text>a model program
				to protect children from exposure to lead at child-occupied facilities that can
				be adopted for use by State, tribal, and local governments.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HDCE6420090364AF39CC8B6BCE332AE11"><enum>(ii)</enum><header>Factors for
				consideration</header><text>In developing the baseline standards and model
				program under clause (i), the Select Group shall take into
				consideration—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H157A12B67E524B3BB154BE677F70C019"><enum>(I)</enum><text>the results of the
				study under subparagraph (A);</text>
								</subclause><subclause id="H842879BA6EF641D38200D928D542C00"><enum>(II)</enum><text>regulations
				promulgated pursuant to subsection (a) (including the process of promulgating
				the regulations); and</text>
								</subclause><subclause id="H122DAFBC5B8B4DE9A45C60AC42E05FB"><enum>(III)</enum><text>guidance for
				childcare providers produced by agencies and other groups, including—</text>
									<item id="H24153BE384304DF697B2CC2385314900"><enum>(aa)</enum><text>any
				member of the Select Group;</text>
									</item><item id="H549EFF57A6464AE7A1649D207D308B91"><enum>(bb)</enum><text>the
				American Academy of Pediatrics;</text>
									</item><item id="H4D935E801BDC4EB0B61D0050FAF8AC59"><enum>(cc)</enum><text>the
				American Public Health Association; and</text>
									</item><item id="H9AB7C3210B4446C6883B8435C700F700"><enum>(dd)</enum><text>the
				National Center for Healthy Housing.</text>
									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8C2C81E3A9224C41A2894860EAC7C2C6"><enum>(iii)</enum><header>Requirements</header>
								<subclause commented="no" display-inline="no-display-inline" id="HF2E49C3C8A364470A7D2CFB350DDE26"><enum>(I)</enum><header>Baseline
				standards</header><text>The baseline standards developed under clause (i)(I)
				shall include guidelines for—</text>
									<item id="H5E5865E7D9BD4592BD205D1446075B67"><enum>(aa)</enum><text>assessing
				child-occupied facilities for the identification and remediation of exposure
				pathways; and</text>
									</item><item id="H8D477F4F1E964F61804F42601843C3DE"><enum>(bb)</enum><text>informing
				children and families that visit child-occupied facilities of the exposure
				pathways and related hazards.</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H6B9C13622CC94BA1AD00F45B7F1E9D1C"><enum>(II)</enum><header>Model
				program</header><text>The model program developed under clause (i)(II) shall
				meet or exceed such applicable standards (including the baseline standards
				under clause (i)(I)) as the Administrator may establish with respect to grant
				programs carried out by the Administrator, including standards requiring
				that—</text>
									<item commented="no" display-inline="no-display-inline" id="HA8571E8E97E44976885CFB288C506F55"><enum>(aa)</enum><text>each appropriate
				child-occupied facility shall be provided a notice as soon as practicable after
				a child served by the child-occupied facility is diagnosed with lead poisoning,
				subject to such guidelines as the Select Group determines to be necessary to
				ensure the protection of privileged medical information; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="H9F0ED01CDA904D4BA2F2004B71253786"><enum>(bb)</enum><text>on receiving a
				notification under item (aa), a child-occupied facility that has not been
				tested for the presence of lead in exposure pathways shall be so tested.</text>
									</item></subclause></clause></subparagraph></paragraph><paragraph id="H4837A2900378407FB82969A7004BB1D"><enum>(4)</enum><header>Grant
				program</header>
						<subparagraph id="H1EE3537928B74363B7994FDFD5EE542B"><enum>(A)</enum><header>Definition of
				eligible facility</header>
							<clause id="H30E35FF16B5F438A987D006E917F6ECA"><enum>(i)</enum><header>In
				general</header><text>In this paragraph, the term <term>eligible
				facility</term> means a child-occupied facility that participates in a State,
				tribal, or local program—</text>
								<subclause id="HE9BEBB62BA414297904FB652D8ACBFC1"><enum>(I)</enum><text>the purpose of
				which is to protect children from exposure to lead at child-occupied
				facilities; and</text>
								</subclause><subclause id="H8CD5ABAA426D47F893B6C2E34C2024B0"><enum>(II)</enum><text>that—</text>
									<item id="HA41C61039B5D4306863B417E8E31F2C2"><enum>(aa)</enum><text>is
				based on the model program developed under paragraph (3)(B)(i)(II); or</text>
									</item><item id="HEC6D5C2EF5B74D5A006933AEA11106F2"><enum>(bb)</enum><text>otherwise meets
				the baseline standards developed under paragraph (3)(B)(i)(I).</text>
									</item></subclause></clause><clause id="HCEB983D4899649CE00B5C7E3BDD0FCE9"><enum>(ii)</enum><header>Exclusion</header><text>The
				term <term>eligible facility</term> does not include a home-based childcare
				facility.</text>
							</clause></subparagraph><subparagraph id="H2296365916FB4107B9588D0624FA28A5"><enum>(B)</enum><header>Establishment</header><text>Not
				later than 1 year after, but in no case before, the date of development of
				baseline standards and the model program under paragraph (3), the
				Administrator, in consultation with the Select Group, shall establish a program
				under which the Administrator shall provide grants to eligible facilities to
				assist the eligible facilities in carrying out activities to protect children
				from exposure to lead at eligible facilities.</text>
						</subparagraph><subparagraph id="H883CCA0EE499432289356B00501080F0"><enum>(C)</enum><header>Application</header><text>To
				be eligible to receive a grant under this paragraph, an eligible facility shall
				submit to the Administrator an application at such time, in such manner, and
				containing such information as the Administrator, in consultation with the
				Select Group, may require.</text>
						</subparagraph><subparagraph id="HE3092287F0694E8194FAFBE8532D6E9"><enum>(D)</enum><header>Cost
				sharing</header>
							<clause id="HDD8EB9ABFFBA436700E683EF37B173E6"><enum>(i)</enum><header>In
				general</header><text>The non-Federal share of the cost of an activity funded
				by a grant under this paragraph shall be 20 percent.</text>
							</clause><clause id="HAE736D741C1846FDA5DE22DAAEA4500"><enum>(ii)</enum><header>Provision</header><text>The
				non-Federal share under clause (i)—</text>
								<subclause id="HDC5259D6C0CF4ED590A026051EC96298"><enum>(I)</enum><text>may be provided
				using State, tribal, and local government funds and private funds; and</text>
								</subclause><subclause id="H8EED66D6B5904A0A94D42E51B67819C1"><enum>(II)</enum><text>shall not be
				provided using funds appropriated pursuant to any Federal program.</text>
								</subclause></clause></subparagraph><subparagraph id="H7B924DCFC16F45278803D7583787FEC8"><enum>(E)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to carry
				out this paragraph $42,600,000 for the period of fiscal years 2007 through
				2011.</text>
						</subparagraph></paragraph><paragraph id="H7D625044D227421D853C3260F809F17C"><enum>(5)</enum><header>Regulations</header>
						<subparagraph id="HF2DCB8D706DB46B2B5F1CBC1A167300"><enum>(A)</enum><header>Testing</header><text>Not
				later than 18 months after the date of enactment of this subsection, the
				Administrator shall promulgate regulations requiring that—</text>
							<clause id="H82AF314BD0CE459FBB1DA3D03B4CC7C6"><enum>(i)</enum><text>child-occupied
				facilities placed into service after that date shall test each applicable
				exposure pathway for the presence of lead; and</text>
							</clause><clause id="H69565F61A5CD49DAA28320E53E055B92"><enum>(ii)</enum><text>no State or
				Indian tribe shall issue to a child-occupied facility described in clause (i) a
				license until—</text>
								<subclause id="H39A0F289CED646ADBE4606D2971F8907"><enum>(I)</enum><text>the testing
				required under clause (i) is completed; and</text>
								</subclause><subclause id="H31D43974731B43C791979929BA9E2D55"><enum>(II)</enum><text>the exposure to
				lead, if any, in each applicable exposure pathway is eliminated.</text>
								</subclause></clause></subparagraph><subparagraph id="HD7DDC89FB07648CFB8C676C5766785C"><enum>(B)</enum><header>Elimination of
				risk</header>
							<clause id="H114F54F6000049849B3E19D5D5BC4D66"><enum>(i)</enum><header>In
				general</header><text>Not later than 3 years after the date of enactment of
				this subsection, the Administrator shall promulgate proposed regulations
				requiring all child-occupied facilities to eliminate the risk of exposure to
				lead through applicable exposure pathways.</text>
							</clause><clause id="HDCDDDF8F922142B5A60063B0DF99EBF"><enum>(ii)</enum><header>Finalization and
				effective date</header><text>The proposed regulations under clause (i)—</text>
								<subclause id="H215CAB11066543BFA251AF9E68E96483"><enum>(I)</enum><text>shall be finalized
				by the Administrator not later than 4 years after the date of enactment of this
				subsection; and</text>
								</subclause><subclause id="H1AF156DDE8274F7DBBECC040609C23B5"><enum>(II)</enum><text>shall take effect
				not later than 5 years after the date of enactment of this subsection.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="H31BAA1B0719349FB8461D61BCC5D9856"><enum>(6)</enum><header>Contractors
				engaged in renovation, remodeling, and painting of child-occupied
				facilities</header><text>Not later than 18 months after the date of enactment
				of this subsection, the Administrator, in consultation with the Select Group,
				shall—</text>
						<subparagraph id="H6929F86FC1F645A890664D31D6DCFC4"><enum>(A)</enum><text>apply regulations
				promulgated pursuant to subsection (c)(3) to contractors and other workers
				engaged in the renovation, remodeling, or painting of child-occupied
				facilities; and</text>
						</subparagraph><subparagraph id="HF0A6C9B5256D4EA0885928D21D209F97"><enum>(B)</enum><text>establish a
				program to provide information, training, and materials concerning those
				activities to the contractors and workers.</text>
						</subparagraph></paragraph><paragraph id="H649C85B605534C03AADA417D92F97BAB"><enum>(7)</enum><header>Report to
				Congress</header><text>Not later than 3 years after the date of enactment of
				this subsection, the Administrator, in consultation with the Select Group,
				shall submit to Congress a report containing—</text>
						<subparagraph id="H2CFA758B2F8142099D9FCD1C43C35D00"><enum>(A)</enum><text>a list of States
				and Indian tribes carrying out programs to protect children from exposure to
				lead at child-occupied facilities that meet the baseline standards developed
				under paragraph (3)(B)(i)(I) (including by adopting the model program developed
				under paragraph (3)(B)(i)(II));</text>
						</subparagraph><subparagraph id="HF0F274CC08B54D7CB7C27E0234333C9F"><enum>(B)</enum><text>the number of
				child-occupied facilities that received grants under paragraph (4) during the
				preceding 3-year period; and</text>
						</subparagraph><subparagraph id="H31607C3F2FC94AA29DFC34D36362F7C"><enum>(C)</enum><text>recommendations for
				additional Federal funds and resources, if any, required to ensure the
				protection of children from exposure to lead at child-occupied
				facilities.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
