<official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code, to provide full payments under such chapter to units of general local government in which entitlement land is located, to provide transitional payments during fiscal years 2008 through 2012 to those States and counties previously entitled to payments under the Secure Rural Schools and Community Self-Determination Act of 2000, and for other purposes.</official-title>

<section id="H33A7F2DDE49A4B859FAA961396286FF0" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Public Land Communities Transition Act of 2007</short-title></quote>. </text></section>
<section id="HCDC9D94177E84B7597844B8BD085B400"><enum>2.</enum><header>Funding for payments in lieu of taxes</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/31/6906">Section 6906</external-xref> of title 31, United States Code, is amended—</text>
<paragraph id="H0699661C757143D40021C005565E730"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—</quote> before <quote>Necessary</quote>; and</text></paragraph>
<paragraph id="H10475AC5834F485E84D0C3373390737C"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>
<quoted-block style="OLC" id="HEECD55AD3CF24CB4B95B81B32B73CD59" display-inline="no-display-inline">
<subsection id="H57355199459B4A19937C6E7E540986BE"><enum>(b)</enum><header>Transition to full funding</header><text display-inline="yes-display-inline">Amounts authorized under this chapter shall be made available to the Secretary of the Interior, out of any other funds in the Treasury not otherwise appropriated and without further appropriation, for obligation or expenditure in accordance with this chapter as follows: </text>
<paragraph id="HC52A726A662B449AA51C8988D0373BF"><enum>(1)</enum><text>For fiscal year 2008, 80 percent of the amount authorized under this chapter in the prior fiscal year. </text></paragraph>
<paragraph id="H424EC3F0B42A4E5A9207787431A0B5A1"><enum>(2)</enum><text>For fiscal year 2009, 90 percent of the amount authorized under this chapter in the prior fiscal year. </text></paragraph>
<paragraph id="HFEE40D9FA9734DDEBDEBA4274015DB26"><enum>(3)</enum><text>For fiscal years 2010 and 2011, 100 percent of the amount authorized under this chapter in the prior fiscal year.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HE4A43ABFB9B84BE4B3ADD84FAB00F0D2"><enum>3.</enum><header>Transitional payments States and counties previously entitled to payments under Secure Rural Schools and Community Self-Determination Act of 2000</header>
<subsection id="H3DAE3C8EB3CD4F00A70539D72C09B8B8"><enum>(a)</enum><header>Transitional payments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">Chapter 69</external-xref> of title 31, United States Code, is amended by adding at the end the following new section:</text>

<section id="HC084BB6266DA4D948B02FC479840552D"><enum>6908.</enum><header>Secure rural schools transition payments</header>
<subsection id="H840BD0F2C56B4754976DA2C72717B00"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="H873E5080C7594FDA9C7455008F18C190"><enum>(1)</enum><header>Adjusted share</header><text>The term <term>adjusted share</term> means the number equal to the quotient obtained by dividing—</text>
<subparagraph id="H24104B993AAF430DA07000E7E089407C"><enum>(A)</enum><text>the number equal to the quotient obtained by dividing—</text>
<clause id="H7A006C5A7ED9439984C67958BE004DBB"><enum>(i)</enum><text>the base share for the eligible county; by</text></clause>
<clause id="HC4ADDA7DFB1644B983C621DC76D5703"><enum>(ii)</enum><text>the income adjustment for the eligible county; by</text></clause></subparagraph>
<subparagraph id="HB73351C726C64C53A69E78A381FFF315"><enum>(B)</enum><text>the number equal to the sum of the quotients obtained under subparagraph (A) and paragraph (8)(A) for all eligible counties.</text></subparagraph></paragraph>
<paragraph id="HA28886D2BB044B21971853E5FFEE074D"><enum>(2)</enum><header>Base share</header><text>The term <term>base share</term> means the number equal to the average of—</text>
<subparagraph id="H3459430D427F472694084B567FD8968F"><enum>(A)</enum><text>the quotient obtained by dividing—</text>
<clause id="H829F22CBFCC94CED939C61A51C1C4DA"><enum>(i)</enum><text>the number of acres of Federal land described in paragraph (7)(A) in each eligible county; by</text></clause>
<clause id="H1903C0D92AC7469AA5BAA127FE913808"><enum>(ii)</enum><text>the total number acres of Federal land in all eligible counties in all eligible States; and</text></clause></subparagraph>
<subparagraph id="HAC0C4AA1F5364C2EA9006FCDD5B4F98"><enum>(B)</enum><text>the quotient obtained by dividing—</text>
<clause id="H9297BA04A2454B338C4E14DAB0425083"><enum>(i)</enum><text>the amount equal to the average of the 3 highest 25-percent payments and safety net payments made to each eligible State for each eligible county during the eligibility period; by</text></clause>
<clause id="H1F64942546644103ABA68BBE37A7654F"><enum>(ii)</enum><text>the amount equal to the sum of the amounts calculated under clause (i) and paragraph (9)(B)(i) for all eligible counties in all eligible States during the eligibility period.</text></clause></subparagraph></paragraph>
<paragraph id="H26AE08DEC5F849F9AB1D16252607F500"><enum>(3)</enum><header>County payment</header><text>The term <term>county payment</term> means the payment for an eligible county calculated under subsection (c).</text></paragraph>
<paragraph id="HCC83E274DCB4469B8970FCF7C4929708"><enum>(4)</enum><header>Eligible county</header><text>The term <term>eligible county</term> means any county that—</text>
<subparagraph id="H6417987ABF704D4CA8D66FE3526CF7D9"><enum>(A)</enum><text>contains Federal land (as defined in paragraph (7)); and</text></subparagraph>
<subparagraph id="HEDB3717C08034765ABF553CCC9974B79"><enum>(B)</enum><text>elects to receive a share of the State payment or the county payment under subsection (f).</text></subparagraph></paragraph>
<paragraph id="HCCBB0A4F823242C28300BB6410481537"><enum>(5)</enum><header>Eligibility period</header><text>The term <term>eligibility period</term> means fiscal year 1986 through fiscal year 1999.</text></paragraph>
<paragraph id="H99586E2FCDA44D64B6164E79F02B8C02"><enum>(6)</enum><header>Eligible state</header><text>The term <term>eligible State</term> means a State or territory of the United States that received a 25-percent payment for 1 or more fiscal years of the eligibility period.</text></paragraph>
<paragraph id="H901C54B1AE7E407DA13800C3F59093F"><enum>(7)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text>
<subparagraph id="HDFD30780A2474C83B358E56295BC72C"><enum>(A)</enum><text>land within the National Forest System, as defined in section 11(a) of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>) exclusive of the National Grasslands and land utilization projects designated as National Grasslands administered pursuant to the Act of July 22, 1937 (<external-xref legal-doc="usc" parsable-cite="usc/7/1010">7 U.S.C. 1010–1012</external-xref>); and</text></subparagraph>
<subparagraph id="HD290E5C6EBFF40A38337BE36DB15BB0"><enum>(B)</enum><text>such portions of the revested Oregon and California Railroad and reconveyed Coos Bay Wagon Road grant land as are or may hereafter come under the jurisdiction of the Department of the Interior, which have heretofore or may hereafter be classified as timberlands, and power-site land valuable for timber, that shall be managed, except as provided in the former section 3 of the Act of August 28, 1937 (50 Stat. 875; <external-xref legal-doc="usc" parsable-cite="usc/43/1181c">43 U.S.C. 1181c</external-xref>), for permanent forest production.</text></subparagraph></paragraph>
<paragraph id="H9A197FDA34C244BCAF008550119B2E85"><enum>(8)</enum><header>50-percent adjusted share</header><text>The term <term>50-percent adjusted share</term> means the number equal to the quotient obtained by dividing—</text>
<subparagraph id="H07F1CB13556C4132A9BF53A18511CF89"><enum>(A)</enum><text>the number equal to the quotient obtained by dividing—</text>
<clause id="H99640BE3A7734D008F08FEC4698B512D"><enum>(i)</enum><text>the 50-percent base share for the eligible county; by</text></clause>
<clause id="HE9A154A6F0FA420E9234F5D37D7784E9"><enum>(ii)</enum><text>the income adjustment for the eligible county; by</text></clause></subparagraph>
<subparagraph id="H24BB436FD5BF4D9285D23F49D00B0A0"><enum>(B)</enum><text>the number equal to the sum of the quotients obtained under subparagraph (A) and paragraph (1)(A) for all eligible counties.</text></subparagraph></paragraph>
<paragraph id="H0A173D87292B488BAB9C285445F7F6BE"><enum>(9)</enum><header>50-percent base share</header><text>The term <term>50-percent base share</term> means the number equal to the average of—</text>
<subparagraph id="H960012F6E28748D9B194611FAC006F25"><enum>(A)</enum><text>the quotient obtained by dividing—</text>
<clause id="H86F8F4ACEB3E4A0BA6B7C898AFAF59B3"><enum>(i)</enum><text>the number of acres of Federal land described in paragraph (7)(B) in each eligible county; by</text></clause>
<clause id="H48B2842CE6F64F67BAD49F2B4D76F2F8"><enum>(ii)</enum><text>the total number acres of Federal land in all eligible counties in all eligible States; and</text></clause></subparagraph>
<subparagraph id="H1C1725D3A1164B3DA6DD11A4EDB5C9E"><enum>(B)</enum><text>the quotient obtained by dividing—</text>
<clause id="HC90468EFD7B34C2E9C412BF0A01EACF"><enum>(i)</enum><text>the amount equal to the average of the 3 highest 50-percent payments made to each eligible county during the eligibility period; by</text></clause>
<clause id="H10B0AC71374248E38B6F85CC1B7F71CE"><enum>(ii)</enum><text>the amount equal to the sum of the amounts calculated under clause (i) and paragraph (2)(B)(i) for all eligible counties in all eligible States during the eligibility period.</text></clause></subparagraph></paragraph>
<paragraph id="H832CFF8D234945839CCF0290004B11DB"><enum>(10)</enum><header>50-percent payment</header><text>The term <term>50-percent payment</term> means the payment that is the sum of the 50-percent share otherwise paid to a county pursuant to title II of the Act of August 28, 1937 (chapter 876; 50 Stat. 875; <external-xref legal-doc="usc" parsable-cite="usc/43/1181f">43 U.S.C. 1181f</external-xref>), and the payment made to a county pursuant to the Act of May 24, 1939 (chapter 144; 53 Stat. 753; <external-xref legal-doc="usc" parsable-cite="usc/43/1181f-1">43 U.S.C. 1181f–1 et seq.</external-xref>).</text></paragraph>
<paragraph id="HA44868E0AEDB4411BC10ECF1A3F3411"><enum>(11)</enum><header>Full funding amount</header><text>The term <term>full funding amount</term> means—</text>
<subparagraph id="H8DF2D27CDD7E48368F93BDA8C9DA8C8"><enum>(A)</enum><text>$520,000,000 for fiscal year 2008; and</text></subparagraph>
<subparagraph id="H404741F22489475D9D547EC5001000A3"><enum>(B)</enum><text>for fiscal years 2009, 2010, and 2011, the amount that is equal to 90 percent of the full funding amount for the preceding fiscal year.</text></subparagraph></paragraph>
<paragraph id="H601F3E1FD2C9496F94C1CB23ECED4F65"><enum>(12)</enum><header>Income adjustment</header><text>The term <term>income adjustment</term> means the square of the quotient obtained by dividing—</text>
<subparagraph id="HE1C54675E1084D6900F273BA590846E2"><enum>(A)</enum><text>the per capita personal income for each eligible county; by</text></subparagraph>
<subparagraph id="H39AC7525768F4825AEBF4CE42D550089"><enum>(B)</enum><text>the median per capita personal income of all eligible counties.</text></subparagraph></paragraph>
<paragraph id="H792E4D9701D841CE8EABE42CF4B8FE95"><enum>(13)</enum><header>Per capita personal income</header><text>The term <term>per capita personal income</term> means the most recent per capita personal income data, as determined by the Bureau of Economic Analysis.</text></paragraph>
<paragraph id="HFCEC536005E946F5A5C8A287E0432E61"><enum>(14)</enum><header>Safety net payments</header><text>The term <term>safety net payments</term> means the special payment amounts paid to States and counties required by section 13982 or 13983 of the <act-name parsable-cite="OBRA93">Omnibus Budget Reconciliation Act of 1993</act-name> (<external-xref legal-doc="public-law" parsable-cite="pl/103/66">Public Law 103–66</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="usc" parsable-cite="usc/43/1181f">43 U.S.C. 1181f</external-xref> note).</text></paragraph>
<paragraph id="HCF7578EA246D42F0841C0397A7A3A5F1"><enum>(15)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text>
<subparagraph id="H4C98AAD7889848E38F91FAD9D4725D05"><enum>(A)</enum><text>the Secretary of Agriculture or the designee of the Secretary of Agriculture with respect to the Federal land described in paragraph (7)(A); and</text></subparagraph>
<subparagraph id="H745083D3E7F14C060047B2FED9F40750"><enum>(B)</enum><text>the Secretary of the Interior or the designee of the Secretary of the Interior with respect to the Federal land described in paragraph (7)(B).</text></subparagraph></paragraph>
<paragraph id="HCDAF07BA96964D2E84AE9FF9347EE289"><enum>(16)</enum><header>State payment</header><text>The term <term>State payment</term> means the payment for an eligible State calculated under subsection (b)</text></paragraph>
<paragraph id="H2A5C1E2EA96A465C941E00ABEBFA7F3C"><enum>(17)</enum><header>25-percent payment</header><text>The term <term>25-percent payment</term> means the payment to States required by the sixth paragraph under the heading of <quote><header-in-text>forest service</header-in-text></quote> in the Act of May 23, 1908 (35 Stat. 260; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>), and section 13 of the Act of March 1, 1911 (36 Stat. 963; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>).</text></paragraph></subsection>
<subsection id="HFC6C0BAA13F5454E92CF1D95CBFEFAE4" display-inline="no-display-inline"><enum>(b)</enum><header>Calculation of State Payment amount</header><text>For each of fiscal years 2008 through 2011, the Secretary of Agriculture shall calculate for each eligible State an amount equal to the sum of the products obtained by multiplying—</text>
<paragraph id="H9F1E9754BC1D404792E29871C6EF442"><enum>(1)</enum><text>the adjusted share for each eligible county within the eligible State; by</text></paragraph>
<paragraph id="H39F1C3D34A954AE48E34DFF9EC636DC"><enum>(2)</enum><text>the full funding amount for the fiscal year.</text></paragraph></subsection>
<subsection id="HCC209FC1730043EF93A9682A52140D0"><enum>(c)</enum><header>Calculation of County Payment amount</header><text>For each of fiscal years 2008 through 2011, the Secretary of the Interior shall calculate for each eligible county that received a 50-percent payment during the eligibility period an amount equal to the product obtained by multiplying—</text>
<paragraph id="HDD98B58E518E4541B47187BE0025CD7D"><enum>(1)</enum><text>the 50-percent adjusted share for the eligible county; by</text></paragraph>
<paragraph id="H6A851DD3F71448BC91088BE3F6779E8B"><enum>(2)</enum><text>the full funding amount for the fiscal year.</text></paragraph></subsection>
<subsection id="H7AC2D7DF2E6B4DE0B70018166E6464B0" display-inline="no-display-inline"><enum>(d)</enum><header>Payment Amounts for eligible States</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall pay to each eligible State an amount equal to the sum of the amounts elected under subsection (f) by each county within the eligible State for—</text>
<paragraph id="H4FAC5B03742D4971BFBC59E26C0008C"><enum>(1)</enum><text>if the county is eligible for the 25-percent payment, the share of the 25-percent payment; or</text></paragraph>
<paragraph id="H1E18A089FE354D76B479D090A92EC922"><enum>(2)</enum><text>the share of the State payment of the eligible county.</text></paragraph></subsection>
<subsection id="HDF18D41A8614486EAD1C234B0104FB2E"><enum>(e)</enum><header>Payment Amounts for eligible counties</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall pay to each eligible county an amount equal to the amount elected under subsection (f) by the county for—</text>
<paragraph id="HA3CB8A502A7741E7804E00006CB52155"><enum>(1)</enum><text>if the county is eligible for the 50-percent payment, the 50-percent payment; or</text></paragraph>
<paragraph id="H1EA10F4AD5924A7EA0F021D577297BB2"><enum>(2)</enum><text>the county payment for the eligible county.</text></paragraph></subsection>
<subsection id="H5FACAFAD8E35493BA01D0087C172D799"><enum>(f)</enum><header>Election To Receive Payment Amount</header>
<paragraph id="HEC98D601B3CB40D480B00D15DC2EBE0"><enum>(1)</enum><header>Election; submission of results</header>
<subparagraph id="H618D969860F54F4299A0F200BDF5B203"><enum>(A)</enum><header>In general</header><text>The election to receive a share of the State payment, the county payment, a share of the State payment and the county payment, a share of the 25-percent payment, the 50-percent payment, or a share of the 25-percent payment and the 50-percent payment, as applicable, shall be made at the discretion of each affected county by August 1, 2008, and thereafter in accordance with paragraph (2)(A), and transmitted to the Secretary concerned by the Governor of each eligible State.</text></subparagraph>
<subparagraph id="HD8EEC31C22514859AD9BE665C9A0962D"><enum>(B)</enum><header>Failure to transmit</header><text>If an election for an affected county is not transmitted to the Secretary concerned by the date specified under subparagraph (A), the affected county shall be considered to have elected to receive a share of the State payment, the county payment, or a share of the State payment and the county payment, as applicable.</text></subparagraph></paragraph>
<paragraph id="HD9E7A829620742C2AB1402007389B191"><enum>(2)</enum><header>Duration of election</header>
<subparagraph id="H16E6F41FF7D746D5B2496634FC65F48"><enum>(A)</enum><header>In general</header><text>A county election to receive a share of the 25-percent payment or 50-percent payment, as applicable, shall be effective for 2 fiscal years.</text></subparagraph>
<subparagraph id="H8F4992866B784D4D8E485BA96750FC73"><enum>(B)</enum><header>Full funding amount</header><text>If a county elects to receive a share of the State payment or the county payment, the election shall be effective for all subsequent fiscal years through fiscal year 2011.</text></subparagraph></paragraph></subsection>
<subsection id="HB66A1C37CC4F423BA9D03CBF3CB2FCDE"><enum>(g)</enum><header>Source of payment amounts</header><text>The payment to an eligible State or eligible county under this section for a fiscal year shall be derived from—</text>
<paragraph id="H14A1F1F61F464FF58B16D2004B75DE58"><enum>(1)</enum><text>any revenues, fees, penalties, or miscellaneous receipts, exclusive of deposits to any relevant trust fund, special account, or permanent operating funds, received by the Federal Government from activities by the Bureau of Land Management or the Forest Service on the applicable Federal land;</text></paragraph>
<paragraph id="HF99336EB3381492D866C993FD27B8B4"><enum>(2)</enum><text>for fiscal year 2008, any funds appropriated to carry out this section; and</text></paragraph>
<paragraph id="HB712B1A14C5D4337AB4CEAD247600018"><enum>(3)</enum><text>to the extent of any shortfall, out of any amounts in the Treasury of the United States not otherwise appropriated.</text></paragraph></subsection>
<subsection id="HC649C650F00940D68ED540C5314DB725"><enum>(h)</enum><header>Distribution and Expenditure of Payments</header>
<paragraph id="HD58B3C2239E64B7ABB526DCEAFDCA0CB"><enum>(1)</enum><header>Distribution method</header><text>A State that receives a payment under this section shall distribute the appropriate payment amount among the appropriate counties in the State in accordance with—</text>
<subparagraph id="H0297D269D6D6496892F2DDCF7972A726"><enum>(A)</enum><text>the Act of May 23, 1908 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>); and</text></subparagraph>
<subparagraph id="HC5CAFACECF72456EBA3FBE408ECDC9A7"><enum>(B)</enum><text>section 13 of the Act of March 1, 1911 (36 Stat. 963; <external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref>).</text></subparagraph></paragraph>
<paragraph id="H4A0C59E13A784B0A9953499D8EACEEF8"><enum>(2)</enum><header>Expenditure purposes</header><text display-inline="yes-display-inline">Subject to paragraph (3), payments received by a State under this section and distributed to counties in accordance with paragraph (1), and payments received directly by an eligible county under this section, shall be expended in the same manner in which 25-percent payments or 50-percent payments, as applicable, are required to be expended.</text></paragraph>
<paragraph id="H2D0473C1962542F4AB53E348CDBB8438"><enum>(3)</enum><header>Reservation of portion of payments</header><text display-inline="yes-display-inline">Each eligible county receiving a payment under this section or a portion of a State’s payment under this section shall reserve not less than 15 percent of the amount received for expenditure in accordance with titles II and III of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref>).</text></paragraph></subsection>
<subsection id="H47E9F1081CC6407789D4374476AB0039"><enum>(i)</enum><header>Time for Payment</header><text>The payments required under this section for a fiscal year shall be made as soon as practicable after the end of that fiscal year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HE41060FC0B004D2DBB041165CD8D80F9"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/69">chapter 69</external-xref> of title 31, United States Code, is amended by adding at the end the following new item:</text>

<section id="HD85EBAEB4CBB462390AE589002D672E" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Special requirements regarding transition payments to certain States</header>
<subsection id="H896AD71BA60E480997AFBE684627AD"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HFE26EB816613488B8D6DEC255999CD85"><enum>(1)</enum><header>Adjusted amount</header><text>The term <term>adjusted amount</term> means, with respect to a covered State—</text>
<subparagraph id="H1E4689B19ED84001B557247901E02F4F"><enum>(A)</enum><text>for fiscal year 2008—</text>
<clause id="H5F6863C045EF4CC59B5DEEC3DA4FBA63"><enum>(i)</enum><text display-inline="yes-display-inline">the sum of the amounts paid for fiscal year 2006 under section 102(a)(2) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref>), as in effect on September 29, 2006, for the eligible counties in the covered State that have elected under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, to receive a share of the State payment for fiscal year 2008; and</text></clause>
<clause id="HFBA2496B4B0449D3B1C196D4C3C4CE9F"><enum>(ii)</enum><text display-inline="yes-display-inline">the sum of the amounts paid for fiscal year 2006 under section 103(a)(2) Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref>), as in effect on September 29, 2006, for the eligible counties in the State of Oregon that have elected under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, to receive the county payment for fiscal year 2008;</text></clause></subparagraph>
<subparagraph id="H8707A857629C4F6D94C36886D36765C3"><enum>(B)</enum><text>for fiscal year 2009, 90 percent of—</text>
<clause id="HE42B50A6BEF64AB7A59D715333B5954"><enum>(i)</enum><text>the sum of the amounts paid for fiscal year 2006 under such section 102(a)(2) for the eligible counties in the covered State that have elected under such section 6908 to receive a share of the State payment for fiscal year 2009; and</text></clause>
<clause id="H6DAAD37A3A6F4AB1A2DC5C6F214E8912"><enum>(ii)</enum><text>the sum of the amounts paid for fiscal year 2006 under such section 103(a)(2) for the eligible counties in the State of Oregon that have elected under such section 6908 to receive the county payment for fiscal year 2009;</text></clause></subparagraph>
<subparagraph id="H8A043894430D4869A8F400AC297693B6"><enum>(C)</enum><text>for fiscal year 2010, 81 percent of—</text>
<clause id="H8E2163B9EE204FF6917CC1AA8E77EF7E"><enum>(i)</enum><text>the sum of the amounts paid for fiscal year 2006 under section such 102(a)(2) for the eligible counties in the covered State that have elected under such section 6908 to receive a share of the State payment for fiscal year 2010; and</text></clause>
<clause id="H921F4F573660460587A411A89893D0E3"><enum>(ii)</enum><text display-inline="yes-display-inline">the sum of the amounts paid for fiscal year 2006 under such section 103(a)(2) for the eligible counties in the State of Oregon that have elected under such section 6908 to receive the county payment for fiscal year 2010; and</text></clause></subparagraph>
<subparagraph id="HFAFF459E9E064AFD8197DFCBB6B9B93"><enum>(D)</enum><text>for fiscal year 2011, 73 percent of—</text>
<clause id="HE3DF84848F164F15A87C155132A2F288"><enum>(i)</enum><text display-inline="yes-display-inline">the sum of the amounts paid for fiscal year 2006 under such section 102(a)(2) for the eligible counties in the covered State that have elected under such section 6908 to receive a share of the State payment for fiscal year 2011; and</text></clause>
<clause id="H009134DD081F4FEE888B26D33D330086"><enum>(ii)</enum><text display-inline="yes-display-inline">the sum of the amounts paid for fiscal year 2006 under such section 103(a)(2) for the eligible counties in the State of Oregon that have elected under such section 6908 to receive the county payment for fiscal year 2011.</text></clause></subparagraph></paragraph>
<paragraph id="H47A5892D7A504429944416626DC851BD"><enum>(2)</enum><header>Covered state</header><text display-inline="yes-display-inline">The term <term>covered State</term> means each of the States of California, Louisiana, Oregon, Pennsylvania, South Carolina, South Dakota, Texas, and Washington.</text></paragraph>
<paragraph id="H9393AD5FCBA1407E8914F2147856CA6C"><enum>(3)</enum><header>Eligible county</header><text display-inline="yes-display-inline">The term <quote>eligible county</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act.</text></paragraph></subsection>
<subsection id="HB505F21725E84F0EA023961974B5CD32"><enum>(b)</enum><header>Transition Payments</header><text display-inline="yes-display-inline">For each of fiscal years 2008 through 2011, in lieu of the payment amounts that otherwise would have been made under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, the Secretary of the Treasury shall pay the adjusted amount to each covered State and the eligible counties within the covered State, as applicable.</text></subsection>
<subsection id="HF50142C68EDD4AC693861F795C6F41BC"><enum>(c)</enum><header>Distribution of Adjusted Amount</header><text display-inline="yes-display-inline">It is the intent of Congress that the method of distributing the payments under subsection (b) among the counties in a covered State (other than California) for each of fiscal years 2008 through 2011 be in the same proportion that the payments were distributed to the eligible counties in that State in fiscal year 2006.</text></subsection>
<subsection id="H344194E4260544C8B8A6AA1243D68CF0"><enum>(d)</enum><header>Distribution of Payments in California</header><text display-inline="yes-display-inline">The following payments shall be distributed among the eligible counties in the State of California in the same proportion that payments under section 102(a)(2) of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref>), as in effect on September 29, 2006, were distributed to the eligible counties for fiscal year 2006:</text>
<paragraph id="H74E55FDF70C44CA8AC81AA05C0F3A9B7"><enum>(1)</enum><text>Payments to the State of California under subsection (b).</text></paragraph>
<paragraph id="HBEBFE7E744214E499614BD83003F002F"><enum>(2)</enum><text display-inline="yes-display-inline">The shares of the eligible counties of the State payment for California under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, for fiscal year 2011.</text></paragraph></subsection>
<subsection id="HC8907EAD8CF94C3F9925C3E74F328608"><enum>(e)</enum><header>Treatment of Payments</header><text display-inline="yes-display-inline">Any payment made under subsection (b) shall be considered to be a payment made under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, except that each eligible county receiving a payment under such subsection or a portion of such payment under subsection (c) or (d) shall reserve not less than 15 percent of the amount received for expenditure in accordance with titles II and III of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/500">16 U.S.C. 500</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/106/393">Public Law 106–393</external-xref>), as required by subsection (h)(3) of such section 6908.</text></subsection></section>
<section id="HF3E34F5BBAA449978725D637D7F1908" section-type="subsequent-section" display-inline="no-display-inline"><enum>5.</enum><header>Conservation of Resources Fees</header>
<subsection id="H39D5CBFB0F7541B6B586E03BC9490D"><enum>(a)</enum><header>Establishment of Fees</header>
<paragraph id="H584E4D3A64234F9997EF3DA548C8E48E"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary of the Interior by regulation shall establish—</text>
<subparagraph id="H9F98E4C0487E418FAC8DF5D60D334B6"><enum>(A)</enum><text>a conservation of resources fee for producing Federal oil and gas leases in the Gulf of Mexico; and</text></subparagraph>
<subparagraph id="H179111503DF64FA8B8F5EF234E7D461"><enum>(B)</enum><text>a conservation of resources fee for nonproducing Federal oil and gas leases in the Gulf of Mexico.</text></subparagraph></paragraph>
<paragraph id="HB5D81706061E4DE88F1BE640066B00D7"><enum>(2)</enum><header>Producing lease fee terms</header><text>The fee under paragraph (1)(A)—</text>
<subparagraph id="H49136EA040134E8F9C5C0053BFB969A1"><enum>(A)</enum><text>subject to subparagraph (C), shall apply to covered leases that are producing leases;</text></subparagraph>
<subparagraph id="HA30C9D6B908D439DB77E55325B812864"><enum>(B)</enum><text>shall be set at $9 per barrel for oil and $1.25 per million Btu for gas, respectively, in 2005 dollars; and</text></subparagraph>
<subparagraph id="HDA1041488AF640D0AC8BF64E08B9F571"><enum>(C)</enum><text>shall apply only to production of oil or gas occurring—</text>
<clause id="H0ABCE8B4F5C14FF6B52FAC5027B62682"><enum>(i)</enum><text>in any calendar year in which the arithmetic average of the daily closing prices for light sweet crude oil on the New York Mercantile Exchange (NYMEX) exceeds $34.73 per barrel for oil and $4.34 per million Btu for gas in 2005 dollars; and</text></clause>
<clause id="H9C0572A669444103928629A91CFED5"><enum>(ii)</enum><text>on or after October 1, 2006.</text></clause></subparagraph></paragraph>
<paragraph id="HCED39727F1BF4283992FB1B98C23875"><enum>(3)</enum><header>Nonproducing lease fee terms</header><text>The fee under paragraph (1)(B)—</text>
<subparagraph id="H35DEBB5B09524F6CA293E3C38C782526"><enum>(A)</enum><text>subject to subparagraph (C), shall apply to leases that are nonproducing leases;</text></subparagraph>
<subparagraph id="HFC4667A894A44717A9C2A44750B7BCCC"><enum>(B)</enum><text>shall be set at $3.75 per acre per year in 2005 dollars; and</text></subparagraph>
<subparagraph id="H964877AC41D74CF7AA67CAD62C12B2D7"><enum>(C)</enum><text>shall apply on and after October 1, 2006.</text></subparagraph></paragraph>
<paragraph id="H748FCAF64E5D427BB50325F7DE57FCA2"><enum>(4)</enum><header>Treatment of receipts</header><text>Amounts received by the United States as fees under this subsection shall be treated as offsetting receipts.</text></paragraph></subsection>
<subsection id="HABE882959D3B4D569322B57411F5D186"><enum>(b)</enum><header>Covered Lease Defined</header><text>In this section the term <quote>covered lease</quote> means a lease for oil or gas production in the Gulf of Mexico that is—</text>
<paragraph id="HC0EDE3C9D9F34AFFAD56DBD41B98F2F"><enum>(1)</enum><text>in existence on the date of enactment of this Act;</text></paragraph>
<paragraph id="HE2573C7CEA1D4A8CB6398B40EE8FE6C6"><enum>(2)</enum><text>issued by the Department of the Interior under section 304 of the Outer Continental Shelf Deep Water Royalty Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/58">Public Law 104–58</external-xref>); and</text></paragraph>
<paragraph id="H2004AF58DCCA45A6BABCD78558B99E01"><enum>(3)</enum><text>not subject to limitations on royalty relief based on market price that are equal to or less than the price thresholds described in clauses (v) through (vii) of section 8(a)(3)(C) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(a)(3)(C)</external-xref>).</text></paragraph></subsection>
<subsection id="H8C9D44BE0D8B44CDA11862F338818404"><enum>(c)</enum><header>Royalty suspension provisions</header><text display-inline="yes-display-inline">The Secretary of the Interior shall agree to a request by any lessee to amend any lease issued for Central and Western Gulf of Mexico tracts during the period of January 1, 1998, through December 31, 1999, to incorporate price thresholds applicable to royalty suspension provisions, or amend existing price thresholds, in the amount of $34.73 per barrel (2005 dollars) for oil and for natural gas of $4.34 per million Btu (2005 dollars).</text></subsection></section>
<section id="H4742DAA1DEA3432F9833E8567F81F115"><enum>6.</enum><header>Sense of Congress on distribution of Secure rural schools transition payments to eligible counties</header><text display-inline="no-display-inline">It is the sense of Congress that amounts made available by a State to an eligible county under <external-xref legal-doc="usc" parsable-cite="usc/31/6908">section 6908</external-xref> of title 31, United States Code, as added by section 3 of this Act, or under section 4 of this Act to support public schools in that county should be in addition to, and not in lieu of, general funds of the State made available to support public schools in that county, and that the State should not adjust education funding allocations to reflect the receipt of amounts under such section 6908 or section 4.</text></section>
