<legis-type>A BILL</legis-type> 
<official-title>To amend title 10, United States Code, to permit certain additional retired members of the Armed Forces who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs for their disability and either retired pay by reason of their years of military service or Combat-Related Special Compensation and to eliminate the phase-in period under current law with respect to such concurrent receipt.</official-title>

<section section-type="section-one" id="H4F61E170FEE64C07AAF6EDA1565DD35E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Retired Pay Restoration Act</short-title></quote>.</text></section> 
<section id="H4743863D57344E609B989E273C2BC668"><enum>2.</enum><header>Findings and sense of Congress</header> 
<subsection id="H835C4FCCDD934884B5E9BB051F8D2D62"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="H55FCC4D177F14ED38C62ABB072942685"><enum>(1)</enum><text>For more than 100 years before 1999, all disabled military retirees were required to fund their own veterans’ disability compensation by forfeiting one dollar of earned retired pay for each dollar received in veterans’ disability compensation.</text></paragraph> 
<paragraph id="HAF0D116704DA439A90DFF4EE17587CB6"><enum>(2)</enum><text>Since 1999, Congress has enacted legislation to progressively expand eligibility criteria for relief of the retired pay disability offset and reduce the burden of financial sacrifice on disabled military retirees.</text></paragraph> 
<paragraph id="H4A3F02971E754CE3867E4395ABF6C9E4"><enum>(3)</enum><text>Absent adequate funding to eliminate the sacrifice for all disabled retirees, Congress has given initial priority to easing financial inequities for the most severely disabled and for combat-disabled retirees.</text></paragraph> 
<paragraph id="H8AD905F71AE349EFB7035D449E34FD7"><enum>(4)</enum><text display-inline="yes-display-inline">In the interest of maximizing eligibility within cost constraints, Congress effectively has authorized full concurrent receipt for all qualifying retirees with 100-percent disability ratings and all qualifying retirees with combat-related disability ratings, while phasing out the disability offset to retired pay over 10 years for retired members with noncombat-related, service-connected disability ratings of 50 percent to 90 percent.</text></paragraph> 
<paragraph id="H60BA91BCC5C04D9D955BCB096CDA3345"><enum>(5)</enum><text>In pursuing these good-faith efforts, Congress acknowledges the regrettable necessity of creating new thresholds of eligibility that understandably are disappointing to disabled retirees who fall short of meeting those new thresholds.</text></paragraph> 
<paragraph id="H66C58F70BE0F4DCA87A2C3502B060000"><enum>(6)</enum><text>Congress is not content with the status quo.</text></paragraph></subsection> 
<subsection id="H5A249CC3F3484624A3C6CDF57431C9E3"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that military retired pay earned by service and sacrifice in defending the United States should not be reduced because a military retiree is also eligible for veterans’ disability compensation awarded for service-connected disability.</text></subsection></section> 
<section id="H9A6F54CB320042BA8500A883D000B174"><enum>3.</enum><header>Eligibility for payment of both retired pay and veterans’ disability compensation for certain additional military retirees with compensable service-connected disabilities</header> 
<subsection id="H17F0552D315040BBA0AC609AC9EC072"><enum>(a)</enum><header>Extension of Concurrent Receipt Authority to Retirees With Service-Connected Disabilities Rated Less Than 50 Percent</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/10/1414">section 1414</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H8400F4B6D7964EEB86D1E4AD019BAC40"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text></quote> in the subsection heading and all that follows through <quote>Subject</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Compensation</header-in-text>.—Subject</quote>; and</text></paragraph> 
<paragraph id="H939163D80B074FEAA426670092384549"><enum>(2)</enum><text>by striking paragraph (2).</text></paragraph></subsection> 
<subsection id="H6C00AA51B2FA4BC08B6989FFC6FCBB47"><enum>(b)</enum><header>Repeal of Phase-In of Concurrent Receipt of Retired Pay and Veterans’ Disability Compensation</header><text>Such section is further amended—</text> 
<paragraph id="HCFF0993D96CD4EB3B31E4513002CD975"><enum>(1)</enum><text>in subsection (a), as amended by subsection (a) of this section, by striking the final sentence;</text></paragraph> 
<paragraph id="HC4D9269EDB61462A9BDD6735DB00807D"><enum>(2)</enum><text>by striking subsection (c) and redesignating subsections (d) and (e) as subsections (c) and (d), respectively; and</text></paragraph> 
<paragraph id="H96673283AA6446399ED53CD0F6FDBE58"><enum>(3)</enum><text>in subsection (d), as so redesignated, by striking paragraphs (3) and (4).</text></paragraph></subsection>

<subsection id="H2BAAE572E9EE4D32878313DD11BA8527"><enum>(a)</enum><header>Eligibility for TERA Retirees</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a</external-xref> of title 10, United States Code, is amended by striking “entitled to retired pay who—” and all that follows through the end of paragraph (1) and inserting “who—</text>

<paragraph id="HB65F7A8C833B4B4593292BD0B825268B"><enum>(1)</enum><text>is entitled to retired pay, other than a member retired under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/61">chapter 61</external-xref> of this title with less than 20 years of service creditable under <external-xref legal-doc="usc" parsable-cite="usc/10/1405">section 1405</external-xref> of this title and less than 20 years of service computed under <external-xref legal-doc="usc" parsable-cite="usc/10/12732">section 12732</external-xref> of this title; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H1356E8855D4A4F6482B6A6658E39A998"><enum>(1)</enum><header>Clerical and conforming amendments</header><text>Section 1413a of such title is further amended—</text>
<subparagraph id="HB1CDCBFE63A44F18B9BE1998017C66BD"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading for paragraph (3) of subsection (b), by striking <quote><header-in-text level="paragraph">rules</header-in-text></quote> and inserting <quote><header-in-text level="paragraph">rule</header-in-text></quote>; and</text></subparagraph>
<subparagraph id="HFD2852C97757484E800000218592292E"><enum>(B)</enum><text>in subsection (f), by striking <quote>Subsection (d)</quote> and inserting <quote>Subsection (c)</quote>.</text></subparagraph></paragraph> 
<paragraph id="HAE378FDB221B4BA3B0A9FF22647EE362"><enum>(2)</enum><header>Specification of qualified retirees for concurrent receipt purposes</header><text>Section 1414 of such title, as amended by section 3, is amended—</text> 
<subparagraph id="HCE146CCBAF9444EC9BC3CCA500D8AADB"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="HA5AAC0BEB47142C69207746D7E143106"><enum>(i)</enum><text>by striking <quote>a member or</quote> and all that follows through <quote>retiree’)</quote> and inserting <quote>an individual who is a qualified retiree for any month</quote>; and</text></clause> 
<clause id="H8200A8DE831945B1B6626E5021B54398"><enum>(ii)</enum><text>by inserting <quote>retired pay and veterans’ disability compensation</quote> after <quote>both</quote>; and</text></clause></subparagraph> 
<subparagraph id="H2278B32913214A2B95162952028FBB9C"><enum>(B)</enum><text>in subsection (d), by adding at the end the following new paragraph:</text>

<paragraph id="HD09A0EED0AFA44BE8F6570EE01C4CCCE"><enum>(3)</enum><header>Qualified retiree</header><text display-inline="yes-display-inline">The term <quote>qualified retiree</quote> means a member or former member of the uniformed services who, with respect to any month—</text> 
<subparagraph id="H5E99466CCD7349FB8050A83D88753D06"><enum>(A)</enum><text>is entitled to retired pay, other than in the case of a member retired under chapter 61 of this title with less than 20 years of service creditable under section 1405 of this title and less than 20 years of service computed under section 12732 of this title; and</text></subparagraph> 
<subparagraph id="H431B396CD7E74281B0A2E8B126FAA05"><enum>(B)</enum><text>is entitled to veterans’ disability compensation.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H53ED72FE822B42C98F924F7892E7D213"><enum>(3)</enum><header>Standardization with crsc rule for chapter <enum-in-header>61</enum-in-header> retirees</header><text>Subsection (b) of section 1414 of such title is amended—</text> 
<subparagraph id="H0F1BFBB1764543DCA871B638DA9C30CE"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection">Special Rules</header-in-text></quote> in the subsection heading and all that follows through <quote>is subject to</quote> and inserting <quote><header-in-text level="subsection">Special Rule for Chapter 61 Disability Retirees</header-in-text>.—In the case of a qualified retiree who is retired under chapter 61 of this title, the retired pay of the member is subject to</quote>; and</text></subparagraph> 
<subparagraph id="HCE502A1AA25743C68D9FD1C636F082C6"><enum>(B)</enum><text>by striking paragraph (2).</text></subparagraph></paragraph></subsection> 
<subsection id="HAB5684D53E6D452CB8D1F17E2F7085A5"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall take effect as of January 1, 2008, and shall apply to payments for months beginning on or after that date.</text></subsection></section>
